MINUTES OF AN ADJOURNED REGULAR MEETING
CITY COUNCIL HELD JUNE 2, 1981, AT
3:300.CLOCK, P.M., IN THE COUNCIL
CHAMBER OF THE CITY HALL, LOCATED AT
4305 SANTE FE AVENUE, VERNON, CALIF.
MEMBERS PRESENT: McCormick, Malburg, Ybarra, Gonzales
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
It was moved by McCormick, seconded by Ybarra, that the minutes
of the City Council meeting of May 19,1981, be approved as written and
submitted. Motion carried.
It was moved by McCormick, seconded by Ybarra) that the minutes
of an adjourned regular City Council meeting held May 26, 1981, be
approved as written and submitted. Motion carried.
Parcel Map No. 14055 for subdivision of land owned by Swift and
Company into two parcels, was presented. (Deferred at last meeting.)
It was moved by Gonzales, seconded by McCormick, that this item
be deferred until the next regular meeting of the City Council, June 16,
1981. Motion carried.
Communication from Bruce V. Ma1kenhorst, City Administrator, dated
May 26, 1981, with regard to Parcel Map No. 14055, answering two questions
which were brought up by Mayor Malburg, at the last council meeting.
1. A cost estimate has been prepared by the Director of
Water for 630 feet of 8 inch water line in the amount
of approximately $35,000.
2. A list of property owners of Jewel Avenue.
It was moved by Ybarra, seconded by Gonzales, that the communication
from Bruce V. "alkenhorst, City Administrator, with regard to Parcel Map No.
14055, be rec~~ved and filed. Motion carried.
Communication from Attorneys, Rogers and Harris, dated May 18,1981
transmitting original and two copies of Claim for Damages by Harold Wayne
West and Roxanne Celeste West, as a result of motorcycle-train collision on
April 14, 1981, at 26th Street and RR Grade Crossing, Frontage Road, was
presented.
It was moved by Ybarra, seconded by McCormick, that the claim for
damages submitted by Attorneys, Rogers and Harris, representing Harold Wayne
West and Roxanne Celeste West, as a result of motorcycle-train collision on
April 14,1981, at 26th Street and RR Grade Crossing, Frontage Road, be
denied. Motion carried.
Communication from Southern California Joint Powers Insurance
Authority requesting appointment of .a director to represent the City of
Vernon (in accordance with Article 7 of the SCJPIA Agreement), dated May
21, 1981, was presented.
It was moved by McCormick, seconded by Gonzales, that Leonis C.
Malburg be appointed to serve as a member of the Board of Directors of the
Southern California Joint Powers Insurance Authority and Robert Fleischman
be appointed to serve as alternate, representing the City of Vernon.
Motion carried.

RESOLUTION NO. 4812 - A Resolution of the City Council of the
City of Vernon appointing a City Counci1member and One Alternate To
Serve As A Member Of The Board Of Directors Of the Southern California
Joint Powers Insurance Authority Representing The City of Vernon, was
presented.
It was moved by Gonzales, seconded by McCormick, that Resolution
No. 4812 be approved and adopted. Motion carried.

"Warrant Register No. 57311 covering claims and demands presented
during the period May 16 thru May 31, which includes Demands Nos. 3362
to 3423, (both Inclusive) excluding Void Demand No. 3379, drawn on the
United California Bank, totaling $261,575.84 (Light and Power Warrants
$170,889.34). Accounting period, June, 1981, was examined and audited.
It was moved by Ybarra, seconded by McCormick, that Warrant
Register No. 573 be approved and payment authorized for Demands Nos. 3362
to 3423 (both inclusive) excluding void Demand No. 3379, with no other
exceptions. Motion carried.
"Payroll Warrant Register No. 289" covering claims and demands
presented during period April 19 thru May 16 1981, which includes
Demands Nos. 3266 to 3282 (both inclusive), drawn on the Crocker National
Bank, totaling $498,920.18. Accounting period May 1981, was examined and
audited.
It was moved by Ybarra, seconded by McCormick, that Payroll Warrant
Register No. 289, be approved and payment authorized for Demands Nos. 3266
to 3282 (both inclusive) with no exceptions. Motion carried.
Communication from Bruce V. Ma1kenhorst, dated June 2, 1981,
transmitting minutes of the Personnel Committee meeting held June 1, 1981,
recommending approval of recommendations contained therein, was presented.
It was moved by Ybarra, seconded by McCormick, that the minutes of
the Personnel Committee, held June 1, 1981, be deferred to Executive
session, later the same day. Motion carried.
Police Department Activity Log - May 17 thru May 31, 1981, was
presented.
It was moved by McCormick,secorided by;Ybarra, that the Activity Log
of the Police Departmel't be r~~d and filed. f1otion carried.
Summons and Complaint filed in Pasadena Superior Court received by
the City of Vernon, May 22, 1981. Case entitled Aubrey L. Teters and Dolly
Teters vs. State of California, City of Vernon, City of San Marino, Robert
Randle, Does I to XV, Inclusive, for an unspeci:tfied amount, as a result of
an accident on August 22, 1980, was presented.
It was moved by Ybarra, seconded by Gonzales, that Summons and
Complaint Aubrey L. Teters and Dolly Teters vs. State of California, City
of Vernon, City of San Marino, Robert Randle, Case NO. NEC 31172, be
referred to Southern California Joint Powers Insurance Authority for
necessary action. Motion carried.
RESOLUTION NO. 4810 - A Resolution of the City Council of the City
of Vernon Appointing Bruce V.Ma1kenhorst As City Treasurer, was presented.
It was moved by Ybarra, seconded by McCormick, that Resolution No.
4810 be approved and adopted. Motion carried.

Corrnnunication from Bruce V. Malkenhorst, City Administrator
dated May 28, 1981, recorrnnending the leasing of a new I.B.M. copier
at a cost of approximately $711. 86 per month and transferring of
the current copier (which is owned by the City) to the Police
Department to replace their older model, was presented.
It was moved by McCormick, seconded by Ybarra, that the
recorrnnendation of the City Administrator to lease a new I.B.M.
copi er for the City Hall as a cost of $711.86 per month and
transferring of City Hall's present copier to the Police Department
be approved. Motion carried.
At this time, Mayor Malburg announced that a Certificate of
Appreciation to the City Council of the City of Vernon had been received from
the Vernon Lions Club, in appreciation of the invaluable services and
cooperation extended by the City of Vernon.
It was moved by Gonzales, seconded by Ybarra, that the Certificate of
Appreciation be received and that a letter be sent to the Li onsCl ub
expressing the City Council's gratitude in receiving the Certificate of
Appreciation. Motion carried.
Communication from Bruce V. Malkenhorst, City Treasurer, dated June 2,
1981, recorrnnending transfer of funds and creation of new funds as specified
below was presented.

It was moved by Gonzales, seconded by McCormick, that the recommendation
of the City Treasurer be approved and that funds in the amount of $5,700,000
be transferred to the specified accounts. Motion carried.
Fire Chief George Bass corrnnented that Fire Chief Holliday, from the City
of Alhambra, would like the City of Vernon Fire Department to participate in
their parade, June 13, 1981, celebrating the City's 75th Anniversary.
It was moved by Gonzales, seconded by Ybarra, that the request for the
City of Vernon Fire Department to participate in the City of Alhambra parade,
June 13, 1981, be approved. Motion carried.
Communication from George Van Fossan to the City Administrator, dated
May 4, 1981, regarding resuming City Tours, a cooperative venture by the City
of Vernon and the Vernon Chamber of Corrnnerce. The theme of the tours would be
to famil i ari ze members of the Vernon Commun i ty wi tl1 City servi ces and
facilities. It would also provide the opportunity for business people to meet
many of the City officials and other community leaders.
, At this time, 5:06 o'clock, p.m., it was moved by Gonzales, seconded
by McCormick, that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator and the City
Attorney, were excluded from the executive session.
Mayor Malburg declared all communication to and from the executive
session were deemed private and confidential.
At 5:06 o'clock,p.m., the Mayor declared a recess.

At this time, 5:40 a'clack, p.m., the City Council recanvened in
executive session, all members present befare the recess, again being
present.
At this time, 6:15 a'clack,p.m., it was maved by Ybarra, seconded
by McCarmick, that the City Cauncil go. aut af executive sessian and resume
regular sessian. Mation carried.
The City Attarney presented prapased Stipulatians with Request far
Award and Award in regard to. the Warkers' Campensatian Appeals Baard case
af Frank E. Sweeney vs. City af Vernan, Case No.. 80-VN94142/43 and
recammended to. the City Cauncil that Stipulatians be appraved with a
permanent disability rating af 47%.
It was maved by Ganzales, .secanded by MeCarmick, that the prapased
Stipulatians with Request far Award and Award in the Case af Frank E.
Sweeney vs. City af Vernan, Case No.. 80-VN94142/43, with a permanent
di sabil ity rati ng; af 47% be appraved and the Ci ty Attarney be authari zed
to. execute said Stipulatians with request far Award and Award an behalf
af the City af Vernan. Matian carried.

June 2, 1981, transmitting minutes af Persannel Cammittee Meeting af
June 1, 1981, recammending appraval af recammendatians cantained therein,
was presented.
It was maved by McCarmick, seconded by Ybarra, that the minutes af
the June 1,1981, Persannel Cammittee meeting be appraved and adapted, with
the exceptian af the item regarding the advancement of Lewis R. Adams,
Directar af Water and Pawer,: to. grade 2, effective July 1, 1981, which is
deferred to. regular meeting af the City Cauncil, June 2, 1981. Mati an
carried.
Communicationrecammending that Lewis R. Adams, Directar af Water
and Po.wer be advanced to. Grade 2, effective July 1, 1981, was presented.
(Deferred fram Persanne 1 Cammittee meeti ng, June 1, 1981.)
It was maved by Ganzales, secanded by Ybarra, that the advancement
af Lewis R. Adams to. Grade 2 be deferred until the first Persannel
Cammittee meeting in December far their cansideration. Matian carried.
