19820408 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL, HELD APRIL 8, 1982, AT 5:00 O'CLOCK, P. M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIF. MEMBERS PRESENT: Malburg, McCormick, Davis, Ybarra, Gonzales MEMBERS ABSENT: None I The meeting was called to order by Mayor Malburg. The City Clerk announced that this was the time and place for ccnsiderationofBid No~118l for new Health Department vehicles. , - It was moved by Gonzales, seconded by Ybarra, thattbe consid- eratib~ of Bid No. 1181, be deferred until the regular City Council meeting, April 20, 1982. Motion carried. It was moved by McCormick, seconded by Ybarra, that the minutes of the regular City Council Meeting held March 16, 1982 be approved as submitted. Motion carried. It was moved by Gonzales, seconded by Davis, that the minutes of the adjourned City Council Meeting held March 23, 1982, be approved as submitted. Motion carried. RESOLUTION NO. 4884 - A Resolution of the City Council of the City of Vernon, California, Ordering The Canvass Of The General Municipal Election To Be Held On Tuesday, April 13, 1982, To Be Made By The City Clerk, was presented. It was moved by McCormick, seconded by Davis, that Resolution No. 4884 be approved and adopted. Motion carried. Espinoza, Chief of Police, dated March 15, 1982, reconnnending authority and funds for Officer James A. Wohlt to attend the CAPTO Training Seminar in Solvang, April 22 and 23, 1982 with an expense allowance of $203.00 was presented. It was moved by Davis, seconded by Gonzales, that the reconnnendation of the Chief of Police be approved, and authority be granted to issue warrant in the amount' of $203.00 to Officer James A. Hohlt to attend the CAPTO Training Seminar, in Solvang, April 22 and 23, 1982. Motion carried. Connnunication from Arthur E. Nelson, Director Connnunity Services, dated March 23, 1982, reconnnending authority and funds for Raymond Rich to attend the 54th Annual Training School and Conference for California l.vater Pollution Control April 28, 29, 30, 1982, with an expense allowance of $500.00, to be held at State- line, Nevada, was presented. It was moved by Davis, seconded by Ybarra, that the reconnnendation of the Director Connnunity Services be approved, and authority be granted to issue warrant in the amount of $500.00 to Raymond Rich to attend the 54th Annual Training School and Conference for California Water Pollution Control. RESOLUTION NO. 4891 - A Resolution of the City Council of the City of Vernon Expressing Its Opposition to Assembly Bill 2660 And Urging The Members Of The Legislature To Reject Said Bill. was presented. Gonzales NOES: None Absent:None I RESOLUTION NO. 4892 - A Resolution of the City Council of the City of Vernon Approving And Authorizing The Execution Of A Grant Award Contract By And Between The City Of Vernon And The State Of California Department Of Health Services Providing For The Purchase Of Two New Fuel-Efficient Vehicles For Use By Register- ed Sanitarians Of The Health And Environmental Control Section. City Of Vernon. Department Of Community Services. was presented. It was moved by Gonzales. seconded by Davis. that Resolution No. 4892 be approved and adopted. Motion carried. AYES: Gonzales. Davis. McCormick NOES: None Absent: None RESOLUTION NO. 4867 - A Resolution of the City Council of the City of Vernon Approving And Authorizing The Execution Of The Agreement By And Between The City Of Vernon And The American Bus Shelter. Inc. Providing For A Bus Shelter Program. was presented. (Deferred from January 19. 1982 City Council Meeting) It was moved by Ybarra. seconded by McCormick. that Resolution No. 4867 be dropped from the agenda. Motion carried. AYES: Ybarra. McCormick. Malkenhorst, City Administrator/ City Clerk, dated March 30, 1982, recommending that a claim for damages in the amount of $375.19 be paid to Automobile Club of Southern California as subrogee of Jose Guadalupe DeLuna as a result of a traffic collision caused by a City of Vernon police vehicle on December 15, 1982, on condition that both parties sign a full release, was presented. It was moved by McCormick, seconded by Gonzales, that the recommendation of the City Administrator/City Clerk be approved and authority granted to issue warrant in the amount of $375.19 to Automobile Club of Southern California as subrogee of Jose GuadalupeDeLuna for damages caused by a City of Vernon police vehicle, on condition that both parties sign a full release. Motion carried. ORDINANCE NO. 926 - An Ordinance of the City Council of the City of Vernon Repealing Articles I And II Of Chapter 12, Section 12.1 Through 12.12 Of The Code Of The City Of Vernon, California 1959 And Adding New Articles I And II To Chapter 12, Sections 12.1 Through 12.18 To Said Code Regarding Weed And Rubbish Abatement And Repealing All Ordinances And Parts Of Ordinances In Conflict Therewith, was read by title for a first reading. It was moved by Gonzales, seconded by McCormick, that Ordinance No. 926 be deferred until the regular City Council Meeting, April 20, 1982. Motion carried. Payroll Warrant Register No. 302 covering claims and demands presented during the period January 10 through February 6, 1982, which includes Demand Nos. 3431 - 3446 (both inclusive) drawn on the Crocker National Bank, totaling $551,220.32, (Account- ing period, February, 1982) was examined and audited. It was moved by Ybarra, seconded by Davis, that Payroll Warrant Register No. 302, be approved and payment authorized for Demand Nos. 3431-3446 (both inclusive), in the amount of $551,220.32 with no exceptions. Motion carried. Payroll Warrant Register No. 303, covering claims and demands presented during the period February 7 through March 6, 1982, which includes Demand Nos. 3447-3464 (both inclusive) drawn on the Crocker National Bank, totaling $544,825.12, (Accounting period, March, 1982) was examined and audited. I It was moved by t1cCormick, seconded by Gonzales, that Payroll Warrant Register No. 303, be approved and payment authorized for Demand Nos. 3447-3464 (both inclusive), in the amount of $544,825.12, with no exceptions. Motion carried. Warrant Register No. 593, covering claims and demands presented during the period March 16-31, 1982, which includes Demand Nos. 6006-6173 (both inclusive) excluding Light and Power Demands and void Demand Nos. 6091 and 6097, drawn on the First Interstate Bank, totaling $215,091.55, (accounting period April, 1982) was examined and audited. It was moved by Davis, seconded by Ybarra, that Warrant Register No. 593 be approved and payment authorized for Demand Nos. 6006-6173 (both inclusive) excluding Light and Power Demands and void Demand Nos. 6091 and 6097, in the amount of $215,091.55, with no other exceptions. Motion carried. 670 =4= 4/8/82 Warrant Register No. 593, covering claims and demands presented during the period March 16-31, 1982, which includes Light and Power Demand Nos. 6021, 6065, 6066, 6088, 6089, 6090, 6093, 6096, 6110, 6124, 6135, 6142, 6145, 6162, 6163, 6164, and 6165, totaling $4,674,517.10, (Accounting period, April, 1982) was examined and audited. I It was moved by McCormick, seconded by Ybarra, that Warrant Register No. 593, be approved and payment authorized for Light and Power Demand Nos. 6021, 6065, 6066, 6088, 6089, 6090, 6093, 6096, 6110, 6124, 6135, 6142, 6145, 6162, 6163, 6164, and 6165, in the amount of $4,674,517.10, with no except- ions. Motion carried. Councilman Davis abstained. RESOLUTION NO. 4893 - A Resolution of the City Council of the City of Vernon Approving And Ratifying The Purchase Of Four (4) New Police Department Vehicles From Domenich Basso, Inc., was presented. - It was moved by McCormick, seconded by Ybarra, that Resolution No. 4893 be approved and adopted. Motion carried. AYES: McCormick, Ybarra, Malburg, Gonzales, Davis NOES: None Absent: None RESOLUTION NO. 4894 - A Resolution of the City Council of the City of Vernon Approving And Ratifying The Purchase Of Two (2) Jeeps From The U. S. Postal Service For Use In The Civilian Traffic Enforcement Division Of The Police Department, was pre- sented. It was moved by Ybarra, seconded by Davis, that Resolution No. 4894 be approved and adopted. Motion carried. Nelson, Director Community Services, dated April 1, 1982, advising that Contract No. 444, Traffic Signal Installation, Soto Street and Fruitland Avenue, Pacific Boulevard and Fruitland Avenue has been completed, and that a final partial payment of $23,490.00 is now due, with the remaining ten percent of $2,610.00 payable thirty five (35) days after acceptance and recommending that the work be accepted and authority be granted to pay the contractor, Steiny and Company, Inc., P.O. Box 74901, Los Angeles, California, 90004, in accord- ance with the agreement, was presented. It was moved by Gonzales, seconded by Davis, that the recommendation of the Director Community Services be approved and authority be granted to issue warrant in the amount of $23, 490.00 to Steiny and Company, Inc., P.O. Box 74901, Los Angeles, California, 90004, final partial payment, with the remaining ten percent of $2,610.00 payable thrity five (35) days after acceptance. Motion carried. RESOLUTION NO. 4895 - A Resolution of the City Council of the City of Vernon Accepting The Work Of Traffic Installation, Soto Street And Fruitland Avenue, Pacific Boulevard And Fruit- land Avenue, In Accordance With Contract No. 444 Of The City Of Vernon, was presented. 671 =5= 4/8/82 It was moved by Ybarra, seconded by McCormick, that Resolution No. 4895 be approved and adopted. Luich, Secretary of the Board of Library Trustees, dated April 1, 1982, recommending that the City Council re-appoint trustees Malburg and Ybarra to a two (2) year term as of July 1, 1982, as their present term expires on June 30, 1982, was presented. It was moved by Davis, seconded by Ybarra, that the recommendation of the Secretary of the Board of Library Trustees, to re-appoint trustees Malburg and Ybarra to a two (2) year term as of July 1, 1982 be deferred until the regular City Council Meeting, April 20, 1982. Motion carried. Cormnunication from George F. Bass, dated April 1, 1982, recormnending authority and funds to attend the California Fire Chiefs' 26th Annual Conference in Long Beach, May 9-13, 1982, with an expense allowance of $150.00, was presented. It was moved by McCormick, seconded by Ybarra, that the recormnendation of Fire Chief Bass be approved and authority be granted to issue warrant in the amount of $150.00 to George F. Bass to attend the California Fire Chiefs' 26th Annual Con- ference, in Long Beach. Motion carried. Cormnunication from Police Chief L. A. Espinoza, dated March 31, 1982, recommending authority and funds to attend the Seminar on "The Problem Employee" to be held in Santa Ana, April 13, 1982, with an expense allowance of $43.00, was presented. It was moved by Davis, seconded by Ybarra, that the recormnend- ation of the Police Chief be approved and authority be granted to issue warrant in the amount or:$43. 00 to L. A. It was moved by Gonzales, seconded by McCormick, that the recormnendation of the Police Chief be approved and authority be granted to issue warrants in the amount of $148.70 to J. E. Mason, and R. E. Lascurain to attend the California Association of Labor Relations Officers Seminar in Palm Springs. Motion carried. Cormnunication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated April 7, 1982, transmitting the minutes of the Personnel Cormnittee Meeting held April 6, 1982, for approval of recommendations contained therein, was presented. It was moved by McCormick, seconded by Davis, that the minutes of the Personnel Cormnittee Meeting held April 6, 1982 be approved as written and recommendations contained therein be adopt- ed. Motion carried. 672 =6= 4/8/82 Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated April 6, 1982, submitting a claim for damages from Donald W. Vannoy, due to Enrique Romero, a city employee, backing into Mr. Vannoy's vehicle while driving a city vehicle, and recommending that the claim for damages in the amount of $448.49 be paid on the condition of Mr. Vannoy signing a full release, was presented. 1 It was moved by Ybarra, seconded by McCormick, that the recommendation of the City Administrator/City Clerk be approved and authority be granted to issue warrant in the amount of $448.49, to Donald W. Vannoy, for damages, on the condition of Mr. Vannoy signing a full release. Motion carried. Communication from Arthur E. Nelson, Director Community Services, dated April 7, 1982, advising that the bids received and opened April 6, 1982, for Contract No. 448, Soto Street and Santa Fe Avenue Improvement have been reviewed and recommending that the contract be awarded to Vernon Paving Company, 17100 Norwalk Boulevard, Suite 103, Cerritos, on the basis of their bid of $119,721.10, was presented. RESOLUTION NO. 4896 - A Resolution of the City Council of the City of Vernon Accepting The Bid Of Vernon Paving Company For Soto Street And Santa Fe Avenue Improvement, In Accordance With Contract No. 448 Of The City of Vernon And Approving The Execution Of Said Contract, was presented. It was moved by Gonzales, seconded by Ybarra, that approval of Resolution No. 4896, be deferred until the regular City Council Meeting, April 20, 1982. Motion carried. Communication from Bruce V. Malkenhorst, Executive Director of Light and Power, dated April 7, 1982, recommending that the refund from the ER76-205 Case be returned to customers at the rate of 0.4759/KWH, was presented. It was moved by Ybarra, seconded by McCormick, that the, recommendation of the Executive Director of Light and Power be approved and that the refund from the ER76-205 Case be returned to customers at the rate of 0.4759/KWH. Motion carried. Communication from the Police and Fire Commission, recommend- ing that the City of Vernon Fire Department participate in the Santa Fe Springs Annual Parade on Saturday, May 15, 1982, was presented. I It was moved by Gonzales, seconded by Davis, ,that the recommendation of the Police and Fire Commission be approved and that the City of Vernon Fire Department participate in~the Santa Fe Springs Annual Parade on Saturday, May 15, 1982. Motion carried. At this time, 6:00 o'clock, p.m., the Mayor declared a recess. At this time, 6:20 o'clock, p.m., it was moved by Ybarra seconded by Davis, that the City Council go into executive session, under Attorney/Client privilege. Motion carried. All persons with the exception of the City Administrator/ City Clerk, City Attorney and Victor Vaits were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidental. 673 =7= 4/8/82 Victor Vaits was excused from the executive session at 6:35 o'clock, p.m. Lewis R. Adams arrived at 6:40 o'clock, p.m. Lewis R. Adams was excused from the executive session at 6:50 o'clock, p.m. I At 7:30 o'clock, p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. Communication from David B. Brearley, City Attorney, dated April 6, 1982, recommending that a Complaint for Property Damage be filed against Salvador Beltran Carrillo and Francisco Bega, to recover the cost of repairing the oroperty damaged, in the sum of $11,447.01, as a result of an accident which occured on June 24, 1981, was presented. It was moved by Gonzales, seconded by McCormick, that the City Attorney be authorized to sign and file a Complaint for Property Damage against Salvador Beltran Carrillo and Francisco Bega on behalf of the City of Vernon, for the sum of $11,447.01. Motion carried. It was moved by McCormick, seconded by Gonzales, that authority be granted to issue appropriate funds to Thomas A. Ybarra and William J. Davis to attend the Mayors and Councilmen Conference, at San Diego, May 12-14, 1982. Motion carried.
