MINUTES OF A REGULAR MEETING OF THE
CITY COUNCIL, HELD MARCH 6, 1984, AT
2:00 P.M., IN THE COUNCIL CHAMBER OF
THE CITY HALL, LOCATED AT 4305 SANTA
FE AVENUE, VERNON, CALIFORNIA

The meeting was called to order by Mayor Malburg.
It ~as moved by Ybarra, seconded by Davis, that the minutes
of the adjourned regular City Council Meeting held February 21,
1984 be approved as written and submitted. Motion carried.
At this time, Mayor Malburg presented a Service Pin Award
to Sergeant William Waxman for ten years of service to the
City of Vernon.
RESOLUTION NO. 5083 - A Resolution of the City Council of
the City of Vernon Commending Lawrence Jackson For His Many
Years of Service To The City Of Vernon, was presented.
It was moved by Gonzales, seconded by McCormick, that
Resolution No. 5083 be approved and adopted. Motion carried.

At 2:10 P.M., the Mayor declared a recess.
At 2:15 P.M., the City Council reconvened in regular
session, all members present before the recess, again being
present.
Police Department Activity Log for the period February
16-29, 1984 was presented.
It was moved by McCormick, seconded by Ybarra that the
Police Department Activity Log for the period February 16-29,
1984 be received and filed. Motion carried.

Payroll Warrant Register No. 328, covering claims and
demands presented during the period January 8 through February
4, 1984 which includes Demand Nos. 3885-3899 (both inclusive)
drawn on the Crocker National Bank, totaling $642,440.03,
(Accounting period February, 1984) was examined and audited.
It was moved by Davis, seconded by Gonzales, that Payroll
Warrant Register No. 328 be approved and payment authorized for
Demand Nos. 3885-3899 (both inclusive), in the amount of
$642,440.03, with no exceptions. Motion carried.
Warrant Register No. 639, covering claims and demands pre-
sented during the period February 16-29, 1984, which includes
Demand Nos. 00283-00393 (both inclusive), excluding void Demand
Nos. 00298-00307, (both inclusive) 00361 and Light and Power
Demands drawn on the First Interstate Bank, totaling $128,416.16,
(Accounting period March, 1984) was examined and audited.

It was moved by Ybarra, seconded by Davis, that Warrant
Register No. 639 be approved and payment authorized for Demand
Nos. 00283-00393 (both inclusive), excluding void Demand Nos.
00298-00307 (both inclusive), 00361, and Light and Power Demands,
in the amount of $128,416.16, with no other exceptions. Motion
carried.
Warrant Register No. 639, covering claims and demands pre-
sented during the period February 16-29, 1984 which includes
Light and Power Demand Nos. 00283, 00295, 00297, 00311, 00337,
00340, 00347, 00362, 00368,00372, 00373, 00382 and 00387,
totaling $226,416.16, (Accounting period March 1984), was
examined and audited.

It was moved by McCormick, seconded by Gonzales, that
Warrant Register No. 639, be approved and payment authorized
for Light and Power Demand Nos. 00283, 00295, 00297, 00311,
00337, 00340, 00347, 00362, 00368, 00372, 00373, 00382, and
00387, in the amount of $226,416.16 with no exceptions. Motion
carried. Councilman Davis abstained.
Communication from Bruce V. Malkenhorst, ~ity Administra-
tor/City Clerk, dated February 15, 1984, recommending that the
agreement for janitorial services with Maintenance Management
Company be terminated and. requesting that the City Administra-
tor/City Clerk be allowed to negotiate for janitorial services
for the balance of the 1983-1984 fiscal year, (Deferred from
February 21, 1984 Council meeting) was presented.
It was moved by Gonzales, seconded by Ybarra, that the
recommendation of the City Administrator/City Clerk be approved
and that the agreement for janitorial services with Maintenance
Management Company be terminated with release from their bond,
and that the City Administrator/City Clerk be allowed to nego-
tiate for janitorial services for the balance of the 1983-1984
fiscal year. Motion carried.
ORDINANCE NO. 948 - An Ordinance of the City Council of
the City of Vernon Amending The Code Of The City Of Vernon,
California 1959 By Adding Section 7.92 - To Said Code Regard-
ing The Establishment Of A Variance Fee And Repealing All
Ordinances Or Parts Of Ordinances In Conflict Therewith, was
read by title for a second and final reading.
It was moved by McCormick, seconded by Davis, that
Ordinance No. 948 receive and pass a second and final reading
and be adopted. Motion carried.

Communication from Bruce V. Malkenhorst, Director of Finance,
dated March 1, 1984, transmitting the minutes of the Finance Com-
mittee Meeting, held January 23, 1984, for approval of recommend-
ations contained therein, was presented.
It was moved by McCormick, seconded by Ybarra, that the
minutes of the Finance Committee Meeting held January 23, 1984
be approved as written and recommendations contained therein
be adopted with the exception of the item to approve the repair
of the surveilance cameras which, is to be deferred. Motion
carried.
Communication from Police Chief L. A. Espinoza, dated
February 14, 1984, recommending authority and funds for Sergeant
William Waxman to attend the California Homicide Investigators
Associations 15th Annual Training Seminar, in Oakland, March 7-9,
1984, with an expense allowance of $370.54, was presented.

It was moved by Davis, seconded by McCormick, that the
recommendation of the Police Chief be approved and authority
be granted to issue a warrant to William Waxman, in the
amount of $370.54 to attend the California Homicide Investi-
gators Associations 15th Annual Training Seminar in Oakland.
Motion carried.
Communication from MargaretM. Garcia, South El Monte
City Clerk, dated February 16, 1984, transmitting Resolution
No. 84-2614, endorsing the Court Reform Initiative adopted
by South El Monte, on February 9, 1984, and requesting an
endorsement from the City of Vernon, was presented.

It was moved by McCormick, seconded by Gonzales, that the
communication and resolution from the City Clerk of South El
Monte be received and filed. Motion carried.
Communication from Louis S. Hauger, Health Office, dated
February 28, 1984, recommending authority and funds for John
Reid to attend the 33rd Annual Educational Symposium of the
California Environmental Health Association, in San Diego,
April 11-13, 1984, with an expense allowance of $469.00, was
presented.
It was moved by Ybarra, seconded by Davis, that the
recommendation of the Health Officer be approved and authority
be granted to issue a warrant to John Reid, in the amount of
$469.00, to attend the 33rd Annual Educational Symposium of
the California Environmental Health Association, in San Diego.
Motion carried.
Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated March 1, 1984, advising that Kal Kan
Foods, Inc. has requested an extension of their present
trailer permit and recommending that said permit be granted
for their twelve (12) trailers for one year contingent upon
payment of the renewal permit fees, was presented.
It was moved by Gonzales, seconded by McCormick, that the
recommendation of the City Administrator/City Clerk be approved
and that an extension of Kal Kan Foods, Inc. 's present trailer
permit be granted for their twelve (12) trailers for one year
contingent upon payment of the renewal permit fee. Motion
carried.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated March 1, 1984, recommending authority
and funds for registration fees to the Independent Cities
Association's 24th Annual Seminar, in San Diego, May 2-6, 1984,
at a total cost of $1,750.00 for Mayor Leonis C. Malburg,
Mayor Pro-tern Thomas A. Ybarra, Councilman Hilario Gonzales,
Councilman William J. Davis, Councilman William M. McCormick,
City Administrator Bruce V. Malkenhorst, and City Attorney David
B. Brearley, was presented.
It was moved by Ybarra, seconded by Davis, that the recom-
mendation of the City Administrator/City Clerk be approved and
authority be granted to issue a warrant to the Independent
Cities Association, in the amount of $1,750.00, for registra-
tion fees, for the above City Officials to attend the Indepen-
dent Cities Association's 24th Annual Seminar, in San Diego.
Motion carried.
Communication from Victor Vaits, Director of Community
Services, dated March 1, 1984, recommending authority and funds
for Richard A. Lucas to attend the Uniform Building Codes and
State Codes Seminar in Costa Mesa, March 29-30, 1984, with an
expense allowance of $67.00 was presented.
It was moved by Davis, seconded by Gonzales, that the
recommendation of the Director of Community Services be approved
and authority be granted to issue a warrant to Richard A. Lucas,
in the amount of $67.00 to attend the Uniform Building Codes and
State Codes Seminar, in Costa Mesa. Motion carried.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated March 1, 1984, advising that the Vernon
Health Permit Fees, which have not been adjusted since April,
1982, have been reviewed and recommending that said Fees be
increased by approximately 5%, effective April 1, 1984, to
compensate for the increase in the Consumer Price Index, was
presented.
It was moved by McCormick, seconded by Ybarra, that the
recommendation of the City Administrator/City Clerk be
approved and that the communication be received and filed.

RESOLUTION NO. 5089 - A Resolution of the City Council of
the City of Vernon Establishing Health And Permit Fees Appli-
cable To All Permits Granted By The City of Vernon Pursuant To
Section 11.25 And Section 13.7 Of The Vernon City Code And
Repealing Resolution No. 4886, was presented.
It was moved by Gonzales, seconded by Davis, that
Resolution No. 5089 be approved and adopted. Motion carried.

Communication from Lewis R. Adams, Emergency Services Co-
ordinator, dated February 29, 1984, recommending authority and
funds for the following members of the Vernon Emergency Opera-
tions Organization to attend the Annual Emergency Preparedness
Seminar, April 4, 1984, at Industry Hills, with registration
fees at $15.00 per person, for a total.cost of $165.00, was

It was moved by Ybarra, seconded by Davis, that the recom-

attend the Annual Emergency Preparedness Seminar, at Industry
Hills. Motion carried.

Communication from Victor H. Vaits, Director of Community
Services, dated March 1, 1984, transmitting Contract No. 463,
Santa Fe Avenue (Pacific Boulevard to south boundary) and Soto
Street (Vernon Avenue to south boundary) resurfacing, specifi-
cations and construction plans and recommending that said
Contract be approved and authority be granted to advertise for
bids, was presented.
RESOLUTION NO. 5090 ... A Resolution of the City Council
of the City of Vernon Approving Contract No. 463 And Author-
izing Notice Inviting Sealed Proposals Or Bids For Santa Fe
Avenue (Pacific Boulevard To South Boundary) And Soto Street
(Vernon Avenue To South Boundary) Resurfacing, In Accordance
With Contract No. 463, Of The City Of Vernon, was presented.

Personnel Committee Meeting, held March 5, 1984, for approval

It was moved by McCormick, seconded by Gonzales, that the
minutes of the Personnel Committee Meeting, held March 5, 1984,
be approved as written and recommendations contained therein
be adopted. Motion carried.
Communication from Lewis R. Adams, Director of Water, dated
March 5, 1984, recommending authority and funds to attend the
California Nevada Section American Water Works Association
Spring Conference, in Monterey, April 12-13, 1984, with an ex-
pense allowance of $531. 00, was presented..
It was moved by Ybarra, seconded by Davis, that the recom-
mendation of the Director of Water be approved and authority be
granted to issue a warrant to Lewis R. Adams, in the amount of
$531.00, to attend the California Nevada Section American Water
Works Association Spring Conference, in Monterey. Motion
carried.
Communication from Lily Lee Chen, Mayor of the City of
Monterey Park, dated February 22, 1984, advising that the City
Council and residents who are concerned about the health and
safety in the spraying for the eradication of the Mexican fruit
fly, are taking legal action to end the program and urges the
City of Vernon to take similar action, was presented.
It was moved by McCormick, seconded by Ybarra, that the
communication from the Mayor of the City of Monterey Park be
received and filed. Motion carried.
At 3:00 P.M., Mayor Malburg declared that the Public Hear-
ing to consider an application for a conditional use permit to
construct and operate a mini-warehouse on a property located
at 4250 S. Alameda Street in the City of Vernon was open.

Mayor Malburg asked Victor Vaits, Director of Community
Services, if he had evidence to submit for the public hearing
to consider an application for a conditional use permit to
construct and operate a mini-warehouse on a property located
at 4250 S. Alameda Street and to briefly explain his recommen-
dations.
The Director of Community Services submitted a Declaration
of Posting, Notice of Public Hearing and copies of notification
letters sent to property owners affected by the outcome of the
hearing. Mr. Vaits recommended that the conditional use permit
for the proposed Alameda Street Self Storage facility be granted
with certain conditions which are listed in the recommendation
submitted as evidence.

or testimony from the audience.
Mayor Malburg asked the City Attorney if he had any
comments.
The city Attorney recommended that the evidence submitted
for the Public Hearing by the Director of Community Services
be received and filed and accepted as evidence.

Public Hearing to consider an application for a conditional
use permit to construct and operate a mini-warehouse on a

be closed. Motion carried.
It was moved by McCormick, seconded by Davis, that the
evidence submitted by Victor Vaits, Director of Community
Services be received and filed and accepted as evidence.
Motion carried.

recommendation of the Director of Community Services, be ap-
proved and that a conditional use permit to construct and
operate a mini-warehouse be granted with certain conditions

It was moved by McCormick, seconded by Davis, that the
recommendation of the Director of Community Services be

The City Attorney recommended that the evidence submitted
for the Public Hearing by the Director of Community Servicas
be received and filed and accepted as evidence.
It was moved by Gonzales, seconded by Davis, that the
Public Hearing to consider an application for a conditional
use permit to construct and operate a cogeneration facility on
Downey Road at 50th Street, be closed. Motion carried.
It was moved by McCormick, seconded. by Ybarra, that the

It was moved by McCormick, seconded by Ybarra, that the
recommendation of the Director of Community Services be approved
and that a conditional use permit to construct and operate a
cogeneration facility on Downey Road at 50th Street be granted
subject to the conditions outlined in the report submitted as
evidence and subject to the additional conditions that there
be constructed a cinderblock wall along the west side of the
property in order to abate the effects of noise pollution.
Motion carried.
Communication from Victor Vaits, Director of Community
Services, dated August 31, 1983, advising that Mr. Fred Stein,
Subdivider, submitted Parcel Map No. 15469 for investigation
and report in accordance with the Subdiviion Map Act and
transmitting as evidence a Report on Parcel Map No. 15469 and
Excerpts from the Subdivision Map Act and also recommending
that the proposed Parcel Map be approved as the evidence sub-
mitted supports a finding that it is consistent with the Gen-
eral Plan of the City of Vernon, was presented (Deferred from
September 6, 1983, City Council Meeting) .

It was moved by Gonzales, seconded by Davis, that the Re-
port on Parcel Map No. 15469 and Excerpts from the Subdivision
Map Act, submitted by Fred Stein be received and filed as evi-
dence and that the proposed Parcel Map No. 15469 be approved
as the evidence submitted supports a finding that it is con-
sistent with the General Plan of the City of Vernon. Motion
carried.
At 3:57 P.M., the Mayor declared a recess.
At 4:40 P.M., the City Council reconvened in regular ses-
sion, all members present before the recess, again being pre-
sent.

At this time, it was moved by Ybarra, seconded by McCormick,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, the City Attorney and Louis Hauger were excluded
from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
Louis Hauger was excused at 4:45 P.M.
At 4:55 P.M., it was moved by McCormick, seconded by Ybarra,
that the City Council go out of executive session and resume reg~
ular session. Motion carried.
It was moved by Ybarra, seconded by Gonzales, that the
Claim for Indemnification by the County of Los Angeles, in the
Mary Louise Fulton Case No. SEC. 43011, received February 21,
1984 be denied. Motion carried.
Communication from David B. Brearley, City Attorney, dated
February 28, 1984, advising the Council that on February 14,
1984, the City Administrator/City Clerk, sent a letter to Offi-
cer Robert James Crouch indicating that his letter of resignation,
dated February 3, 1984., would be rejected by the Council and
demanding that Officer Crouch either complete the term of his
employment agreement or pay the sum of $3,267.24 as reimburse-
ment for costs incurred in relation to his employment. The
City Attorney stated that he had been advised that Officer
Crouch has neither returned to work nor attempted to make res-
titution in response to the demand letter and recommends that
he be authorized to file a lawsuit in the municipal court against
Officer Crouch for the breach of his employment contract with
the City, was presented.

Communication from David B. Brearley, city Attorney, dated
February 29, 1984, advising the Council that on October 6, 1983,
the City Administrator/City Clerk, sent a letter to Officer
Patrick W. Long indicating that his letter or resignation, dated
September 24, 1983, was rejected by the City Council and demand-
ing that Officer Long either complete the term of his employment
agreement or pay the sum of $4,232.20 as reimbursement for costs
incurred in relation to his employment. The City Attorney stated
that he had been advised that Officer Long has neither returned
to work nor attempted to make restitution in response to the
demand letter and recommends that he be authorized to file a
lawsuit in the municipal court against Officer Long for the
breach of his employment contract with the City, was presented.

Communication from David B. Brearley, City Attorney,
dated February 29, 1984, advising the Council that on October
17, 1983, the City Administrator/City Clerk, sent a letter to
Officer Tony Wayne Perkins indicating that his letter of
resignation, dated October 8, 1983, would be rejected by the
Council and demanding that Officer Perkins either complete
the term of his employment agreement or pay the sum of
$6,136.75, as reimbursement for costs incurred in relation
to his employment. The City Attorney stated that he had been
advised that Officer Perkins has neither returned to work nor
attempted to make restitution in response to the demand letter
and recommends that he be authorized to file a lawsuit in the
municipal court against Officer Perkins for the breach of his
employment contract with the City, was presented.

It was moved by Davis, seconded by Gonzales, that the City
Attorney be authorized to file lawsuits in the municipal court
against Officer Perkins, Office.r Long, and Officer Crouch for
the breach of their employment contracts with the City.
Motion carried.
The City Attorney notified the City Council that he had
received notice of a filing from the Southern California Edison
Company in the Federal Energy Regulatory Commission dated
February 14, 1984, identified as FERC Docket No. ER84-241-000,
which indicated that Edison has filed a petition with the Com-
mission requesting the Commission to wa.ive any regulation,
including the regulation pertaining to fuel adjustment clauses,
that would permit Edison to treat October 9, 1983, as the ef-
fective in-service date for wholesale ratemaking treatment of
San Onofre Nuclear Generating Station, Unit No.2. The City
Attorney further indicated that the Federal Energy Regulatory
Commission provided that all petitions should be filed on or
before February 29, 1984. He therefore requested that the
City Council ratify his filing of a petition to intervene in
said matter.
It was moved by McCormick, seconded by Ybarra, that the
City Attorney's actions in filing the petition to intervene in
FERC Docket No. ER84-241-000 is hereby approved and ratified.
Motion carried. Councilman Davis abstained.
There being no further business to come before the City
Council, it was moved by McCormick, seconded by Davis, that
the meeting be adjourned. Motion carried.
