19791016 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HELD OC'DOBER 16, 1979, AT TWO O'CLOCK, P. M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA I MEMBERS PRESENT: Kaeser, McCormick, Ybarra, Malburg MEMBERS ABSENT: Gonzales (Assumed seat at 4:00 p. m.) I The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by Kaeser, that the minutes of the meeting of October 2, 1979, be approved as written and submitted. Motion carried. Communication from Elizabeth Belles, Representative of the land owners and business owners and voters in the County Island located between 52nd Street-Slauson and Malabar Avenues and Santa Fe Avenue, dated October 15, 1979, advising that there is a possibility that Vernon- Santa Fe Avenue Annexation 41= 1 may be referred back to LAFCO for further review, requesting the City of Vernon to prepare and have avail- able to file within approximately two weeks, an Environmental Impact Report for LAFCO, was presented. Elizabeth Belles addressed the City Council and announced that the landowners and business interests have filed a suit to prevent a decision on the recommendation of LAFCO by the Board of Supervisors, and if successful, the petitioners' efforts toward annexation to the City of Vernon would be enhanced. I The City Attorre y stated that as of this moment, there was nothing before the City Council to approve or act upon, but that the Director of Public Works could put together a report on the costs of the services in case of annexation to the City and an environmental impact report, but that it would be futile at this time, to assume a posture favorable to the petitioners, until a decision is reached that supports the City's annexation. It was moved by McCormick, seconded by Ybarra, that the Director of Public Works be instructed to draft a report on the costs of services to the City, and an environmental impact report once the project is before the City Council. Motion carried. Communication from Arthur E. Nelson, Director of Public Works/ Building, dated October 3, 1979, requesting authority and funds for F. A. Tachovsky to attend Basic Techniques of Industrial Commercial Electrical Systems, San Francisco, November 8 to November 9, 1979, with an expense allowance of $254.00, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Director of Public Works be ~pproved, and authority granted to issue warrant in the amount of $254.00 to F. A. Tachovsky. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated October 3, 1979, requesting authority and funds to attend 1979 Annual Calpelra Conference, Monterey, November 14 to November 17, 1979, with an expense allowance of $456.00, was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the City Administrator/City Clerk, be approved and authority granted to issue warrant in the amount of $456.00 to Bruce V. Malkenhorst. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated October 3, 1979, requesting authority and funds for Keith K. Kaeser to attend 19th Annual Seminar, Independent Cities Asseciation of Los Angeles County at Santa Barbara, November 1 to November 4, 1979, with an expense allowance of $479.00, was presented. I t was moved by Ybarra, seconded by McCormick, that the request of the City Administrator be approved and authority granted to issue warrant to K. K. Kaeser, in the amount of $479.00. Oslan, First Vice President, Vernon Chamber of Commerce, dated September 28, 1979, requesting that con- sideration be given to the appointment of Mr. Phil Reavis to the City Council, if the Council should find itself inaposition of having to fill an unscheduled council vacancy, was presented. It was moved by Ybarra, seconded by Kaeser, that the communication from Robert N. Oslan, First Vice President, Vernon Chamber of Commerce, dated September 28, 1979, be received and filed. Motion carried. Police Department Activity Log, October 1 - 15, 1979, was presented. It was moved by McCormick, seconded by Ybarra, that the Police Department Activity Log, October I - 15, 1979, be received and filed. Motion carried. I Health Department Activities Report, month of September 1979, was presented. It was moved by Ybarra, seconded by McC ormick, that the Health Department Acttvities Report, mort h of September 1979, be received and filed. Motion carried. Communication from Arthur E. Nelson, Director of Public Works/ Building, dated October 9, 1979, transmitting fully executed Easement Deed for a portion of 52nd Street from H. A. Geib and Gretchen L. Gorman, recommending that the Deed be accepted and grantor advised of the official recordation, was presented. It was moved by Kaeser, seconded byYbarra that the Easement Deed for a portion of 52nd Street from H. A. Geib and Gretchen L. Gorman, be accepted upon approval by the City Attorney. Motion carried. "Warrant Register No. 535" covering claims and demands presented during the period October 1 to 15, which includes Demands Nos. 91622 to 91746 (both inclusive) excluding voided Demands Nos. 91671, 91687, 91689, drawn on the United California Bank, totaling $4,342,463.64 (Light and Power Warrants $4,290, 753.01) (Accounting Period October 1979) was examined and audited; It was moved by Ybarra, seoonded by McCormick that "Warrant Register No. 535 be approved and payment authorized for Demands Nos. 91622 to 91746 (both inclusive) excluding voided Demands No. 91671, 91687 and 91689, with no other exceptions. Motion carried. Communication from Arthur E. Nelson, Director of Public Works/ Building, dated October 10, 1979, requesting authority and funds for Jim Persons to attend a one-day course on roadway lighting in Los Angeles, October 23, 1979, with a registration fee of $50.00, was presented. It was moved by Kaeser, seconded by Ybarra, that the re quest of the Director of Public Works be approved and that authority be granted to issue warrant in the amount of $50.00 to Jim Persons. Motion carried. Communication from Bruce V. Malkenhorst, City Administl:a tor / Director of Finance, dated October 11, 1979, transmitting minutes of the Finance Committee meetings held October 4 and October 9, 1979, requesting approval and adoption of the recommendations contained therein, was pre- sented. It was moved by Kaeser, seconded by Ybarra, that the minutes of the meetings of the Finance Committee held October 4 and October 9, 1979, be approved, and that the recommendations contained therein be adopted. Motion carried. I I I Summons and Complaint, Richard D. Ferris vs. City of Vernon; Vernon Police Department, L. S. Rosenkrantz; James Mason, and Does 1 through 500, inclusive, Superior Court of the Southeast Judicial District, Case #SEC30647, served on the City October 11, 1979, seekingcompansatory damages in the sum of $225,000.00, costs of suit herein and such other relief as the court may deem proper, was presented. It was moved by Ybarra, seconded by McCormick, that this item be deferred to executive session for discussion. Motion carried. 362 -3- 10/ 16/ 79 I Communication from Arthur E. Nelson, Director of Public Works/ Building, dated October 10, requesting authority and funds for Victor H. Vaits to attend a Seminar on the Design of Horizontal Wood Diaphragms in Los Angeles, November 19, 1979, with a registration fee of $40.00 was presented. It was moved by Kaeser, seconded by Ybarra, that the request of the Director of Public Works be approved and that authority be granted to issue warrant in the amount of $40.00 to Victor H. Vaits. Motion carried. Resolution No. 4678 - A Resolution of the City COWlcil of the City of Vernon Approvfng'l:neRePlacement of the Heating and Cooling System at Fire Station #3 Located at 2800 Soto Street in the City of Vernon and Author- izing Notice Inviting Sealed Proposals or Bids for the Purchase Thereof, was presented. It was moved by Kaeser ~ seconded by Ybarra, that Resolution No. 4678, be approved and adoptea. Motion carried. It was moved by Kaeser, seconded by Ybarra, that the minutes of the Personnel Committee meeting held October 15, 1979, be approved, and that the recommendations contained therein be adopted. Motion carried. Communication from L. A. Espinoza, Acting Chief of Police, dated October 2, 1979, Ie questing that Officer Paul J. Koppes be advanced from Police Officer I, Grade 5 to Police Officer I, Grade 4, effective the October 21, 1979 pay period. Request is predicated on successful completion and graduation from the Academy at Rio Hondo College on October 19, 1979. It was moved by Kaeser, seconded by Ybarra, that the request of the Acting Chief of Police to advance Officer Koppes be approved. Motion carried. I I Acknowledgment from the family of Edward Valliere for the expression of sympathy by the City Council, was presented. It was moved by Ybarra, seconded by Kaeser, that the acknowledge- ment be received and filed. I I It was moved by Ybarra, seconded by Kaeser, that Resolution No. 4679 be approved and adopted. Motion carried. AYES: Ybarra, Kaeser, McCormick, Malburg NOES: None Absent: Gonzales At this time, 2 :45 o'clock, p. m., it was moved by Kaeser, seconded by Ybarra, that the City Council go into executive session under the Attorney/ Client privilege. Motion carried. All persons with the exception of Acting Chief of Police, L. A. Espinoza, the City Administrator/City Clerk and the City Attorney were excluded from the executive session. I Mayor Malburg ordered that all communications to and fro m the ex- ecutive session were deemed private. At this time, 3:05 o'clock, p. m., it was moved by Ybarra, seconded by Kaeser, that the City Council go out of executive session under Attorney/ Client privilege and into executive session under the provisions of Section 54957 of the Government Code. Motion carried. All persons with the exception of Acting Chief of Police, L. A. Espinoza, the City Administrator/City Clem: and the Gty Attorney were excluded from the executive session. Mayor Malburg ordered tm t all com- munications to and from the executive session were deemed private. At this time, 3:21 o'clock, p. m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session under Sec. 54957 of the Government Code, and into executive session under the Attorney/Client privilege. Motion carried. Councilman McCormick was excused from further attendance at this session at 3 :35 o'clock, p. m. Councilman Gonzales assumed his seat on the City Council at 4:00 o'clock, p. m. At this time, 4:05 o'clock, p. m., it was moved by Ybarra, seconded by Kaeser, tmt the City Council go out of executive session and resume regular session. Motion carried. I Communication from Captain L. F. Ely, dated October 16, 1979, advising that Officer David Melnyk has submitted his resignation from the Police Department, effective close of business October 18, 1979. It was moved by Kaeser, seconded by Ybarra, that the resignation of Officer David Melnyk from the Police Department, effective October 18, 1979, be accepted. Motion carried. Acting Chief of Police, L. A. Espinoza, discussed the propriety of issuance of identification cards to police personnel who have retired from service.
