19830405 Regular City Council Meeting - Minutes MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HELD APRIL 5. 1983, AT 2:00 P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Ybarra, Gonzales, Davis, McCormick I MEMBERS ABSENT: Malburg The meeting was called to order by Mayor Pro tern Ybarra. It was moved by McCormick. seconded by Davis, that the minutes of the adjourned City Council Meeting held March 22, 1983. be approved as written and submitted. Motion carried. At this time, the Mayor Pro tem presented Service Pin Awards to the following employees: Richard Hilton. Chief Deputy Director Environmental Health, for twenty five years of service. Captain Robert Salisbury. Captain James Dunn and Acting Captain Art Miekosz, Fire Department. for twenty years of service. Captain Robert Salisury's Pin was accepted by B/C Lloyd Schultz, in his behalf. At 2:05 P.M., the Mayor Pro tem declared a recess. At 2:10 P.M.. the City Council reconvened in regular session, all members present before the recess, again being present. RESOLUTION NO. 4985 - A Resolution of the City Council of the City Vernon Commending Kenneth Ellis for His Many Years of Service to the City of Vernon, was presented. It was moved by Gonzales. seconded by Davis, that Resolut- ion No. 4985 be approved and adopted. Motion carried. Deputy Director of Commun- ity Services. dated March 3, 1983. recommending authority and funds for John Reid, Environmental Specialist, to attend the 32nd Annual Educational Symposium of the California Environmental Health Association at Fresno, Ca., April 27-29. 1983, with and expenses allowance of $318.00. was presented. It was moved by McCormick. seconded by Davis, that the re- commendation of the Deputy Director of Community Services be approved and authority be granted to issue warrant to John Reid, in the amount of $318.00, to attend the 32nd Annual Educational Symposi.um, April 27-29, 1983. It was moved by Davis, seconded by Gonzales, that the re- commendation of the Deputy Director of Community Services, be approved and authority be granted to issue warrant to Fred Tachov- sky, in the amount of $347.93 to attend the Quint Chapter Meeting of the Southern California Chapters of the International Associat~ ion of Electrical Inspectors. Payroll Warrant Register No. 315. covering claims and demands presented during the period January 9 through February 5. 1983. which includes Demand Nos. 3648-3665 (both inclusive) drawn on the Crocker National Bank, total $526.182.32. (Accounting period Feb- ruary, 1983) was examined and audited. It was moved by McCormick, seconded by Gonzales. that Payroll Warrant Register No. 315 be approved and payment authorized for Demand Nos. 3648-3665 (both inclusive), in the amount of $526,182. 32, with no exceptions. Motion carried. Warrant Register No. 617. covering claims and demands pre- sented during the period March 16-31, 1983, which includes Demand Nos. 9741-9628 (both inclusive) excluding void Demand No. 9568, and Light and Power Demands, drawn on the First Interstate Bank, totaling $140,192.62, (Accounting period April 1983) was examined and audited. It was moved by Gonzales, seconded by Davis, that Warrant Register No. 617 be approved and payment authorized for Demand Nos. 9741-9628 (both inclusive) excluding void Demand No. 9568 and Light and Power Demands, in the amount of $140.192.62. with no other exceptions. (Accounting period April 1983) was examined and audited. Motion carried. Councilman Davis abstained. Communication from Victor Vaits, Deputy Director of Community Services. dated March 30. 1983. recommending authority and funds for Eve Wise. RESOLUTION NO. 4986 - A Resolution of the City Council of the City of Vernon Approving the Purchase of a Front Door at Fire Station 2 and Authorizing the Purchasing Agent to Advertise for Bids for Said Door. was presented. It was moved by Gonzales, seconded by Davis that Resolution No. 4986. be approved and adopted. Motion carried. It was moved by Gonzales, seconded by Davis, that the re- commendation of the Deputy Director Community Services be approved and that the bids received for Contract No. 452. Sewer Cleaning 1983-86 be rejected. Motion carried. I RESOLUTION NO. 4987 - A Resolution of the City Council of the City of Vernon Approving Contract No. 457 and Authorizing Notice Inviting Sealed Proposals or Bids for Sewer Cleaning 1983-86, in Accordance with Contract No. 457 of the City of Vernon, was pre- sented. It was moved by McCormick, seconded by Gonzales, that Re- solution No. 4987 be approved and adopted. Motion carried. Chief Engineer of Water Works and Assistant Manager of Department of Water and Power of the County of Los Angeles, dated March 2, 1983, advising of the recent State Supreme Court decision regarding Mono Basin water rights and of a bill presently in Congress (HR 1341) which would establish a National Monument at Mono Lake and how it could serious- ly affect Los Angeles' water rights and asking the City of Vernon's support in opposing this bill, was presented. RESOLUTION NO. 4988 - A Resolution of the City Council of the City of Vernon Urging Congressmen In The House Of Represent- atives To Either Delay Or Defeat The Passage of Bill H.R. 1341 Which Establishes A National Monument At Mono Lake, was presented. It was moved by McCormick, seconded by Davis, that the communication from Duane L. Georgeson be received and filed and that Resolution No. 4988 be approved and adopted. Motion carried. Malkenhorst, City Administrator/ City Clerk, dated April 5. 1983, recommending that Arturo Morales be granted a merit step increase to Utilityman IV, Grade 3, effect- ive April 17. 1983, based on his satisfactory job performance dur- ing the past year, was presented. It was moved by McCormick, seconded by Davis that the re- commendation of the City Administrator/City Clerk be approved and authority be granted to issue warrants to William Davis and Hilario Gonzales in the amount of $383.00 to attend the California Contract Cities 24th Annual Municipal Seminar in Palm Springs. It was moved by Gonzales, seconded by Davis, that appropriate funds be issued for a suite to be shared by Ybarra and McCormick at the California Contract Cities Association 24th Annual Municipal Seminar, in Palm Springs. May 18-22, 1983. Motion carried. Communication from Chuck Belba, Chairman, Selection Committee, League of California Cities, dated April 4, 1983 requesting that the City Council designate a representative to serve on the Selections Committee, was presented. It was moved by Gonzales, seconded by Davis, that William McCormick be designated as our representative to serve on the Selections Committee and to vote on behalf of the City of Vernon. Motion carried. =7= 4/5/83 At 3:00 P.M., the Mayor Pro Tem declared a recess. At 3:45 P.M., the City Council reconvened in regular session, all members present before the recess, again being present. At 3:46 P.M., it was moved by McCormick, seconded by Davis. that the City Council go into executive session under Attorney/ Client privilege. Motion carried. I All persons with the exception of the City Administrator/ City Clerk, City Attorney and Louis Hauger were excluded from the executive session. Mayor Pro Tem Ybarra declared all communications to and from the executive session deemed private and confidenta1. Louis Hauger was excused at 4:05 p.m. Lewis Adams arrived at 4:10 p.m. At 4:10 p.m.. it was moved by Gonzales, seconded by McCormick. that the City Council go out of executive session and resume re- gular session. Motion carried. The City Administrator/City Clerk reported that the Los Angeles, Unified School District had filed two claims against the City of Vernon. The first claim is for property damages in the sum of $2,639.19 and the second claim is for reimbursement of workers' compensation benefits for an estimated total amount of $2.000.00 or higher in connection with an automobile accident that occured on January 5, 1983. at the intersection of Slauson Avenue and Boyle Avenue wherein the School District's vehicle was involved in a collision with a vehicle driven by Horia Moraica. The City Administrator/City Clerk recommended that the School District's claims for property damage and worker' compensation benefit reimbursement be denied. It was moved by McCormick, seconded by Davis. that the claims submitted by the Los Angeles Unified School District be de- nied. Motion carried. I The City Attorney advised the City Council that on December 12, 1982, Michael Edward Karas, Warwic Marcus Stone and Jose Saul Mercado were the registered owners and drivers of vehicles that were involved in a collision that destroyed City property. The cost of repairing the damage to the City property was the sum of $15. 603.41. He further advised the City Council that the Purchas- ing Agent, Frank Murillo. was unsuccessful in his attempts to collect the costs incurred by the City from the above-referenced individuals and recommended that legal proceedings be initiated to recover the City's costs in repairing the damaged property. He recommended that a complaint be filed in the Municipal Court of the Southeast Judicial District for the sum of $15, 000.00 which is the jurisdictional limit of the Municipal Court. It was moved by McCormick, seconded by Gonzales. that the City Attorney's recommendation be approved and that he be authorized to file a complaint in the Municipal Court of the Southeast Judicial District on behalf of the City against Michael Edward Karas, Warwic Marcus Stone, Jose Saul Mercado and Does 1 through 10, inclusive, to recover the City's costs incurred in repairing the property damaged in the collision which occured on December 12, 1982.
