19800819 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HElli AUGUST 19, 1980, AT TWO 0' CLOCK, P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCA'IED AT 4305 SANTA FE AVENUE, VERNON, CALIF. MEMBERS PRESENT: McCormick, Gonzales, Ybarra JVJElVJBERS ABSENT: Kaeser, Malburg The meeting was called to order by Mayor pro tem Ybarra. I It was moved by McCormick, seconded by Gonzales, that the minutes of the regular meeting of the City Council held August 5, 1980, be approved as submitted and that the minutes of the adjourned meeting of the City Council held August 13, 1980, be approved as written and submitted. Motion carried. .. It was moved by Gonzales, seconded by McCormick, that the minutes of the Finance Comnittee meeting held August 11, 1980, be approved and that the recommendations contained therein be adopted. Motion carried. The City Clerk announced that this was the time and place for opening of bids for Irving Street Storm Drain, Contract No. 437 of the City of Vernon. It was moved by Gonzales, seconded by McCormick, that the Clerk be in- structed to open and read the bids submitted. Motion carried. The City Clerk opened and read the following bids: 464 B-l Enterprise Corporation Butch Engineering Construction Alberta Pipeline, Inc. Wesco Construction Co. Richard Osborne Construction Christine Corporation George Miller Construction Co City Construction Co. $64,103.00 66,101.00 84,260.00 79,455.04 77,678.00 71,413.00 85,869.90 76,676.00 It was moved by McCormick, seconded by Gonzales, that the bids received for Contract No. 473, Irving Street Storm Drain, be referred to the Director of Public Works for recapitulation and recctrrnendation. Motion carried. Petition of Ben Lilien for Zone Variance upon the property located at 3320 E. Vernon Avenue, Vernon, California, was presented. It was moved by McCormick, seconded by Gonzales, that the Petition of Ben Lilien for a zone variance be referred to the City Attorney and the Director of Public Works for review and recommendation. Motion carried. I Comrmmication from David B. Brearley, dated July 23, 1980, regarding Trio Consolidation Corporation vs. City of Vernon, Case No. CIV 56830, was presented. It was moved by McCormick, seconded by Gonzales, that this item be de- ferred to executive session under attorney/client privilege, scheduled later this same day. Motion carried. Health Department Report for the month of July, 1980, was presented. It was moved by ]\1cCormick, seconded by Gonzales, that the July 1980 Health Department Report by received and filed. Motion carried. Police Department Activity Log, August 1 - 16, 1980, was presented. It was moved by Gonzales, seconded by McCormick, that the Activity Log of the Police Department for the period August 1 - 16, 1980, be received and filed. Motion carried. -2- 8/19/80 Ordinance No. 905 - An Ordinance of the City Council of the City of Vernon Amending Section 2 of Ordinance No. 895 Providing for Rates to be Charged for Electrical Energy Distributed and Supplied by Said City With- in its Boundaries and Repealing all Ordinances and Parts of Ordinances in Conflict Therewith, was presented. It was moved by Gonzales, seconded by McCormick, that the reading of Ordinance No. 905 in full be waived; and that Ordinance No. 905 receive a second and final reading by title. Motion carried. AYES: NOES: ABSENT : Gonzales, McCormick, Ybarra None Kaeser, Malburg I "Warrant Register No. 554" covering claims and demands presented during the period August 1 - 15, 1980, which includes Demands Nos. 1001 to 1223 (both inclusive) excluding voided Demands Nos. 1191 and 1205, drawn on the United California Bank, totaling $4,688,322.19 (Light and Power Warrants $4,509,263.03) (Accounting Period August, 1980) was examined and audited. It was moved by Gonzales, seconded by McCormick that "Warrant Register No. 554" be approved and payment authorized for Demands Nos. 1001 to 1223 (both inclusive) excluding voided Demands Nos. 1191 and 1205, with no other exceptions. Motion carried. "Payroll Warrant Register No. 279" covering Claims and Demands presented during the period June 29 to July 26, which includes Demands Nos. 3102 to 3123 (both inclusive) drawn on the Crocker National Bank, totaling $512,313.92 (Ac- counting Period July, 1980) was examined and audited. It was moved by Gonzales, seconded by McCormick, that lIpayroll Warrant Register No. 279" be approved and payment authorized for Demands Nos. 3102 to 3123 (both inclusive), with no exceptions. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated August 19, 1980, transmitting minutes of the Finance Committee held August 18, 1980, was presented. (Copy to each member of the City Council) It was moved by McCormick, seconded by Gonzales, that the minutes of the Finance Committee meeting held August 18, 1980, be approved and that the recommendations contained therein be adopted. Motion carried. Comnunication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated August 19, 1980, recomnending that Contract No. 411, Traffic Signal Maintenance, be extended for one year, based on the agreement with the present contractor to increase their rates only 13%, was presented. I Resolution No. 4752 - A Resolution of the City Council of the City of Vernon Extending Contract No. 4n for Traffic Signal Maintenance, 1977-l98Q with Signal Maintenance, Inc. for a Period of One Year, September 1, 1980 to August 31, 1981, and Approving the Execution of Said Contract. It was moved by McCormick, seconded by Gonzales, that Resolution No. 4752 be approved and adopted. Motion carried. Malkenhorst, City Administrator/City Clerk, dated August 18, 1980, advising that the Director of Public Works reported that Transamerica Delaval, 5125 Alcoa Avenue was issued a permit on August 16, 1979 for two temporary mobile trailers, 10 ft. X 55 ft., joined together on their property to house a light soldering assembly operation. They are now soliciting bids for a new building and this operation will be relocated in the new building upon its completion and the trailers removed, recommending a one- year extension of the permit, until August 16, 1981, was presented. It was moved by McCormick, seconded by Gonzales, that Transamerica Delaval be granted a one-year extension permit for two temporary trailers at 5125 Alcoa Avenue, until August 16, 1981. Motion carried. 465 -3- 8/19/80 At this time, Mayor pro tern Ybarra called for corrments from the Staff. Lou Hauger, Director of Environmental Health discussed the City's Animal Control Contract with the County of Los Angeles, stating that he would make a further report before the City Council ratifies the agreement with the County. Capt. L.F. Ely briefed the City Council on the strike situation within the City. There being no further corrmentsat this time, 2:33 o'clock, p.m., it was moved by Gonzales, seconded by McCormick that the City Council go into executive session under attorney/client privilege. Motion carried. I All persons, with the exception of the City Administrator, the City Attorney and Acting Chief of Police were excluded from the executive session. Mayor pro tern Ybarra ordered that. all corrnnunications to and from the executive session were deemed private and confidential. At this time, 3:05 o'clock, p.m., it was moved by Gonzales, seconded by McCormick, that the City Council go out of executive session and resume regular session. Motion carried. Invoice from Ball, Hunt, Hart, Brown and Baerwitz, dated August 14, 1980, for legal services rendered during July, 1980, in the amount of $2,116.40, in connection with litigation in the case of Spencer E. Hogan vs. City of Vernon and Leonis C. Malburg, was presented. It was moved by McCormick, seconded by Gonzales, that the invoice presented be approved and authority granted to issue warrant in the amount of $2,116.40, to Ball, Hunt, Hart, Brown and Baerwi tz . Motion carried. Communication from David Acosta Montoya, Secretary, City Hall, Ensenada, Baja California, Mexico, dated July 23, 1980, transmitting a formal bid of $7,500.00 for the 1954 Fir:e Engine which the City of Vernon Fire Department has declared surplus, was presented. Resolution No. 4753- A Resolution of the City Council of the City of Vernon Accepting the Bid of the City Government of Ensenada, Baja California for the Purchase of a 1954 Fire Engine, Crown Pumper, as Surplus Pursuant to Section 2.31 of the Vernon City Code in Accordance with Purchasing Department Quotation No. 1142 of the City of Vernon and Approving the Execution of any fucument in Relation Thereto. It was moved by Gonzales, seconded by McCormick, that Resolution No. 4753 be approved and adopted. l\1otion carried.
