MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL, HELD AUGUST 5, 1980,
AT TWO O'CLOCK, P.M., IN THE COUNCIL
CHAMBER OF THE CITY HALL, LOCATED AT
4305 SANTA FE AVENUE, VERNON, CALIF.

The meeting was called to order by Mayor pro tern Ybarra.
The City Clerk announced that this was the time and place for opening of
bids for replacement of heating and air conditioning system at Fire Station No.2.
It was moved by Gonzales, seconded by McCormick, that the Clerk be in-
structed to open and read the bids submitted. Motion carried.
The City Clerk opened and read the following bids:

6,495.00
14,452.00
It was moved by McCormick, seconded by Gonzales, that the bids received for
replacement of heating and air condiitoning system at Fire Station No.2, in
accordance with Quotation No. 1161, be referred to the Purchasing Agent and the
City Administrator for review and recommendation. Motion carried.
At this time, 2:15 o'clock, p.m., the City Council recessed for ten minutes.
The City Council reconvened, all members/p-resent at the beginning of the
City Council meeting held July 15, 1980, and the minutes of the Special Council
meeting held July 29, 1980, be approved as written and submitted. Motion '~arried.
Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated
August 4, 1980, requesting approval of the Finance Committee recommendations
made August 4, 1980 at the Finance Committee Meeting.
It was moved by McCormick, seconded by Gonzales, that the recommendaitons
of the Finance Committee Meeting held August 4, 1980, be approved and adopted.
Motion carried.

Communication from. Bruce V. Malkenhorst~ Director of Finance, dated August
4, 1980, submitting cost estimate for increasing the size of the proposed storm
drain in Irving Street, in order to accept storm water from Willig Freight Line
development at 2230 E. 38th Street, with a total project cost estimated at
$64,000, Willig Freight Line having agreed to pay a minimum total of their share
$18,000, and the balance of the project cost, not to exceed $46,000, to be
borne by the Cit~, was presented.
It was moved by McCormick, seconded by Gonzales, that proposal submitted by,'
the City Administrator be accepted. Motion carried.
Communication from Arthur E. Nelson, Director of Community Services, dated
July 31, 1980, transmitting for consideration Contract No. 437, Irving Street
Storm Drain, recommending same be approved and authority granted to advertise
for bids, was presented.
Resolution No. 4750 - A Resolution of the City Council of the City of Vernon
Approving Contract No. 437, and Authorizing Notice Inviting Sealed Proposals or Bids
for Irving Street Storm Drain, in Accordance with Contract No. 437 of the City of
Vernon, was presented.
It was moved by McCormick, seconded by Gonzales, that Resolution No. 4750
be approved and adopted. Motion carried.

Communication from Arthur E. Nelson, Director of Public Works/Building,
dated July 23, 1980, submitting proposed Encroachment License Agreement for
Atlantic Richfield Company with the recent amended rates included, for approval,
was presented.
It was moved by Gonzales, seconded by McCormick, that Encroachment
License Agreement for Atlantic Richfield Company, with the recent amended
rates included, be approved, and authority granted for the Mayor and the City
Clerk to execute the agreement on behalf of the City. Motion carried.
Communication from Louis S. Hauger, Director of Environmental Health,
dated July 29, 1980, requesting authority and funds to attend the 1980 Annual
Meeting of the California Conference of Directors of Environmental Health in
Bakersfield, September 22 to September 26, 1980, with an expense allowance of
$425.00, was presented.
It was moved by McCormick, seconded by Gonzales, that the request of the
Director of Environmental Health dated July 29, 1980, be approved and authority
granted to issue warrant in the amount of $425.00 to Louis S. Hauger. Motion
carried.
Claim for Damages submitted by Esperanza Alvarado, date of loss June 22,
1980, in the amount of $50.00, as a result of Police Department line of duty
action, was presented.
It was moved by McCormick, seconded by Gonzales, that the claim of
Esperanza Alvarado for damages, in the amount of $50.00, incurred June 22, 1980,
be approved and authority granted to issue warrant in the amount of $50.00 to
Esperanza Alvarado. Motion carried.
Communication from Vernon Lions Club dated July 11, 1980, offering their
appreciation and thanks for cooperation., support and interest in the success of
the 4th of July Fireworks Sale, was presented.
It was moved by McCormick, seconded by Gonzales, that the communication
from Vernon Lions Club be received and filed. Motion carried.
Communication from Peter Weber, Mayor of Rolling Hills Estates, dated
July 17, 1980, recommending opposition to Assembly Bill 2464 (Local Housing Policy)
was presented.
It was moved by Gonzales, seconded by McCormick, that the communication from
Peter Weber, Mayor of Rolling Hills Estates be received and filed. Motion carried.
"Warrant Register No. 553" covering claims and demands presented during the
period July 16th through July 31, 1980, which includes demand nos. 93568, 93581,
93696, 93704 to 93706 (inclusive) 93746, 93842 to 93889 (inclusive); 93906, and
93926 through 94001 (both inclusive) drawn on the United California Bank,
totaling $234,151.72 (Light and Power Warrants $85,393.92) (Accounting Period August,
1980) was examined and audited.
It was moved by McCormick, seconded by Gonzales, that Warrant Register No. 553
be approved and payment authorized for demands nos. 93568, 93581, 93696, 93704 to
93706 (inclusive), 93746, 93842 to -93889 (inclusive); 93906 and 93926 through 94001
(both inclusive) with no exceptions. Motion carried.
Police Department Activity Log, July 16 - 31, 1980, was presented.
It was moved by McCormick, seconded by Gonzales, that Police Department
Activity Log, July 16 - 31, 1980, be received and filed. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator, dated
August 5, 1980, recommending that the City Council grant a permit extension for
one office trailer and one toilet trailer to Latchford Glass Company, 4855
E. 52nd;Pl ace, to September 1, 1980, was presented.
It was moved by McCormick, seconded by Gonzales, that a permit extension
until September 1, 1980, be granted to Latchford Glass Company, for one office
trailer and one toilet trailer. Motion carried.

Communication from Bruce V. Malkenhorst, City Administrator, dated
August 5, 1980, recommending that the City Council grant a year's extension
of the trailer permit at the new building being constructed by Seymour Owens
of Vernon Meatland, Inc., easterly of 45th Street, until April 1, 1980, with
the provision that the permits for new construction will be suspended if the
emporary office trailer is not removed or relocated in accordance with Vernon1s
Codes at the conclusion of the extension period, was presented.
It was moved by Gonzales, seconded by McCormick, that the request of the
City Administrator for a one years extension of the trailer permit to Vernon
Meatland, Inc., be approved~ until April 1, 1981, under the provision specified
above. Motion carried.

Communication from Acting Chief L.A. Espinoza, dated July 30, 1980,
requesting authority and funds for R.D. Tisdale to attend Western States
Auto Theft Investigators Conference, Fresno, California, September 18 to
September 19, 1980, with an expense allowance of $230.24, was presented.
It was moved by McCormick, seconded by Gonzales, that the request of
the Acting Chief of Police be approved, and authority granted to issue warrant
in the amount of $230.24 to R~D. Tisdale. Motion carried.
Communication from David B. Brearley, City Attorney, dated July 28, 1980,
advising that after due investigation and review of the claim of Andrew E. Garcia,
received by the City of Vernon on July 10, 1980, for damages incurred in an
automobile accident which occurred on June 24, 1980, a recommendation to deny
the claim is submitted.
It was moved by Gonzales, seconded by McCormick, that the Claim for
Damages filed by .Andrew E. Garcia, be denied. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/City Clerk,
dated August 5, 1980, transmitting for approval, Finance Committee minutes of
the July 29, 1980 meeting, was presented.
It was moved by McCormick, seconded by Gonzales that the minutes of the
Finance Committee meeting of July 29, 1980, be approved and that the recommendations
contained therein be adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated
August 4, 1980, transmitting for~pproval the minutes of the Personnel Committee
meeting held August 4, 1980, was presented.
It was moved by Gonzales, seconded by McCormick, that the minutes of the
Personnel Committee meeting held August 4, 1980, be approved and the recommendations
contained therein be adopted. Motion carried.
Resolution No. 4749 - A Resolution of the City Council of the City of Vernon
Approving a Budget for the Fiscal Year 1980-81, was presented.
It was moved by Gonza les., seconded by McCormi ck, that Reso 1 uti on No. 4749
be approved and adopted. Motion carried.

Communication from David B. Brearley, City Attorney, dated July 25, 1980,
rendering his opinion as requested by Councilman Kaeser, concerning the City
Council's authority to defend a City Councilman in an election contest, was
presented.
It was moved by Gonzales, seconded by McCormick, that the communication from
the City Attorney, dated July 25, 1980, be received and filed. Motion carried.
Petition for Zone Variance, filed by Ben Lilien, 4260 Olympiad Drive,
Los Angeles, requesting property located on the South side of Vernon Avenue,
west of Boyle (L.A. Beefland) be changed from MSI to MS2, for the op~ration
of a rendering plant, was presented.

Victor Vaits, Building Department, reported that a hearing of this petition
for Zone Variance must be set in accordance with the existing Ordinance of the
City; that notices must be sent to property owners within 300 feet of the site
of the proposed zone change, and that an appropriate date would be the first
meeting in September 1980 of the City Council for this hearing.

It was moved by Gonzales, seconded by McCormick, that the Petition for
Variance filed by Ben Lilien, be scheduled for September 2, 1980. Motion carried.
Mr. Vaits also suggested that the hearing on Ordinances 899, 901, 902 and
903 be scheduled for hearing during the second regular meeting of the City
Council, in September 1980.
It was moved by Gonzales~ seconded by McCormick, that September 16, 1980
at 3:00 o'clock, p.m., be set as the time for presentation and first reading~
of Ordinances 899, 901, 902 and 903, with respect to Building Department
regulations. Motion carried.
At this time, 2:46 o'clock, p.m., it was moved by McCormick, seconded by Ybarra,
that the City Council go into executive session, under Attorney/Client privilege.
Motion carried.
All persons with the exception of the City Clerk and RonaldJ. Einboden,
Assistant City Attorney, were excluded from the executive session.
Mayor pro tern Ybarra ordered that all communications to and from the executive
session were deemed private.
At this time 3:00 O'clock, p.m., it was moved by McCormick, seconded by
Gonzales, that the City Council go out of executive session and resume regular
session. Motion carried.
Communication from City Attorney David B. Brearley, dated July 25, 1980,
advising that at a Workers' Compensation Appeals Board hearing, July 17, 1980,
in the case of Randall Bertz vs. City of Vernon (WCAB Case No. 78 MON 23987)
the parties executed Stipulations with Request for Award and Judge Leaver issued
an award as follows: Permanent disability rating of ~% payable forthwirth in the
sum of $735.00, together with the lien of Dr. Strahan in the sum of $365.00,
State Compensation Insurance Fund would pay directly to the applicant the sum
of $506.00 and the City of Vernon would pay $594.00 less attorney's fees of
$80.00 of which $65.00 is payable to Conrad Lopes and $15.00 is payable to
Lewis and Marenstein, and less credit for amount previously paid on Dr. Strahan's
lien.
It was moved by Gonzales, seconded by McCormick, that the Stipulations with
Request for Award qnd Award, in the case of Randall Bertz vs. City of Vernon, be
approved, and authority granted to issue warrants as specified therein. Motion
carried.
There being no further business to come before the City Council, it was
moved by McCormick, seconded by Gonzales, that the meeting adjourn until 4:30
o'clock, p.m., Wednesday, August 13,1980. Motion carried.
