MINUTES OF A REGULAR MEETING OF
THE CITY COUNCIL, HELD MAY 3, 1983,
AT 2:00 P.M., IN THE COUNCIL CHAJ1BER

The meeting was called to order by Mayor Malburg.
It was moved by Gonzales, seconded by Ybarra, that the
minutes of the adjourned regular City Council Meeting held
April 26, 1983 be approved as written and submitted. Motion
carried.
Mayor Malburg reported that two private citizens had
assisted a female victim while the crime of theft and assualt
was being perpetrated on March 31, 1983, at Santa Fe Avenue
south of East 30th Street in the City of Vernon, by capturing
the perpetrator and providing aid and assistance to the victim
until the arrival of police officers of the Vernon Police
Department. Mayor Malburg further indicated that these indivi-
duals had provided a valuable service to the City of Vernon
and the inhabitants thereof and should be recognized and commended
for such bravery and issued the following proclamations:
A Proclamation of the Mayor and the City Council of the
City of Vernon Commending David Allen Dezara In Recognition Of
His Help And Assistance In Preventing The Commission Of A Crime
And In Capturing The Perpetrator Thereof, was presented.
A Proclamation of the Mayor and the City Council of the
City of Vernon Commending Lloyd Herbert Medley In Recognition Of
His Help And Assistance In Preventing the Commission Of A Crime
And In Capturing The Perpetrator Thereof, was presented.
It was moved by Gonzales, seconded by Ybarra, that the
Proclamations issued by the Mayor of the City of Vernon be
approved. Motion carried.
At this time the Mayor presented the Proclamations to
David Allen Dezara and Lloyd Herbert Medley.
At 2:15 P.M., the Mayor declared a recess.
At 2:20 P.M., the City Council reconvened in regular
session, all members present before recess, again being present.

Payroll Warrant Register No. 317, covering claims and
demands presented during the period March 20 through April 16,
1983 which includes Demand Nos. 3688-3703 (both inclusive)
drawn on the Crocker National Bank, totaling $544,367.68,
(Accounting period April, 1983) was examined and audited.
It was moved by Davis, seconded by Ybarra, that Payroll
Warrant Register No. 317 be approved and payment authorized for
Demand Nos. 3688-3703 (both inclusive), in the amount of
$544,367.68, with no exceptions. Motion carried.

Warrant Register No. 619 - covering claims and demands
presented during the period April 16-30, 1983, which includes
demand Nos. 9814-9895 (both inclusive) excluding Light and
Power Demands, drawn on the First Interstate Bank, totaling
$204,848.94, (Accounting period May 1983) was examined and
audited.

It was moved by Gonzales, seconded by Davis, that Warr-
ant Register No. 619 be approved and payment authorized for
Demand Nos. 9814-9895 (both inclusive), excluding Light and
Power Demands, in the amount of $204,848.94, with no other
exceptions. Motion carried.
Warrant Register No. 619 - covering claims and demands
presented during the period April 16-30, 1983, which includes
Light and Power Demand Nos. 9814, 9820, 9821, 9828, 9878, 9882,
and 9895, totaling $335,042.11, (Accounting period May 1983)
was examined and audited.
It was moved by McCormick, seconded by Ybarra, that Warr-
ant Register No. 619 be approved and payment authorized for Light
and Power Demand Nos. 9814, 9820, 9821, 9828, 9878, 9882, and
9895, in the amount of $335,042.11, with no exceptions. Motion
carried. Councilman Davis abstained.
Police Department Activity Log for the period April 15-30,
1983, was presented.
It was moved by Ybarra, seconded by Davis, that the Police
Department Activity Log for the period April 15-30, 1983 be re-
ceived and filed. Motion carried.
Communication from Chief of Police L. A. Espinoza, dated
April 28, 1983,recommending authority and funds for J. E. Mason
and R. E. Lascurain to attend the California Association of Labor
Relations Officers Training Seminar in Anaheim, May 26-27, 1983,
with an expense allowance of $83.00 each, was presented.
It was moved by Gonzales, seconded by Ybarra, that the
recommendation of the Police Chief be approved and authority be
granted to issue warrants to J. E. Mason and R. E. Lascurain in
the amount of $83.00 to attend the California Association of
Labor Relations Officers Training Seminar in Anaheim. Motion
carried.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated April 28, 1983, recommending approval and renewal
of a Letter of Agreement from CAS, Associates, Inc., for the 1983-
84 Fiscal Year. The City Administrator advised that there is a
reduction in the retainer fee from $2400 to $1600 per year, however
the per case fee 'tv-ould be increased from $150 to $175 , was present-
ed
It was moved by McCormick, seconded by Ybarra that this item
on the agenda be deferred to the regular City Council meeting of
May 17, 1983. Motion carried.
ORDINANCE NO. 934 - An Ordinance of the City Council of the

ern California Public Power Authority was read by title for a se-
cond and final reading.

Ordinance No. 934 receive a second andi'.final reading and be
adopted. Motion carried.

Communication from Supervisor Michael D. Antonovich,
County of Los Angeles, dated April 11, 1983, requesting our
support, by resolution, of Assembly Bill 1376: which repeals
the "right to strike" by employees of the Southern California
Rapid Transit District, was presented.

RESOLUTION NO. 4994 - A Resolution of the City Council
of the City of Vernon Expressing Its Support For AB 1376 And
Urging The Members Of The Legislature To Pass Said Bill, was
presented.
It was moved by Gonzales, seconded by Ybarra, that the
communication from Supervisor Michael D. Antonovich be received
and filed and that Resolution No. 4994 be approved and adopted.
Motion carried.

Mayor Malburg indicated that he had received a communication
dated March 27, 1983, from Colonel Rolfe G. Arnhym, Brigade
Commander, Third Brigade, State Military Reserve, notifying him
that Congress had established Armed Forces Day to give national
recognition to armed forces for May 21, 1983, and requested
that the City formally recognize that May 21, 1983 was Armed
Forces Day.
Therefore, the Mayor issued the following proclamation
on behalf of the City Council proclaiming May 21, 1983 as
Armed Forces Day:
A Proclamation of the Mayor and the City Council of the
City of Vernon Proclaiming The 21st Day Of May, 1983 As Armed
Forces Day, was presented.

Proclamation issued by the Mayor of the City of Vernon be
approved.
ORDINANCE NO. 935 - An Ordinance of the City Council of
the City of Vernon Amending The Code Of The City Of Vernon,
California 1959 By Adding New Chapter 4A Regulating Emergency
Burglar And Alarm Systems; Providing For The Issuance of Permits
And Collection Of Fees Therefor, And Providing For Penalties
For The Violation Of Any Provision Of This Ordinance, was read
by title ~or a first reading.
It was moved by Gonzales, seconded by Ybarra, that Or-
dinance No. 935 receive and pass a first reading. Motion carried.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 2, 1983, transmitting a copy of a Ground
Lease Agreement between the City of Vernon and International Baking
Company for parking purposes along with Addendum No. 1 to the
Agreement and recommending approval of said lease agreement and
Addendum No. 1 to lease agreement, was presented.
RESOLUTION NO. 4996 - A Resolution of the City Council of
the City of Vernon Approving The Lease Of Surplus City Property
To International Baking Company, was presented.

It was moved by McCormick, seconded by Ybarra, that the
copy of a Ground Lease Agreement between the City of Vernon and
International Baking Company for parking purposes along with
Addendum No. 1 to the Agreement be received and filed and that
Resolution No. 4996 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, Director of
Personnel, dated May 3, 1983, recommending the following
personnel actions:
I. Merit Step Increases:
1. Karon Berry be advanced to Switchboard Operator,
Grade 5, effective May 29, 1983, based on her
satisfactory job performance within the past year.
It was moved by Ybarra, seconded by Davis, that the re-
commendation of the Personnel Director be approved and that
Karon Berry be advanced to Switchboard Operator,Grade 5, effect-
ive May 29, 1983. Motion carried.
2. Fernando Weathers be advancedto Utilityman V, Grade
3, effective May 15, 1983, based on his satisfactory
job performance during the past year.
It was moved by Gonzales, seconded by Davis, that the re-
commendation of the Personnel Director be approved and that
Fernando Weathers be advancedto Utilityman V, Grade~3,effective
May 15, 1983. Motion carried.

3. Fire Engineer J. R. Winfrey be advanced to Engineer,
Grade 1, effective May 29, 1983 based on his satis-
factory job performance during the past year.
It was moved by McCormick, seconded by Ybarra, that the
recommendation of the Personnel Director be approved and that
Fire Engineer J. R. Winfrey be advancedto Engineer, Grade 1,
effective May 29, 1983. Motion carried.
4. Adrian Yasutake be advanced to Civil Engineering
Associate, Grade 3, effective May 29, 1983, based
on his satisfactory job performance during the past
year.
It was moved by Ybarra, seconded by Davis, that the re-
commendation of the Personnel Director be approved and that
Adrian Yasutake be advance to Civil Engineering Associate, Grade
3, effective May 29, 1983. Motion carried.
5. Officer James A. Wohlt be advanced to Patrolman II,
Grade III, effective May 31, 1983 based on his satis-
factory job performance during the past year with a
monthly salary of $2,326.00 (which includes the 2~%
Intermediate POST Certification pay and the $125.00
pay increase for Detective Bureau Assignment).
It was moved by Gonzales, seconded by Ybarra, that the re-
commendation of the Personnel Director be approved and that Officer
James A. Wohlt be advanced to Patrolman II, Grade III, effective
May 31, 1983, with a monthly salary of $2,326.00 (which includes
the 2~% Intermediate POST Certification pay and the $125.00 pay
increase for Detective Bureau Assignment). Motion carried.

II. Incentive Pay Increases:
I. Arnold DeBoer be granted the 2~% Educational
Incentive Pay increase for his satisfactory
completion of 30 units in Fire Science Courses,
effective May 15, 1983, with a monthly salary
of $3,256.00.

It was moved by Ybarra, seconded by McCormick, that the
recommendation of the Personnel Director be approved and that
Arnold DeBoer be granted the 2~% Educational Incentive Pay in-
crease, effective May 15, 1983, with a monthly salary of $3,256.

III. Educational Reimbursement from the Education and
Training Appropriation Fund:
1. Fire Captain Robert Salisbury be reimbursed
$12.50 for satisfactory completion of courses
taken in connection with his position with the
City.
It was moved by Ybarra, seconded by McCormick, that the
recommendation of the Personnel Director be approved and that
Fire Captain Robert Salisbury be reimbursed $12.50 from the
Education Fund for satisfactory completion of courses taken
in connection with his position with the City. Motion carried.
2. Engineer Richard Garcia be reimbursed $17.50
for his satisfactory completion of courses
taken in connection with his position with the
City.
It was moved by McCormick, seconded by Davis, that the
recommendation of the Personnel Director be approved and that
Engineer Richard Garcia be reimbursed $17.50 for his satis-
factory completion of courses taken in connection with his
position with the City. Motion carried.
Communication from Bruce V. Ma1kenhorst, City Administrator/
City Clerk, dated May 3, 1983, advising that the Board of Police
and Fire Commissioners at its adjourned regular meeting held April
26, 1983, approved to recommend to the City Council that the Vernon
Fire Department be allowed to participate in the City of Santa Fe
Springs 26th Annual Birthday Parade, May 14, 1983, was presented.

It was moved by Davis, seconded by Ybarra, that the re-
commendation of the Board of Police and Fire Commissioners be
approved and that the Vernon Fire Department be allowed to part-
icipate in the City of Santa Fe Springs 26th Annu;3.1 Birthday
Parade, May 14, 1983. Motion carried.
Communication from Bruce V. Ma1kenhorst, City Administrator/
City Clerk, dated May 3, 1983, recommending approval of Amendment
No. 1 to Service Schedule D of the Interconnection Agreement bet-
ween the Nevada Power Company and the City of Vernon, effective
May 1, 1983, and that the Mayor be authorized to sign... said Amend-
ment, was presented.
It was moved by McCormick, seconded by Gonzales, that the
recommendation of the City Administrator/City Clerk for approval
of Amendment No. 1 to Service Schedule D of the Interconnection
Agreement between the Nevada Power Company and the City of Vernon
effective May 1, 1983 and that the Mayor be authorized to sign
said Amendment, be approved. Motion carried. Councilman Davis
abstained.

Communication from David B. Brearley, City Attorney,
dated May 3, 1983, advising that the City of Vernon re-
quested the Department of Water and Power of the City of
Los Angeles to negotiate an interruptible transmission ser-
vice agreement which would permit Vernon to purchase energy
from suppliers other than the Southern California Edison
Company, and that negotiations with the LAD\VP have recently
concluded and a final draft of an Interruptible Transmission
Service Agreement has been received.

The City Attorney recommends that the City of Vernon
enter into this Interruptible Transmission Service Agreement
because it would permit Vernon to have more flexibility in
its attempts to purchase economy energy from other utilities.
RESOLUTION NO. 4995 - A Resolution of the City Council
of the City of Vernon Approving The Execution Of An Interrupt-
ible Transmission Service Agreement Between The City of Vernon
And The Department Of Water And Power Of The City Of Los Angeles,
was presented.
It was moved by McCormick, seconded by Gonzales, that
Resolution No. 4995 be approved and adopted. Motion carried.

Communication from Michael A. Rosales, Principal Vernon
City Elementary School, dated April 29, 1983, requesting the
City's assistance in helping the school with a contribution for
the Cinco de Mayo Fiesta to be held May 5, 1983, was presented.
It was moved by Davis, seconded by Gonzales, that the
request of the Principal of the Vernon City Elementary School
be approved and authority be granted to issue funds for re-
freshments for the Cinco de Mayo Fiesta, May 5, 1983. Motion
carried.
At 3:15 P.M., the Mayor declared a recess.
At 4:22 P.M., the City Council reconvened in regular
session, all members present before the recess, again being
present.

At 4:22 P.M., it was moved by Ybarra, seconded by McCormick,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, City Attorney, Louis Hauger and Arthur Nelson were
excluded from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
At 4:45 P.M., it was moved by Ybarra, seconded by McCormick,
that the City Council go out of executive session and resume
regular session. Motion carried.

At 4:46 P.M., it was moved by Gonzales, seconded by Davis,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, City Attorney, Police Chief Espinoza and Captain
Rosenkrantz were excluded from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidental.
I At 4:50 P.M. , Police Chief Espinoza and Captain Rosenkrantz
arrived.
At 5:25 P.M. , Police Chief Espinoza and Captain Rosenkrants
were excused.
At 5:52 P.M., it was moved by McCormick, seconded by Ybarra,
that the City Council go out of executive session and resume
regular session. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated May 2, 1983, advising the Council that a timely
claim from Dirnfield & ZeIner, Attorneys at Law, on behalf of their
client Mary Louis Felton had been received and that the claim is
due to an incident which occurred at the Mindiola Ballroom in Hunt-
ington Park on February 11, 1983.
The City Administrator/City Clerk recommended that the claim
submitted by Dirnfield & ZeIner, on behalf of their client Mary
Louise Felton be denied, and referred to our liability administrator.
It was moved by McCormick, seconded by Davis, that the claim
submitted by Dirnfield & ZeIner, on behalf of their client Mary
Louise Felton be denied and referred to our liability administrator.
Motion carried.
There being no further business to come before the City
Council, it was moved by McCormick, seconded by Ybarra, that the
meeting be adjourned. Motion carried.
