MINUTES OF AN ADJOURNED REGULAR
MEETING OF THE CITY COUNCIL HELD
TUESDAY, JULY 13, 1982 AT 4:45 P.M.
IN THE COUNCIL CHAMBER OF THE CITY
HALL LOCATED AT 4305 SANTA FE AVE.
VERNON, CALIFORNIA
MEMBERS PRESENT: Ybarra, Davis, Gonzales, McCormick

The meeting was called to order by Mayor Pro-tem Ybarra.
At this time the Mayor Pro-tem declared that the Public
Hearing to consider the adoption of Ordinance No. 929 fixing rates
to be charged for electrical energy distributed and supplied by
the City of Vernon is open, and requested that the City Attorney
explain the procedures for the public hearing.
City Attorney, David B. Brearley, advis.ed that Mr. Baker
G. Clay would explain briefly his recommendations from his report
for the City of Vernon to increase its retail rates for electricity
in conformance with the increased costs of purchasing electrical
energy.
Mayor Pro-tern Ybarra requested Mr. Clay to give testimony
as to the recommendations in his report.
Mr. Clay was sworn in by the City Clerk.
After Mr. Clay's testimony the Mayor Pro-tem asked if anyone
would like to make any comments or ask questions regarding the
proposal of new rates.
Councilman Gonzales inquired about the 81-177 rate case and
about the Step 2 surcharge.
Mr. Clay and the City Attorney both responded to these
questions and advised that the surcharge is necessary.
Councilman Davis inquired about Exhibit C, Sheet 4, with
reference to the delivery voltage for Bee Jay and Kinetic.
Councilman Gonzales asked about Songs 2, and the surcharge
that is to be effective as of August 15, 1982.
Mr. Clay responded briefly to these questions.
Mayor Pro-tem asked the City Attorney if he had any additional
comments.
At this time, 5: 45 P.M., the Mayor Pro-tem closed the Public
Hearing.
It was moved by McCormick, seconded by Gonzales, to receive
and file and to accept as evidence "Report on Rate Design" prepared
by Baker G. Clay. Motion carried.
ORDINANCE #929 - An Ordinance of the City council of the
City of Vernon Fixing Rates to be Charged for Electrical Energy
Distributed and Supplied by the City of Vernon.
It was moved by McCormick, seconded by Gonzales, that
Ordinance #929 receive and pass a first reading. Motion carried.

At this time 5:48 P.M., it was moved by Gonzales, seconded
by Davis, that the City Council go into Executive Session under
Attorney/Client privilege. Motion carried.
Mayor Pro-tem Ybarra declared all communications to and
from the Executive Session were deemed private and confidential.
All persons with the exception of the City Administrator/
City Clerk, the City Attorney, Lewis R. Adams, Baker G. Clay and
Arnold Fieldman, were excluded from the Executive Session
It was moved by McCormick, seconded by Gonzales, that
the City Council come out of Executive Session, the time being 6:20 P.M.
ORDINANCE 11927 - An Ordinance of the City Council of the
City of Vernon Undertaking to Comply with Certain Federal Energy
Regulatory Commission Regulations on Arrangements with Qualifying
Cogeneration and Small Power Production Facilities Under Section
210 of the Public Utility Regulatory Policies Act of 1978.
It was moved by McCormick, seconded by Davis, that Ordinance
11927 pass a first read~ng. Motion carried.

ORDINANCE #928 - An Ordinance of the City Council of the
City of Vernon Providing for Certain Electric Power and Energy
Arrangements with Qualifying Cogeneration and Small Power Production
Facilities.
It was moved by McCormick, seconded by Gonzales, that
Ordinance #928 pass a first reading. Motion carried.

There being no further business to come before the City
Council it was moved by Davis, seconded by McCormick, that the Meeting
adjourn.
