MINUTES OF A SPECIAL MEETING OF THE
CITY COUNCIL, HELD SEPTEMBER 10, 1980
AT ONE 0' CLOCK, P. M., IN '!HE COUNCIL
CHAMBER OF THE CITY HALL, LOCA 'lED AT
4305 SANTA FE AVENUE, VERNON, CALIF.

The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Kaeser, that the special session
of the City Council to consider waiving the Attorney/Client privilege in respect
to executive sessions that were held during the adjourned regular meetings held
on May 23, 1980 and May 28, 1980, be convened. Motion carried.
The City Attorney explained to the City Council that the Attorney/Client
privilege can onLy be waived by the City Council by formal motion. He further
indicated that an individual councilman cannot reveal the matters discussed in
an executive session pursuant to the Attorney/Client privilege, unless the City
Council waives the Attorney/Client privilege permitting the individual council-
man to reveal said matters.

The City Attorney advised the City Council that it should waive the
Attorney/Client privilege in order to permit the individual councilmen to reveal
1he matters discussed in the executive sessions held on May 23rd and 28th, 1980,
relating to the election litigation, Case Nos. 321507, 321525 and 323919, if
called upon to testify during the contempt proceedings presently pending before
Judge Vernon Foster. If the City Council permits this testimony, then the
individual councilman will be able to defend themselves in said contempt action.
It was moved by Kaeser, seconded by McCormick that the City Council
permit the individual councilmen to testify in regard to matters discussed
during fue executive sessions that were held during the adjourned regular meet-
ings of May 23 and May 28, 1980, in Superior Court Case No. 321525, in respect
to the motion re: contempt, scheduled before Judge Vernon Foster. Motion
carried.
There being no further business to come before the City Council, it
was moved by McCormick, seconded by Ybarra, that the meeting adjourn. Motion
carried.

the door of the place at which said meeting of Sep ember 10, 1980, is to be
held.
In addition, I did, on MONDAY, Sepmmber 8, 1980, post three (3)
copies of ~e NOTICE AND CALL OF A SPECIAL MEETING OF THE CITY COUNCIL, one
in each of ~he following places, to wit: At the northwest corner of 38th
street and ~anta Fe Avenue, at the nor beast corner of Leonis Boulevard and
Pacific Bou]evard, and on the bulletin board i- the lobby of the City Hall,
located at ~305 Santa Fe Avenue, all in the City of Vernon, there being no
newspaper o~ general circulation printed and published in the City of Vernon.

A cqp- of this Notice has also been delivered to all members of the
city Counci~ personally or by mail 24 hours in advance of the time and date
of this Special Meeting.
