19820728 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL HELD JULY 28, 1982, AT 4:45 P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA I MEMBERS PRESENT: MEMBERS ABSENT: McCormick, Ybarra, Gonzales, Davis Malburg The meeting was called to order by Mayor Pro Tern Ybarra. The City Clerk indicated that the City Council had given first reading to Ordinance No. 929 on July 22, 1982, and re- commended that said Ordinance receive a second reading and final approval. ORDINANCE NO. 929 - An Ordinance of the City Council of the City of Vernon Fixing Rates To Be Charged For Electrical Energy Distributed And Supplied By Said City Within Its Bound- aries And Repealing Certain Ordinances Of The City Of Vernon Relating Thereto, was read by title for a second and final read- ing. It was moved by Gonzales, seconded by McCormick, that Ordinance No. 929 receive and pass a second reading and be adopted. Motion carried. AYES: NOES: Absent: Gonzales, McCormick, Ybarra, Davis None Malburg Mr. Lewis R. Adams, Operations Manager of the Light and Power Department, pre8ented an Energy Exchange Agreement by and between the City of Glendale and the City of Vernon and re- commended that the City of Vernon authorize the Chief Executive Officer of the Light and Power Department to execute said Agree- ment on its behalf. It was moved by McCormick, seconded by Gonzales, that the recommendation of the Operations Manager of the Light and Power Department be approved and that the Chief Executive Officer of the Light and Power Department be authorized to exe- cute said Agreement on behalf of the City of Vernon. Motion carried. Councilman Davis abstained. I Communication From Bruce V. Malkenhorst, City Adminis- trator/City Clerk, dated July 28, 1982, transmitting the status report from Victor Vaits, Deputy Director of the Community Services Department, dated July 22, 1982, concerning the Extra Work Order #1 on Contract No. 449 for sewer reconstruction on Exchange and Lorna Vista Avenues. It was moved by Gonzales, seconded by McCormick, that the status report on the Extra Work Order #1, Contract No. 449, for sewer reconstruction on Exchange and Lorna Vista Avenues be received and filed. Motion carried. 722 72,3 =2= 7/28/82 I The City Attorney reported that the City Council had approved in substance, during an Executive Session of an adjourned City Council Meeting, held July 22, 1982, that the Mayor Pro Tern be authorized to execute a letter agreement with Southern California Edison Company which would permit the City to operate its diesel plant and therefore settle the issues raised by the City of Vernon before the Federal Energy Regulat- ory Commission in Docket No. ER8l-l77, Phase II. Re further reported that the final draft of the letter agreement submitted by Edison conformed to the letter consider- ed by the City Council on July 22, 1982 and, therefore, re- commended that the City Council ratify the execution of said letter agreement by the Mayor Pro Tern. It was moved by Gonzales, seconded by McCormick, that the final draft of the letter agreement submitted by Edison be approved and that the execution of said agreement by the Mayor Pro Tern be ratified as being consistent with the Council's previous instructions. Motion carried. The City Attorney reported that negotiations with South- ern California Edison Company towards reaching an agreement on an Integrated Operations Agreement ("lOA") restricted to the City's acquisition of an interest in the Palo Verde Nuclear Generating Station had concluded and recommended that the City approve the lOA and a side letter agreement which would provide the City with the right to modify the lOA in the event that the City's litigation efforts before the Federal Energy Regulatory Commission are successful and to permit the City of Vernon to further restrict the effect of the lOA and its nonfirm energy provisions. It was moved by McCormick, seconded by Gonzales, that the submitted lOA by and between Southern California Edison Company and the City of Vernon and the attached side letter agreement by and between Southern California Edison Company and the City of Vernon be approved and the Mayor Pro Tern be authorized to execute said lOA and said letter agreement on behalf of the City or Vernon. Motion carried. Councilman Davis abstained. There being no further business, it was moved by Davis, seconded by Gonzales, that the meeting be adjourned. Motion carried.
