The m-eting was called to order by Mayor Malburg.
It was moved by McCormick, seconded by Gonzales, that the minutes of
the meeting of the City Council held December 4, 1980, be approved as written
and submitted. Motion carried.
The City Administrator/City Clerk announced at this time qualified
city employees eligible to receive service pins were present at the meeting
for awarding of the service pin.
The Mayor presented service pins for 25, 20, 15, 10 and 5 years'
service to the following employees:

Comnunication from Bruce V. Malkenhorst, City Administrator/City Clerk,
dated December 16, 1980, transmitting minutes of the Finance Corrmittee meeting
held December 8, 1980, for approval of recomnendations contained therein, was
presented.

It was moved by Kaeser, seconded by Ybarra, that minutes of the Finance
Comnittee meeting held December 8, 1980, be approved and that the recomnendations
contained therein be adopted. Motion carried.
Comnunication from Bruce V. Malkenhorst, City Administrator/City Clerk,
da ted December 16, 1980, transmitting minutes of the Personnel Comnittee meeting
held December 15, 1980, for approval of recomnendations contained therein, was
presented.
It was moved by Kaeser, seconded by Gonzales, that the minutes of the
Personnel Corrmittee meeting held December 15, 1980, be approved and that the
recomnendations contained therein be adopted. Motion carried.

Comnunication from Victor H. Vaits, Deputy Director of Comnunity
Services, dated December 8, 1980, recomnending Byron-Jackson be granted an
extension of their temporary portable office permit to December 31, 1981, was
presented.
It was moved by Kaeser, seconded by McCormick, that temporary portable
office permit for Byron-Jackson be extended until December 31, 1981. Motion
carried.
Comnunication from Arthur E. Nelson, Director of Comnunity Services,
dated December 9, 1980, requesting authority and funds to attend a short course,
"The General Plan - California Law, Current Legal Issues and Recent Case Law",
in San ta Ana, California, January 22, 1981, with a total expense allowance of
$85.00, was presented.
It was moved by Ybarra, seconded by Kaeser, that the request of the
Director of Comnunity Services be approved, and authority granted to issue warrant
in the amount of $85.00 to Arthur E. Nelson. Motion carried.

Claim for damages, dated November 28 , 1980, in the amount of $433.56
as a result of an accident occurring November 10, 1980, wherein a City employee
in the line of duty, damaged a power switch assembly at Central Valley Hide Co.,
Vernon, California, was presented.
It was moved by Gonzales, seconded by McCormick, that the claim for
damages by Central Valley Hide Company, in the amount of $433.56, be approved,
and authority granted to issue warrant in the amount of $433.56 to Central Valley
Hide Company. Motion carried.

Communication from Lewis R. Adams, Director of Water & Power, dated
December 10, 1980, requesting authority and funds to attend the 49th Ammal Con-
ference, California Municipal Utilities Association, 'in Coronado, California,
January 28 - 30, 1981, with an expense allowance of $329.00, was presented.
It was moved by McCormick, seconded by Kaeser, that the request of
Lewis R. Adams be granted and authority granted to issue warrant in the amount
of $329.00 to Lewis R. Adams. Motion carried.
Communication from the City of Bell Gardens, dated December 9, 1980,
rej ecting the claim in the amount of $15,000, which the City of Vernon presented
November 12, 1980, regarding iheir employment of former Police Officer D. H.
Mains, was presented.
It was moved by McCormick, seconded by Kaeser, that this item be
deferred to executive session, to be held later this same day. Motion carried.
Communication from Fire Chief George F. Bass, dated December 4, 1980,
requesting Firefighter F. Salisbury be reimbursed $31.75 for formal education
in connection with his position with the City, was presented.
It was moved by Kaeser, seconded by Ybarra, that the request of Fire
Chief Bass be approved and authority granted to issue warrant in the amount of
$31. 75 to Firefighter F. Salisbury. Motion carried.
RESOLurION NO. 4759 - A Resolution of "he City Council of the City of
Vernon Approving the Execution of the .Amended and Renewal of a Contract Between
ihe City of Vernon and MEDEVAC, INC., for Interim Paramedic Services and Deter-
mining that the Execution and Implementation of Said Agreement Will Not Have Any
Adverse Affect Upon the Wages, Hours, or Working Conditions of Employees in the
Fire Department of "the City of Vernon, was presented.
It was moved by McCormick, seconded by Ybarra, that Resolution No.
4759 be approved and adopted. Motion carried.

"Warrant Register No. 562" covering claims and demands presented during
"the period December 1 through December 15, which includes Demands Nos. 2027 to
2173 (both inclusive) drawn on the United California Bank, totaling $5,243,206.81
(Light and Power Warrants $5,137,686.92) Accounting period December, 1980, was
examined and audited.
It was moved by Ybarra, seconded by Gonzales that Warrant Register No.
562 be approved and payment authorized for Demands Nos. 2027 to 2173 (both in-
clusi ve) with no exceptions. Motion carried.
"Payroll Warrant Register No. 283" covering claims and demands presented
during the period October 19 through November 15, 1980, which included Demands
Nos. 3169 through 3186 (both inclusive), drawn on the Crocker National Bank,
totaling $506,678.16 (Accounting period November 1980), was examined and audited.
It was moved by Ybarra, seconded by Gonzales that Payroll Warrant
Register No. 283 be approved and payment authorized for Demands Nos. 3169 through
3186 (both inclusive), with no exceptions.

Police Department Activity Log, December 1 - 15, 1980, was presented.
It was moved by Kaeser, seconded by McCormick, that the Log be received
and filed. Motion carried.
Communication from BruceV. Malkenhorst, City Administrator/City Clerk,
dated December 15, 1980, requesting authority and funds for all counciJrnen, the
City Attorney and the City Administrator, to attend the 15th Annual Employee
Relations Institute, League of California Cities, in San Francisco, California,
January 21 - 22, 1981, with an expense allowance of $490.00 each, was presented.

It was moved by Gonzales, seconded by Ybarra, that the request of the
City Administrator be approved and authority gr>anted to issue warrants in the
amount of $490.00 to each of the individuals above set forth. Motion carried.
Communication from Roy M. Ulrich, Superior Properties, dated December
9, 1980, advising ihat pursuant to Section 7.64 of the Vernon City Code, a
request for an exception be made to a decision of Fire Chief Bass, requir:ing
sprinklers be installed at the property located at 5075 Santa Fe Avenue; that
the current protection equipment in place is more than adequate under the UBC
and that the decision of the Fire Chief amounts to an unlawful and unreasonable
restriction on the use of private property, was presented.
Fire Chief Bass and Victor Vaits discussed this item, indicating thc~t
according to a violation notice issued January 24, 1980, subject property was
not in conformance with the Municipal Code requirements and the company repre-
sentative, Roy Ulrich, was instructed to comply by correcting the violations
listed in the notice.
It was moved by Kaeser, seconded by Ybarra, that action on this item
be deferred until the next regular meet:ing of the City Council, January 6, 1981,
that Fire Chief Bass be ins true ted to confer with Mr. Ulrich and his partner
regard:ing installation of an automatic fire sprinkler system, and that Victor
Vaits and George Bass prepare a report to the City Council, submitting their
recommendations, from which the council may be able to act upon this request.
Motion carried.
RESOLTOION NO. 4765 ,.... A Resolution of the City Council of the City of
Vernon Requesting Membership in the Southern California Public Power Authority,
was presented.
It was moved by Ybarra, seconded by Kaeser, that Resolution No. 4765
be approved and adopted. Motion carried.

RESOLurION NO. 4766 - A Resolution of the City Council of the City of
Vernon Amending Section 5 of ihe Resolution No. 4740 Which Established Fees For
Build:ing, Electrical, Plumbing, Heat:ing, Ventilating, Cooling, Refrigeration,
and Fire Prevention Permits Issued by "the City of Vernon and For Special In-
spections, Certificates of Occupancy, Temporary Use of Commercial Coaches and
For Review and Approval of 'lentati ve Parcel Maps For Subdivision of Property,
was presented.
It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4766
be approved and adopted. Motion carried.

At this time, the Mayor invited comments from the Staff; there being
none, it was moved by McCormick, seconded by Ybarra, that the City Council go
into executive session under Attorney/Client privilege, at this time, 5:30
o'clock, p.m. Motion carried.

All persons with the exception of the City Administrator/City Clerk
and the City Attorney were excluded from the executive session.
Mayor Malburg ordered that all corrmunications to and from the executive
session were deemed private.
At this time, 6:01 o'clock, p.m., it was moved by McCormick, seconded
by Ybarra, that the City Council go out of executive session and resume regular
session. Motion carried.

Corrmunication from Bruce V. Malkenhorst , City Administrator /Director
of Finance, dated December 16, 1980, transmitting recorrmendation of the Finance
Committee regarding stipulation with respect to Compromise and Release, Curtis
Frank, retired, was presented.
It was moved by Ybarra, seconded by McCormick, that the proposed Com-
promise and Release in the case of Curtis Frank, WCAB Case No. 79 VN 902574,
be approved. Motion carried.
It was moved by Kaeser, seconded by Gonzales, that the City Attorney
be authorized to institute legal action against the City of Bell Gardens and
D. H. Mains, in the Superior Court, County of Los Angeles, in the amount of
$15,000, arising from the breach of employment contract by D. H. Mains.
Motion carried.
There being no fUrther business to come before the City Council, it
was moved by McCormick, seconded by Ybarra, that the meeting adjourn. Motion
carried.
