The meeting was called to order by Mayor Malburg.
It was moved by Gonzales, seconded by Davis, that the
minutes of the regular meeting, held December 6, 1983, be
approved as submitted. Motion carried.
ORDINANCE NO. 942 - An Ordinance Of The City Council Of The
City Of Vernon Amending The Code Of The City Of Vernon, California
1959 By Amending Sections 25.1, 25.2, 25.3, 25.5, 25.46, 25,48,
and 25.51, Of Said Code Establishing The Rates For The Sale Of
Water In Said City To Be Set By Resolution And Repealing All
Ordinances In Conflict Therewith, Specifically Ordinance No. 933,
was read by title for a second and final reading. Motion carried.
It was moved by McCormick, seconded by Ybarra, that Ordinance
NO. 942 receive and pass a second reading and be adopted.

RESOLUTION NO. 5066 - A Resolution Of The City Council Of The
City of Vernon Consenting To The Establishment Of A Portion Of Real
Property To Be Known As The Los Angeles Bike Path Located Within
The City Of Vernon As A Part Of The System Of Highways Of The
County Of Los Angeles And Relieving The City of Vernon From Any
And All Maintenance Responsibility And Liability For The Operation
And Maintenance Of The Facility, was presented.
It was moved by Ybarra, seconded by Davis, bhat Resolution
No. 5066 be approved and adopted. Motion carried.

Police Department Activity Log for the period December 1-
15, 1983, was presented.

It was moved by McCormick, seconded by Gonzales, that the
Police Department Activity Log for the period December 1-15, 1983,
be received and filed. Motion carried.
Health Department Report for the month of December 1983,
was presented.
It was moved by Ybarra, seconded by Gonz:ales, that the
Health Department Report for the month of December 1983, be
received and filed. Motion carried.
Communications from L. A. Espinoza, Chief of Police, dated
December 2, 1983, requesting funds to attend the 1984 Annual
California Police Chiefs Association Conference in San Diego,
February 1 to 4, 1984 with an expense allowance of $522.00, was
presentled.
It was moved by Ybarra, seconded by Gonzales, that the request
of Chief of Police be approved and authority be granted to issue
warrant to L. A. Espinoza, in the amount of $522.00, to attend the
1984 Annual California Police Chiefs Association Conference in San
Diego. Motion carried.

Communication from L. A. Espinoza, Chief of Police, dated
December 7, 1983, requesting authority and funds for Captain Louis
Rosenkrantz to attend the California Association of Polygraph
Examiners Training Seminar in Costa Mesa, February 25, 1984, with
an expense allowance for registration in the amount of $55.00,
was presented.
It was moved by Gonzales, seconded by Ybarra, that the request
of the Chief of Police be approved and authority be granted to
issue warrant to Louis Rosenkrantz in the amount of $55.00, to
attend the California Association of Polygraph Examiners Training
Seminar in Costa Mesa. Motion carried.

Warrant Register No. 634 - covering claims and demands present-
ed during the period December 1-16, 1983, which includes Demand Nos.
11871-12067 (both inclusive) excluding Light & Power Demands drawn
on the First Interstate Bank totaling $195,468.35 (accounting
period December 1983), was examined and audited.
It was moved by Davis, seconded by McCormick, that Warrant
Register No. 634 be approved and payment authorized for Demand Nos.
11871-12067 (both inclusive) excluding Light & Power Demands drawn
on the First Interstate Bank totaling $195,468.35, with no other
exceptions. Motion carried.
Warrant Register No. 634 - covering claims and demands present-
ed during the period December 1-16, 1983, which includes Light &
Power Demand Nos. 11913, 11923, 11927, 11976, 11991, 12009, 12011,
12034, 12036, 12050, 12051, 12066, and 12067, totaling $5,032,803.13,
(accounting period December 1983), was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that Warrant
Register No. 634 be approved and payment authorized for Light &
Power Demand Nos. 11913, 11923, 11927, 11976, 11991, 12009, 12011,
12034, 12036, 12050, 12051, 12066, and 12067, totaling $5,032,803.13,
(accounting period December 1983), with no exceptions. Motion
carried. Councilman Davis abstained.

Communications from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated December 15, 1983, transmitting for review the
Amendment to the In-Lieu Replenishment Agreement and advising that
due to recent changes in MWD Water Rates it is necessary to amend the
In-Lieu Replenishment Agreement. The City Administrator/City Clerk
advised that the amendment will be more of a benefit to us in that
the cost of water will be lower than that in the present agreement
and that it will relieve the City from returning the water in the
future. The City Administrator recommended approval of said amend-
ment and authority for the Mayor and City Clerk to execute same on
behalf of the City.
RESOLUTION NO. 5068 - A Resolution Of The City Council Of The
City of Vernon Approving The Execution Of An Amendment To The In-
Lieu Replenishment Agreement Among The City of Vernon, The Central
And West Basin Water Replenishment District and The Central Basin
Municipal Water District, was presented.
It was moved by McCormick, seconded by Ybarra, that Resolution
No. 5068 be approved and adopted, and that the Mayor and City Clerk
be authorized to execute said Agreement for and on behalf of the
City of Vernon. Motion carried.

RESOLUTION NO. 5070 - A Resolution Of The City Council Of
The City of Vernon, California Calling And Giving Notice Of The
Holding Of A General Municipal Election To Be Held In The City On
Tuesday, April 10, 1984 For The Election Of Certain Officers Of
The City As Required By The Provisions Of The Law Of The State Of
California Relating To General Law Cities, was presented.
It was moved by Ybarra, seconded by Gonzales, that Resolution
No. 5070 be approved and adopted. Motion carried.
RESOLUTION NO. 5071 - A Resolution Of The City Council Of
The City of Vernon, California Adopting Regulations For Candidates
For Elective Office, Pertaining To Materials Submitted To The
Electorates And The Cost Of The Candidates Statement For The General
Hunicipal Election To Be Held In The City On Tuesday, April 10, 1984,
was presented.
It was moved by McCormick, seconded by Davis, that Resolution
No. 5071 be approved and adopted. Motion carried.

RESOLUTION NO. 5072 - A Resolution Of The City Council Of The
City of Vernon Amending Section 2 Of Resolution No. 4956 And Establish-
ing The Business License Fees For Mini Storage Warehouses Pursuant
To Section 15.34 Of The Code Of The City of Vernon, California 1959,
was presented.
It was moved by Ybarra, seconded by Davis, that Resolution No.
5072 be approved and adopted. Motion carried.

The City Administrator/City Clerk indicated that Mr. Hauger, Health Officer,
had reccmrended additional changes and IIDdifications in Ordinance No. 944 and
recCIIlllEIlded that Ordinance No. 944 be given a First Reading as an urgency ordinance.
ORDINANCE NO. 944 - An Ordinance Of The City Council Of The
City of Vernon Amending The Code Of The City of Vernon, California
1959 By Adding An Article III, Sections 13.27 Through 13.47 To
Chapter 13 Providing For The Establishment Of Regulations Governing
The Underground Storage Of Hazardous Substances And Accepting Ex-
clusive Jurisdiction Pursuant To Section 25150.1 And Chapter 6.7
(Co~ncing With Section 25280) Of Division 20 Of The Health And
Safety Code And Repealing All Ordinances Or Parts Of Ordinances In
Conflict Therewith, was presented as an urgency ordinance.
It was moved by Davis, seconded by Ybarra, that Ordinapce No.
944 be approved and adopted as an urgency ordi:nance to be effective
immediately. Motion carried.

RESOLUTION NO. 5073 - A Resolution Of The City Council Of The
City of Vernon Establishing Permit Fees Applicable To All Permits
Granted By The City of Vernon Pursuant To Section 13.31 Of The
Code Of The City of Vernon, California 1959 Relating To The Under-
ground Storage Of Hazardous Substances, was presented.
It was moved by McCormick, seconded by Gonzales, that Resolution
No. 5073 be approved and adopted. Motion carried.
RESOLUTION NO. 5074 - A Resolution Of The City Council Of The
City of Vernon Providing For The Recognition Of Certain Signatures
And Facsimile Signatures On Warrants Issued By The City of Vernon
For Payroll Purposes Or To Withdraw Funds Deposited By The City of
Vernon In Any Bank Account And To Enter Any Safety Deposit Box Held
In The Name Of The City of Vernon, was presented. -
It was moved by Ybarra, seconded by Gonzales, that Resolution
No. 5074 be approved and adopted. Motion carried.

ORDINANCE NO. 945 - An Ordinance Of The City Council Of The
City of Vernon Amending The Code Of The City of Vernon, California
1959 By Adding Sections 17.6-1 And 17.6-2 To Said Code Prohibiting
Possession Of An Open Alcoholic. Beverage Container In A Liquor
Store Or On The Immediately-Adjacent Premises As Shall Be Posted
And Repealing Any Ordinance Or Parts Of Ordinances In Conflict
Therewith, was presented as an urgency ordinance.
It was moved by Ybarra, seconded by Davis, that Ordinance No.
945 be approved and adopted as an urgency ordinance to be effective
immediately. Motion carried.

dated December 20, 1983, transmitting the minutes of the Personnel
Committee Meeting held December 19, 1983, for approval of recommend-
ations contained therein, was presented.
It was moved by Gonzales, seconded by Davis, that the minutes
of the Personnel Committee Meeting held December 19, 1983 be approved
as written, and recommendations contained therein be adopted.

dated December 20, 1983, transmitting the minutes of the Finance
Committee Meeting held December 19, 1983, for approval of recommend-
ations contained therein, was presented.
It was moved by Ybarra, seconded by Davis, that the minutes of
the Finance Committee Meeting held December 19, 1983 be approved as
written, and recommendations contained therein be adopted. Motion
carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated December 10, 1983, advising that Agrashell, Inc.,
of 4560 E. 26th Street has requested an extension on their
present trailer permit to January 31, 1984 and recommending that
said extension be granted contingent upon payment of the usual
permit fees, was presented.

City of Vernon Amending The Code Of The City of Vernon, California
1959 By Amending Section 13 Of Appendix IV Of Said Code And Adding
A New Chapter l8A To Said Code For The Establishment Of Conditional
Use Permit Procedures For Public Storage Facilities And Repealing
Any Ordinance Or Parts Of Ordinances In Conflict Therewith, was
read by title for a first reading.
It was moved by Davis, seconded by Ybarra, that Ordinance No.
946 receive and pass a first reading. Motion carried.

At 4:20 p.m. Mayor Malburg declared that the Public Hearing
the purpose of determining new electrical rates to be charged
electrical energy distributed and supplied by the City of Vernon
opened and requested the City Attorney to explain the procedures
the Public Hearing.
The City Attorney explained the procedures for the Public
Hearing.
Mayor Malburg asked if there were any comments, questions or
testimony from the audience.
Mayor Malburg asked the City Attorney if he had any additional
comments.
The City Attorney submitted a letter and a report on Rate
Design from Baker G. Clay & Associates, Inc. and recommended that
the letter and report be received and filed as evidence.
At 4:35 p.m. Mayor Malburg declared the Public Hearing for
the purpose of determining New Electrical Rates to be charged for
electrical energy distributed and supplied by the City of Vernon
closed.
At 4:38 p.m. Mayor Malburg declared a recess.
At 5:10 the City Council reconvened in regular session, all
members present before the recess again being present.

It was moved by McCormick, seconded by Davis, that the Rate
Report on Rate Design and letter submitted by Baker G. Clay &
Associates, Inc. be accepted and approved as evidence and received
and filed by the City Clerk. Motion carried.
At 5:12 p.m., it was moved by McCormick, seconded by Ybarra,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/City
Clerk and City Attorney were excluded from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
At 5:40 p.m., it was moved by McCormick, seconded by Ybarra,
that the City~Council go out of executive session and resume regular
session. Motion carried.
The City Attorney reported that Mr. Kevin Lloyd was willing
to settle the City's Breach of Contract case for the sum of $3,000
and he recommended that the City accept the proposed settlement.
It was moved by Gonzales, seconded by Davis, that the City
Attorney's recommendation be approved and that the Breach of Contract
case against Kevin Lloyd be settled for a lump sum payment of

There being no further business to come before the City
Council, it was moved by Ybarra, seconded by McCormick, that the
meeting be adjourned. Motion carried.
