19800102 Regular City Council Meeting - Minutes . 379 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL HELD JANUARY 2, 1980, AT TWO 0' CLOCK, P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Gonzales, McCormick, Ybarra MEMBERS ABSENT: Kaeser I 1 The meeting was called to order by Mayor Malburg. It was moved by McCormick, seconded by Gonzales, that the minutes of the December 4, 1979 meeting, be approved as submitted. Motion carried. It was moved by McCormick, seconded by Ybarra, that the minutes of the December 18, 1979 meeting, be approved as submitted. Motion carried. Summons and Complaint filed December 12, 1979, in Superior Court of the State of California, Coutny of Los Angeles, Case No. SEC31177, entitled, "Damages for Personal Injuries, Property Damages,.1 of Morris Schwartzman, vs. Louis E. Robertson, City of Vernon, a Municipal Corporation; Does 1 through 50, inclusive, received by Ci.ty Clerk, December 26, 1979. It was moved by Ybarra, seconded by Gonzales, that this matter be referred to Joint Powers Insurance, Authority for Defense. Motion carried. Communication from Arthur E. Nelson, Director of Public Works/Building, dated December 18, 1979, requesting that Contract No. 434, be awarded to "R & M Highway Improvements", on the basis of thet~ bid of $15,808.84, for Traffic Pavement Striping, 1980. I Resolution No. 4688 - A Resolution of the City Council of the City of Vernon, Accepting the Bid of R & M Highway Improvement for Traffic Pavement Striping for 1980 in Accordance with Contract No. 434 of the City of Vernon and Approving the Execution of Said Contract. AYES: NOES: ABSENT: McCormick, Ybarra, Gonzales, Malburg None Kaeser It was moved by McCormick, seconded by Ybarra, that Contract No. 434, Traffic Pavement Striping, 1980, be approved as submitted. Motion carried. Communication from Arthur E. Nelson, Director of Public Works/Building, dated January 2, 1980, requesting authority and funds for John E. Reid, Health Department, to attend the NSF Regional Seminar re Food Service Equipment and Facility Plan, Preperation and Review, in Los Angeles, California, on January 21 to 22, 1980, with a registration fee of $75.00. 1 It was moved by McCormick, seconded by Ybarra, that Arthur Nelson's request be approved and funds be authorized to John E. Reid, in the amount of $75.00, to attend the above mentioned seminar. Motion carried. Resolution No. 4689 - A Resolution of the City Council of the City of Vernon, California, Adopting Regulations for Candidates for Elective Office, Pertaining to Materials Submitted to the Electorate and the Costs Thereof for the General Municipal Election to be held in Said City on Tuesday, April 8, 1980. I It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4689, be approved and adopted. Motion carried. Nelson, Director of Public Works/Building, dated October 29, 1979, (Deferred to this meeting at the December 4, 1979, session,) submitting a report on the Santa Fe Land Improvement, with a hydrant rental for private fire hydrants on District Boulevard. Hamed, M.D., against Dolores Villa, Fred Horrel, the State of California, the County of Los Angeles, the City of Huntington Park, the City of Vernon, Superior Signal Service Corporation, a.California Corporation, and Does 1 through 100, inclusive. It was moved by Gonzales, seconded by Ybarra, that this matter be referred to Joint Powers Insurance, Authority for Defense. Motion carried. Communication from Acting Chief Espinoza, dated January 2, 1980, requesting authorization to hire Ms. Teri R. Herbert as a Communications Operator in the Police Department, with a monthly salary of $908.00, (Step 6), effective January 2,1980. It was moved by Ybarra, seconded by Gonzales, that Acting Chief Espinoza's request to hire Terri R. Herbert as Communications Operator, be approved. Motion carried. Resolution No. 4690 - A Resolution of the City Council of the City of Vernon, Calling-ana-Movlng-Notlce of the Holding of a General Election to be Held in Said City on Tuesday, April 8, 1980, for the Election of Certain Officers' in Said City as Required by the Provision of the Laws of the State of California, Relating to General Law Cities. It was moved by Ybarra, seconded by Gonzales, that Resolution No. 4690, be ap- proved and adopted. Motion carried. AYES: NOES: ABSENT: Ybarra, Gonzales, McCormick, Malburg None Kaeser At this time, 2:45 o'clock, p.m., it was moved by McCormick, seconded by Ybarra, that the Committee go into executive session under attorney/client privilege. Motion carried. All persons with the exception of the Elect-rt,cal Consultant, City Administrator, and the City Attorney, were excluded from the executive session. At this time, 3:20 o'clock, p.m., Paul Hendricks was excused from executive session. At this time, 3:21 o'clock, p.m., Councilman McCormick was excused, at his request, from further attendance at the executive session. At this time, 3:30 o'clock, p.m., it was moved by Ybarra, seconded by Gonzales, that the Committee go out of executive session and resume regular session. Motion carried. At this time, 3:31 o'clock, p.m., Councilman McCormick resumed his seat. It was moved by Gonzales, seconded by Ybarra, that the City Attorney be authorized to institute legal proceedings against Philip Reavis for indemnification of attorney's fees to the City of Vernon in connection with the unlawful detainer action to the City against Marge Garcia, and the suit of Marge Garcia vs. the City of Vernon (U.S. District Court Action No. CV79-02988.) McCormick abstained, all others approved. Motion carri ed. It was moved by Gonzales, seconded by Ybarra, that the City Attorney be instructed to prepare an Ordinance to adjust electrical rates for the City of Vernon and to instruct the City Clerk to post a notice of Public Hearing to be held on February 5, 1980, 2:30 p.m., to consider the electrical rates.
