19840703 Regular City Council Meeting - Minutes MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL, HELD JULY 3, 1984, AT 5:00 P.M., IN THE COUNCIL CHAMBER OF THE CITY HALL, LOCATED AT 4305 SANTA FE AVENUE, VERNON,. CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales, McCormick MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. I It was moved by Ybarra, seconded by McCormick, that the minutes of the adjourned City Council Meeting held June 28, 1984, be deferred to 7/17/84. Motion carried. At this time, the Mayor presented Service pin Awards to the following employees: Murry Wooten Charla Duncan 25 Years 5 Years Chief Espinoza accepted the service pin award for Murry Wooten. RESOLUTION NO. 5123 -- A Resolution Of The City Council Of The City Of Vernon Commending Frederick B. Helmer For His Many Years Of Service To The City Of Vernon, was presented. It was moved by Ybarra, seconded by Gonzales, that Res- olution No. 5123 be approved and adopted. Motion carried. AYES: NOES: Absent: Ybarra, Gonzales, Malburg, Davis, McCormick None None At 5:05 p.m., the Mayor declared a recess. At 5:10 p.m., the council reconvened in regular session all members present before the recess, again being present. Police Department Activity Log for the period June 16-30, 1984, was presented. It was moved by Davis, seconded by Gonzales, that the Police Department Activity Log for the period June 16-30, 1984, be received and filed. Motion carried. I Communication from Mr. Douglas R. Miller, President of Three Valleys Municipal Water District, dated June 5, 1984, requesting the City of Vernon's assistance and support through their Metropolitan Water District Representative to hold down excessive spending at the Metropolitan Water District (deferred from June 19, 1984 City Council Meeting), was presented. It was moved by McCormick, seconded by Ybarra, that the communication from Mr. Douglas R. Miller, President of Three Valleys Municipal Water District, dated June 5, 1984, requesting the City of Vernon's assistance and support through their Metro- politan Water District Representative to hold down excessive spending at the Metropolitan Water District be received and filed. Motion carried. 1. 819 =2= 7/03/84 Payroll Warrant Register No. 332 covering claims and demands presented during the period May l3-June 9, 1984, which includes Demand Nos. 3956-3973 (both inclusive) drawn on the Crocker National Bank totaling $595,249.12 (accounting period June 1984), was examined and audited. It was moved by Davis, seconded by Gonzales, that Payroll Warrant Register No. 332 be approved and payment authorized for Demand Nos. 3956-3973 (both inclusive), in the amount of $595,249.12, with no exceptions. Motion carried. I Warrant Register NQ. 647 covering claims and demands pre- sented during the period of June l6-30, 1984, which includes Demand Nos. 1440-1557 (both inclusive) excluding Void Demand Nos. 1445, 1453, 1457 to 1462 and 1557, and Light and Power Demands dra.wn on the First Interstate Bank totaling $135,839.05, (accounting period June in July 1984), was examined and audited. It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 647 be approved and payment authorized for Demand Nos. 1440~1557 (both inclusive), excluding Void Demand Nos. 1445, 1453, 1457 to 1462 and 1557, and Light and Power Demands, in the amount of $135,839.05, with no other exceptions. Motion carried. Warrant Register No. 647, covering claims and demands pre- sented during the period of June 16-30, 1984, which includes Light & Power Demand Nos. 1441-1444 (both inclusive), 1454, 1463, 1465,1476, 1484, 1491, 1495, 1502, 1505, 1506, 1515, 1519, 1524, 1535, 1537 and 1556, totaling $433,299.32 (account- ing period June in July 1984), was examined and audited. It was moved by Gonzales, seconded by Ybarra, that Warrant Register No. 647, be approved and payment authorized for Light & Power Demand Nos. 1441-1444 (both inclusive), 1454, 1463, 1465, 1476, 1484, 1491, 1495, 1502, 1505, 1506, 1515, 1519, 1524, 1535, 1537 and 1556, in the amount of $433,299.32, with no exceptions. Motion carried. Councilman Davis abstained. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated June 28, 1984, advising that the Chiropractic, Health Education and Research Foundation has submitted a request, dated June 11, 1984, for permission to place canisters similar to those of the March of Dimes, etc., at business locations throughout the city. Mr. Malkenhorst also advised that this does not require a business license, was presented. I .It was moved by Davis, seconded by Ybarra, that the com- munication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated June 28, 1984, advising that the Chiropractic, Health Education and Research Foundation has submitted a re- quest, dated June 11, 1984, for permission to place canisters similar to those of the March of Dimes, etc., at business locations throughout the city be? referred to the Police Department. Communication from Don Benninghoven, Executive Director of the League of California Cities, dated June 13, 1984, re- questing the City to designate a voting representative and an alternate for the League Annual Conference Business Session, was presented. . It was moved by McCormick, seconded by Davis, that the Mayor be the designated voting representative and the Mayor Pro Tern be appointed as an alternate for the League of California Cities. Motion carried. l020 =3= 7/03/84 Communication from Bruce V. Malkenhorst, City Adminis- trator/City Clerk, dated June 27, 1984, advising that Harshaw/ Filtrol Partnership has submitted a request for permission to install and maintain three pipes under 26th street, 506 feet west of the first angle point west of Downey Road and recom- mending that the Encroachment License Agreement be approved, was presented. It was. moved by McCormick, seconded by Davis, that the recommendation of the city Administrator/City Clerk be approved and that Harshaw/Filtrol Partnership be granted permission to install and maintain three pipes under 26th street, 506 feet west of the first angle point west of Downey Road and an Encroachment License Agreement be granted. Motion carried. I Summons dated June 18, 1984, from Arnold I. Weber, William E. Saul, Claude F. Kohm, attorneys for plantiff Southern Pacific Pipe Lines, Inc. (received in the City Clerk's office July 2, 1984,) v. Board of Equalization of the State of California (Los Ange.les County, City of Vernon) in the Superior Court of the State of California for the county of Los Angeles, Case No. 0502533 - Complaint For Re- fund of Property Tax for Fiscal Years 7/1/79 through 6/30/80, 7/1/80 through 6/30/81, 7/1/81 through 6/30/82, and 7/1/82 through 6/30/83, was presented. It was moved by McCormick, seconded by Ybarra, that the Summons dated June 18, 1984, from Arnold I. Weber, William E. Saul, Claude F. Kohm, attorneys for plantiff Southern Pacific Pipe Lines, Inc. v. Board of Equalization of the State of California (Los Angeles County, City of Vernon) in the Superior Court of the State of California for the County of Los Angeles, Case No. 0502533 - Complaint For Refund of Property Tax be referred to County Counsel of Los Angeles County. Motion carried. Communication from Bruce V. Malkenhorst, Director of Personnel, dated July 3, 1984, transmitting the minutes of the Personnel Committee Meeting held July 2, 1984, for ap- proval of recommendations contained therein, was presented. It was moved by Gonzales, seconded by Davis, that the minutes of the Personnel Committee Meeting held July 2, 1984, be approved as written and recommendations contained therein be adopted. Motion carried. I The City Attorney presented to the City Council two Transmission Service Agreements between Sunlaw Cogeneration partners I and the City of Vernon for cogeneration facilities located in the City of Vernon. He further indicated that the city Council had previously approved the granting of condi- tional use permits for said facilities and he recommended that the Transmission Service Agreements be approved. RESOLUTION NO. 5124 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of A Transmission Service Agreement By And Between Sunlaw Co- generation Partners I And The City Of Vernon For Cogeneration Facility Located At Downey Road At 50th Street, was presented. It was moved by Gonzales, seconded by Ybarra, that Res- olution No. 5124 be approved and adopted. Motion carried. AYES: NOES: Absent: Gonzales, Ybarra, Malburg, Davis, McCormick None None 1fl21 =4= 7/03/84 RESOLUTION NO. 5125 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of A Transmission Service Agreement By And Between Sunlaw cogeneration Partners I And The City Of Vernon For Cogeneration Facility Located At The Southwest Corner Of Vernon And Alcoa Avenues, was presented. It was moved by Gonzales, seconded by Davis, that Res- olution No. 5125 be approved and adopted. Motion carried. AYES: NOES: Absent: Gonzales, Davis, Malburg, McCormick, Ybarra None None I At 6:14 P.M., it was moved by Gonzales, seconded by McCormick, that the City Council go into executive session under Government Code Section 54957. Motion carried. All persons with the exception of the City Administrator/ City Clerk and the City Attorney were excluded from the execu- tive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 6:18 P.M., it was moved by MCCormick, seconded by Ybarra, that the City Council go out of executive session and resume regular session. Motion carried.
