MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD JN~UARY 3, 1984

The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Davis, that the minutes of
the Adjourned Regular City Council Meeting held December 20, 1983,
be deferred until the next City Council Meeting on January 17, 1984.
Motion carried.
Payroll \varrant Register No. 326 - covering claims and demands
presented during the period November 13, 1983 - December 10, 1983,
which includes Demand Nos. 3852-3870 (both inclusive) drawn on the
Crocker National Bank totaling $642,602.26 (accounting period Jan-
uary 1984), was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that Payroll
Warrant Register. No. 326 be approved and payment authorized for
demands presented during the period November 13, 1983 - Dece~ber 10,
1983, which includes Demand Nos. 3852-3870 (both inclusive) drawn
on the Crocker National Bank totaling $642,602.26 (accounting period
January 1984), with no exceptions. Motion carried.
Warrant Register No. 635 - covering claims and demands presented
during the period December 17, 1983 - December 31, 1983, which in-
cludes Demand Nos. 12068-12162 (both inclusive) excluding Light &
Power demands drawn on the First Interstate Bank totaling $93,970.83
(accounting period January 1984), was examined and audited.
It was moved by McCormick, seconded by Davis, that Warrant
Register No. 635 be approved and payment authorized for Demand Nos.
12068-12162 (both inclusive) excluding Light & Power demands, drawn
on the First Interstate Bank totaling $93,970.83, with no other ex-
ceptions. Motion carried.
Warrant Register No. 635 - covering claims and demands presented
during the period December 17, - December 31, 1983, which includes
Light & Power Demand Nos. 12071, 12074, 12106, 12133, 12136, 12140,
12141, 12142, 12155, 12159, and 12162, totaling $368,221.68, (account-
ing period January 1984), was examined and audited.

It was moved by Ybarra, seconded by Gonzales, that Warrant
Register No. 635 be approved and payment authorized for Demand Nos.
l207l, 12074, 12106, 12133, 12136, 12140, 12141, 12142, 12155, 12159,
and 12162, totaling $368,221.68, with no other exceptions. Motion
carried. Councilman Davis abstained.
Communications from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated December 19, 1983, requesting authority and funds
to attend the League of California Cities Annual City Manager's
Meeting in San Diego, February 8-10, 1984, with an e}~ense allowence
of $574.50, was presented.
It was moved by Ybarra, seconded by Davis, that the recommend-
ation of City Administrator/City Clerk be approved and authority be
granted to issue vJarrant in the am:n!ntof$574.50 to Bruce V. Nalkenhorst
to attend the League of California Cities Annual City Manager's Meet-
ing in San Diego, February 8-10, 1984. Motion carried.
ORDINANCE NO. 946 - An Ordinance Of The City Council Of The
City of Vernon Amending The Code Of The City .of Vernon, California
1959 By Amending Section 13 Of Appendix IV If Said Code And Adding
A New Chapter l8A To Said Code For The Establishment Of Condllibional
Use Permit Procedures For Public Storage Facilities And Cogeneration
Facili ties And Repealing Any Ordinance Or Parts Of Ordinances In I) ....,

It was moved by McCormick, seconded by Ybarra, that Ordinance
No. 946 receive and pass a first reading. Motion carried.

ORDINANCE NO. 947 - An Ordinance Of The City Council Of The
City of Vernon Amending Ordinance No. 941 To Establish Said
Ordinance As An Urgency Ordinance Amending Section 20.12 Of The
Code Of The City of Vernon, California 1959 Imposing A Sales And
Use Tax To Be Administered By The State Board Of Equalization And
Repealing All Ordinances Or Parts Of Ordinances In Conflict There-
with, was read by title for a first and final reading.
It was moved by Gonzales, seconded by Davis, that Ordinance
No. 947 receive and pass a first and final reading and be adopted.
Motion carried.

RESOLUTION NO. 5075 - A Resolution Of The City Council Of The
City of Vernon Establishing The Rates For The Sale Of Water In The
City of Vernon In Accordance With Ordinance No. 942, was presented.
It was moved by Davis, seconded by McCormick, that Resolution
No. 5075 be approved and adopted. Motion carried.

RESOLUTION NO. 5076 - A Resolution Of The City Council Of The
City of Vernon Providing For The Establishment Of Electrical Rates
To Be Charged For Electrical Energy Distributed And Supplied By
Said City Within Its Boundries, was presented.
It was moved by Ybarra, seconded by Gonzales, that Resolution
No. 5076 be deferred until the next City Council Meeting, January
17, 1984. Motion carried.

Communication from Bruce V. Malkenhorst, Director of Personnel,
dated January 3, 1984, recommending that Ms. Patricia Lomeli be
hired as a Transcriber Typist Grade 7 with a monthly salary of
$1,193.00, effective January 3, 1984, was presented.
It was moved by McCormick, seconded by Gonzales, that the
recommendation of the Director of Personnel be approved and that
Ms. Patricia Lomeli be hired as a Transcriber Typist Grade 7 with
a monthly salary of $1,193.00, effective January 3, 1984. Motion
carried.
Communication from Bruce V. Malkenhorst, Director. of Personnel,
dated January 3, 1984, recommending that Mr. Robert Lee Parks be
hired as a Police Cadet, Grade VI with a monthly salary of
$1,021.00, effective January 3, 1984, was presented.
It was moved by Ybarra, seconded by Davis, that the recommend-
ation of the Director of Personnel be approved and that Mr. Robert
Lee Parks be hired as a Police Cadet, Grade VI with a monthly
salary of $1,021.00, effective January 3, 1984. Motion carried.
The Police Activity Log for the period December 15-31, 1983,
was presented.
It was moved by Ybarra, seconded by McCormick, that the Police
Department Activity Log for the period December 15-31, 1983, be
received and filed. Motion carried.

Communication from Bruce V. Malkenhorst, Director of Personnel,
dated January 3, 1984, recommending that the resignation of Mr.
Dwayne Hammond be accepted effective at the end of the business day
January 17, 1984, was presented.
It was moved by McCormick, seconded by Davis, that the recom-
mendation of the Director of Personnel be approved and that the
resignation of Mr.. Dwayne Hammond be accepted effective at the end
of the business day January 17, 1984. Motion carried.
Communication from Bruce V. Malkenhorst, Director of Personnel,
dated January 3, 1984, recommending that the resignation of Officer
Michael Marshall be accepted effective January 3, 1984, was presented.
It was moved by Ybarra, seconded by Davis, that the recommend-
ation of the Director of Personnel be approved and that the resig-
nation of Officer Michael Marshall be accepted effective January 3,
1984. Motion carried.

tion No. 5077 be approved and adopted. Motion carried.

RESOLUTION NO. 5078 - A Resolution Of The City Council Of The
City of Vernon Expressing Its Grief At The Passing Of Raymond Gonzales,
Son Of Leonard Gonzales, An Emp loyee Of The City of Vernon. 'was presented.
It/,was moved by Davis, seconded by Gonzales., that Resolution
No. 50781::>e approved and adopted. Motion carried.

At 5:30 P.M., Mayor Malburg declared a recess.
At 6:00 P.M., the City Council reconvened in regular session,
all members present before the recess, again being present.
At 6:03 P.M., it was moved by Gonzales, seconded by Ybarra,
that the City Council go into executive session under Attorney/Client
privilege. Motion carried.
All persons with the exception of the City Administrator/City
Clerk, City Attorney, and Lewis Adams were excluded from the executive
session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
Lewis Adams was excused from the executive session at 6:28 P.M.
Captain Rosenkrantz and Chief Espinoza were called into the
executive session at 6:32 P.M.
Captain Rosenkrantz and Chief Espinoza were excused from the
executive session at 6:55 P.M.
It was moved by McCormick, seconded by Ybarra, that the City
Council go out of exective session and resume regular session at
7: OSP .H. notion carried.
It was moved by Ybarra, seconded by Gonzales, that the timely
claim received from Shapiro & Finn, Attorneys at Law, on behalf of
their client, Robert J. Ferrer, be denied. Motion carried.

There being no further business to come before the Council,
it was moved by McCormick, seconded by Davis, that the meeting be
adjourned. Motion carried.
