MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL, HELD MAY 20, 1980, AT
2:15 O'CLOCK, P.M., IN THE COUNCIL
CHAMBER OF THE CITY HALL, LOCATED AT
4305 SANTA FE AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Gonzales, Kaeser, McCormick, Ybarra, Malburg
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Gonzales, that the minutes of the meeting
of the City Council held May 6, 1980, be approved as submitted. Motion carried.
It was moved by Ybarra, seconded by Gonzales, that the minutes of the Personnel
Committee meeting held May 19, 1980, be approved as submitted. Motion carried.
It was moved by Ybarra, seconded by Gonzales, that the minutes of the
Finance Committee meeting held May 19, 1980, be approved as corrected. Motion
carried.
Communication from Arthur E. Nelson, Director of Public Works/Building, dated
May 13, 1980, requesting that Contract No. 435, Slurry Sealing, be awarded to
Roy Allen Slurry, based on their bid of $6,311.90, was presented.
Resolution No. 4734 - A Resolution of the City Council of the City of Vernon
Accepting the Bid of Roy Allen Slurry Seal for Slurry Sealing of Various Streets
in Accordance with Contract No. 435 of the City of Vernon and Approving the
Execution of said Contract, was presented.
It was moved by Kaeser, seconded by McCormick, that Resolution No. 4734
be approved and adopted. Motinn carried.

Resolution No. 4735 - A Resolution of the City Council of the City of Vernon
Approving Purchasing Contract No. 003 and Authorizing Notice Inviting Sealed
Proposals or Bids for Supplying City Hall Janitorial Services in Accordance
with Contract No. 003 of the City of Vernon, was presented.
It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4735 be
approved and adopted. Motion carried.

Ordinance No. 900 - An Ordinance of the City Council of the City of Vernon
Amending the Code of the City of Vernon, California 1959 by Amending Section 7.9-16
of Said Code, Prescribing Penalties for the Violation of Any Provision of Ordinance
No. 889 which Adopted by Reference the National Electrical Code, 1978 Edition, and
Repealing all Ordinances and Parts of Ordinances in Conflict Therewith, was presented.
It was moved by Gonzales, seconded by Ybarra, that Ordinance No. 900 receive
and pass a first reading by title, and that after a second and final reading
thereof, said Ordinance be approved and adopted. Motion carried.

Communication from Cletus V. Schmidt, Attorney at Law, dated May 12, 1980,
submitting Claim for Damages on behalf of Bernice Arnold, Thomas Arnold and
Ronald Arnold, in the amount of $652,638.68, as a result of death of Lawrence Arnold,
February 15, 1980, at 3301 E. Vernon Avenue, alleging failure of City to provide
adequate police protection, was presented.

It was moved by Ybarra, seconded by Gonzales, that the communication and
the Claim for Damages, be referred to the City Attorney for review and recommendation
of the City's insurance carrier. Motion carried.
Summons and Complaint filed April 23, 1980, National Can Corporation,
National Pet Food Corporation and NCC Food Corporation, Plaintiff, vs. County
of Los Angeles, City of Los Angeles, City of Vernon, et al; Notice and Acknowledgement
of Receipt, for refund of taxes, 1978-79, under Sections 5096 and 5097 of the
California Revenue and Taxation Code, was presented.
It was moved by McCormick, seconded by Ybarra, that the City Clerk be authorized
to acknowledge receipt of service of said Summons and Complaint, that the claim be
rejected, and that the City Attorney be instructed to request County Counsel to defend
said action on behalf of the City of Vernon. Motion carried.
Communication from Arthur E. Nelson, Director of Public Works/Building, dated
May 14, 1980, transmitting a proposed Encroachment License Agreement for maintaining
an eight inch Mobil oil line in Soto Street, was presented.
It was moved by Kaeser, seconded by McCormick, that the Mayor and the
City Clerk be authorized to execute the Encroachment License Agreement on
behalf of the City of Vernon. Motionl:arried,
Communication from Arthur E. Nelson, Director of Public Works/Building,
dated May 15, 1980, requesting authority and funds to attend University of
California Seminar on Compliance with Planning and Zoning Regulations, at Irvine,
July 2, 1980, with a registration fee of $70,00.
It was moved by Kaeser, seconded by Gonzales, that the request of the Director
of Public Works/Building be approved and that authority be granted to issue warrant
to Arthur E. Nelson in the amount of $70.00. Motion carried.
Building Department Report for the month of April 1980, was presented.
It was moved by Ybarra, seconded by Kaeser, that the report be received and
filed. Motion carried.
Police Department Activity Log, May 1 - 15, 1980, was presented.
It was moved by McCormick, seconded by Ybarra, that the Police Department
Activity Log, May 1 - 15, 1980, be received and filed. Motion carried.
Warrant Register No. 548, covering claims and demands presented during the
period of May 1 ~ 16, 1980, which includes demands Nos. 93153 to 93339, (both
inclusive), excluding voided Demand No. 93322, drawn on the United California
Bank, totaling $5,190,969.46 (Light and Power Warrants $4,959,821.19) Accounting
period May 1980, was examined and audited,
It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 548
be approved and payment authorized for Demands Nos. 93153 to 93339 (both inclusive),
excluding voided Demand No. 93322, with no other exceptions,
Health Department Activities Report for the month of April 1980, was presented.
It was moved by McCormick, seconded by Gonzales, that the Health Department
Activities Report for the month of April ,1980, be received and filed, Motion carried.
Communication from the League of California Cities dated April 25, 1980
requesting that the City of Vernon designate its delegate and alternate to the
League's meetings, was presented.
It was moved by Gonzales, seconded by Kaeser, that the Mayor of the City of
Vernon, Leonis C. Malburg be designated as the delegate to t~ League of California
Cities and that Councilman Thomas A. Ybarra, be designated as the alternate. Motion
carri ed.
Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated
May 20, 1980, recommending that Mary Mason be employed as a Police Department
Dispatcher, Step 6, effective May 20, 1980, pending successful completion of
physical examination, was presented.
It was moved by Ybarra, seconded by Kaeser, that the request of the City
Administrator/City Clerk be approved. Motion carried.

Communication from Bruce V, Malkenhorst, City Administrator/City Clerk~
dated May 20, 1980, recommending acceptance of the Purchasing Agent's request
to reject the bid received from Crescent Oil and Refining Company for the purchase
of 9100 Barrels of No, 4 Diesel Fuel, based on failure to meet fuel specifications,
was presented.
It was moved by Kaeser, s~conded by Gonzales that the recommendation of the
City Admini strator/City Clerk to reject the bi d from Crescent Oi 1 and Refining
Company for the purchase of 9100 barrels of No.4 Diesel Fuel, be approved, and
that the Purchasing Agent be authorized to re-advertise this item with definite
specifications and a 90-days' delivery period, Motion carried,
The Director of Public Works gave a report on the City of Vernon's progress
with regard to assumption of Southern California Water Company's services within
the City, and the City's graffiti-eradication project,
Lou Hauger, Health and Environmental Control Section~ reported on the State of
California's well-sampling regulations and on the discovery of several opened
packages of fumigant on L,A, Junction Railway~s property within the City,
Paul p, Hendricks, Consulting Engineer, reported on a fuel clause adjustment
increase in effect May to June 14, of 1.2664<t (~<t higher than last month) but
somewhat lower than the annual forcast, which will result in a $500,000,00 per
month increase in the cost of power, Mr, Hendricks also reported on the forcast for
summer power shortage, and that he would prepare a supplement on this item for
publication in the Vernon Update,
At this time, 2:45 olclock, p.m" it was moved by McCormick~ seconded by
Ybarra, that the .City Council go into executive session under AttorneylClient
privilege. Motion carried,
All persons with the exception of the City Administrator/City Clerk and the
City Attorney were excluded from the executive session,
Mayor Malburg ordered that all communications to and from the executive session
were deemed private and confidential.
At this time, 3:15 o'clock, p,m., it was moved by McCormick, seconded by Ybarra,
that the City Council go out of executive session and resume regular session,
Motion carried.
There being no further business to come before the meeting, it was moved by
Ybarra seconded by Ka~ser, that the meeting adjourn until 10'00 o'clock, a.m..
