It was moved by Kaeser, seconded by Ybarra, that the minutes of the meeting of the City Cotmcil held November 4, 1980, be approved as written and submitted. Motion carried. Conmunication fram Bruce V. Ma1.kenhorst, City Administrator/Director of Finance, transmitting for approval, recOIllIEIldations contained in the Finance Conmittee minutes of November 10, 1980, was presented. It was moved by Kaeser. seconded by McConnick, that the minutes of the Finance Corrmittee meeting held Novernber 10, 1980, be approved and that the recoomendations contained therein be adopted. Motion carried. SurrmJIlS & Complaint filed Novernber 8, 1979, by Xerox Corporation; Diablo Systems, Inc., and Xerox. Development Corporation against the City of Vemon, et al., in Superior Court of the State of Ca1ifomia, COtmty of Los Angeles, Case No. C303822, for refund of property taxes allegedly collected erroneously or illegally, was presented. It was moved by Gonzales, seconded by McConnick, that the pleadings in the above-entitled court and cause be referred to Cotmty Cotmsel for defense in this matter. .~Q:ti~ carried. The City Clerk announced that this was the time and place for the hearing relating to the adoption of Ordinances No. 899. 901, 902, 903 and 904 of the City of Vemon, in accordance with the minute order of the City Cotmcil issued November 4, 1980. The City Attomey reported that since changes were necessary in Ordinances No. 903 and 904, presented and read for a first reading on Septernber 16, 1980, it was his recorrmendation that corrected Ordinances 903 and 904 be presented and read at this time, for a first reading. Ordinance No. 903 - An Ordinance of the City Cotmcil of the City of Vemon Adding New Article IX, Sections 7.90 Through 7.93 to the Code of the City of Vemon, California, 1959, Providing for Liability and Variances and Prescribing Penalties for the Violation of any Provision of Ordinance Nos. 899, 901, 902, 903 and 904 v,,lhich Adopted by Reference the Unifonn Building Code, 1979 Edition, the Unifonn Mechanical Code, 1979 Edition, the Unifonn Plumbing Code, 1979 Edition, the Unifonn Fire Code, 1979 Edition and Repealing all Ordinances and Parts of Ordinances in Conflict Therewith. (First Reading.) It was moved by Gonzales, seconded by Ybarra, that Ordinance No. 903 receive and pass a first reading. Motion carried. AYES: NOES: ABSENT : Gonzales, Ybarra, Kaeser, McConnick, Malburg None None Ordinance No. 904 - An Ordinance of the City of Vemon Adopting the Unifonn Fired Code, 1979 Edition, Including Appendices A Through I, Prescribing Regulations Goveming Conditions Hazardous to life and Property from Fire or Explosion, and Establishing a Bureau of Fire Prevention and Providing Officers Therefor and Defining Their Powers and Duties, and Repealing all Ordinances and Parts of Ordinances in Conflict Therewith. Motion carried. Health Depart::mmt Activity Log, November 1 - 15, 1980, was presented. It was moved by Kaeser, seconded by Ybarra, that the Activity Log of the Health Department be received and filed. Motion carried. Police Department ActiVity Log, November 1 - 15, 1980, was presented. It was moved by McConnick, seconded by Ybarra, that the Activity Log of the Police Depart::rrent, November 1 - 15, 1980, be received and filed. Motion carried. ''Warrant Register No. 560" covering claims and demands presented during the period Novenher 1 thru 16, 1980, which includes Demands Nos. 1818 to 1954 (both inclusive) excluding voided Demand No. 1935, drawn on the United Califomia Bank, totaling $4,438,097.45 (Light and Power Warrants $4,320,778.33) Accounting Period Noverrber 1980, was examined and. audited. It was moved by Kaeser, seconded by Ybarra, that Warrant Register No. 560, be approved and payment authorized for Demands Nos. 1818 to 1954 (both inclusive) excluding voided Demand No. 1935, with no other exceptions. Motion carried. Resolution No. 4759 - A Resolution of the City Council of the City of Vernon, Approving the Execution of the Amendnent and Renewal of a Contract Between the City of Vernon and Medevac, Inc., for Interim Paramedic Services, was presented/ It was moved by Gonzales, seconded by Kaeser, that adoption of this item be deferred to the next regular meeting of the City Council on December 2, 1980. Motion carried. Camn..m.ication from Arthur E. Nelson, Director of Comnunity Services, dated November 12, 1980, submitting Contract No. 438, Pavement Striping for 1981, for approval and authorization to advertise for bids, was presented. Resolution No. 4761 ;....j A Resolution of the City Council of the City of Vernon, Approving Contract No. 438 and Authorizing Sealed Proposals or Bids for Pavement Striping, 1981, was presented. It was moved by Kaeser, seconded by Ybarra, that Resolution No. 4761 be approved and adopted. Motion carried. Adams, Director of Water & Power, dated November 18, 1980, recOllIrending that the present Energy Cost Adjust::mmt Billing Factor of 1.052 cents per kilowat hour be continued for the next quarter, was presented. It was moved by Ybarra, seconded by McConnick, that the recOIIIIeIldation of Lewis R. Adams, Director of Water & Power, to continue for the next quarter the present Energy Cost Adjustment Billing Factor (ECABF) of 1.052 cents per ki10wat hour, be approved. Motion carried. Ordinance No. 907 - Pm Ordinance of the City of Vernon to License for the Purpose of Revenue and Regulation, Certain Kinds of Businesses Authorized by Law and Carried on in the City of Vernon, Including Shows, Exhibitions, and Lawful Games; to Fix and Establish their Rates of License Taxes and to Provide for their Collection by Suit or Otherwise; Prescribing Penalties for the Violation of any Provisions of this Ordinance, and Repealing all Ordinances and Parts of Ordinances in Conflict Therewith, was presented, I and read by title for a first reading. 491. Nelson, Director of Camn.m.ity Services, dated Novenber 18, 1980, recoomending Rose Gonzales be advanced to Utility Clerk Step 4, effective Novenber 30, 1980, on the basis of ~rit and having been in grade one year, was presented. It was moved by Gonzales, seconded by Kaeser, that the reccmnendation of the Director of Carmunity Services be approved. Motion carried. Conmt.mi.cation fran Bruce V. Malkenhorst, City Administrator, dated Novenber 18, 1980, transmitting Personnel Coomittee Minutes of November 17, 1980 ~eting, recornnending reccmnendations contained therein be approved, was presented. It was IIDVed by Kaeser, seconded by Gonzales that the minutes of the Personnel Carrnittee ~eting held November 17, 1980 be approved and that the rE?coomendations contained therein be adopted. Motion carried. Camn.m.ication fran Bruce V. Malkenhorst, City Administrator/City Clerk, dated Novenber 18, 1980, reconmending that the City sponsor a Christmas Party on Decenber 19, 1980, and that a charge of $5.00 be made for each couple, was presented. It was moved by Kaeser, seconded by Ybarra, that the recornnendation of the City Administrator be approved and authority granted to sponsor a Christmas Party on Decenber 19, 1980 for city employees, with the City bearing the cost of said party. Malkenb.orst, City Administrator/City Clerk, dated Novenber 18, 1980, reccmnending Susan McCants be hi-red, contingent on the results of her medical examination, as a Police DepartnEnt Conmunications Operator , effective' Novenber 24, 1980, was presented. It was moved by Kaeser, seconded by Ybarra, that the recarmandation of the City Administrator be approved and pending result of physical examination Susan McCants be hired as Conmunications Operator , effective November 24, 1980. Motion carried. At this time the Mayor invited cornnents fran the Staff. 'Ihe Director of Conmuni ty Services reported that Southern. California Rapid Transit District plans another bus route in Vernon covering 38th Street, 37th Street, Soto Street, Vernon Avenue,..a:ld~S.ante_.Fe...Avenue. The Mayor asked Randy Echols , representative from Senator Greene's office, whether he wished to address the City COlIDcil. Mr. Echols introduced Mr. Curtis Ernest, who will be Mr. Greene's repre- sentative, as Mr. Echols is leaving for Washington, D.C. to be Congressman- elect Dymal1y's consultant. Mr. Echols invited the City COlIDcil to feel free to call upon Mr. Ernest for informa.tion or assistance regarding state labor legislation. At this time, 2:45 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the City Co1.ID.cil go into executive session in accordance with Section 54957 of the Government Code. Motion carried. I All persons, with the exception of the City Administrator/City Clerk and City Attorney were excluded from the executive session. Battalion Chief P .N. Moorehead and Firefighter J. Hardy were requested to remain on call of the City Council. B/C Moorehead attended the executive session at 3:00 o'clock, p.m., and was dismissed fran further attendance at 3:15 o'clock, p.m. Firefighter J. All persons with the exception of the City Administrator/City Clerk and the City Attorney were excluded fraIl the executive session. Mayor Malburg ordered that all corrmmications to and fraIl the executive session were deemed private and confidential. At this time, 4:16 o'clock, p.m., it was moved by Kaeser, seconded by Ybarra, that the City Cotmci1 go out of executive session and resune regular session. Motion carried. The City Attomey reviewed for the City Cotmcil the tenns of the Judgment issued by Superior Court Judge John A. Loomis on Novenber 14, 1980, in L.A.S.C. Case No. C327733, Philip S. Reavis and Spencer E. Hogan, Contestants v. Keith Kaeser, Defendant. It was lOOVed by Kaeser, seconded by McConnick that the .Judgment as issued by Judge John A. Loomis be received and filed. Motion carried. It was IIDved by McConnick , seconded by Ybarra, that an action be filed in the Small Claims Court, Southeast Judicial District against Ismae1 Garcia Mendoza and Ruben Montoya as a result of traffic collision with Police Department unit driven by Don Green on November 23, 1979, in the arrmmt of 654.01. Motion carried. At this time, 4:20 o'clock, p.m., it was lOOVed by Kaeser, seconded by Ybarra, that the City Cotmci1 go into executive session rn.der Section 54957 of the Goverrnnent Code. Motion carried. All persons with the exception of the City Administrator/City Clerk and the City Attomey were excluded fraIl the executive session.
