19821102 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HELD NOVEMBER 2, 1982, AT 2:00 P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA 1 MEMBERS PRESENT: MEMBERS ABSENT: Malburg, Ybarra, Gonzales, Davis, McCormick None The meeting was called to order by Mayor MalbuEg. A Certificate of Appreciation for outstanding service to the community was presented to Mr. Fred Riggs, Plant Manager of Owens-Illinois, by Mayor Malburg. At this time, Mayor Malburg presented a 25 year Service Pin to Eugene De Frank. At 2:03 p.m., the Mayor declared a recess. At 2:05 p.m., the City Council reconvened in regular session, all members present before the recess, again being present. It was moved by McCormick, seconded by Ybarra, that the minutes of the adjourned regular City Council Meeting held, October 26, 1982 be approved as written and submitted. Motion carried. Warrant Register No. 607, covering claims and demands presented during the period October 16-31, 1982, which includes Demand Nos. 8090 - 8185 (both inclusive), excluding Light and Power Demands, drawn on the First Interstate Bank, totaling $119,652.29, (Accounting period, November 1982) was examined and audited. It was moved by Ybarra, seconded by Davis, that Warrant Register No. 607 be approved and payment authorized for Demand Nos. 8090 - 8185 (both inclusive), excluding Light and Power Demands, in the amount of $119,652.29, with no other exceptions. Motion carried. 1 Warrant Register No. 607, covering claims and demands presented during the period October 16-31, 1982, which includes Light and Power Demand Nos. 8090, 8114, 8136, 8138, 8146, 8153, 8163, 8183, and 8184, totaling $234,977.79, (Accounting period November 1982) was examined and audited. It was moved by Gonzales, seconded by Ybarra, that Warrant Register No. 607 be approved and payment authorized for Light and Power Demand Nos. 8090, 8114, 8136, 8138, 8146, 8153, 8163, 8183, and 8184, in the amount of $234, 977.79, with no exceptions. Motion carried. Councilman Davis abstained. Police Department Activity Log for the period October 16-31, 1982, was presented. It was moved by McCormick, seconded by Davis, that the Police Department Activity Log for the period October 16-31, 1982, be received and filed. Motion carried. ",oq:.,':"',,;, !. : ~ .,' (2) 11/2/82 1 ORDINANCE NO. 931 - An Ordinance of the City of Vernon, Amending The Code Of The City Of Vernon, California 1959, By Amending Sections 15.8, 15.27, 15.28, 15.29, 15.30, 15.31, 15.32, 15.33, 15.35, 15.42, 15.44, 15.45, 15.46 and 15.47 Of Said Code Regarding Licenses For The Purpose of Revenue And Regulation Of Certain Kinds Of Businesses Authorized By Law And Carried On In The City Of Vernon, Including Shows, Exhibit- ions And Lawful Games; To Fix And Establish Their Rates of License Taxes And To Provide For Their Collection By Suit Or Otherwise; Prescribing Penalties For The Violation Of Any Pro- visions Of This Ordinance, And repealing All Ordinances And Parts Of Ordinances In Conflict Therewith, Specifically Ordinance Nos. 868, 871, 907, and 909, was read by title for a second and final reading. It was moved by Gonzales, seconded by Ybarra, that Ord- inance No. 931 receive and pass a second and final reading, and be adopted. Motion carried. Nelson, Director of Community Services, dated October 27, 1982, advising that Con- tract No. 451, Exchange Avenue Storm Drain has been completed, with the total contract amount being $102,669.00. A final part- ial payment of $92,402.10 is now due with the remaining ten per- cent, $10,266.90, payable thirty-five (35) days after accept- ance and recommending that the work be accepted and authority be granted to pay the contractor, Clarke Contracting, P.O. Box 5664, Compton, Ca., 90244, in accordance with said contract, was pre- sented. RESOLUTION NO. 4953 - A Resolution of the City Council of the City of Vernon Accepting The Work On The Exchange Avenue Storm Drain In Accordance With Contract No. 451, Of The City Of Vernon, was presented. It was moved by McCormick, seconded by Davis, that Resolution No. 4953 be approved and adopted. Motion carried. AYES: McCormick, Davis, Malburg, Gonzales, Ybarra NOES: None Absent: None 1 Communication from Bruce V. Malkenhorst, City Admini- strator/City Clerk, dated November 1, 1982, recommending that the claim from Financial Indemnity Company (their insured Peter Torreano) for an accident occurring on July 20, 1982, at 27th St. and Santa Fe Avenue, be denied and that said claim be referred to the City's liability claims administrator, was presented. It was moved by Ybarra, seconded by Gonzales, that the recommendation of the City Administrator/City Clerk be approved and that the claim from Financial Indemnity Company be denied and that said claim be referred to the City's liability claims ad- ministrator. Motion carried. Communication from Arthur E. Nelson, Director Community services, dated November 1, 1982, recommending authority and funds for Louis Hauger to attend the Legal Aspects Related to the Industrial Hygiene Practice seminar, in Long Beach, November 18, 1982, with an expense allowance of $30.00 for registration fees, was presented. 75.9 (3) 11/2/82 It was moved by Davis, seconded by Ybarra, that the recommendation of the Director Community Services be approved and authority granted to issue warrant in the amount of $30.00, to Louis S. Hauger, to attend the Legal Aspects Related to the Industrial Hygiene Practice, on November 18, 1982. Motion carr- ied. 1 Communication from Police Chief L. A. Espinoza, dated October 26, 1982, recommending authority and funds for James E. Mason to attend the California Association of Labor Relations Officers Training Seminar, November 29-30, 1982, in Carmel, with an expense allowance of $311.08, was presented. It was moved by Gonzales, seconded by Ybarra, that the recommendation of the Police Chief be approved and that authority be granted to issue warrant in the amount of $311.08, to James E. Mason to attend the California Association of Labor Relations Officers Training Seminar. Motion carried. Communication from Bruce V. Malkenhorst, Director of Personnel, dated November 2, 1982, transmitting the minutes of the Personnel Committee Meeting held November 1, 1982, for approval of recommendations contained therein, was presented. It was moved by Gonzales, seconded by McCormick, that the minutes of the Personnel Committee Meeting, held November 1, 1982 be approved as written and recommendations contained therein be adopted. Motion carried. At 2:45 p.m., Mayor Malburg declared a recess. At 3:55 p.m., the City Council reconvened in regular session, all members present before the recess, again being pre- sent. 1 Victor Vaits advised the Council that Southern Californ- ia Edison Company had made an error when they submitted a Grant Deed dated August 3, 1982, to the City of Vernon by failing to specify that the property described therein was to be used for road purposes because the accompanying parcel map did not specify the creation of a parcel which was to be transferred to the City. Therefore, the original Certificate of Acceptance should be void- ed and a new Certificate of Acceptance be approved which would indicate that the property would be accepted on behalf of the public for road purposes so that the transfer of said property conforms tQthe pr.eviously approved parcel map and can then be recorded with the County Recorder's Office. It was moved by McCormick, seconded by Ybarra, that the previous Certificate of Acceptance dated August 3, 1982, is here- by declared null and void and that the Mayor be authorized to sign a new Certificate of Acceptance indicating that the interest in the real property conveyed by the Grant Deed dated August 3, 1982, from Southern California Edison Company to the City of Vernon is for road purposes. Motion carried. It was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Section 54957 of the Government Code, at 4:15 p.m. Motion carried. All persons with the exception of the City Administrator/ City Clerk and City Attorney were excluded from the executive session. 760 (4) 11/2/82 Mayor Malburg ordered all communications to and from the executive session deemed private and confidenta1. At 5:10 p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. 1 RESOLUTION NO. 4954 - A Resolution of the City Council of the City of Vernon Amending Schedule VII, Exhibit "F", Of Resolution 4918 Fixing The Compensation Of Certain Employees Of The City Of Vernon To Be Effective November 1, 1982, was presented. It was moved by Ybarra, seconded by McCormick, that Resolution No. 4954 be approved and adopted. Motion carried. AYES: NOES: Absent: Ybarra, McCormick, Malburg, Davis, Gonzales None None At 5:11 p.rn, it was moved by McCormick, seconded by Davis, that the City Council go into executive session under Attorney/Client privilege. All persons with the exception of the City Administrator/ City Clerk and City Attorney were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 5:45 p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried.
