MINUTES OF AN ADJOURNED REGULAR
MEETING OF THE CITY COUNCIL, HELD
MAY 1, 1984, AT 5:00 O'CLOCK
P.M., IN THE COUNCIL CHAMBER OF THE
CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales, McCormick
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.

It was moved by McCormick, seconded by Ybarra, that the
minutes of the adjourned regular City Council Meeting held
April 17, 1984 be approved as written and submitted. Motion
carried.
At this time, the Mayor presented a Service pin Award
to Lois Hilton for 15 years service to the City of Vernon.
At 5:08 p.m., the Mayor declared a recess.
At 5:11 p.m., the council reconvened in regular session,
all members present before the recess, again being present.
Police Department Activity Log for the period April 16-30,
1984, was presented.
It was moved by McCormick, seconded by Gonzales, that the
Police Department Activity Log for the period April 16-30,
1984, be received and filed. Motion carried.
Payroll Warrant Register No. 330 covering claims and demands
presented during the period March 18-April 14, 1984, which
includes Demand Nos. 3922-3939 (both inclusive) drawn on the
Crocker National Bank totaling $666,384.72, (accounting period
April 1984), was examined and audited.
It was moved by Davis, seconded by Ybarra, that Payroll
Warrant Register No. 330 be approved and payment authorized for
Demand Nos. 3922-39939 (both inclusive) in the amount of
$666,384.72, with no exceptions. Motion carried.
Warrant Register No. 643, covering claims and demands pre-
sented during the period of April 16-30, 1984, which includes
Demand Nos. 885-992 (both inclusive) excluding void Demand Nos.
905-909 (both inclusive) and Light and Power Demands, drawn on
the First Interstate Bank, totaling $267,848.55, (accounting
period May 1984), was examined and audited.

It was moved by Gonzales, seconded by McCormick, that
Warrant Register No. 643 be approved and payment authorized for
Demand Nos. 885-992 (both inclusive) excluding void Demand Nos.
905-909 (both inclusive) and Light and Power Demands, in the
amount of $267,848.55, with no other exceptions. Motion carried.
Warrant Register No. 643, covering claims anddemiiindspre-
sented during the period of April 16-30, 1984, which includes
Light and Power Demand Nos. 885, 902, 904, 910, 913, 916, 922,
936, 937, 942, 957, 971, 985 and 989, totaling $351,866.38
(accounting period May 1984), was examined and audited.
It was moved by Ybarra, seconded by McCormick, that Warrant
Register No. 643, be approved and payment authorized for Light
and Power Demand Nos. 885, 902, 904, 910, 913, 916, 922, 936, 937,
942, 957, 971, 985 and 989, in the amount of $351,866.38, with no
exceptions. Motion carried. Councilman Davis abstained.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated April 17, 1984, requesting authority and funds
for the following fire captains to attend a seminar on Fire
Management on May 14 and 15, 1984, at a total cost of $350.00
to cover registration fees.

It was moved by McCormick, seconded by Ybarra, that the
recommendation of the City Administrator/City Clerk be approved
and that authority be granted to issue a warrant to Paul H.
Stein, the Fire Management Seminar Instructor, in the amount of
$350.00 for registration fees for the above listed fire captains
to attend the seminar in Santa Monica. Motion carried.
Communication from George Voig;1::, Executive Director of
the California Contract Cities Association, dated April 19,
1984, requesting the designation of a voting delegate and an
alternate, who must be members of the City Council, to represent
the City and the notification of same to Contract Cities, was
presented.
It was moved by Ybarra, seconded by Davis, that William M.
McCormick be appointed voting delegate and Hilario Gonzales be
appointed as an alternate to represent the City on the Board of
Directors of the California Contract Cities Association. Motion
carried.
Communication from Victor Vaits, Director of Community
Services, dated April 25, 1984, transmitting Contract 465, Pave-
ment Striping 1984-85, for consideration and recommending that
said contract be approved and authority granted to advertise for
bids, was presented.

It was moved by ybarra, seconded by Gonzales that the
communication and Contract No. 465 be received and filed.
RESOLUTION NO. 5101 .... A Resolution of the City Council of
the City of Vernon Approving Contract No. 465 and Authorizing
Notice Inviting Sealed Proposals or Bids for Pavement Striping
1984-85, In Accordance With Contract Now 465 of the City of
Vernon, was presented.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 5101 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, Director of
Personnel, dated May 1, 1984, transmitting the minutes of
the Personnel Committee Meeting held April 30, 1984, for
approval of recommendations contained therein, was presented.
It was moved by Gonzales, seconded by Davis, that the
minutes of the Personnel Conunittee Meeting held April 30, 1984,
be approved as written and recommendations contained therein be
adopted. Motion carried.

At 5:35 P.M., it was moved by Ybarra, seconded by McCormick,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, City Attorney and Louis Hauger were excluded from
the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.

At 6:05 P. M. , Louis Hauger was excused.
At 6:42 P. M. , Councilman Davis was excused.
At 7:05 P.M. , Councilman Davis resumed his seat on the council.
At 7:22 P.M., it was moved by Ybarra, seconded by McCormick,
that the City Council go out of executive session and resume
regular session. Motion carried.
Communication from Bruce V.Malkenhorst, City Administrator/
City Clerk, dated April 30, 1984, advising that a timely claim
has been received from Moton Holt, Esquire on behalf of William
E. Gibeau for personal injury, and recommending that said claim
be denied, was presented.
It was moved by McCormick, seconded by Davis, that the claim
received from Moton Holt, Esquire on behalf of William E. Gibeau
be denied. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated April 30, 1973, advising that a timely claim
has been received from Lee G. Lipscomb, Esquire on behalf of
Essie B. and Wilbert Childs for 'personal injuries, and recommending
that said claim be denied, was presented.
It was moved by Gonzales, seconded by Ybarra, that the claim
received from Lee G. Lipscomb, Esquire on behalf of Essie B. and
Wilbert Childs be denied. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated April 30, 1984, advising that a timely claim
has been received from Michael S. Kotzker, Esquire on behalf of
Albertine Alma Johnson for personal injuries, and recommending
that said claim be denied, was presented.
It was moved by Ybarra, seconded by McCormick, that the claim
received from Michael S. Kotzker, Esquire on behalf of Albertine
Alma Johnson be denied. Motion carried.

The City Attorney presented proposed Stipulations with
Request for Award and Award in regard to the Workers' Com-
pensation Appeals Board case of Joseph Blaut v. City of Vernon,
Case No. 79 VN 88538, et. al. and recommended to the City
Council that said Stipulations be approved with a permanent
disability rating of 56~~.
It was moved by McCormick, seconded by Gonzales, that the
proposed Stipulations with Request for Award and Award in the
case of Joseph Blaut v. City of Vernon, Case No. 79 VN 88538,
et. al., with a permanent disability rating of 56~% be approved
and the City Attorney be authorized to execute said Stipulations
with Request for Award and Award on behalf of the City of Vernon.
Motion carried.

The City Attorney indicated to the City Council that the
Cities of Colton and Riverside had filed an appeal of the de-
cision issued by the Federal Energy Regulatory Commission in
FERC Uocket No. ER79-150-000. He recommended that the City
Council authorize the City Attorney to file a Motion For Leave
to Intervene pursuant to Rule 15 (d) of the Federal Rules of
Appellate Procedure in said appeal filed in the United states
Court of Appeal for the Ninth Circuit in Case No. 84-7220.

It was moved by Gonzales, seconded by McCormick, that the
City Attorney's recommendation be approved, and that he be
authorized to file a Motion For Leave to Intervene in said pro-
ceeding. Motion carried. Councilman Davis abstained.
There being no further business to come before the City
Council, it was moved by McCormick, seconded by Ybarra, that
the meeting be adjourned. Motion carried.
