19811027 Regular City Council Meeting - Minutes I I MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL HELD OCTOBER 27, 1981 AT 4:30 O'CLOCK, P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALI FORNIA MEMBERS PRESENT: MEMBERS ABSENT: Malburg, Ybarra, McCormick, Davis Gonzales (arrived at 4:50 o'clock, p.m.) The meeting was called to order by Mayor Malburg. It was moved by McCormick, seconded by Ybarra, that the minutes of the regular City Council Meeting held October 6, 1981, be approved as written and submitted. Motion carried. Communication from Luis A. Espinoza, Chief of Police, dated September 21, 1981, recommending authority and funds for Officer R. V. Sapp to attend the Western States Safe and Burglary Investigator's Seminar in Santa Barbara, November 2-5, 1981, with an expense allowance of $364.85, was presented. It was moved by Davis, seconded by Ybarra, that the recommendation of the Chief of Police be approved and authority granted to issue warrant in the amount of $364.85 toR. V. S,rpp to attend the Western States Safe and Burglary Investigator's Seminar in Santa Barbara, November 2-5, 1981. Motion carried. Communication from Arthur E. Nelson, Director Community Services, dated October 8, 1981, advising of bids for Contract No. 445 being reviewed and recommending that said contract be awarded to Petroleum Contractors, Inc. 1700 Hayes Avenue, Long Beach, Ca. 90813 on the basis of their bid of $32,298.00, was presented. RESOLUTION NO. 4848 - A Resolution of the City Council of the City of Vernon Accepting The Bid Of Petroleum Oil Contractors, Inc., For Fuel Manage- ment System, In Accordance With Contract No. 445 Of The City Of Vernon And Approving The Execution Of Said Contract, was presented. It was moved by Ybarra, seconded by Davis, that Resolution No. 4848 be approved and adopted. Motion carried. AYES: NOES: Absent: Ybarra, Davis, Malburg, McCormick None Gonzales Warrant Register No. 582, covering claims and demands presented during the period October 1-15, 1981, which includes Demand Nos. 4525 through 4692 (both inclusive), excluding Demand Nos. 4597, 4637, 4655, 4689, 4690, and void Demand Nos. 4685, 4541, 4542, 4545, and 4570, drawn on the First Interstate Bank, totaling $50,528.66, (accounting period October 1981), was examined and audited. It was moved by McCormick, seconded by Davis, that Warrant Register No. 582, be approved and payment authorized for Demand Nos. 4525-4692 (both inclusive) excluding Demand Nos. 4597, 4637, 4655, 4689, 4690, and void Demand Nos. 4685, 4541, 4542, 4545, and 4570, with no other exceptions. Motion carried. Warrant Register No. 582, covering claims and demands presented during the period October 1-15, 1981, which includes Light and Power Demand Nos. 4597, 4637, 4655, 4689, 4690, drawn on the First Interstate Bank, totaling $4,763,538.71, (accounting period October 1981) was examined and audited. 605 I I =2= 10/27/81 It was moved by Ybarra, seconded by McCormick that Warrant Register No. 582, be approved and payment authori zed for Li ght and Power Demand Nos. 4597,4637, 4655, 4690, totaling $4,763,538.71. Motion carried. Police Department Activity Log for the Period October 1-15, 1981, was presented. It was moved by McCormick, seconded by Davis, that the Police Department Activity Log for the period October 1-15, 1981, be received and filed. Motion carried. Health Department Activity Report for September, 1981, was presented. It was moved by Ybarra, seconded by McCormick, that the Health Department Activity Report for September, 1981, be received and filed. r'10tion carried., Communication from Michael T. Roberts on behalf of Lewis, Marenstein and Kadar, Attorneys at Law, dated October 21, 1981, requesting that the hearing of Raymond Michalski vs. City of Vernon be continued to the first available date in December due to a calendar conflict for the date of November 3, 1981, was presented. It was moved by Ybarra, seconded by McCormick, that the request of Michael T. Roberts be approved and that the hearing of Raymond Michalski vs. City of Vernon be continued to December 15, 1981, at 3:00 o'clock, p.m. Motion carried. Communication from Arthur E. Nelson, Director of Community Services, dated October 15, 1981, advising that slurry sealing of streets in accordance with Contract No. 441 has been completed. The total amount of the contract is $24,431.00, the final partial payment totaling $21,987.90 is now due, and the remaining ten percent of $2,443.10 is payable thirty-five days after acceptance. It is recommended that the work be accepted and that authority be granted to pay the contractor, Roy Allen Slurry Seal Contractor, 30381 Via Alacazar, Laguna Niguel, California, 92677, in accordance with the agreement, was presented. RESOLUTION NO. 4849 - A Resolution of the City Council of the City of Vernon Accepting The Work For Slurry Sealing Of Various Street In The City Of Vernon, was presented. It was moved by McCormick, seconded by Ybarra, that Resolution No. 4849 be approved and adopted. Motion carried. Malkenhorst, City Administrator, dated October 20, 1981, recommending authority and funds for Lois Hilton to attend the League of California Cities-City Clerks Election Law Seminar, in Newport Beach, November 18.to 20, 1981, with an expense allowance of $248.00, was presented. It was moved by Davis, seconded by Ybarra, that the recommendation of the City Administrator be approved and authority be granted to issue warrant in the amount of $248.00 to Lois Hilton, to attend theLeague of California Cities-City Clerks Election Law Seminar. Motion carried. Communication from Acting Captain Rosenkrantz, dated October 16, 1981, recommending authority and funds for B. G. Emrick to attend the California Law Enforcement Warrant Officers Association "Statewide" Training Seminar in Sacramento, November 4-6, 1981, with an expense allowance of $325.50, was presented. 606 I I =3= 10/27/81 It was moved by Davis, seconded by Ybarra, that the recommendation of Acting Captain Rosenkrantz be approved and that authority be granted to issue warrant in the amounto~ $325.50, to R. Adams, Director of Water and Power, submitting a computation determining the Energy Cost Adjustment Billing Factor for the next three month period, was presented. It was moved by Ybarra, seconded by McCormick, that the communication from Lewis R. Adams, Director of Water and Power be received and filed. Motion carried. RESOLUTION NO. 4850 - A Resolution of the City Council of the City of Vernon Changing The Energy Cost Adjustment Billing Factor Charged For Electrical Energy Distributed And Supplied To Its Electrical Consumers, was presented. It was moved by Ybarra, seconded by McCormick, that Resolution No. 4850 be approved and adopted. Motion carried. Nelson, Director of Community Services, dated October 21, 1981, advising that bids received and opened on October 20, 1981, according to Contract No. 444 have seen reviewed and recommends that said contract be awarded to Steiny and Company, Inc., 4620 E. La Palma Avenue Anaheim, California, 92807, on the basis of their bid of $26,100.00, was presented. RESOLUTION NO. 4851 - A Resolution of the City Council of the City of Vernon Accepting The Bid Of Steiny And Company, Inc., For Traffic Signal Installation Soto Street And Fruitland Avenue, Pacific Boulevard And Fruitland Avenue, In Accordance With Contract No. 444 Of The City Of Vernon And Approving The Execution Of Said Contract. Motion carried. It was moved by McCormick, seconded by Davis, that Resolution No. 4851 be approved and adopted. Motion carried. AYES: McCormick, Davis, Malburg, Ybarra NOES: None Absent: Gonzales The Mayor declared a recess, at 4:40 o'clock, p.m. At this time, 4:50 o'clock, p.m., the council reconvened in regular session, all members present before the recess, again being present. Councilman Gonzales assumed his seat on the Council at this time. Communication from Bruce V. Malkenhorst, Finance Director, dated October 26, 1981, transmitting the minutes of the Finance Committee Meeting held October 22, 1981, and recommending approval of recommendations contained therein, was presented. It was moved by McCormick, seconded by Ybarra that the minutes of the Finatlce Committee Meeting Held October 22, 1981 be deferred until the executive session, later the same day. Motion carried. Communication from Bruce V. Malkenhorst, Personnel Director, dated October 27, 1981, transmitting the minutes of the Personnel Committee Meeting held October 26, 1981, and recommending approval of recommendations contained therein, was presented. e07 I I =4= 10/27/81 It was moved by Gonzales, seconded by Davis, that the minutes of the Personnel Committee Meeting held October 26, 1981, be approved as written and recommendations contained therein adopted. Malkenhorst, City Administrator, dated October 27, 1981, recommending authority and funds for the following to attend the Independent Cities Association 21st Annual Seminar at Santa Barbara, November 11-15, 1981, with an expense allo\'Jance of $680.00, was presented. Brearley to attend the Independent Cities of Los Angeles County 21st Annual Seminar at Santa Barbara. ~10tion carried. The City Administrator read in its entirety a letter to Fire Chief Bass, from John Catlin, Weyerhaeuset Company, commending Captain Wiles, Engineer Dressen, Firefighter Bicknell, Paramedic Riedel and Paramedic Hel in, for their quick and efficient response to an emergency call that was issued on September 29, 1981, and for their sincere concern and effort to revive on of the employees that had suffered a cerebral hemorrhage. It was moved by Gonzales, seconded by McCormick, that the letter from Mr. Catlin be received and filed. Motion carried. At 5:20 o'clock, p.m., the Mayor declared a recess. At 5:44 o'clock, p.m., the council reconvened in regular session, all members present before the recess, again being present. At this time, 5:45 o'clock, p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go in to executive session under Government Code 54957. All persons with the exception of the City Administrator and the City Attorney were excluded from the executive session. Mayor Malburg, declared all communications to and from the executive session deemed private and confidential. At 6:15 o'clock, p.m., it was moved by McCormick, seconded by Gonzales, that the City Council go out of executive session. Motion carried. It was moved by McCormick, seconded by Ybarra, that the minutes of the Finance Committee Meeting held October 22, 1981, be approved as written and recommendations contained therein adopted. Moti.on carried. At 6:17 o'clock, p.m., it was moved by Ybarra, seconded by McCormick, that the City Council go in to executive session under Attorney/Client privilege. Motion carried. All persons with the exception of the City Administrator and the City Attorney were excluded from the executive session. 608 I I =5= 10/27/81 Mayor Malburg, declared all communications to and from the executive session deemed private and confidential. At 6:37 o'clock, p.m., it was moved by McCormick, seconded by Davis, that the City Council go out of executive session, and resume regular session. Motion carried. Communication from Kevin C. Lloyd to the City Administrator, dated October 19, 1981, regarding compensation time, vacation time and uniform allowance, was presented. It was moved by Ybarra, seconded by McCormick, that the communication from Kevin C. Lloyd be referred to the City Attorney for review and report. Motion carried. It was moved by Gonzales, seconded by Davis, that funds in the amount of $800.00 be approved for "Hospitality Room" expenses to host delegates to the Independent Cities Association's 21st Annual Seminar at Santa Barbara, November 11-15, 1981. Moti on carried. Communication from Carl A. Bruning, Manager of the Vernon City Employees Credit Union, requesting permission to install wrought iron steel mesh doors on each entrance door to the building located at 2265 East 38th Street. It was moved by Ybarra, seconded by McCormick, that the request of Carl Bruning be approved and permission to install wrought iron steel mesh doors on each entrance door to the buildina located at 2265 East 38th Street, be granted.
