THE CITY COUNCIL,HELD SEPIEMBER 16,
1980, AT TWO O'CIDCK, P. M., IN THE

The meeting was called to order by Mayor Malburg.

The Mayor decla red a recess until 2: 25 0' clock, p. m., so that everyone
present, and other City employees, could participate in a coffee and cake
ceremony celebrating the 75th anniversary of the City's founding.
At 2:25 o'clock, p.m., the City Council reconvened, all members present
before the recess, again being present.
It was moved by Kaeser, seconded by Ybarra, that the minutes of the
regular meetings of the City Council held August 19, 1980, September 2, 1980
and the Special Meeting of the City Council held September 10, 1980, be approved
as submitted. Motion carried.
Mayor Malburg expressed the appreciation of the City Council to "c"
Platoon and Captain Muldown for their efforts during he picnic September 13,
1980, celebrating he 75th anniversary of Vernon's founding. Also conmended
were Frank Murillo and Battalion Chief R. Simensen.
The Mayor announced that this was the time scheduled for the public
hearing to adopt the Uniform Building Code, Electrical, Mechanical, Plumbing
and Fire Codes of the City of Vernon. The City Attorney indicated that the City
Council might desire Victor Vai ts of the Building Department and George Bass
of the Fire Department to explain the proposed uniform codes during this hear-
ing, and the need for a consistent variance procedure with respect thereto.
Victor Vaits and Fire Chief Bass addressed the City Council in relation
to the proposed uniform codes, and the need for uniform variance procedures.
ORDINANCE NO. 899 - An Ordinance of the City Council of the City of
Vernon Regulating the Erection, Construction, Enlargement, Alteration, Repair,
Moving, Removal, Conversion, Demolition, Occupancy, Equipm ent, Use, Height, Area,
and Maintenance of Building or Structures in the City of Vernon, S'late of Cali-
fornia, and Providing for the Issuance of Permits and Collection of Fees Therefor,
Providing Penalties for the Violation Thereof, and Adopting he Uniform Building
Code, 1979 Edition, Including Appendices, Chapters 23, 38, 48 and 57 Promulgated
by the International Conference of Building Officials, and Repealing All
Ordinances and Parts of Ordinances in Conflict Therewith, was read by title for
a first reading.

Therefor and Defining Their Powers and Duties, and Repealing All Ordinances and
Parts of Ordinances in Conflict Therewith, was read by title for a first reading.

Conmunication from L. A. Espinoza, Acting Chief of Police, dated:' September
2, 1980, requesting authority and funds for Lt. L. S. Rosenkrantz to attend LEIU
Northwest/Southwest Conference, at Monterey, California, October 14, to October 17,
1980, with an eXpense allowance of $411.82, was presented.
It was moved by Ybarra, seconded by Gonzales, that the request of Acting
Chief of Police Espinoza be approved and authority granted to issue warrant in
the amount of $411.82, to Lt. L. S. Rosenkrantz. Motion carried.
Conmunication from Bruce V. Malkenhorst, City Administrator/City Clerk,
dated September 10, 1980, transmitting memo from Lou Hauger, Health & Environ-
mental Control Section, dated September 8, 1980 with St ctement of Intent to
Apply for Litter Control Grant Funds from the State Solid Waste Management Board;
the amount available to the City of Vernon is approximately $600.00 for litter
control, reconmending that since the amount is insufficient for the City to carry

out a viable litter control program, that the City Administrator be instructed
to sign 'the Staterrent of Intent, authorizing the. transfer of Vernon's enti tle-
ment to the C01..mty of Los Angeles, and to adopt Resolution No. 4756, was
presented.
RESOLillION NO. 4756 - A Resolution of the City Council of the City of
Vernon Allocating the City of Vernon Entitlement for the Three-Year Period Ending
1983 to the Los Angeles Countywide Program, was presented.
It was moved by Ybarra, seconded by Kaeser, that Resolution No. 4756
be approved and adopted, and that the City Administrator be authorized to sign
the Statement of Intent. Motion carried.

Communication from Director of ConnnunityServices, dated September 8,
1980, transmitting fully executed Easement Deed from Gautier Land Company for a
portion of Alameda Street, recormending that the Easement Deed be accepted and
the grantor be advised of the official recordation, was presented.
It was moved by Gonzales, seconded by Ybarra, that the recomnendation of
'the Director of Community Services be approved, and that the Mayor and the City
Clerk be authorized to execute the Certificate of Acceptance on behalf of the
City of Vernon. Motion carried.
"Warrant REGISTER No. 556" covering claims and demands presented during
the period Sept. 1 to 15, which includes Demands Nos. 1294 to 1444 (both inclusive)
excluding voided Demands Nos. 1326, 1329, 1340, 1344, 1352 and 1429, drawn on the
United California Bank, totaling $3,836,053.67 (Light and Power Warrants
$3,760,328.82) (Accounting Period September 1980), was examined and audited.
It was moved by Ybarra, seconded by Kaeser, that "Warrant Register No.
556" be approved and payment authorized for Demands Nos. 1294 to 1444 (both
inclusive, excluding voided Demands Nos. 1326, 1329,1340, 1344, 1352 and 1429,
wi th no other exceptions. Motion carried.
"Payroll Warrant Register No. 280" covering claims and demands presented
during the period 7/27 to 8/9/80, which includes Demands Nos. 3124 to 3133
(both inclusive), drawn on Crocker National Bank, totaling $237,921.86 (Account-
ing Period August 1980), was examined and audited.
It was moved by Ybarra, seconded by Kaeser, that "Payroll Warrant Register
No. 280" be approved and payment authorized for Demands Nos. 3124 to 3133 (both
inclusive), with no exceptions. Motion carried.
Report of Health & Environmental Control Section, August 1980, was
presented.

Police Department Activity Log,. September 1 - 15, 1980, was presented.
It was moved by Gonzales, seconded by Kaeser, that the Activity Log be
received and filed. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/Director of
Finance, da iEd September 15, 1980, transmitting minutes of the meeting of the
Finance Comnittee held September 15, 1980, requesting approval of the recomnend-
at ions contained therein, was presented.

Finance Comnittee meeting held September 15, 1980 be approved and the recomnend-

Personnel Comnittee meeting held September 15, 1980, be approved and the recom-
mendations contained therein be adopted. Motion carried.
Comnunication from Arthur E. Nelson, Director of Community Services/
Health Officer, dated September 11, 1980, requesting authority and funds for
Eve Wise, R.. N~,:,_to attend Workers'.Comp. SysttEmSeminar, as it relates to
Occupational Health Nurse - Community & Environmental Medicine, at Irvine,
California, September 27, 1980, with an expense allowance of $32.00, was
presented.
It was moved by Ybarra, seconded by Gonzales, that the request of the
Director of Community Services be approved, and authority granted to issue
warrant in the amount of $32.00 to Eve Wise. Motion carried.
Comnunication from Arthur E. Nelson, Director of Community Services,
dated September 11, 1980, transmitting for consideration Agreement between the
City of Vernon and County of Los Angeles for modifying traffic signal control
system at the intersection of Downey Road and Fruitland Avenue, shared equally
between the County and the City, which agreement calls for the City to design
and administer the contract with the County, paying one-half of the construction
cost, estimated at $32,000, the County will deposit $16,000 with the City after
the project is advertised for construction; recomnending that the Agreement be
approved and the Mayor be authorized to execute the agreement, was presented.
RESOLillION NO. 4755 - A Resolution of the City Council of the City of
Vernon Approving the Execution of a Contract By and Between the County of Los
Angeles and the City of Vernon Modifying the Traffic Signal Control System at
the Intersection of Downey Road and Fruitland Avenue, was presented.
It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4755
be approved and adopted. Motion carried.

Conference in Santa Barbara, October 30/November 2, 1980, with an expense
allowance of $500.00, was presented.

dated September 11, 1980, requesting authority and funds for David B. Brearley,
City Attorney, Hilario Gonzales, Councilman, and Bruce V. Malkenhorst, City
Administrator, to attend the Independent Cities of Los Angeles County Conference
in San 1i Barbara, November 1 and 2, 1980, with an expense allowance of $348.00,
was presented.
It was moved by Kaeser, seconded by Ybarra, that the request of the City
Administrator be approved, and authority be granted to issue warrants in the
amount of $348.00 to David B. Brearley, Hilario Gonzales and Bruce V. Malkenhorst.

dated September 16, 1980, submitting alternative to Los Angeles Contract for
Animal Control Services, was presented.

Communication from Bruce V. Malkenhorst, City Administrator/City Clerk,
dated September 16, 1980, submitting a proposed fee schedule for adoption, for
purposes of the 1980-1981 Medevac Budget, was presented.
It was moved by Gonzales, seconded by Ybarra, that the fee schedule for
ihe 1980-1981 Medevac Budget be approved, and the City Attorney be instructed
to prepare an amendment to the Contract consistent with said fee schedule.

RESOLUTION NO. 4691 - A Resolution of the City Council of the City of
Vernon Determining the Disability Retirement of Gary Alvarez, a Local Safety
Member Employed by the City of Vernon (SS 21024 & 21025 of the Government Code)
was presented.
It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4691
be approved and adopted. Motion carried.

Comnunication from Lewis R. Adams, Director of Water & Power, dated
September 16, 1980, submitting a report providing information for a special
contract rate for Bethlehem Steel Corporation consistent with a proposed
modified operating condition and recomnending that a contract be given con-
sideration, was presented.
Mr. Adams further advised the City Council that this special contract
rate is designed to meet Bethlehem Steel's proposal to shift demand to off-
peak periods, thereby lowering Vernon's cost of purchased power, which would
be passed on to the customer. The proposed contract rate recovers all cos ts
of providing service to Bethlehem Steel Corporation.
At this time, 3:00 o'clock, p.m., the Mayor declared a recess for
thirty minutes, in order to study Mr. Adams' report and recomnendation.
The City Council reconvened at 3:30 o'clOCk, p.m., at which time all
members present before the recess were again present.

It was moved by Gonzales, seconded by Ybarra, that the report submitted
by Lewis R. Adams regarding special contract rate for Bethlehem Steel Corpor-
ation be approved as submitted, and that the contract rate be approved, and
that the report be received and filed. Motion carried.
RESOLUTION NO. 4754 - A Resolution of the City Council of the City of
Vernon Approving the Execution of a Contract by and BetWeen Bethlehem Steel
Corporation and the City of Vernon Which Provides for Electrical Services,
was presented.
It was moved by Ybarra, seconded by Kaeser, that Resolution NO. 4754
be approved and adopted. Motion carried.

Communication from Fire Chief Bass, dated September 11, 1980, trans-
mi tting written bid from San Diego Fire Equipment Company, Inc., dated September
10, 1980, for the 1954 Crown Fire Engine, declared surplus, in the amount of
$7,500.00, recommending that the bid be accepted, as the City of Ensenada,
Mexico has declined the City's acceptance of their bid and have purchased a
fire engine from the City of Lynwood, was presented.
After discussion of this item by the City Council and Fire Chief Bass,
it was moved by Ybarra, seconded by Kaeser, that the item be referred to Fire
Chief Bass for an in-depth study, and that said stury be presented to the
Finance Comnittee. Motion carried. d(
At this time, 4:25 o'clock, p.m. , it was moved by Ybarra, seconded by
Gonzales, that the City Council go into executive session, under Attorney/Client
pri vile g;. Motion carried.
All persons, with the exception of the City Administrator/City Clerk,
and City Attorney, were excluded from the executive session. Arthur E. Ne-lson
and L. A. Espinoza were requested to remain on call of the City Council.
Mayor Malburg ordered that all communications to and from the executive
session were deemed private and confidential.
At this time, 4:40 o'clock, p.m., Councilman Kaeser was excused from
fur ther attendance at this session of the council.
At this time, 5:30 o'clock, p.m., it was moved by Gonzales, seconded by
Ybarra, that the City Council go out of executive session and resume regular
session. Motion carried.
It was moved by Gonzales, seconded by Ybarra, that the City Attorney be
authorized to file a law suit against Coast Metals to enjoin their improper use
of the sidewalks for the storage of heavy metal rolls, and to recover damages
suffered by the City of Vernon for the destruction of portions of sidewalks
and streets. Motion carried.
It was moved by Ybarra, seconded by Gonzales that the City Attorney be
instructed to institute an action in Superior Court against Officer D. H. Mains,
III, for recovery of costs expended by the City of Vernon on training, salary
and mandated benefits, pursuant to an employment eontract, for the period
February 20, 1980 to August 27, 1980. Motion carried.
It was moved by Ybarra, seconded by Gonzales, that authority and funds
be granted for Bruce V. Malkenhorst and David B. Brearley to attend a hearing
in Washington, D. C., Re: FERC Docket No. ER79-150, Southern California Edison
Company. Motion carried.
Communication from Rapid Transit District, dated September 9, 1980,
requesting the City of Vernon's aid in petitioning the federal and state govern-
ments to provide sufficient transit subsidies, was presented.
It was moved by Ybarra, seconded by Gonzales, that the communication
from the R T D be received and filed. Motion carried.
It was moved by Ybarra, seconded by Gonzales , that Application No.
59929 of the Southern California Gas Company before the Public Utilities Com-
mission of the State of California, on September 8, 1980, requesting determin-
ation tklat SoCal acted reasonably in buying certain volumes of gas from Pacific
Interstate Transmission Company and requesting authority to decrease rates 1. 3%
under SoCal' s current ra tes and char~s, over an annual period beginning October
1, 1980, be received and filed. Motion carried.
At this time, 5:35 o'clock, p.m., it was moved by Gonzales, seconded
by Ybarra, that ihe City Council go into executive session under Section 54957
of the Government Code. Motion carried.

5% be given to Victor Vai t3, Civil Engineer!Deputy Director of Community
Services; Louis Hauger, Director of Environmen tal Health; and Ann Dorsey,
Secretary, Department of Community Services, effective October 5, 1980. Motion
carried.
There being no further business to come before the City Council, it was
moved by Ybarra, seconded by Gonzales, that the meeting adj oum until 4: 30
o'clock, p.m., September 30, 1980. Motion carried.
