19830104 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL, HELD JANUARY 4, 1983, IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Davis, Ybarra, McCormick, Gonzales MEMBERS ABSENT: None I The meeting was called to order by Mayor Malburg. It was moved by McCormick, seconded by Ybarra that the minutes of the regular City Council Meeting held December 21, 1982 be approved as written and submitted. Motion carried. Communication from David B. Brearley, City Attorney, dated January 4, 1983, relating to the Government Code and the Code of the City of Vernon in determining the procedures to be followed in disposing of surplus property, was presented. It was moved by McCormick, seconded by Gonzales, that the communication from the City Attorney be received and filed, and that Ordinance No. 804 relating to the sale of surplus property be referred to the Finance Committe for review. Motion carried. RESOLUTION NO. 4960 - A Resolution of the City Council of the City of Vernon Authorizing The Sale Of One City Vehicle As Surplus Property Pursuant To Section 2.31 Of The Vernon City Code, was presented. (Deferred from December 21, 1982 City Council meeting) It was moved by McCormick, seconded by Ybarra, that Resolution No. 4960 be approved and adopted. Motion carried. Malkenhorst, City Admini- strator/City Clerk, dated November 29, 1982, recommending author ity and funds for Frank Murillo, Purchasing Agent, to attend the Annual Conference of the California Association of Public Pur- chasing Officers in Sacramento, Ca. January 18-21, 1983, with an expense allowance of $529.80, was presented. I It was moved by Ybarra, seconded by Davis, that the recommendation of the City Administrator/City Clerk be approved and that authority be granted to issue warrant to Frank Murillo in the amount of $529.80 to attend the Annual Conference of the California Association of Public Purchasing Officers, in Sacra- mento. Motion carried. Communication from L. A. Espinoza, Chief of Police, dated December 14, 1982 recommending authority and funds for Robert N. Graham to attend the Eleventh Annual Robbery Invest- igators Training Seminar in Las Vegas, February 2-5, 1983 with an expense allowance of $304.28, was presented. It was moved by Davis, seconded by Gonzales, that the recommendation of the Police Chief be approved and authority be granted to issue warrant to Robert N. Graham, in the amount of $304.28 to attend the Eleventh Annual Robbery Investigators Seminar in Las Vegas. Motion carried. 778 (2) 1/4/83 I Communication from Victor Vaits, Deputy Director Community Services, dated December 20, 1982, advising that Contract No. 453, Vernon Avenue and Bandini Boulevard Improve- ment has been completed, with the total contract amount being $101,227.09. A final partial payment of $91,104.38 is now due and the remaining ten percent, $10,122.71, payable thirty-five (35) days after acceptance and recommending that the work be accepted and authority be granted to pay the contractor, Sully Miller Contracting Company, 3000 E. South Street, Long Beach, Ca. 90805, in accordance with the agreement, was presented. It was moved by Ybarra, seconded by Davis, that the recommendation of the Deputy Director Community Services, be approved and that the completion of Contract No. 453, be accept- ed and that authority be granted to pay the contractor, Sully Miller Contracting Company the final partial payment of $91,104. 38, which is now due and the remaining ten percent, $10,122.71, payable thirty-five (35) after acceptance, in accordance with the agreement. RESOLUTION NO. 4962 - A Resolution of the City Council of the City of Vernon Accepting The Work Of Vernon Avenue And Bandini Boulevard Improvement In Accordance With Contract No. 453 Of The City Of Vernon, was presented. It was moved by Gonzales, seconded by McCormick, that Resolution No. 4962 be approved and adopted. Motion carried. Malkenhorst, City Admini- strator/City Clerk, dated December 29, 1982, recommending that the Purchasing Agent be granted authority to advertise for bids for a 1983 Pick-up Truck to be utilized by the Community Ser- vices Department, was presented. It was moved by Ybarra, seconded by Davis, that the recommendation of the City Administrator/City Clerk be approved and that the Purchasing Agent be granted authority to advertise for bids. Motion carried. RESOLUTION NO. 4963 - A Resolution of the City Council of the City of Vernon Approving The Purchase Of One New Pick- up Truck For Use In The Community Services Department And Author izing The Purchasing Agent To Advertise For Bids For Said Truck, was presented. I It was moved by McCormick, seconded by Davis, that Resolution No. 4963 be approved and adopted. Motion carried. Malkenhorst, City Admini- strator/City Clerk, dated December 29, 1982, recommending the disposal of surplus property from the Vernon Light and Power Department and authority for the Purchasing Agent to advertise for bids for said disposal, was presented. I RESOLUTION NO. 4964 - A Resolution of the City Council of the City of Vernon Authorizing The Sale Of Surplus Property From The Vernon Light And Power Department Pursuant To Section 2.31 Of The Vernon City Code, was presented. It was moved by Ybarra, seconded by Gonzales, that Resolution No. 4964 be approved and adopted. Motion carried. AYES: Ybarra, Gonzales, Malburg, Davis, McCormick NOES: None Absent:None Warrant Register No. 611, covering claims and demands presented during the period December 16-31, 1982, which includes Demand Nos. 8662-8754 (both inclusive) excluding Light and Power Demands, drawn on the First Interstate Bank, totaling $178,094. 76, (Accounting period January 1983) was examined and audited. It was moved by Davis, seconded by Ybarra, that Warrant Register No. 611, be approved and payment authorized for Demand Nos. 8662-8754 (both inclusive), excluding Light and Power Demands, in the amount of $178,094.76, with no other exceptions. Motion carried. Warrant Register No. 611, covering claims and demands presented during the period December 16-31, 1982, which includes Light and Power Demand Nos. 8667, 8669, 8673, 8674, 8704, 8713 and 8754, totaling $267,988.25, (Accounting period January 1983) was examined and audited. It was moved by McCormick, seconded by Gonzales, that Warrant Register No. 611, be approved and payment authorized for Demand Nos. 8667, 8669, 8673, 8674, 8704, 8713 and 8754, in the amount of $267.988.25, with no exceptions. Motion carried. Councilman Davis abstained. I Communication from Arthur E. Nelson, Director Community Services, dated December 219, 1982, advising of the County of Los Angeles requesting jurisdiction to acquire right of way and construct the Los Angeles River Bike Path between Atlantic Boule- vard and Florence Avenue and the required work would be at no cost to the City of Vernon and recommending that the County of Los Angeles be granted jurisdiction to construct the Los Angeles River Bike Path between Atlantic Boulevard and Florence Avenue, was presented. RESOLUTION NO. 4965 - A Resolution of the City Council of the City of Vernon Consenting To Establishment Of A Portion Of Real Property To Be Known As The Los Angeles River Bike Path Located Within The City Of Vernon As A Part Of The System Of Highways Of The County Of Los Angeles, was presented. It was moved by Ybarra, seconded by McCormick, that Resolution No. 4965 be approved and adopted. 7SiO 7~1 (4) 1/4/83 I At this time, a discussion was held as to whether the County of Los Angeles or the City of Vernon would have jurisdiction over that portion of property after construction has been completed. It was moved by Ybarra, seconded by Davis that the motion to approve Resolution No. 4965 be.. rescinded and that approval of Resolution No. 4965 be deferred until the City Council Meeting to be held January l8,1983,so that further information may be obtained. Motion carried. Communication from Bruce V. Malkenhorst, City Admini- strator/City Clerk, dated January 4, 1983, transmitting the minutes of the adjourned regular Personnel Committee Meeting held January 3, 1983 for approval of recommendations contained therein, was presented. It was moved by Gonzales, seconded by Davis, that the minutes of the adjourned regular Personnel Committee Meeting, held January 3, 1983 be approved as written and recommendations contained therein be adopted. Motion carried. Police Department Activity Log for the period December 16-31, 1982, was presented. It was moved by McCormick, seconded by Ybarra, that the Police Deparment Activity Log for the period December 16-31, 1982 be received and filed. Motion carried. At 5:45 p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Attorney/Client privilege. All persons with the exception of the City Administrator and City Attorney were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 6:40 p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. At 6:41 p.m., it was moved by McCormick, seconded by Gonzales, that the City Council go into executive session under Section 54957 of the Government Code. Motion carried. I All persons with the exception of the City Administrator and City Attorney were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 7:00 p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried. Bruce V. Malkenhorst, City Administrator/ City Clerk 7B2 (5) 1/4/83 The City Administrator/City Clerk notified the City Council that a Summons and Complaint for Damages filed by Lizandro Cruz Castaneda and Antonio Perez was served on his office on December 20, 1982, alleging the responsibility of the City and Police Officer Michael Dixon for an automobile accident which had occurred on March 10, 1979, and recommend- ed that the Summons and Complaint be referred to Southern California Joint Powers Insurance Authority for defense and processing. I It was moved by McCormick, seconded by Davis, that the Summons and Complaint filed by Lizandro Cruz Castaneda and Antonio Perez be referred to the Southern California Joint Powers Insurance Authority for processing and defense on behalf of the City and Police Officer Michael Dixon. Motion carried. Communication from David B. Brearley, City Attorney, dated December 30, 1982, advising the City Council that a motion approving the first reading of Ordinance No. 908 was not recorded in the Minutes of the City Council Meeting of April 7, 1981, and recommended that the City Council approve an amendment to the Minutes of April 7, 1981, as follows: "ORDINANCE NO. 908 - An Ordinance of the City Council of the City of Vernon Authorizing the Issuance by Southern California Public Power of Notes and Power Project Revenue Bonds, was read by title for a first reading (deferred from March 31, 1981 City Council Meeting) . It was moved by Gonzales, seconded by McCormick, that Ordinance No. 908 receive and pass a first reading. Motion carried." I It was moved by Ybarra, seconded by McCormick, that the Minutes of the City Council Meeting of April 7, 1981, be amended to reflect that Ordinance No. 908 receive and pass a first reading as follows: "ORDINANCE NO. 908 - An Ordinance of the City Council of the City of Vernon Authorizing the Issuance by Southern California Public Power of Notes and Power Project Revenue Bonds, was read by title for a first reading (deferred from March 31, 1981 City Council Meeting) . It was moved by Gonzales, seconded by McCormick, that Ordinance No. 908 receive and pass a first reading. Motion carried." Motion carried.
