19831115 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL HELD NOVEMBER 15, 1983 AT 4:45 P.M., IN THE COm~CIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SA~TA FE AVENUE, VERJ.'\l"ON, CALIFORNIA I Malburg, Ybarra, Gonzales, McCormick, Davis MEMBERS PRESENT: MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. The City Clerk read the following bids for Contract No. 460, Traffic Signal Modifications, that had been opened by the Chief Deputy City Clerk at 2:00 p.m., earlier the same day. Signal Maintenance, Inc. S & W Electical Contractors, Inc. Raymor Electric Company C. T. & F. In c. Steiny & Company Inc. Grissom & Johnson Inc. $38,380 $41,579 $50,000 $43,580 $35,865 $39,237 It was moved by Gonzales, seconded by Ybarra, that the bids received for Traffic Signal Modifications in accordance with Contract No. 460 be referred to the Community Services Department for checking and report. Motion carried. The City Clerk read the following bid for Contract No. 461, Street Sweeping 1984-86, that had been opened by the Chief Deputy City Clerk at 2:00 p.m., earlier the same day. R.F. Dickson Co. Inc. $36,000 After a brief discussion, it was moved by McCormick, seconded by Davis, that the bid received for Street Sweeping 1984-86, in accordance with Contract No. 461 be awarded to R.F. Dickson Co. Inc., 12524 Clark Avenue, Downey, CA 90242, on the basis of their bid, in the amount of $36,000. Motion carried. I It was moved by Ybarra, seconded by Gonzales, that the minutes of the City Council Meeting held November 1, 1983, be approved as written and submitted. Motion carried. Communication from Police Chief L.A. Espinoza, dated November 7, 1983, recommending authority and- funds for Louis Rosenkrantz to attend the Manpower Needs Development Training Course, in Montclair, December 5-6, 1983, with an expense allowance of $90.00, was presented. It was moved by Davis, seconded by Gonzales, that the recommendation of the Police Chief be approved and authority be granted to issue a warrant in the amount of $90.00 to Louis Rosenkrantz to attend the Manpower Needs Development Training Course, in Montclair, December 5-6, 1983. Communications from Victor Vaits, Director of Community Services, dated November 3, 1983, reconnnending authority and funds for Richard Lucas to attend the seminar on Accessibility Regulations, in Burbank, on January 18, 1984, with an expense allowance of $48.00 was presented. Motion carried. I Police Department Activity Log for the period Nov- ember 1-14, 1983, was presented. It was moved by Davis, seconded by Ybarra, that the Police Department Activity Log for the period November 1-14, 1983 be received and filed. Motion carried. Payroll Warrant Register No. 324, coveriIl:g; claims and demands presented during the period September 18-0ctober 15, 1983 which includes Demand Nos. 3808-3828 (both inclusive) drawn on the Crocker National Bank totaling $638,886.75 was examined and audited. (Accounting period October 1983) It was moved by Ybarra, seconded by Gonzales, that Pay- roll Warrant Register No. 324 be approved and payment auth- orized for Demand Nos. 3808-3828 (both inclusive), in the amount of $638,886.75, (Accounting period October 1983), with no exceptions. Motion carried. Warrant Register No. 632, covering claims and demands presented during the period November 1-15, 1983, which includes Demand Nos. 11530-11719 (both inclusive) excluding Light & Power Demands, drawn on the First Interstate Bank, totaling $77,381.86, (Accounting period November 1983) was examined and audited. It was moved by Davis, seconded by Gonzales, that Warrant Register No. 632, be approved and payment authorized for Demand Nos. 11530-11719 (both inclusive), excluding Light and Power Demands, in the amount of $77,381.86, with no other exceptions. Motion carried. Warrant Register No. 632 covering claims and demands pre- sented during the period November 1-15,1983, which includes Light and Power Demand Nos. 11546, 11552, 11555, 11557, 11559, 11567, 11573, 11576, 11593, 11594, 11598, 11599, 11600, 11617, 11669, 11670, 11673, 11687, 11700, 11709 and 11719, totaling $5,234,078.44, (Accounting period November 1983) was examined and audited. I It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 632 be approved and payment authorized for Light and Power Demand Nos. 11546. 11552, 11555, 11557, 11559, 11567, 11573, 11576, 11593, 11594, 11598, 11599,11600, 11617, 11669, 11670, 11673, 11687, 11700, 11709 and 11719, in the amount of $5,234,078.44, with no exceptions. Motion carried. Councilman Davis abstained. Health Department Report for the month of October 1983, was presented. It was moved by Davis, seconded by Gonzales, that the Health Department Report for the month of October 1983, be received and filed. Malkenhorst, Director of Finance, dated November 10, 1983, transmitting the minutes of the adjourned regular Finance Committee Meeting, held November 7, 1983, for approval of recommendations contained therein, was presented. I It was moved by Davis, seconded by Ybarra, that the minutes of the adjourned regular Finance Committee Meeting, held November 7, 1983, be deferred until executive session, later the same day. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated November 10, 1983, advising that Flanagan Motor Express and Warehouse Company has requested an extension of their trailer permit and recommending that said permit be granted to December 31, 1983, with the usual permit fees, was presented. It was moved by Gonzales, seconded by Ybarra, that the re- commendation of the City Administrator/City Clerk be approved and that an extension of a trailer permit be granted to Flanagan Motor Express and Warehouse Company to December 31, 1983, with the usual permit fees and that the Director of Community Services ad- vise Flanagan Motor Express and Warehouse Company that this will be the last extension granted to them. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated November 10, 1983, requesting that authority be granted to advance funds against expenses for the following City Officials to attend the National League of Cities Conference, in New Orleans, La., November 25-29, 1983, as indicated below: Councilman William J. Davis Councilman Hilario Gonzales Bruce V. Malkenhorst, City Clerk David B. Brearley, City Attorney Councilman William M. McCormick Mayor Pro Tem Thomas A. Ybarra $800 $800 $800 $800 $548 $548 It was moved by Davis, seconded by Ybarra, that the request from the City Administrator/City Clerk be approved and that author- ity be granted to issue warrants to the City Officials to attend the National League of Cities Conference in New Orleans, La., as indicated above. McCormick and Mayor Pro Tem Thomas A. Ybarra at the National League of Cities Conference in New Orleans, La., November 25-29, 1983, was presented. It was moved by Gonzales, seconded by Davis, that the request of the City Administrator/City Clerk be approved and authority be granted to issue a warrant to the Sheraton New Orleans, in the amount of $1,320.00 to cover a hotel suite for Councilman William M. Ot'll) () .\-; .~. 924 =4= 11/15/83 RESOLUTION NO. 5061 - A Resolution of the City Council of the City of Vernon Amending Exhibits "A", "B", "E", And "F", Of Resolution No. 5051, Schedules A-8, A-7, D And PA-l, Respectively, Which Fixed Surcharge Rates To Be Charged For Electrical Energy Distributed And Supplied By Said City With- in Its Boundaries In Accordance With Ordinance No. 929, was presented. It was moved by McCormick, seconded by Ybarra, that Resolution No. 5061 be approved and adopted. Motion carried. I AYES: NOES: Absent: McCormick, Ybarra, Gonzales, Malburg, Davis None None ORDINANCE NO. 940 - An Ordinance of the City Council of the City of Vernon Providing That Rates To Be Charged For Electrical Energy Distributed And Supplied By Said City With- in Its Boundaries Shall Be Set By Resolution And Repealing All Ordinances Or Parts Of Ordinances In Conflict Therewith was read by title for a first reading. It was moved by Gonzales, seconded by McCormick, that Ordinance No. 940 receive and pass a first reading. Motion carried. AYES: NOES: Absent: Gonzales, McCormick, Malburg, Davis, Ybarra None None Communication from Bruce V. Malkenhorst, Director of Personnel, dated November 15, 1983, transmitting the minutes of the Personnel Committee Meeting, held November 14, 1983, for approval of recommendations contained therein, was pre- sented. It was moved by Gonzales, seconded by Davis, that the minutes of the Personnel Committee Meeting, held November 14, 1983 be approved as written and recommendations contained therein be adopted. Motion carried. At 6:09 P.M., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Government Code Section 54957. Motion carried. All persons with the exception of the City Administrator/ City Clerk, City Attorney and Police Chief were excluded from the executive session. I Mayor Malburg declared all communications to and from the executive session deemed private and confidental. At 6:25 P.M., it was moved by Gonzales, seconded by Davis, that the City Council go out of executive session and resume regular session. Motion carried. The Chief of Police was excused at this time. At 6:26 P.M., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Attorney/ Client privilege. Mayor Malburg declared all communications to and from the executive session deemed private and confidental. Councilman Davis was excused at 6:35 P.M. I At 6:55 P.M., it was moved by Ybarra, seconded by Gonzales, that the City Council go out of executive session and resume regular session. Motion carried. At 6:58 P.M., Councilman Davis resumed his seat on the council. The City Administrator/City Clerk reported that a claim had been received from the law offices of Robert I. Schwartz. in behalf of Daniel L. Broome for an accident that occurred on or about August 8, 1983, in the vicinity of the premises located at 2101 E. 51st St., and recommending that said claim be denied. It was moved by Ybarra, seconded by McCormick, that the claim received from the law offices of Robert I. Schwartz in behalf of Daniel L. Broome be denied. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated November 10, 1983, transmitting the minutes of the adjourned regular Finance Committee Meeting, held November 7, 1983, for approv- al of recommendations contained therein, was presented. It was moved by McCormick, seconded by Davis, that the minutes of the adjourned regular Finance Committee Meeting, held November 7, 1983 be approved as written and recommendations contained therein be adopted with the exception of the minute order on janitorial action.
