MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL. HELD JULY 7, 1981 AT
2:00 O'CLOCK, P.M.. IN THE COUNCIL
CHAMBER OF THE CITY HALL, LOCATED AT
4305 SANTA FE AVENUE, VERNON, CALIF.
MEMBERS PRESENT: Malburg, Gonzales, Ybarra, McCormick. Davis

The meeting was called to order by Mayor Malburg.
It was moved by McCormick, seconded by Ybarra, that the minutes
of the meeting of the City Council, held June 9, 1981 be approved as
written and submitted. Motion carried.
It was moved by Gonzales, seconded by McCormick. that the minutes
of the meeting of the City Council, held June 16, 1981, be approved as
written and submitted. Motion carried.
The City Administrator announced, at this time, qualified city
employees eligible to receive servic~ pins, were presented at the meeting
for award of the service pin. J
The Mayor presented service pins for twenty year service to:

Communication from Bruce V. Malkenhorst, City Administrator, dated
July 1, 1981. recomm~nding that a variance be granted to Gould Inc., Metals
Division, 2700 Indiana Street, from the fire sprinkler installation
requirements (per Uniform Building Code), was presented.
It was moved by Gonzales, seconded by Ybarra, that the recommendation
of the City Administrator that a variance be granted to Gould Inc., Metals
Division, 2700 Indiana Street, from the fire sprinkler installation
requirements. (per Uniform Building Code), be approved. Motion carried.
Police Department Activity Log - June 16-30, 1981, was presented.
It was moved by Ybarra, seconded by McCormick, that the Police
Department Activity Log of June 16 thru 30. 1981 be received and filed.
Motion carried.

Warrant Register No. 575, covering claims and demands presented during
the period June 16 thru 30th, which includes Demad Nos. 3584 thru 3699,
(both inclusive). excluding Demand Nos. 3662, 3681, 3614, 3617, 3636, 3638, 3639,
and 3699 and Void Demand Nos. 3640 and 3641, drawn on the First Interstate
Bank of California, totaling $103,195.06. (Accounting Period June 1981), was
examined and audited.
It was moved by Ybarra, seconded by McCormick. that Warrant Register No.
575, be approved and payment authorized for Demands Nos. 3584 thru 3699, (both
inclusive), excluding Demand Nos. 3662, 3681, 3614, 3617, 3636, 3638, 3639, 3699 and
Void Demand Nos. 3640 and 3641, with no other exceptions. Motion carried.

3681, 3614, 3617, 3636, 3638, 3639, and 3699, totaling $44,710.21, drawn on the

RESOLUTION NO. 4820 - A Resolution of the City Council of the City of
Vemon Changing Th.e Energy Cost Adjustment Billing Factor. Charged For Electrical
Energy Distributed and Supplied To Its Electrical Consl..lrers, was presented.
It was moved by lYf.cCormick, seconded by Ybarra, that Resolution No. 4820
be approved and adopted. Motion carried.

RESOLUTION NO. 4821 - A Resolution of the City Council of the City of
Vemon Approving '!be Execution Of A Th.ird Contract By And Between Bethlehem Steel
Corporation And '!be City Of Vemon Which Provides For Electrical Services t was
presented.
It was moved by Ybarra, seconded by Gonzales, that Resolution No. 4821
be approved and adopted. Motion carried.

It was moved by Gonzales, seconded by McCormick, that Resolution No. 4822

Mr. Reavis addressed the City Council, regarding the garage space on his
property.
Canumication fran Phillip Reavis, dated Jme 16, 1981, requesting
permission to address the City Cotmci1 in regard to the City of Vemon Zoning
Ordinance No. 856 and the construction of garage space on his property at 2032
E. 45th Street, was presented.
It was moved by Gonzales, seconded by McCormick, that the ca:IIIl.lIlication

ORDINANCE NO. 915 - An Ordinance of the City Council of the City of
Vernon Amending Exhibits "B" And "J" Of Ordinance No. 911 Fixing Rates To Be
Charged Fo~ Electrical Energy Distributed And Supplied By Said City Within Its
Boundaries And Repealing Certain Ordinances Of The City Of Vernon Related, was
presented. (First Reading)
It was moved by Gonzales, seconded by McCormick, that Ordinance No. 915
receive and pass a 1st reading. Motion carried.

At this time, 2:41 o'clock. p.m.. the Mayor delcared a recess.
At this time, 3:04 o'clock, p.m., the City Council reconvened in regular
session, all members present before the recess, again being present.
The Mayor called the hearing on Raymond Michalski's application for
disability retirement.
A court reporter was present and recorded the testimony of Raymond
Michalski.
It was moved by Ybarra, seconded by Gonzales, that the hearing on
Raymond Michalski's request for disability retirement be continued to the
next regular City Council Meeting to be held August 4, 1981, at 3:00 o'clock,
p.m. Motion carried.
At this time, 3:36 o'clock, p.m., the Mayor de:lared a recess.
At this time, 3:55 o'cl~ek, p.m., the City Council reconvened in
regular session, all members present before the recess, again being present.

It was moved by Ybarra, seconded by McCormick, that the Mayor be
authorized to issue a subpoena to Ralph De Mott. to testify at the hearing
to be held at 3:00 o'clock, p.m., August 4, 1981. Motion carried.
At this time 4:080'clock, p.m., it was moved by Gonzales, seconded
by McCormi~k, that the City Council go into executive session, under Attorney/
Client privilege. Motion carried.

All persons with the exception of the City Administrator and the City
Attorney, were excluded from the executive session.
Mayor Malburg declared all communication to and from the executive
session deemed private and confidential.
At 4:09 o'clock. p.m., Councilman Davis requested that he be excused.
Mayor Malburg excused Councilman Davis at this time.
It was Moved by McCormick. seconded by Ybarra. that the City Council
go out of executive session and resume regular session. Motion carried.
It was moved by Gonzales, seconded by Ybarra, that authority and
Funds to be granted for Bruce V. Malkenhorst, City Administrator and
David B. Brearley, City Attorney to attend meetings in Washington D.C., July
16, 17, and 18, 1981. Motion carried.
There being no further business to come before the City Council. it was
moved by McCormick, seconded by Ybarra, that the meeting adjourn. Motion carried.
