VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Davis,Gonza1es, McCormick, Ybarra MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. I It was moved by Davis, seconded by Ybarra, that the min- utes of the adjourned regular City Council Meeting held July 17, 1984, be approved as written and submitted. Motion carried. It was moved by Gonzales, seconded by Davis, that the min- utes of the adjourned City Council Meeting held June 28, 1984, (deferred from the July 3, .adjourned regular City Council) be deferred. Motion carried. At this time, the Mayor presented Service pin Awards to the following employees: At 5:05 p.m., the Mayor declared a recess. At 5:10 p.m., the council reconvened in regular session all members present before the recess, again being present. Police Department Activity Log for the period July 16-31, 1984, was presented. It was moved by McCormick, seconded by Ybarra, that the police Department Activity Log for the period July 16-31, 1984, be received and filed. Warrant Register No. 650, covering claims and demands pre- sented during the period of July 16-31, 1984, which includes Demand Nos. 1719-1844 (both inclusive), excluding void Demand Nos. 1731-1734 (both inclusive), 1795 and 1844, and Light and Power Demands, drawn on the First Interstate Bank, totaling $118,117.84, (accounting period August 1984) was examined and audited. I It was moved by Gonzales, seconded by Davis,that Warrant Register No. 650 be app~oved and payment authorized for Demand Nos. 1719-1844 (both inclusive), excluding void Demand Nos. 1731-1734 (both inclusive), 1795 and 1844 and Light and Power Demands, in the amount of $118,117.84, with no other exceptions. Motion carried. Warrant Register No. 650, covering claims and demands pre- sented during the period of July 16-31, 1984, which includes Light and Power Demand Nos. 1722, 1725, 1728-1730 (both inclusive), 1743, 1745, 1754, 1756, 1757,1761~ 1763, 1768, 1776, 1777, 1784, 1787, 1796, 1798, 1801, 1815, 1818, 1821-1823 (both inclusive), 1832, 1834, 1835 and 1839, totaling $797,172.52 (accounting period August 1984), was examined and audited. 1030 =2= 8-07-84 It was moved by Ybarra, seconded by Gonzales, that War- rant Register No. 650, be approved and payment authorized for Light and Power Demand Nos. 1722, 1725, 1728-1730 (both inclu- s i ve), 1743, 1745, 1754, 1756, 1757, 1761, 1763, 1768, 1776, 1777, 1784, 1787, 1796, 1798, 1801, 1815, 1818, 1821-1823 (both inclusive), 1832, 1834, 1835 and 1839, in the amount of $797,172.52, with no exceptions. Motion carried. Councilman Davis abstained. Payroll Warrant Register No. 333, covering claims and de- mands presented during the period June 10-23, 1984, which in- cludes Demand Nos. 3974-3981 (both inclusive), drawn on the Crocker National Bank totaling $306,664.15, (accounting period June paid in July 1984) was examined and audited. I It was moved by Davis, seconded by McCormick, that Payroll Warrant Register No. 333, be approved and payment authorized for Demand Nos. 3974-3981 (both inclusive), in the amount of $306,664.15, with no exceptions. Motion carried. Payroll Warrant Register No. 334, covering claims and de- mands presented during the period June 24-July 7, 1984, which includes Demand Nos. 3982-3990 (both inclusive), drawn on the Crocker National Bank totaling $305,652.31, (accounting period July 1984), was examined and audited. It was moved by Gonzales, seconded by Ybarra, that Payroll Warrant Register No. 334, be approved and payment authorized for Demand Nos. 3982-3990 (both inclusive), in the amount of $305,652.31, with no exceptions. Motion carried. communication from Mr. Dale Aaronson of Gray Jug Liquor store, dated July 30, 1984, submitting his opinions on the Mobile Check Cashing Services who wish to do business in the city, was presented. It was moved by Gonzales, seconded by Davis, that the com- munication from Mr. Dale Aaronson of Gray Jug Liquor store, dated July 30, 1984, submitting his opinions on the Mobile Check Cashing Services be received and filed. Motion carried. The Mayor asked if anyone would like to address the City Council at this time. Dale Aaronson and Joe Aaronson from Gray Jug Liquor Store addressed the City Council; the owner of Gee Gee Liquor and the owner of Ben's General store addressed the City Council. I Communication from Police Chief Espinoza, dated July 24, 1984, requesting authority and funds for Lt. James Mason to attend the 9th Annual Labor, Police, Management Seminar in Las Vegas, Nevada, September 14-16, 1984, with an expense allowance of $360.50, was presented. It was moved by Ybarra, seconded by Davis, that the rec~ ommendation of the Police Chief be approved and authority be granted to issue a warrant in the amount of $360.50 to James Mason to attend the 9th Annual Labor, Police, Management Seminar in Las Vegas, Nevada, September 14-16, 1984. Motion carried. 1831 =3= 8-07-84 Communication from Bruce V. Malkenhorst, City Administra- tor/City Clerk, dated July 31, 1984, advising of a request for variance from Jade Range, Inc., owners of property at 4901 Fruit- land Avenue, Vernon, from Section 7.52 of the Vernon City Code (space required). They wish to delay the reconstruction of their 40 ft. dock to the required 65 ft. indentation from the street property line (a condition of parcel map 15947) for two years. This has been reviewed by the Community Services Depart- ment and it is hereby recommended that said variance be granted with the condition that the maximum length of trucks permitted in the dock will be 40 ft. and the dock be reconstructed within two years, was presented. I It was moved by Gonzales, seconded by Ybarra, that the com- munication from Bruce V. Malkenhorst, City Administrator/City Clerk, dated July 31, 1984, advising of a request for variance from Jade Range, Inc., owners of property at 4901 Fruitland Avenue, Vernon, from Section 7.52 of the Vernon City Code (space required) be deferred to the August 21, 1984 meeting. Motion carried. Communication from Bruce V. Malkenhorst, City Administrator/ City Clerk, dated July 31, 1984, advising of a request from Hi Point Industries for a variance from Section 2003(b), openings in walls, of the 1979 Uniform Building Code as they wish to construct property line openings and a connecting ramp between adjacent buildings located at 4767 and 4755 East 49th Street (they own both buildings). This has been reviewed by both the Community Services Department and the Fire Department and it is hereby recommended that a variance from the 1979 Edition of the Uniform Code Section 2003(b) be granted, was presented. It was moved by Ybarra, seconded by Gonzales, that the rec- ommendation of the City Administrator/City Clerk be approved and that a variance from Section 2003(b), openings in walls, of the 1979 Uniform Building Code be granted to Hi Point Industries to construct property line openings and a connecting ramp between adjacent buildings located at 4767 and 4755 East 49th Street (they own both buildings). Motion carried. Communication from Bruce V. Malk.enhorst, City Administra- tor/City Clerk, dated July 31, 1984, advising of a request from community Food Resources of Los Angeles County, Inc., for the city to waive the business warehousing fees based upon their being a charitable, non-profit, tax-exempt organization, how- ever, city services (i.e., police and fire departments) will be utilized by them whenever necessary_ The locations of their warehouse site is at 1900 East 25th Street, was presented. I It was moved by Davis, seconded by Ybarra, that the com- munication from Bruce V. Malkenhorst, City Administrator/City clerk, dated July 31, 1984, advising of a request from Community Food Resources of Los Angeles County, Inc., for the city to waive the business warehousing fees based upon their being a charitable, non-profit, tax-exempt organization be referred to the Director of Environmental Health, Louis Hauger, for review and report. Motion carried. Communication from Bruce V. Malkenhorst, City Administra- tor/City Clerk, dated August I, 1984, advising of a request from Mr. J. Herman (realtor for property owners of 4464 District Boul'El!- vard) for a variance from Section 7.39 (minimum parking require~. ment) of the City Code Book for the property owners to construct a loading dock at the rear of the loading area, approximately 82 ft. from the street right-of-way line, as this area cannot be practically used for parking and it is hereby recommended that said variance be granted, was presented. 1632 =4= It was moved by McCormick, seconded by Davis, that the recommendation of the City Administrator/City Clerk, dated August 1, 1984, advising of a request from Mr. J. Herman (realtor for property owners of 4464 District Boulevard), for a variance from Section 7.39 (minimum parking requirement), of the City Code Book, be approved and that a variance be granted. Motion carried. I Communication from Bruce V. Malkenhorst, City Administra- tor/City Clerk, dated August 2, 1984, recommending that author- ity be granted to destroy evidence recovered by the police de- partment pertaining to cases which have either been adjudicated, received a rejection on filings by district attorneys, or have not been claimed by the rightful owners, for the period of 1979 to present, was presented. RESOLUTION NO. 5129 - A Resolution Of The City Council Of The City Of Vernon Authorizing The Police Chief To Destroy Certain Instruments Pursuant To Section 34090 Of The Government Code Of The State Of California, was presented. It was moved by Ybarra, seconded by Davis, that Resolution No. 5129 - A Resolution Of The City Council Of The City Of Vernon Authorizing The Police Chief To Destroy Certain Instruments Pur- suant To Section 34090 Of The Government Code Of The State Of California be deferred to the August 21, 1984 meeting. Motion carried. RESOLUTION NO. 5130 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of An Agreement By And Between The City Of Vernon And Motorola Communications And Electronics, Inc. (Motorola) for a Police Communication System, was presented. It was moved by Gonzales, seconded by Davis, that Resolution No. 5130 - A Resolution Of The City Council Of The City Of Vernon Approving And Authorizing The Execution Of An Agreement By And Between The City Of Vernon And Motorola Communications And Electronics, Inc. (Motorola) for a Police Communication System be deferred to the August 21, 1984 meeting. Motion carried. communication from Bruce V. Malkenhorst, City Administra- tor/City Clerk, dated August 2, 1984, advising of the receipt of an "Application from Leave to Present a Late Claim", on July 30, 1984, from the law offices of Walter J. Nicholas on behalf of Mr. Rafael Rodriguez Moreno for a traffic collision at Soto Street and Washington in Los Angeles, February 18, 1984. This claim has been reviewed by our Liability Administrator and it is hereby recommended that said "Application for Leave to Present a Late Claim" be denied, was presented. I It was moved by McCormick, seconded by Ybarra, that the claim received from the law offices of Walter J. Nicholas on behalf of Rafael Rodriguez Moreno be denied. Motion carried. Communication from Bruce V. Malkenhorst, City Administra- tor/City Clerk, dated August 2, 1984, advising of the receipt of a timely claim from the law firm of Bauer, O'Brien & Bernstein on behalf of Stuart Finkelstein, dated June 26, 1984. This claim is for injuries and property damage allegedly re- sulting from a traffic collision with a Santa Fe engine at P.U.C. crossing 2HO.4 on 27th Street, May 4, 1984. The claim has been reviewed by the city's liability administrator and it is hereby recommended that said claim be denied, was presented. 1fUJ3 =5= 8-07-84 It was moved by Gonzales, seconded by Ybarra, that the claim received from the law firm of Bauer, O'Brien & Bernstein on behalf of Stuart Finkelstein be denied. Motion carried. Communication from Ray Groom, dated July 29, 1984, re- sponding to the City's request that he vacate the premises at 3357 Fruitland Avenue, was presented. It was moved by Ybarra, seconded by Gonzales, that the communication from Ray Groom, dated July 29, 1984, be received and filed. Motion carried. I Communication from Bruce V. Malkenhorst, Director of Person- nel, dated August 1, 1984, requesting that he be granted author- ity to create a position of an Administrative Aide on a full time basis with a salary range of $1,389.00 to $1,916.00, was pre- sented. It was moved by Ybarra, seconded by Davis, that the rec- ommendation of the Director of Personnel be approved and that authority be granted to create a position of an Administrative Aide on a full time basis with a salary range of $1,389.00 to $1,9l6.~0. Malkenhorst, Director of Person- nel, dated August 7, 1984, recommending that the following personnel actions be approved with the effective dates' as indicated: I Resignations: Officer Roger D. Gambill effective at the end of his watch on August 4, 1984. It was moved by Gonzales, seconded by Ybarra, that Roger D. Gambill's resignation be accepted effeCtive August 4, 1984. Motion carried. Anna Alonzo, Police Transcriber Typist, effective July 22, 1984. It was moved by McCormick, seconded by Davis, that Anna Alonzo's resignation be accepted effective July 22, 1984. Motion carried. II Terminations: Benjamin Otero, Temporary Emproyee, effective August 2, 1984. I It was moved by Ybarra, seconded by Davis, that Benjamin Otero be terminated effective August 2, 1984. Motion carried. Officer Timothy B. Sanchez effective July 18, 1984. It was moved by Gonzales, seconded by Ybarra, that Timothy B. Sanchez be terminated effective July 18, 1984. Motion carried. III Request to Hire: Audrey M. Martinez as Transcriber Typist, Grade VII, with a monthly salary of $1,193.00, effective August 20, 1984. It was moved by McCormick, seconded by Gonzales, that Audrey M. Martinez be hired as Transcriber Typist, Grade VII, assigned to the Police Depart- ment with a monthly salary of $1,193.00. Motion carried. 1634 =6= I I IV 8-07-84 Patrick Keye as a full time regular employee, Utilityman V, step 7, with a monthly salary of $1247.00, effective August 5, 1984. It was moved by Gonzales, seconded by Ybarra, that Patrick Keye be hired as Utilityman V, step 7, with a monthly salary of $1247.00, effective August 5, 1984. Motion carried. Mr. Jose J. Avila and Mr. Keith O'Neil Washington as Police Cadets, Grade VII, with monthly salaries of $968.00 and that their continued employment be contingent upon their satisfactory completion of the background process, effective August 20, 1984 and August 8, 1984, respectively. It was moved by McCormick, seconded by Gonzales, that Jose L. Avila and Keith O'Neil Washington be hired as Police Cadets, Grade VII, with monthly salaries of $968.00 and that their continued em- ployment be contingent upon their satisfactory completion of the background process, effective August 20, 1984 and August 8, 1984, respectively. Motion carried. Merit Increase and Advances (temporary): Firefighter Frank Hlifka to Acting Engineer, Grade 3, with a monthly salary of $2,541.00 (which includes the 2~% educational incentive pay previously granted), effective August 19, 1984. It was moved by Ybarra, seconded by McCormick, that Frank Hlifka be granted a merit increase/advance to Acting Engineer, Grade 3, with a monthly salary of $2,541.00, effective August 19, 1984. Motion carried. Fire Engineer Gerald Lohrke to Acting Captain, Grade 4, with a monthly salary of $2800.00, effective August 19, 1984. It was moved by Gonzales, seconded by McCormick that Gerald Lohrke be granted a merit increase/advance to acting Captain, Grade 4, with a monthly salary of $2800.00, effective August 19, 1984. Motion carried. Firefighter William Manolovits to Acting Engineer, Grade 3, with a monthly salary of $2479.00, effec- tive August 19, 1984. It was moved by Ybarra, seconded by Davis, that William Manolovits be granted a merit increase/advance to Acting Engineer, Grade 3, with a monthly salary of $2479.00, effective August 19, 1984. Motion carried. Sergeant Thomas Igyarto be granted a merit step increase to Grade II, with a monthly salary of $2955.00 (which includes the 5% pay increase for his possession of the Advanced P.G.S.T. Certificate), effective August 19, 1984, based on his satisfactory job performance during the past year. V Incentive Pay Acting Fire Engineer Loren Dome be granted the 2~% educational incentive pay for his completion of college courses and fire science classes required. VI Employment Agreement Agreement for the position of Lieutenant in the Vernon Police Department by and Between the City of Vernon and Leslie W. Brown be accepted and ratified, effective August 3, 1984. It was moved by Ybarra, seconded by Gonzales, that the employment agreement for the position of Lieutenant in the Vernon Police Department by and Between the City of Vernon and Leslie W. Brown be accepted and ratified, effective August 3, 1984. Motion carried. Conununication from Bruce V. Malkenhorst, Director of Person- nel, dated August 8, 1984, reconunending that Mr. Marcos Forrester and Mr. David Russell be hired on a temporary basis with an hourly wage of $5.00 each, effective August 8, 1984. It was moved by Ybarra, seconded by McCormick, that the reconunendation of the Director of Personnel, dated August 8, 1984, be approved and that Marcos Forrester and David Russell be hired on a temporary basis with an hourly wage of $5.00 each, effective August 8, 1984. Motion carried. I At 6:25 p.m., it was moved by Ybarra, seconded by Gonzales, that the City Council go into executive session under Govern~ ment Code Section 54957. Motion carried. All persons with the exception of the City Administrator/ City Clerk, City Attorney, Captain Rosenkrantz and Chief Espinoza were excluded from the executive session. Mayor Malburg declared all conununications to and from the executive session deemed private and confidential. At 6:35 p.m., it was moved by Ybarra, seconded by McCormick, that the City Council go out of executive session and resume regular session. Motion carried. At 6:35 p.m., Captain Rosenkrantz and Chief Espinoza were excused. 1636 =8= 8-07-84 At 6:36 p.m., it was moved by McCormick, seconded by Ybarra, that the City Council go into executive session under Attorney/Client privilege. Motion carried. All persons with the exception of the City Administrator/ City Clerk and the City Attorney were excluded from the exec- utive session. Mayor Malburg declared all communications to and from the executive session deemed private and confidential. At 6:50 p.m., it was moved by Gonzales, seconded by McCormick, that the City Council go out of executive session and resume regular session. Motion carried. I Communication from Bruce V. Ma1kenhorst, Director of Personnel, dated August 7, 1984, recommending that Mr. William Wilson be hired as Administrative Aide, effective upon his giv- ing two weeks notice to his present employer, was presented. It was moved by Gonzales, seconded by Davis, that the recommendation of the Director of Personnel, be approved and that William Wilson be hired as an Administrative Aide. Motion carried. The City Attorney presented a proposed Stipulation and Order on Issue of Contribution Between Defendants in regard to the Workers' Compensation Appeals Board case of Henry Wilson v. City of Vernon and State Compensation Insurance Fund, Case Nos. 77 ING 42282 and 79 VN 90013, and recommended to the City Council that said Stipulation be approved to reimburse State Compensation Insurance Fund for 35% of all medical expenses, including hospital and nursing expenses, paid by the State Fund under the Findings and Award of November 5, 1979, incurred by Mr. Wilson for medical treatment relating to industrial injuries as specified in said Award from the date of April 26, 1984 and continuing. It was moved by Ybarra, seconded by McCormick, that the pro- posed Stipulation and Order on Issue of Contribution Between Defendants in the case of Henry Wilson v. City of Vernon and state Compensation Insurance Fund, Case Nos. 77 ING 42282 and 79 VN 90013 be approved and the City Attorney be authorized to execute said Stipulation on behalf of the City of Vernon. Motion carried. There being no further business to come before the City council, it was moved by McCormick, seconded by Ybarra,that the meeting be adjourned. Motion carried.
