19800122 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED MEETING OF THE CITY COUNCIL, HELD JANUARY 22, 1980, AT FOUR O'CLOCK, P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, 4305 SANTA FE AVENUE, VERNON, CALIFORNIA. I MEMBERS PRESENT: Ybarra, Gonzales, Kaeser, Malburg MEMBERS ABSENT: McCormick (Seated at 4:35 p.m.) I The meeting was called to order by Mayor Malburg, at 4:10 o'clock,p.m. Communication from Bruce V. Malkenhorst, City Administrator, dated January 22, 1980, submitting the bids to purchase 2010 barrels of No.2 diesel oil, the City's present surplus, from W. H. Tank Lines at $26.96 per barrel, Ru~erford Oil Company at $26.04 per barrel, and Crescent Oil Company, at $21.75 per barrel. Recommendation from City Administrator to accept the high bid of W. H. Tank Lines at $26.96 per barrel. It was moved by Ybarra, seconded by Kaeser, that the bid of W. H. Tank Lines be accepted on the basis of their high bid of $26.96 per barrel. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator, dated January 22, 1980, requesting authorization to advertise for bids for the clean- ing of ~e city storage tank. I It was moved by Kaeser, seconded by Gonzales, that the City be authorized to solicit bids to clean the City's storage tank now holding No. 2 diesel oil. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator, dated January 22, 1980, requesting authority to advertise for the purchase of 9500 barrels of diesel oil No.4, 1/4% sulphur content by weight. It was moved by Gonzales, seconded by Ybarra, that authorization to advertise for the purchase of 9500 barrels of diesel oil No.4, 1/4% sulphur content by weight, be granted. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator, dated January 22~ 1980, recommending that Judy Fuller be hired as a Communications Operator with the City of Vernon Police Department, contingent upon her satis- factory passing of a physical examination. It was moved by Gonzales, seconded by Ybarra, that Judy Fuller be hired as Communications Operator, Step 3, as recommended. Motion carried. I ORDINANCE NO.' 894 - An Ordinance of the City of Vernon Repealing Ordinance No. 884 and Providing for Salary and Expense Allowance for Members of the City Council of the City of Vernon, was presented. I It was moved by Ybarra, seconded by Kaeser, that Ordinance No. 894 receive and pass the second and final reading. Ordinance No. 894 was read in its entirety for a second reading. Motion carried. AYES: NOES: Absent: Ybarra, Kaeser, Gonzales, Malburg None McCormick At this time, 4:35 o'clock, p.m., Councilman McCormick assumed his seat. 386 -2- 1/22/80 At this time, 4:40 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the Council go into executive session under Attorney/Client privilege. Motion carr ed. All members with the exception of the City Administrator and the City Attorney were excluded from the executive session. I Mayor Malburg ordered that all communications to and from the executive session were deemed private and confidential. I At this time, 5:14 o'clock, p.m., it was moved by McCormick, seconded by Ybarra~ that the Council, go out of executive session and resume regular session. Motion carrled":'.' , The City Administrator recommended that the City Council approve a Compromise and Release with Lloyd B. Reimers, in full settlement of Workers Compensation Appeals Board Cases No. 78-LB-99877, 99878 and 99435. It was moved by McCormick, seconded by Ybarra, that a Compromise and Release with Lloyd B. Reimers, per Workers Compensation Appeals Board Cases No. 78-LB-99877, 99878 and 99435, be approved. Motion carried. The City Attorney recommended that the City Council approve a stipul- ation for award to Robert Smith providing for a permanent disability rating of 19i.%. It was moved by McCormick, seconded by Gonzales that a stipulation for award with Robert Smith, providing a permanent disability rating of 19i.% be accepted. Motion carried. I It was moved by Kaeser, seconded by Ybarra, that the City Administrator and the Fire Chief be instructed to develop a job description for the Fire Engineer position. Motion carried. At this time, 5:20 o'clock, p.m., it was moved by Kaeser, seconded by McCormick, that the City Council go into executive session under Government Code, Sec. 54957. Motion carried. All members with the exception of the City Administrator and the City Attorney were excluded from the executive session. Mayor Malburg ordered that all communications to and from the executive session were deemed private and confidential. At this time, 5:57 o'clock, p.m., it was moved by Gonzales, seconded by McCormick, that the City Council go out of executive session and resume regular session. Motion carried. I RESOLUTION NO. 4696 - A Resolution of the City Council of the City of Vernon, Determining the Disability Retirement of Lloyd B. Reimers, a Local Safety Member Employed by the City of Vernon (SS21024, 21025 of the Government Code) It was moved by Gonzales, seconded by McCormick, that Resolution No. 4696 be approved and adopted. Motion carried. I AYES: NOES: Absent: Gonzales, McCormick, Ybarra, Kaeser, Malburg None None After review of City Attorney David Brearley's report on Randall Bertz and based on the medical reports received in regard to Bertz' request for Dis- ability Retirement, it was moved by Gonzales, seconded by Ybarra, that Bertz' request be denied. Motion carried. 387 -3- 1/22/80 It was. moved by McCormick, seconded by Ybarra, that Cfty Attorney David Brearley's report concernfng the Industrfal Disability of John C. Marx in relation to Marx's qualification for Disability Retirement, be received and filed. Motion carried. I It was moved by Ybarra, seconded by McCormick, that Frank Sweeney, James Miller and Joseph Blaut be notified that the City Council intends to convene a hearing to consider their Disability Retirement, at the regularly scheduled council meeting of February 5, 1980. Motion carried. I At this time, 6:16 o'clock, p.m., it was moved by Ybarra, seconded by Kaeser, that the City Council go into executive session in accordance with Attorney/Client privilege. Motion carried. All members with the exception of the City Administrator and the Cfty Attorney were excluded from the executive session. Mayor Malburg ordered that all communications to and from the executive session were deemed private and confidential. At this time, 6:17 o'clock, p.m., Councilman McCormick requested that he be excused from further attendance at this meeting of the City Council. Councilman McCormick's request was granted, and he withdrew from the Council Chamber. I At this time, 6:45 o'clock p.m., it was moved by Kaeser, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried.
