19820302 Regular City Council Meeting - Minutes 655 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HELD MARCH 2, 1982, AT 2:00 O'CLOCK, P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg" Ybarra, Gonzales, McCormick, Davis I MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. The City Clerk announced that this was the time and place for opening of bids for Equipment and Services, Police Department Radio System, Contract No. 447 of the City of Ver~on. It was moved by Ybarra, seconded by Gonzales, that the Clerk be instructed to open and read the bids submitted. Motion carried. - The City Clerk opened and read the following bids: Motorola Communications and Electronics Inc. General Electric Co. $61,498. $58,135. It was moved by McCormick, seconded by Ybarra, that the bids received for Contract No. 447, Equipment and Services, Police Department Radio System be referred to the Community Services Department for recapitulation and recommendation. Motion carried. It was moved by McCormick, seconded by Ybarra, that the minutes of the regular City Council Meeting held February 16, 1982, be approved as submitted. Motion carried. Police Department Activity Log for the period February 16-28, 1982, was presented. It was moved by Ybarra, seconded by Davis, that the Police Department Activity Log for the period February 16-28, 1982, be received and filed. Motion carried. I Communication from Arthur E. Nelson, Director Community Services, dated February 22, 1982, advising that Contract No. 446, Public Works tacility Reroofing has been completed and recommend- ing that the work be accepted and authority be granted to pay the contractor, Stout Roofing, Inc., the final partial payment of $31, 093.20 and the remaining 10% of $3,454.80 is payable thirty- five days after acceptance, was presented. RESOLUTION NO. 4881 - A Resolution of the City Council of the City of Vernon Accepting The Work Of Reroofing Of Public Works Facility, In Accordance With Contract No. 446 Of The City Of Vernon, was: 'presented. " Tt was moved by McCormick, seconded by Davis, that Resolution No. 4881 be approved and adopted. Motion carried. Nelson, Director Community Services, dated February 22, 1982, requesting authority and funds to attend the Public Works Officers Institute, March 24- 26, 1982, in San Diego, with an expense allowance of $309.50, was presented. I It was moved by Ybarra, seconded by Gonzales, that the request of the Director Community Services be approved and authority be granted to issue warrant in the amount of $309.50 to Arthur E. Nelson to attend the Public Works Officers Institute March 24-26, 1982, in San Diego. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated February 23, 1982, transmitting a letter received from Joseph Gardner, City-County Coordinator for the County of Los Angeles, dated February 10, 1982, advising that if the City of Vernon wishes to have the County act on the City's behalf in the matter of property tax cases a resolution is needed before the County may do so. It is the recommendation of the City Administrat- or/City Clerk that the City Attorney be authorized to prepare a resolution. It was moved by Gonzales, seconded by Davis that the recommend ation of the City Administrator/City Clerk be approved and that the City Attorney be authorized to prepare a resolution and that the letter received from Joseph Gardner, City-County Coordinator be received and filed. Motion carried. RESOLUTION NO. 4882 - A Resolution of the City Council of the City of Vernon Designating The County Of Los Angeles As Its Agent For Service Of Process For Actions Under The Revenue And Taxation Code, was presented It was moved by Gonzales, seconded by Davis, that Resolution No. 4882, be approved and adopted. Motion carried AYES: Gonzales, Davis, Malburg, Ybarra, McCormick NOES: None Absent: None Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated February 23, 1982, recommending that the contract with the County of Los Angeles on "Tract and/or Parcel Map Check Agreement", which expires June 30, 1982, be renewed, was presented. I RESOLUTION NO. 4883 - A Resolution of the City Council of the City of Vernon Authorizing The Renewal Of Examination Of Tract And Parcel Maps Agreement Between The City Of Vernon And The County Of Los Angeles, was presented. It was moved by McCormick, seconded by Ybarra, that Resolut- ion No. 4883, be approved and adopted. Motion carried. AYES: McCormick, Ybarra, Malburg, Gonzales, Davis NOES: None Absent: None 656 Warrant Register No. 591, covering claims and demands present- ed during the period February 16-28, 1982, which includes Demand Nos. 5722 through 5830, (both inclusive) excluding Light and Power Demands, drawn on the First Interstate Bank, totaling $80,100.49, Accounting Period March, 1982, was examined and audited. =3= I I 3/2/82 It was moved by Davis, seconded by Ybarra, that Warrant Register No. 591, be approved and payment authorized for Demand Nos. 5722 through 5830 (both inclusive), excludinf, Light and Power Demands, with no other exceptions. Motion carried. Warrant Register No. 591, coverinf, claims and demands pre- sented during the period February 16 through February 28, 1982, which includes Light and Power Demand Nos. 5751, 5752,5753,5759, 5760, 5761, 5762, 5779, 5812, 5825, and 5829, totaling $95,719.66, drawn on the First Interstate Bank, (Accounting Period March, 1982) was examined and audited. It was moved by McCormick, seconded by Ybarra, that Warrant Register No. 591, be approved and payment authorized for Demand Nos. 5751, 5752, 5753, 5759, 5760, 5761, 5762, 5779, 5812, 5825, and 5829, totaling $95,719.66, with no exceptions. Motion carried. Councilman Davis abstained. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated February 23, 1982, recommending authority and funds for Gloria Orosco to attend the workshop on "Managerial Techniques for Secretaries and Administrative Assistants", in Anaheim, on April 21, 1982, with an allowance of $145.00 to cover registration fees, was presented. It was moved by Ybarra, seconded by Davis,that the recommend- ation of the City Administrator/City Clerk be approved and author- ity be granted to issue warrant in the amount of $145.00 to Gloria Orosco to attend the workshop on "Managerial Techniques for Secret- aries and Administrative Assistants". Motion carried. RESOLUTION NO. 4884 - A Resolution of the City Council of the City of Vernon Ordering The Canvass Of The General Municipal Election To Be Held On Tuesday, April 13, 1982, To Be Made By The City Clerk, was presented. It was moved by Gonzales, seconded by McCormick that the approval of Resolution No. 4884 be deferred until the regular City Council Meeting April 6, 1982. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated March 2, 1982, transmitting the minutes of the Personnel Committee Meetin~ held March 1, 1982, for apnroval of recommendations contained therein, was presented. . . It was moved by Ybarra, seconded by Gonzales, that the minutes of the Personnel Committee Meeting held March 1, 1982 be deferred to Executive Session, later the same day. Motion carried. Communication from Arthur E. Nelson Director of Community Services, dated March 2, 1982, recommending authority and funds for Victor Vaits to attend the Government Liability Seminar in Berkley, Friday, March 12, 1982, with an allowance of $255.00, was present- ed. It was moved by Ybarra, seconded by Davis, that the recommend- ation of the Director of Community Services, be approved and authority be granted to issue warrant in the amount of $255.00, to Victor Vaits to attend the Government Liability Seminar in Berkley. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated March 2, 1982, recommending that the bid for the Portable Air Compressor be awarded to Ingersoll-Rand Equipment Company for a total cost of $12,900.00, including tax, was present- ed. It was moved by Gonzales, seconded by Davis, that the recommendation of the City Administrator/City Clerk be approved and that the bid for the Portable Air Compressor be awarded to Ingersoll-Rand Equipment Company for a total cost of $12,900.00 Motion carried. 657 =4= 3/2/82 I Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated March 2, 1982 recommending approval for the purchase of a QWIP Facsimile Transceiver, Model No. 2150, which will be utlilized to transmit and receive material from the offices of Goldberg, Fieldman and Letham, Public Utilities Consultants in Washington, D.C. and also Baker G. Clay & Associates in Annapolis, Maryland via telephone lines, total cost including tax and install- ation charges is ~4,l08.92, was presented. It was moved by Gonzales, seconded by McCormick that the recommendation of the City Administrator/City Clerk be approve~ and authority be granted for the purchase of a qWIP Facsimile Transceiver, Model No. 2150, total cost,including tax and install- ation charges, $4,108.92. Motion carried. At 2:45 o'clock, p.m., the Mayor declared a recess. At 3:35 o'clock, p.m., the council reconvened in regular session, all members present before the recess, again being pre- sent. At 3:37 o'clock, p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Government Code Section 54957. Motion carried. All persons with the exception of the City Administrator and the City Attorney were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidental. Councilman Davis was excused at 4:40 o'clock,p.m. 658 At this time, 4:45 o'clock,p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. It was moved by Ybarra, seconded by McCormick, that the probation period for Mary Jane Jackson be extended to September 30, 1982 and that Chief Espinoza detail her deficiencies. Motion carried. I It was moved by McCormick, seconded by Gonzales, that Linda Alvarado be released from duty as she did not successfully complete her probation period. Motion carried. It was moved by Ybarra, seconded by McCormick, that the communication from Robert L. Gramer regarding Service Retirement, be referred back to him for resubmittal. Motion carried. It was moved by Ybarra, seconded by Gonzales, that the minutes of the Personnel Committee Meeting held March I, 1982 be approved as written and recommendations contained therein be adopt- ed. Motion carried. It was moved by Ybarra, seconded by Gonzales, that authority and appropriate funds be granted to William J. Davis, Hilario Gonzales, Thomas Ybarra, William M. McCormick, Bruce V. Malkenhorst, David B. Brearley to attend the Independent Cities Association of Los Angeles County 22nd Annual Seminar, in San Diego, April 14-18, 1982. Motion carried. 659 =5= 3/2/82 At 4:57 o'clock, p.m., it was moved by Gonzales, seconded by Ybarra, that the City Council go into executive session, under Attorney/Client privilege. Motion Garried. All persons with the exception of the City Administrator/ City Clerk and the City Attorney were excluded from the executive session. I Mayor Malburg declared all communications to and from the executive session deemed private and confidental. At 5:19 o'clock, p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. The City Attorney presented a proposed Compromise and Release in regard to the Workers' Compensation Appeals Board case of Fred H. Colvin vs. City of Vernon, Case No. 78 LB 97796 and recommended to the City Council that said Compromise and Release be approved for a total lump sum of $4,582.20. It was moved by Gonzales, seconded by Ybarra, that the proposed Compromise and Release in the case of Fred. H. Colvin vs. City of Vernon, Case No. 78 LB 97796, for a total lump sum of $4,582.20 be approved and the City Attorney be authorized to execute said Compromise and Release on behalf of the City of Vernon. Motion carried. The City Attorney presented proposed Stipulations with Request for Award and Award in regard to Workers' Compensation Appeals Board case of Richard F. Pavlovsky vs. City of Vernon, Case Nos. 81 BGN 63662/63 and recommended to the City Council that said Stipulations be approved with a permanent disability rating of 75%~ . .. It was moved by McCormick, seconded by Ybarra, that the proposed Stipulations with Request for Award and Award in the case of Richard F. Pavlovsky vs. City of Vernon, Case Nos. 81 BGN 63662/63, with a permanent disability rating of 75% be approved and the City Attorney be authorized to execute said Stipulations with Request for Award and Award on behalf of the City of Vernon.
