MINUTES OF AN ADJOURNED REGULA.R MEETING
OF THE CITY COUNCIL,HELD OCTOBER 16, 1980,
AT FOUR THIRrY 0' CIDCK, P. M., IN THE
COUNCIL CHAMBER OF THE CITY HAIL, IDCATED
AT 4305 SANTA FE AVENUE, VERNON, CALI-
FORNIA.
MEMBERS PRESENT:
Malburg, Ybarra, Kaeser
MEMBERS ABSENT:
Gonzales (arrived 5:00 p.m; McCormick arrived 4:25 p.m.)
The meeting was called to order by Mayor Malburg.
Cormnmication from Arthur E. Nelson, Director of Cormnmity Services,
dated October 15, 1980, recoITmending the work of Slurry Sealing of Certain Streets
be accepted and that authority be granted to pay the contractor, Roy Allen Slurry
Seal Contractor, per Contract No. 435, was presented.
RESOLUTION NO. 4758 - A Resolution of the City Council of the City of
Vernon, accepting the work of Roy Allen Slurry Seal Contractor, for the work done
on various streets within the City of Vernon, under Contract No. 435, was presented.
It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4758
be approved and adopted. Motion carried.

Claim for Damages submitted by Government Employees Insurance Company,
as subrogee of Aubrey L. Teters, and injuries as a result of an accident on August
22, 1980 with a Vernon Police Department pursuit unit, at Mission Street and Los
Robles Avenue, San Marino, California, in the amount of $20,720, was presented.
It was moved by Ybarra, seconded by Kaeser, that the claim for damages
and injuries submitted on behalf of Aubrey L. Teters, in the amount of $20,720.00,
as a result of accident on August 22, 1980 in San Marino, be denied. Motion carried.
Cormnmication from Bruce V. Malkenhorst, City Administrator, dated
October 16, 1980, requesting authority and funds to attend the CALPELRA Conference
in Monterey, California, November 13-14, 1980, with a total expense allowance of
$413.00, was presented.
It was moved by Kaeser, seconded by Ybarra, that the request of the City
Administrator be approved, and authority granted to issue warrant in the amount of
$413.00 to Bruce V. ~lJalkenhorst. Motion carried.
RESOLUTION NO. 4757 - A Resolution of the City Council of the City of
Vernon Establishing Dog License Fees and Approving the Execution of an Agreement
Between the City of Vernon and Southeast .Area Animal Control Authority for Animal
Control Services, was presented.
It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4757 be
approved and adopted. Motion carried.

"Warrant Regis ter No. 558" covering claims and demands presented during
the period October 1st thru 16th, which includes Demands Nos. 1604 to 1727, (both
inclusive) drawn on the United California Bank, totaling $4,149,488.86 (Light and
Power Warrants $4,063,667.33) (Accounting Period October 1980), was examined and
audited.

It was moved by Ybarra, seconded by Kaeser, that Warrant Register No.
558 be approved and payment authorized for Demands Nos. 1604 to 1727 (both inclusive)
drawn on the United California Bank, with no exceptions. Motion carr>ied.
Pursuant to the minute order issued at the City Council meeting of
October 7, 1980, regarding ihe request of Norris Industries, for a pipe bridge
across 50th Street, Arthur E. Nelson submitted further information regarding the
proposed license agreement.
It was moved by Ybarra, seconded by Kaeser, that this item be referred
to the City Attorney for review, report and recommendation. Motion carried.
At the City Council meeting of October 7, 1980, the claim for damages
submitted by Marlene Blauner, Claims Adjuster with Liberty Mutual Fire Insurance
Company, representing JUDITH WHEEIER, Kal Kan Foods, Inc., Case No. c664-220962,
was ordered referred to the Southern California Joint Powers Insurance Authority
for investigation.
The City Attorney recommended that the City Council deny ihe claim
submitted on behalf of Judith Wheeler.
It was moved by Kaeser, seconded by Ybarra, that the claim submitted
on behalf of Judith Wheeler be denied. Motion carried.
Councilman McCormick assumed his seat on the council at this time,
4:25 o'clock, p.m.
At this time, 4:26 o'clock, p.m., it was moved by Ybarra, seconded by
McCormick, that the City Council go into executive session under Attorney/Client
privilege. Motion carried.
All persons with the exception of the City Administrator/City Clerk
and the City Attorney were excluded from the executive session.
Mayor Malburg ordered that all communications to and from the executive
session were deemed private and confiden iial.
At this time, 5:06 o'clock, p.m., Councilman Gonzales assumed his seat
on the City Council.
At this time, 5:06 o'clock, p.m., it was moved by Kaeser, seconded by
McCormick, that the City Council go out of executive session and resume regular
session. Motion carried.
It was moved by Gonzales, seconded by McCormick that authority be
granted to issue warrant in the amount of $942.00 for "Hospitality Room" expenses
($314.00 per day) in ihe Bonaventure Hotel, Los Angeles, October 20, 21 and 22,
1980, to host delegates to the League of California Cities Annual Conference.
Motion carried.
There being no further business to come before the City Council, it was
moved by Kaeser, seconded by McCormick, that the meeting be adjourned until Tuesday,
October 28, 1980, at 2:00 o'clock, p.m. Motion carried.
