19810915 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL HELD Sm;..TEMBER 15, 1981. AT 2:00 O'CLOCK, P.M. IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIF. MEMBERS PRESENT: Malburg, Ybarra, McCormick) Gonzales, Davis MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. I It was moved by McCormick, seconded by Gonzales, that the minutes of the regular City Council Meeting Held September 1, 1981, be approved as written and submitted. Motion carried. '594 Mr. Irving Scott addressed the City Council regarding the request for variance at the property located at 4920 Soto Street. It was suggested by the City Council, that Mr. Scott meet with the Director of Community Services for further discussion. . Parcel Map No. 14055 for subdivision of land owned by Swift and Co., into two parcels, was presented. (Deferred fram September 1,1981 meeting). It was moved by Ybarra, seconded by McCormick, that this matter be deferred until the regular City Council Meeting, October 6, 1981 and that the City Administrator, Director of Public Works, and the City Attorney meet with the owners of said property and the prospective purchasers before the next council meeting in order to expedite the matter. Motion carried. Communication from Victor H. Vaits, Deputy Director of Community Services, dated September 8, 1981, requesting authority for Eve Wise to attend the Tuberculin Skin Testing Program at Barlow Hospital, in Lps Angeles on October 23, 1981, with an expense allowance of $25.00 to cover registration fees, was presented. It was moved by Ybarra, seconded by Davis, that the request of the Deputy Director of Community Services, be approved and authority granted to issue warrant .inthe amount of $25.00 to Eve Uise. to attend the Tuberculin Skin Testing Program. Motion carried. Hearing on Raymond Michalski's application for disability retirement, was presented. (Deferred from July 21, 1981 Council Meeting) It was moved by Ybarra, seconded by Davis that this matter be deferred until the regular City Council Meeting of October 6" 1981, at 3:00 p.m. Motion carried. Police Department Activity Log for the period September 1-15, 1981, was presented. I It was moved by McCormick, seconded by Ybarra, that the Police Department Activity Log for the period September 1-15, 1~81, be received and filed. Motion carried. Health Department Report for the month of August, 1981, was presented. It was moved by McCormick, seconded by Gonzales, that the Health Department Report for the month of August, 1981, be received and filed. Motion carried. 595 =2= 9/15/81 Communication from Arthur E. Nelson, dated September 8, 1981, submitting Contract System and recommending approval of same and bids be granted, was presented. Director of Community Services, No. 445, Fuel Management authority to advertise for RESOLUTION NO. 4840 - A Resolution of the City Council of the City of Vernon Approving Contract No. 445 And Authorizing Notice Inviting Sealed Proposals Or Bids For Fuel Management System, In Accordance with Contract No. 445 Of The City Of Vernon, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 4840 be approved and adopted. Motion carried. It was moved by Davis, seconded by Gonzales, that Resolution No. 4839 be approved and adopted. Motion carried. Malkenhorst ,Personnel:JDire:ct!1l:t; ,dated September 15, 1981, transmitting the minutes of the Personnel Committee Meeting of September 14, 1981 and recommending approval of recommendations contained therein, was presented. It was moved by Ybarra, seconded by Gonzales, that the minutes of the Personnel Committee Meeting of September 14, 1981 be deferred until executive session, later the same day. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated September 15, 1981, transmitting the minutes of the Finance Committee Meeting held September 14, 1981, and recommending approval as written and recommendations contained therein, was presented. It was moved by Ybarra, seconded by Gonzales, that the minutes of the Finance Committee Meeting held September 14, 1981,be approved as written and recommendations contained therein be adopted. Motion carried. Warrant Register No. 580, covering claims and demands presented during the period September 1 through 15, 1981, which includes Light and Power Demands Nos. 4226,4336,4338,4357,4359,4364, and 4367, totaling $5,054,994.43 was examined and audited. (Accounting period September 1981) I It was moved by McCormick, seconded by Gonzales, that Warrant Register No. 580, be approved and payment authorized for Demands Nos. 4226,4336,4338, 4353,4357,4359,4364and 4367 totaling $5,054,994.43, with no exceptions. Motion carried. Councilman Davis abstained. Warrant Register No. 580, covering claims and demands presented during the period September 1 through 15, 1981, which includes Demand Nos. 4226 through 4374 (both inclusive), excluding Demand Nos. 4226,4336,4338, 4353,4357,4359,4364,4367 and void Demand Nos. 4266,4268,4269,4334, and 4363, totaling $40,786,88, drawn on the First Interstate Bank, (Accounting Period September, 1981) was examined and audited. =3= 9/15/81 It was moved by McCormick, seconded by Ybarra, that Warrant Register No. 580, be approved and payment authorized for Demands Nos. 4226 - 4374 (both inclusive) excluding Demand Nos. 4226,4336,4338,4353,4357,4364,4367 and void Demand Nos. 4266,4268,4269,4334, and 4363, totaling $40,786.88, with no other exceptions. Motion carried. Communication from Chief of Police Espinoza, dated August 19, 1981, requesting authority and funds for James E. Mason, to attend the International Association of Bomb Technicians and In~est;i,gatox;s,iWElsteJtn.:$ttl'9i.<mal.Tra:brld::llg Conference in San Diego, Ca. from octoQer6 - 9, 1981, with and expense \ allowance of $297.12, was presented. I It was moved by Ybarra, seconded by Davis, that the request of the Police Chief approved and authority granted to issue warrant in the amount of $297.12 to Acting Lieutenant James E. Mason to attent the International Association of Bomb Technicians and Inyestigators Western Regional Training Conference. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator, dated September 15, 1981, requesting the purqhase of a photo drier for the Police Department, was presented. It was moved by Gonzales, seconded by Davis, that the request of the City Administrator to purchase a photo drier for the Police Department be approved. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator, dated September 15, 1981, recommending the p~rchase of a Frost-free freezer, for the Police Department, for the purpose of preserving biological evidence in sexual assault cases for subsequent 'analysis by the defendant, was presented. It was moved by McCormick, seconded by Davis, that the Director of Enviromental Health and the Police Chief prepare a study to present to the council at the next regular City Council Meeting. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator, dated September 15, 1981, recommending authority and funds for Fire Chief Bass, Acting Battalion Chief L. Spadt, Admn. B/C Scnultz and A/Battalion Chief Claunch, to attend a Special Hazardous Material~ program in the City of Commerce, Thursday, September 17, 1981, with tot~l registration cost $60.00, was presented. It was moved by McCormick, seconded by Ybarra, that the recommendation of the City Administrator be approved and authority granted to issue ~arrant in the amount of $60.00 to Southern California Emergency Services Association, for registration fees, for the above personnel to attend a Special Hazardous Materials Program. Motion carried. City Attorney, David B. Brearley presented a communication from the League of California Cities recommending amicus assistance from all city attorneys' in support of Gridley, in the Case I.B.E.W. vs. City of Gridley. A Brief is being prepared in which all cities may join. I It was moved by McCormick, seconded by Ybarra, that approval be granted, for the City Attorney to sign the brief on behalf of the City of Vernon. Motion carried. The mayor declared a recess at 3:00 o'clock, p.m. At this time, 3:36 o'clock, p.m., the City Council reconvened in regular session, all members present before the recess, again being present. At this time, 3:40 o'clock, p.m. it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session in accordance with Government Code 54957. Motion carried. '596 597 =4= 9/15/81 All persons with the exception of the City Administrator, City Attorney and Police Chief were excluded from the executive session. Mayor Malburg declared all communication to and from the executive session deemed private and confidential. Police Chief Espinoza was excused at 4:31 o'clock, p.m. At this time, 4:33 o'clock, p.m. it was moved by McCormick, seconded by Ybarra that council go out of executive session and resume regular session. Motion carried. I I It was moved by Gonzales, seconded by Davis, that the minutes of the Personnel Committee Meeting of September 14, 1981, be approved as written and recommendations contained therein adopted. Motion carried. At this time, 4:38 o'clock, p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Attorney/ client privilege. Motion carried. All persons with the exception of the City Administrator and the City Attorney were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. Councilman Davis was excused at 4:40 o'clock, p.m. At this time, 5:10 o'clock, p.m. it was moved by Gonzales, seconded by McCormick that the City Council go out of executive session and resume regular session. Motion carried. It was moved by Ybarra, seconded by Gonzales that the recommendation of the City Administrator be approved and that Daniel Keen be hired to fill the position of Administrative Intern, effective September 15, 1981.
