MINUTES OF AN ADJOURNED REGULAR
MEETING OF THE CITY COUNCIL, HELD
MAY 18, 1982, AT 4:45 P.M., IN THE
COUNCIL CHAMBER OF THE CITY HALL,
LOCATED AT 4305 SANTA FE AVENUE
VERNON, CALIFORNIA

MEMBERS PRESENT: Malburg, McCormick, Davis., Ybarra, Gonzales
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
The City Clerk announced that this was the time and place
for consideration of Contract No. 449, Sewer Manhole Improvement.
It was moved by Gonzales, seconded by Ybarra, that the con-
sideration of Contract No. 449, Sewer Manhole Improvement be de-
ferred until the regular City Council Meeting, June 1, 1982.
Motion carried.
It was moved by Ybarra, seconded by Davis, that the minutes
of the regular City Council Meeting held May 4, 1982, be approved
as written and submitted. Motion carried.
At this time, Mayor Malburg awarded a 25 year Service Pin to
Patrick Fulcher, Fire Department. Chief George Bass accepted the
Service Pin, in his behalf.
Health Department Report for the month of April 1982, was
presented.
It was moved by McCormick, seconded by Gonzales, that the
Health Department Report for the month of April 1982, be received
and filed. Motion carried.
Police Department Activity Log for the period May 1-15, 1982,
was presented.
It was moved by Ybarra, seconded by Davis, that the Police
Department Activity Log for the period May 1-15, 1982, be received
and filed. Motion carried.

Communication from Bruce V. Ma1kenhorst, City Administrator/
City Clerk, dated May 17, 1982, transmitting the minutes of the
Finance Committee Meeting Held May 10, 1982, for approval of re-
commendations contained therein, was presented.
It was moved by Gonzales, seconded by Davis, that the minutes
of the Finance Committee Meeting held May 10, 1982, be approved as
written and recommendations contained therein be adopted. Motion
carried.
RESOLUTION NO. 4907 - A Resolution of the City Council of
the City of Vernon Approving The Purchase Of Two New Dump Trucks
In Which One Will Be Used In The Community Services Department and
One Will Be Used In The Water Department And Authorizing The Pur-
chasing Agent To Advertise For Bids For Said Dump Trucks, was
presented.

Resolution No. 4907 be approved and adopted. Motion carried.

RESOLUTION NO. 4908 - A Resolution of the City Council of
the City of Vernon Approving And Authorizing The Execution Of
An Agreement Between The City Of Vernon And James B. Shows, DBA,
Alert Guard Service And Patrol, For School Crossing Guard Ser-
vices, was presented.
It was moved by McCormick, seconded by Ybarra, that
Resolution No. 4908 be approved and adopted. Motion carried.

Payroll Warrant Register No. 304, covering claims and
demands presented during the period March 7, 1982 - April 17,
1982, which includeds Demand Nos. 3465-3488 (both inclusive)
drawn on the Crocker National Bank, totaling $812,878.19,
(accounting period April 1982) was examined and audited.
It was moved by Davis, seconded by Gonzales, that Payroll
Warrant Register No. 304 be approved and payment authorized for
Demand Nos. 3465- 3488 (both inclusive) in the amount of
$812,878.19, with no exceptions. Motion carried.
Warrant Register No. 596, covering claims and demands
presented during the period May 1-15, 1982 which includes
Demand Nos. 6451-6642 (both inclusive), excluding Light and Power
Demands, and void Demand Nos. 6479 and 6614, drawn on the First
Interstate Bank, totaling $85,768.88, was examined and audited.
It was moved by McCormick, seconded by Ybarra, that Warrant
Register No. 596 be approved and payment authorized for Demand
Nos. 6451-6642 (both inclusive), excluding Light and Power Demands
and void Demand Nos. 6479 and 6614, in the amount of $85,768.88,
(Accounting Beriod May 1982) with no other exceptions. Motion
carried.
Warrant Register No. 596, covering claims and demands pre-
sented during the period May 1-15, 1982, which includes Light and
Power Demand Nos. 6463, 6464, 6499, 6517, 6596, 6598, 6599, 6601,
6639 and 6641, totaling $4,623,529.80, (Accounting Period May, 1982)
was examined and audited

It was moved by Gonzales, seconded by Ybarra, that ,^larrant
Register No. 596 be approved and payment authorized for Light and:::
Power Demand Nos. 6463, 6464, 6499, 6517, 6596, 6598, 6599, 6601,
6639 and 6641, in the amount of $4,623,529.80, with no exceptions.
Motion carried. Councilman Davis abstained.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 14, 1982, recommending that the contract
with Los Angeles County for the examination of Tract and Parcel
Map Check be renewed for a five (5) year period, July 1, 1982 -
June 30, 1987, was presented.

RESOLUTION NO. 4909 - A Resolution of the City Council
of the City of Vernon Authorizing The Execution Of An Examination
Of Tract And Parcel Maps Agreement Between The City Of Vernon And
The County Of Los Angeles For A Five (5) Year Period, was present-
ed.
It was moved by Davis, seconded by McCormick, that Resolution
No. 4909 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 17, 1982, recommending that an extension of
a trailer permit be granted to Flanagan Motor Express, located at
4371 E. 49th Street for a period of one year, with and expiration
date of April 8, 1983, was presented.
It was moved by Gonzales, seconded by McCormick, that the
recommendation of the City Administrator/City Clerk be approved and
that an extension of a trailer permit be granted to Flanagan Motor
Express, for a period of one year, with and expiration date of April
8, 1983. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 17, 1982, recommending that an extension of
a trailer permit be granted to Randall Foods for a period of six
months with an expiration date of September 17, 1982, was present-
ed.
It was moved by Davis, seconded by Ybarra, that the recommend-
ation of the City Administrator/City Clerk be approved and
that an extension of a trailer permit be granted to Randall Foods
for a six month period, with an expiration date of September 17,
1982. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 17, 1982, recommending that the Purchasing
Agent be authorized to advertise for bids for Janitorial Services,
was presented.
RESOLUTION NO. 4910 - A Resolution of the City Council of
the City of Vernon Authorizing The Purchasing Agent To Advertise
for Bids For Janitorial Services, was presented.
It was moved by McCormick, seconded by Ybarra, that Resolut-
ion No. 4910 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 18, 1982, recommending the hiring of Ms.
Karon Berry on a full time regular basis, as Switchboard Operator,
Step 6, based on her job performance since her temporary employ-
ment date and contingent upon her passing the pre-employment physi-
cal, to become effective May 30, 1982, was presented.
It was moved by Ybarra, seconded by Davis, that the recommend-
ation of the City Administrator/City Clerk be approved and that
Ms. Karon Berry be hired on a full time regular basis, as Switch-
board Operator, Step 6, based on her job performance since her
temporary employment date and contingent upon her passing the pre-
employment physical, to become effective, May 30, 1982. Motion
carried.

Communication from Bruce V. Malkenhorst, Personnel Director,
dated May 17, 1982, transmitting the minutes of the Personnel
Committee Meeting, for approval of recommendations contained there-
in, was presented.
It was moved by McCormick, seconded by Gonzales, that the
minutes of the Personnel Committee Meeting held May 17, 1982, be
approved as written and recommendations contained therein be adopt-
ed. Motion carried.

Communication from Bruce V. Malkenhorst, Director of Finance,
dated May 18, 1982, transmitting the minutes of the Finance
Committee Meeting, for review of the City Council and approval of
same, was presented.
It was moved by Ybarra, seconded by Davis, that the minutes
of the Finance Committee Meeting, held May 17, 1982, reviewed by
the City Council, be approved as written and recommendations con-
tained therein be adopted. Motion carried.
At 5:50 p.m., it was moved by Gonzales, seconded by Davis,
that the City Council go into executive session, under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, City Attorney and Police Chief Espinoza, were excluded
from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidenb.aL
Police Chief Espinoza was excused at 6:00 p.m.
At 6:05 p.m., it was moved by Ybarra, seconded by McCormick,
that the City Council go out of executive session and resume
regular session. Motion carried.
The City Attorney presented proposed Stipulations with
Request for Award and Award in regard to the Workers' Compensation
Appeals Board case of Nicholas Jurovich vs. City of Vernon, Case
Nos. 81 VN 104707/8/9 and recommended to the City Council that said
Stipulations be approved with a permanment disability rating of
51.2%. -

It was moved by McCormick, seconded by Davis, that the pro-
posed Stipulations with Request for Award and Award in the case of
Nicholas Jurovich vs. City of Vernon" Case Nos. 81 VN 104707/8/9,
with a permanent disability rating of 51.2% be approved and the
City Attorney be authorized to execute said Stipulations with Re-
quest for Award and Award on behalf of the City of Vernon. Motion
carried.
The City Administrator, Bruce V. Malkenhorst, indicated that
Mark Stanford Williams, Patrolman II, had submitted a letter of
resignation, dated May 13, '1982, which violated the terms and con~
ditions of his employment agreement with the City of Vernon, which
was effective on February 11, 1980 and further indicated that he
had sent a letter on May 14, 1982 to Mr. Williams wherein he
indicated that Mr. William's letter of resignation would be reject-
ed by the City Council and that the City of Vernon expects him to
discharge his obligations pursuant to said employment agreement, or
reimburse the City of Vernon for costs which had been incurred by
the City of Vernon and submitted a copy of said letter for con-
sideration by the City Council.

It was moved by Ybarra, seconded by Gonzales, that the
City Council reject the letter of resignation of Mr. Mark
Stanford Williams, Patrolman II, dated May 13., 1982, because
it violates the terms and conditions of the employment agree-
ment between Mr. Williams and the City of Vernon, effective on
February 11, 1980, and that the letter dated May 14, 1982, from
the City Administrator to Mr. Williams be received and filed and
the statements contained therein, be approved. Motion carried.
There being no further business, it was moved by McCormick,
seconded by Ybarra, that the meeting adjourn. Motion carried.
