19831018 Regular City Council Meeting - Minutes 910 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL, HELD OCTOBER 18, 1983, AT 2:00 P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA ~mMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick, Davis HEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. I It was moved by Ybarra, seconded by Davis, that the minutes of the Adjourned Regular City Council Meeting held October 6, 1983, be deferred until the next City Council Meeting on November 1, 1983. Notion carried. Police Department Activity Log for October 1-15, 1983, was presented. It was moved by McCormick, seconded by Davis, that the Police Department Activity Log for October 1-15, 1983, be received and filed. Motion carried. Health Department Report for the Honth of September, 1983, was presented. It was moved by Ybarra, seconded by Gonzales, that the Health Department Report for the month of September, 1983, be received and filed. Motion carried. Warrant Register No. 630 - covering claims and demands pre- sented during the period October 1, 1983 thru October 15, 1983, which includes Demand Nos. 11272 thru 11401 (both inclusive) ex- cluding Light & Power demands, drawn on the First Interstate Bank totaling $51,435.17 (accounting period October 1983), was examined and audited. It was moved by Davis, seconded by Gonzales, that Warrant Register No. 630 be approved and payment authorized for Demand Nos. 11272 thru 11401 (both inclusive) excluding Light & Power demands, drawn on First Interstate Bank totaling $51,435.17, with no exceptions. Motion carried. I Warrant Register No. 630 - covering claims and demands pre- sented during the period October 1-15, 1983, which includes Light and Power Demand Nos. 11273, 11281, 11282, 11283, 11296, 11327, 11378, 11379, 11396, 11397, 11398, 11399, 11400, and 11401, totaling $5,949,437.07 (accounting period October 1983), was examined and audited. It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 630 be approved and payment authorized for Demand Nos. 11273, 11281, 11282, 11283, 11296, 11327, 11378, 11379, 11396, 11397, 11398, 11399, 11400, and 11401, totaling $5,949,437.07, with no exceptions. Motion carried. Councilman Davis abstained. Communication from Victor Vaits, Director of Community Services, dated October 12, 1983, recommending authority and funds for Sayed Ade1 and Kevin Wilson to attend the Asphalt Institute Work- shop in Buena Park, California, November 15-17, 1983, with an expense allowance of $165.00 each, was presented. =2= October 18, 1983 It was moved by Davis, seconded by Gonzales, that the Director of Community Services recommendation be approved and authority be granted to issue warrants to Sayed Adel and Kevin Wilson in the mocrunts of $165.00 each to attend the Asphalt Institute Workshop in Buena Park, California, November 15-17, 1983, Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated October 12, 1983, recommending that a trailer permit extension be granted for Future Way, Inc. of 4395 Ayers Avenue to December 1, 1-983 contingent upon payment of the usual permit fees, was presented. I It was moved by Ybarra, seconded by Davis, that the recommen- dation of the City Administrator/City Clerk be approved and a trailer permit extension be granted for Future Way, Inc, of 4395 Ayers Avenue to December 1, 1983 contingent upon paymertt of the usual permit fees. Motion carried. Communication from Fire Chief George Bass, dated October 12, 1983, recommendingautharity_and funds for FrancisW. Sumner and himself to attend the Modern Technology of Automatic Sprinkler Systems in Anaheim, November 7, 1983 with an expense allowance of $65.00 each, was presented. It was moved by McCormick, seconded by Gonzales, that the recommendation of the Fire Chief be approved and authority be granted to issue warrants to Francis W. Sumner and George Bass in the amounts of $65.00 each to attend the Modern Technology of Automatic Sprinkler Systems in Anaheim, California, November 7, 1983. Motion carried. 911 Communication from Bruce V.Malkenhorst, City Administrator/ City Clerk, dated September 19, 1983, transmitting an executed Joint Powers Agreement from the Cities of Huntington Park and Bell regarding the City of Vernon's allocated shares of the 1980 Parklands Act and recommending that the City Council approve the Joint Powers Agreement with both cities (deferred from October 6, 1983 meeting), was presented. It was moved by McCormick, seconded by Ybarra, that the executed Joint Powers Agreement from the Cities. of Huntington. Park and Bell regarding the City of Vernonts allocated shares of the 1980 Parklands Act be deferred until the next City Council Meeting November 1, 1983. Motion carried. I Communication from Victor Vaits, Director of Community Services, dated October 13, 1983, advising that Contract No. 456, Traffic Signal Installation: Boyle Avenue & LeonisBlvd., Alcoa Avenue & Fruitland and Downey Road and Vernon Avenuenas oeen completed the total contract amount being $28,OOOrOO. A final partial payment of $25,200 is now due with the remaining ten percent of $2,800 due thirty-five days after acceptance, was presented. RESOLUTION NO 5052 - A Resolution of the City Council of the City of Vernon Accepting the Work of Traffic Signal Installation, Boyle Avenue & Leonis Blvd., Alcoa Avenue and F.ruitland, and. Downey Road and Vernon Avenue in accordance with Contract No. 456 of the City of Vernon, was presented. AYES: Malburg, Ybarra, Gonzales, .McCormick, Davis NOES: None Absent: None =3= October 18, 1983 I Communication from Victor Vaits, Director of Community Services, dated October 13, 1983, advising that Vernon Central Warehouse, Inc. has submitted Parcel Map No. 15667 for investi- gation and report in accordance with the Subdivision Map Act and transmitting as evidence a Report on Parcel Map No. 15667 and Excerpts from the Subdivision Map Act and also recommending that the proposed Parcel Map be approved as the evidence submitted supports a finding that it is consistent with the General Plan of the City of Vernon, was presented. It was moved by Gonzales, seconded by Davis, that the Report on Parcel Map No. 15667 and Excerpts from the Subdivision Map Act, submitted by Vernon Central Warehouse be received and filed as evidence and that the proposed Parcel Map No. 15667 be approved as the evidence submitted supports a finding that it is consistent with the General Plan of the City of Vernon. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated October 13, 1983, recommending that a variance from Table No. 5A of the 1979 Uniform Building Code be granted to Pacific Fabric Printers so they may construct a 10 foot property line opening between that location and the leased building at 3314 Fruitland Avenue contingent upon the following: 1. The opening be protected with a three (3) hour fire door. 2. If there is a change in occupancy or lease, both openings be closed. It was moved by Ybarra, seconded by McCormick, that the recommendation from the City Administrator/City Clerk be approved and that a variance be granted from Table 5A of the 1979 Uniform Building Code to Pacific Fabric Printers so they may construct a 10 foot property line opening between that location and the leased building at 3314 Fruitland Avenue contingent upon the above listed conditions. Motion carried. Communication from Captain L. Rosenkrantz, dated October 13, 1983, recommending authority and funds for James Mason to attend the International Association of Bomb Technicians and Investigat- ors 10th Annual Training Conference in Sacramento, November 8-11, 1983, with an expense allowance of $396.10, was presented. It was moved by Davis, seconded by Gonzales, that the recomm- endation of Captain L. Rosenkrantz be approved and authority be granted to issue a warrant in the amount of $396.10 to James Mason, to attend the International Association of Bomb Technicians and Investigators 10th Annual Training Conference in Sacramento. Motion carried. I Communication from Bruce V. Malkenhorst, Director of Finance, dated October 18, 1983, transmitting the minutes of the Finance Committee Meeting held October 17, 1983 for approval of recommend- ations contained therein, was presented. It was moved by McCormick, seconded by Ybarra, that the minutes of the Finance Committee Meeting held October 17, 1983, be approved as written and recommendations contained therein be adopted. Motion carried. Communication from Mr. Michael Rosales, Principal of Vernon Elementary School, dated October 4, 1983, requesting a contribution from the City of Vernon of 25 cases of soft drinks, ice cream and popcorn for approximately 200 people who will be in attendance at their annual Halloween Festival and program to be held on Monday, October 31, 1983, was presented. It was moved by Gonzales, seconded by Davis, that the request of Principal Rosales for a contribution of 25 cases of soft drinks, ice cream and popcorn be denied and that the City of Vernon donate 20 cases Of soft drinks to the Vernon Elementary School for their annual Halloween Festival and program to be held on Monday, October 31, 1983. Motion carried. 912 913 =4= 10/18/83 At this time, a discussion was held concerning the busing of Vernon Elementary School students residingin the City of Vernon, to another city and it was recommended by the Mayor that a Resolut- ion be adopted opposing the busing. RESOLUTION NO. 5054 - A Resolution of the City Council of the City of Vernon Opposing The Busing Of Vernon Elementary School Stud- ents,Who Are Residents Of The City Of Vernon,To Relieve Overcrowding, was presented. I It was moved by Davis, seconded by Ybarra, that Resolution' No. 5054 be approved and adopted. Motion carried. Malkenhorst, Director of Personnel, dated October 18, 1983, transmitting the minutes of the Personnel Committee Meeting held October 17, 1983, for approval of recommend- ations contained therein, was presented. It was moved by Gonzales, seconded by Davis, that the minutes of the Personnel Committee Meeting held October 17, 1983, be approved and recommendations contained therein be adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated October 18, 1983, transmitting a report from Lewis R. Adams on the Energy Cost Adjustment Billing Factor for the next three month period and recommending that the Energy Cost Adjustment Billing Factor for the next three month period be a minus 0.762C per kilowatt hour, effective November 1, 1983, was presented. RESOLUTION NO. 5053 - A Resolution of the City Council of the City of Vernon Changing The Energy Cost Adjustment Billing Factor Charged For Electrical Energy Distributed And Supplied To Its Elect- rical Consumers, was presented. It was moved by Gonzales, seconded by Ybarra, that the report from Lewis R. Adams on the Energy Cost Adjustment Billing Factor for the next three month period be received and filed and that Resolution No. 5053 be approved and adopted. Motion carried. Malkenhorst, City Administrator/ City Clerk, dated October 18, 1983, recommendlng that Acting Fire Captain Joe Stout be returned to the position of Fire Engineer, Grade I, with a monthly salary of $2,828.00, effective October 30, 1983, was presented. It was moved by Ybarra, seconded by Davis, that the recommend- ation of the City Administrator/City Clerk be approved and that Acting Fire Captain Joe Stout be returned to the position of Fire Engineer Grade I, with a monthly salary of $2,828.00, effective October 30, 1983. Motion carried. Lewis R. Adams made a verbal report on noise problems at the diesel generating plant and advised the City Council that the cost per unit, (2per engine, 5 engines, total 10) for fabrication of muffler for diesel engines as recommended by Everett and Associates, Consulting Engineer for diesel engine rebuilding, would be $11,300. =5= 10/18/83 It was moved by McCormick, seconded by Gonzales, that it was in the best interest of the City that the formal contract procedures be waived and that the Purchasing Agent be authorized to expend a sum not to exceed $11,300 per unit for fabrication of muffler for diesel engines as recommended by Everett and Associates, Consulting Engineer for diesel engine rebuilding. Motion carried. I At 3:25 P.M., Mayor Malburg declared a recess. At 4:15 P.M., the City Council reconvened in regular session, all members present before the recess, again being present. At 4:21 P.M., it was moved by Gonzales, seconded by Davis, that the City Council go into executive session under Attorney/ Client privilege. Motion carried. All persons with the exception of the City Administrator/ City Clerk and the Assistant City Attorney were excluded from the executive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 4:25 P.M., it was moved by Ybarra, seconded by McCormick, that the City Council go out of executive session and resume regular session. Motion carried. The City Administrator/City Clerk reported that a claim had been received from the law firm of Quimby and Kohrs in behalf of the Los Angeles, Unified School District and its employee, Pamela Marie Walton. The claim for money and damages is in connection with an accident which occurred at State Street and Slauson Avenue, on January 5, 1983, due to the malfunctioning traffic signals and recommended that the claim be denied. It was. moved by Davis, seconded by McCormick, that the claim submitted by the law firm of Quimby and Kohrs in behalf of the Los Angeles Unified School District and its employee, Pamela Marie Walton be denied and that the claimant be notified by the City Clerk. Motion carried. Communication from Fire Chief George Bass, dated October 18, 1983, recommending authority and funds for the following to attend a one day Earthquake Seminar in the City of Commerce, Wednesday, November 2, 1983, with a total registration of $120.00: I Victor Vaits, Director of Community Services Louis Hauger, Director of Environmental Health George F. Bass, Fire Chief Lloyd Schultz, Administrative Battalion Chief Frank Claunch, Battalion Chief Police Department Representative It was moved by Ybarra, seconded by Gonzales, that the recommendation of the Fire Chief be approved and authority be granted to issue warrant in the amount of $120.00 to Southern California Emergency Service Association for the above listed employees to attend the one day Earthquake Seminar in the City of Commerce, November 2, 1983. Motion carried. At 4:35 P.M., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Section 54947 of the Government Code. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 5:15 P.M., it was moved by Ybarra, seconded by McCormick, that the City Council go out of executive session and resume re- gular session. Motion carried. I It was moved by Gonzales, seconded by Davis, that Bruce V. Malkenhorst, City Administrator/City Clerk receive a merit increase of 5~% and an increase in life insurance to equal the sum of $100, 000.00. Motion carried. RESOLUTION NO. 5056 - A Resolution of the City Council of the City of Vernon Amending Schedule VII, Exhibit "F", of Re- solution No. 5018 Fixing The Compensation Of Certain Employees Of The City Of Vernon, was presented. It was moved by Gonzales, seconded by Davis, that Resolution No. 5056 be approved and adopted. Motion carried.
