MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL.,OF THE CITY OF VERNON,
HElD OCTOBER 7, 1980, AT 4:45 O'CIDCK,
P.M., IN THE COUNCIL CHAMBER OF THE
CITY HAIL, IDCATED AT 4305 SANTA FE

'Ihe meeting was called to order by Mayor Malburg.
It was moved by Gonzales, seconded by Ybarra, that the minutes of the
regularly scheduled Council meeting held September 16, 1980, be approved as
written and submitted. Motion carried.
Fire Chief George F. Bass introduced Samu.el Gierhan, who was awarded a
plaque by the Vernon Kiwanis Club, as the Fire Fighter of the year. Fireman
Gierhan exhibited the plaque presented to him and posed for a photograph with
the membE?rsbfthe City Council.
'Ihe City Clerk reported that this was the time and place for the hearing
relating to the adoption of Ordinances No. 899, 901, 902, 903 and 904 of the
City of Vernon, in accordance with notice dated September 16, 1980.
Proof of Publication in the Los Angeles Daily Journal of September 25,
1980 of "Notice of Public Hearing" was duly acknowledged as being on file.
The City Clerk reported that no written corrmunications relative to this
matter had been received.
Upon recorrmendation of the City Attorney, it was moved by Ybarra, seconded
by Gonzales, that the second and final reading of proposed Ordinances No. 899,
901, 902, 903 and 904 be deferred until the next meeting of the City Council.
Motion carried.

Corrmunication from David B. Brearley, dated September 22, 1980, recorrmending
the claims of IJ.zandro Cruz (Casteneda) and Antonio Perez, submitted by Pereyda and
Delnick, Attorneys at law, as a result of an automobile accident which allegedly
occurred on March 10, 1979, be denied, was presented.
It was moved by Gonzales, seconded by Ybarra, that the claims of IJ.zandro
Cruz (Casteneda) and Antonio Perez be denied. Motion carried.
Claim for damages submitted by Jack P. Maltzman as result of alleged
accident on August 26, 1980, with Vernon Fire Department Engineer, Gerald O. Dressen,
in the amount of $999.73, was presented.
It was moved by Ybarra, seconded by Gonzales, that the claim of Jack P.
Maltzman be referred to the City Administrator and the City Attorney for review,
investigation and recormnendation. Motion carried.
Summons and Complaint filed in the Superior Court of the State of California,
County of Los Angeles, Case No. 32392, entitled Ramona Benson vs. City of :l\1aywood,
City of Vernon, for personal loss occurring June 29, 1979, was presented.
It was moved by Gonzales, seconded by Ybarra, that Summons and Complaint,
Ramona Benson vs. City of Maywood, City of Vernon, LASC Case No. 32392, be refer-
red to Southern California Joint Powers Authority to defend the City's interest.

Claim for damages submitted by Marlene Blauner, Claims Adjuster with
Uberty Mutual Fire Insurance Company, in the case of Judith Wheeler, Kal
Kan Foods, Inc., Case No. c664-220962, for accident occurring July 16, 1980,
was presented.
It was moved by Ybarra, seconded by Gonzales, that this item be considered
by the City Council in executive session later this same day. Motion carried.
Communication from Arthur E. Nelson, Director of Corrmunity Services, dated
September 22, 1980, requesting authority and funds for Jim P.ersons to attend a
one day "Roadway Ughting" course on Tuesday, November 18, 1980, in Los Angeles,
California, with a total expense of $55.00, was presented.
It was moved by Ybarra, seconded by Gonzales, that the request of the
Director of Community Services be approved and authority granted to issue warrant
in the amount of $55.00 to Jim Persons. Motion carried.
Corrmunication from Arthur E. Nelson, Director of'Community Services, dated
October 1, 1980, requesting authority and funds for Eve Wise to attend Emergency
Nursing Symposium in West Covina, California, October 21, 1980, with a total
expense of $40.00, was presented.
It was moved by Ybarra, seconded by Gonzales, that the request of the Director
of Corrmunity Services be approved and authority granted to issue warrant in the
amount of $40.00 to Eve Wise. Motion carried.
Corrmunication from Bruce V. Malkenhorst, City Administrator, Director of
Finance, dated September 30, 1980, recorrmending approval of the recorrmendations
made at the Finance Committee meeting held September 29, 1980, was presented.
It was moved by Gonzales, seconded by Ybarra, that the recorrmendations
submitted by the Finance Committee at the meeting held September 29, 1980, be
approved and adopted. Motion carried.
Police Department Activity Log, September 16-30, 1980,was presented~
It was moved by Ybarra, seconded by Gonzales, that the Police Department
Activity Log, September 16-30, 1980, be received and filed. Motion carried.
Warrant Register No. 557, covering claims and demands presented during the
period September 16 - 30, 1980, which included Demands Nos. 1445 to 1603 (both
inclusive) drawn on the United California Bank, totaling $305,135.88 (Ught &
Power Warrants $172,414.12) (Accounting Period October, 1980) was examined and
audited.
It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 557,
be approved and payment authorized for Demands Nos. 1445 to 1603 (both inclusive)
with no exceptions. Motion carried.
Health Department Report for the month of September, 1980, was presented.
It was moved by Gonzales, seconded by Ybarra, that the Health Department
September 1980 Report be received and filed.
Corrmunication from Bruce V. Malkenhorst, City Administrator, dated September
29, 1980, recorrmending approval of Arthur Nelson's request to relocate the City's
Historical Milestone to the northwest corner of Downey Road and Fruitland Avenue,
inside the fence at Booster Plant #3, was presented.
It was moved by Ybarra, seconded by Gonzales, that the request of Arthur
Nelson be approved, and authority granted to relocate the City's Historical Milestone
as specified. Motion carried.
Corrmunication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated
October 2, 1980, advising that the Director of Corrmunity Services and the City
Attorney have agreed liability insurance schedules be adopted, as required by
Section 22.74 of the Encroachment Ordinance of Vernon; recorrmending adoption of
a schedule of insurance for permittees under the encroachment ordinance for con-
tractors under both permit and contract, as set out in the proposed Certificate of
Insurance, was presented.

It was moved by Gonzales, seconded by Ybarra, that this item be referred to
the Finance Committee for review and recommendation. Motion carried.
Payroll Warrant Register No. 281 covering claims and demands presented
during the period August 10 through September 6, 1980, which included Demands
Nos. 3134 through 3148, (both inclusive) drawn on the Crocker National Bank,
totaling $536,539.51 (Accounting period September 1980) was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that Payroll Warrant Register
No. 281 be approved and payment authorized for Demands Nos. 3134 through 3148
(both inclusive) with no exceptions. Motion carried.
Communication from Acting Chief of Police L.A. Espinoza, dated October 1,1980.
requesting authority and funds for Howard N. Stolan to attend the California Narcotic
Officers Association Training Conference in San Diego, California, October 28 - 31,
1980, with a total expense of $308.84, was presented.
It was moved by Ybarra, seconded by Gonzales that the request of Chief L.A.
Espinoza be approved and authority granted to issue warrant in the amount of $308.84
to Howard N. Stolan. Motion carried.
Communication from Fire Chief, George F.Bass, dated October 6, 1980, re-
questing authority and funds for Francis Sumner to attend a Combined Northern
and Southern Division, Fire Prevention Officers, California Fire Chief's Assoc-
iation meeting in San Diego, California, October 16-17, 1980, with a total expense
allowance of $136.00, was presented.
It was moved by Gonzales, seconded by Ybarra, that the request of Fire
Chief Bass be approved and authority granted to. issue warrant in the amount of
$136.00 to Francis W. Sumner. Motion carried.
Communication from Bruce V. Malkerihorst, City Administrator, dated October
7, 1980, recommending approval of the following personnel actions:
1. That Alvin Jackson be hired as an Academy Cadet, Step 4, effective
October 10, 1980, pending successful completion of pre-employment examinations.
2. That Steven E. Dawson be hired as a Police Department Communications
Operator, Step 6, to become effective October 8, 1980, based on successful com-
pletion of medical examination;
3. That Justus Knight, Jr. ,be hired as Policeman I, Step 4 , effective
October 20, 1980, pending successful completion of Rio Hondo Police Academy,
and to work in the Cormnunication Center upon graduation, until he reaches the
age of twenty at which time he is qualified to become a sworn officer; and
4. That Fire Chief George F. Bass be advanced to Fire Chief Step 2,
effective October 5, 1980.
It was moved by Gonzales, seconded by Ybarra, that the recommendations
of the City Administrator be approved, :and the personnel actions above speci-
fied are effective as noted. Motion carried.
Communication from Bruce V. Malkerihorst, City Administrator, dated October
7, 1980, recommending approval of the request submitted by the Deputy Director
of Community Services, Victor H. Vaits, of the proposed license agreement for a
pipe bridge across 50th Street at Norris Industries, was presented.
A discussion of this item followed, after which, on motion of Ybarra,
seconded by Gonzales, same was referred to the Deputy Director of Community
Services for report, at the council's next meeting, whether the pipe bridge in
question, or any part thereof would be a conductor of toxic chemicals. Motion
carried.
Communication from Victor H. Vai ts, Deputy Director of Community Services,
dated October 6, 1980, recommending that Maas-Hansen Steel Corporation be granted a
variance from the area limitations of the 1976 Uniform Building Code , to construct
approximately 76,260 sq.ft., of noncombustible construction; the UBC allows only
27,000 sq.ft., was presented.
CounciJrnan McCormick assumed his seat on the council at this time, 5: 25
o'clock, p.m.
After discussion of the Maas-Hansen Steel Corporation request for variance,
it was moved by Gonzales, seconded by Ybarra, that the variance be granted, on the
condition that if there is any modification in the existing or porposed Maas-Hansen
building that alters the operation to a more hazardous activity, the new addition shall
be removed or the entire building provided with an approved fire sprinkler system.A82

At this time, the Mayor invited corrments from the Staff; Acting Chief
Espinoza, Captain L.F. Ely and Victor H. Vaits responded.
At this time, 5:30 o'clock, p.m., it was moved by Ybarra, seconded by
Gonzales, that the City Council go into executive session under attorney/client
privilege. Motion carried .
All persons ,with the exception of the City Administrator/City Clerk, the
City Attorney, . and the Director of Corrmunity Services, were excluded from the
executive session.
Mayor Malburg ordered that all comrmmications to and from the executive
session were deemed private and confidential.
At this time, 6:40 o'clock, p.m., it was moved by McCormick, seconded by
Ybarra, that the City Council go out of executive session and resume regular
session. Motion carried.
It was moved by McCormick, seconded by Ybarra, that the claim for damages
submitted by Marlene Blauner, Claims Adjuster with Liberty Mutual Fire Insurance
Company, representing Judity Wheeler, Kal Kan Foods, Inc., Case No. C664-220962,
be referred to Southern California Joint Powers Authority for investigation and
report. Motion carried.
There being no further business to come before the City Council, it was
moved by McCormick, seconded by Ybarra, that the meeting be adjourned until
Tuesday, October 14, 1980, at 4:45 o'clock, p.m. Motion carried.
