MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD OCTOBER 2, 1984
AT 5:00 P.M., IN THE COUNCIL CHAMBER OF
THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales
MEMBERS ABSENT: McCormick
The meeting was called to order by Mayor Malburg.

It was moved by Ybarra, seconded by Gonzales, that the
minutes of. theagjourned regular City Council Meeting held
September 18, 1984, be.~pproved as written and submitted.
Motion carried.
At this time, Mayor Malburg presented a Service Pin Award
to Renee Doull for five years of service to the City of Vernon.
At 5:05 p.m., the Mayor declared a recess.
At 5:07 p~m., the council reconvened in regular session
all members present before the recess, again being present.
Police Department Activity Log for the period September
16-30, 1984, was presented.
It was moved by Davis, seconded by Ybarra, that the Police
Department Activity Log for the period September 16-30, 1984,
be received and filed. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated July 31, 1984, advising of a request from
Community Food Resources of Los Angeles County, Inc., for the
city to waive the business warehousing fees based upon their
being a charitable, non-profit, tax-exempt organization, how-
ever city services (i.e., police and fire) will be utilized by
them whenever necessary. The location of their warehouse site
is 1900 East 25th Street (deferred from September 18, 1984
meeting), was presented.
It was moved by Gonzales, seconded by Davis, that the
communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated July 31, 1984, advising of a request. from
Community Food Resources of Los Angeles County, Inc., for the

deferred to the October 16, 1984 meeting. Motion carried.

Communication from L. A. Espinoza, Chief of police, dated
September 12, 1984, recommending authqrity and funds for
Captain L. S. Rosenkrantz to attend the California Association
of Polygraph Examiner's Seminar in San Diego, October 12, 1984,
with an expense allowance of $251.00, was presented.
It was moved by Ybarra, seconded by Davis, that the recom-
mendation of the Chief of Police be approved and authority be
granted to issue a warrant in the amount of $251.00 to L. S.
Rosenkrantz to attend the California Association of Polygraph
Examiner's seminar in San Diego, October 12, 1984. Motion
carried.

Communication from L.A. Espinoza, Chief of Police, dated
September 14, 1984, recommending authority and funds for Theresa
M. Nicholas and Lorinda A. Anderson, from the Communication
Department, to attend a dispatcher seminar "Your Role in Officer
Survival" in Westminster on October 20, 1984, with an expense
allowance of $49.00 each, was presented.
It was moved by Davis, seconded by Gonzales, that the
recommendation of the Chief of Police be approved and authority
be granted to issue warrants in the amount of $49.00 to Theresa
M. Nicholas and Lorinda A. Anderson to attend a dispatcher
seminar "Your Role in Officer Survival" in Westminster on
October 20, 1984. Motion carried.

Warrant Register No. 654, covering claims and demands
presented during the period September 16-30, 1984, which includes
Demand Nos. 2232~2460 (both inclusive), excluding Void Demand
Nos. 2345,2346, 2347, 2359-2365, 2424 and 2460, and Light and
Power Demands, drawn on the First Interstate Bank totaling
$144,767.65, (accounting period October 1984), was examined
and audited.
It was moved by Ybarra, seconded by Davis, that Warrant
Register No. 654, be approved and payment authorized for Demand
Nos. 2332-2460 (both inclusive), excluding Void Demand Nos. 2345,
2346, 2347, 2359-2365, 2424 and 2460, and Light and Power Demands,
in the amount of $144,767.65, with no other exceptions. Motion
carried.
Warrant Register No. 654, covering claims and demands pres-
ented during the period September 16-30, 1984, which includes
Light & Power Demand Nos. 2335, 2336, 2338, 2340, 2352, 2357,
2358, 2368, 2377, 2383, 2388, 2389, 2390, 2394, 2405, 2415, 2422,
2425, 2429, 2442, 2448, 2450 and 2455, totaling $623,492.13
(accounting period October 1984), was examined and audited.
It was moved by Gonzales, seconded by Ybarra, that Warrant
Register No. 654, be approved and payment authorized for Light
& Power Demand Nos. 2335, 2336, 2338, 2340, 2352, 2357, 2358,
2368, 2377, 2383, 2388, 2389, 2390, 2394, 2405, 2415, 2422, 2425,
2429, 2442, 2448,2450 and 2455 in the amount of $623,492.13,
with no exceptions. Motion carried. Councilman Davis abstained.

Payroll Warrant Register No. 336, covering claims and demands
presented during the Period August 19, 1984 - September 15, 1984,
which includes Demand Nos. 4023-4044 (both inclusive) drawn on
the Crocker National Bank totaling $619,581. 07, (accounting
period September 1984), was examined and audited.

It was moved by Ybarra, seconded by Davis, that Payroll
Warrant Register No. 336, be approved and payment authorized for
Demand Nos. 4023-4044 (both inclusive), in the amount of
$619,581.07, with no exceptions. Motion carried.
Communication from Victor Vaits, Director of Community
Services, dated September 25, 1984, recommending that Contract
No. 466 be awarded to S & W Electrical Contractors, Inc., 4557
E. Slauson Avenue, Maywood, California, 90270, on the basis of
their bid, $52,230.00, was presented.
It was moved by Ybarra, seconded by Gonzales, that the com-
munication from the Director of Community Services, dated Sep-
tember 25, 1984, that the bids received and opened on September
18, 1984, in accordance with Contract No. 466 have been reviewed
and recommending that said Contract be awarded to S & W Electrical
Contractors, Inc., 4557 E. Slauson Avenue, Maywood, California,
90270, on the basis of their bid in the amount of $52,230.00 be
received and filed. Motion carried.

RESOLUTION NO. 5141 - A Resolution Of The city Council Of
The City Of Vernon Accepting The Bid Of S & W Electrical
Contractors, Inc. For Traffic Signal Modernization, SotoStreet
And 26th Street, Santa Fe Avenue And Fruitland Avenue, Santa Fe
Avenue and 55th street In Accordance With Contract No. 466 Of
The City Of Vernon And Approving The Execution Of Said Contract,
was presented.
It was moved by Ybarra, seconded by Gonzales, that Reso-
lution No. 5141 be approved and adopted. Motion carried.

RESOLUTION NO. 5142 - A Resolution Of The City Council Of
The City Of Vernon Approving And Authorizing The Execution Of
An Administrative Services Contract By And Between The City Of
Vernon And Mutual Life Insurance Company Of New York ("MONY"),
was presented.
It was moved by Ybarra, seconded by Davis, that Resolution
No. 5142 - A Resolution Of ~he City Council Of The City Of
Vernon Approving And Authorizing The Execution Of An Administra-
tive Services Contract By And Between The City Of Vernon And
Mutual Life Insurance Company Of New York ("MONY"), be deferred
to the October 16, 1984 meeting. Motion carried.
RESOLUTION NO. 5143 - A Resolution Of The City Council Of
The City Of Vernon Authorizing Fleming & Associates To Establish
A City Of Ve.rnon Liability Insurance Trust Account With First
Interstate Bank Of California And Authorizing The Execution Of
Checks Or Other Instruments Necessary For The Administration Of
The City Of Vernon Liability Insurance Program, was presented.
It was moved by Gonzales, seconded by Ybarra, that Reso-
lution No. 5143 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated October 2, 1984, recommending approval of the
grinding of Bandini Boulevard between Indiana and Bonnie Beach
and that it be done so on an emergency basis and that authority
be granted for Vernon Paving Company to.do the work on the basis
of their bid in the amount of $23,912.00, was presented.

It was moved by Gonzales, seconded by Davis, that the rec-
ommendation of the City Administrator/City Clerk, dated October
2, 1984, be approved and that the grinding of Bandini Boulevard
between Indiana and Bonnie Beach be done on an emergency basis
and authority be granted for Vernon Paving Company to do the
work on the basis of their bid in the amount of $23,912.00.
Motion carried.
Communication from Bruce V. Malkenhorst, Director of Per-
sonnel, dated October 2, 1983, transmitting the minutes of the
adjourned regular Personnel Committee Meeting held October 1,
1984, for approval of recommendations contained therein, was
presented.
It was moved by Davis, seconded by Gonzales, that the min-
utes of an adjourned regular Personnel Committe~ Meeting held
October 1, 1984, be approved as written and recommendations
contained therein be adopted. Motion carried.

Communication from Container Corporation of America dated
September 27, 1984, advising the City Council that they wish to
appeal the August 22, 1984 denial of Container's request for an
electric transmission line encroachment license, was presented.
It was moved by Gonzales, seconded by Ybarra, that the com-
munication from Container Corporation of America dated Septem-
ber 27, 1984, advising the City Council that they wish to appeal
the August 22, 1984 denial of Container's request for an
electric transmission line encroachment license be deferred to
the meeting of October 16, 1984. Motion carried. Councilman
Davis abstained.

At 6:10 p.m., it was moved by Ybarra, seconded by Davis,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, City Attorney and Louis Hauger were excluded from
the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
At 6:30 p.m., Louis Hauger was excused.
At 7:05 p.m., it was moved by Ybarra, seconded by Gonzales,
that the City Council go out of executive session and resume
regular session. Motion carried.
Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated October 1, 1984, advising that a timely
claim had been received from Tokio Marine & Fire Insurance
Company and Dynax, Inc. for subrogation regarding a traffic
collision and recommending that said claim be denied, was
presented.
It was moved by Ybarra, seconded by Davis, that the claim
received from Tokio Marine & Fire Insurance Company and Dynax,
Inc. be denied. Motion carried.
Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated October 2, 1984, recommending that Donald
T. Curran be retired per the medical report of Dr. Bruce S.
Gillis dated August 3, 1984, was presented.
It was moved by Davis, seconded by Gonzales, that the com-
munication and medical report be received and filed. Motion
carried.

RESOLUTION NO. 5145 - A Resolution Of The City Council Of
The City Of Vernon Determining The Disability Retirement Of
Donald Curran, A Local Safety Member Employed By The City Of
Vernon (gg2l024 & 21025 of the Government Code), was presented.
It was moved by Gonzales, seconded by Ybarra, that Reso-
lution No. 5145 be approved and adopted. Motion carried.

The City Attorney indicated to the City Council that an
appeal of the decision issued by the Federal Energy Regulatory
Commission in FERC Docket No. ER79-l50 had been filed in the
matter of the Cities of Riverside, et al., v. Federal Energy
Regulatory Commission, Case Nos. 84-7184, 84-7220 and 84-7576
(Consolidated). He recommended that the City Council authorize
the City Attorney to file a Motion for Leave to Intervene
pursuant to Rule l5(d) of the Federal Rules of Appellate Pro-
cedure in said appeal filed in the united states Court of
Appeals for the Ninth Circuit in Case Nos. 84-7184, 84-7220
and 84-7576 (consolidated).

It was moved by Gonzales, seconded by Ybarra, that the
City Attorney's recommendation be approved, and that he be
authorized to file a Motion for Leave to Intervene in said
proceeding. Motion carried.
At 7:05 p.m., the City Attorney was excused.
At 7:05 p.m., it was moved by Davis, seconded by Ybarra,
that the City Council go into executive session under Govern-
ment Code Section 54957. Motion carried.
All persons with the exception of the City Administrator/
City Clerk was excluded from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
At 7:25 p.m., Bruce V. Malkenhorst was excused.
At 7:46 p.m., Bruce V. Malkenhorst returned to executive
session.
At 7:55 p.m., it was moved by Gonzales, seconded by Davis,
that the City Council go out of executive session and resume
regular session. Motion carried.
Communication from Julio Valdez dated October 2, 1984,
requesting a one month extension of his moving date from
November 1, 1984 to December 1, 1984, was presented.
It was moved by Gonzales, seconded by Ybarra, that the
request for an extension for Julio Valdez to remain in the
city house until December 1, 1984 be approved. Motion
carried.
The City Administrator/City Clerk, Bruce V. Malkenhorst,
presented to the City Council his Annual Review Report, dated
October 2, 1984.

It was moved by Ybarra, seconded by Davis, that the Annual
Review Report presented to the City Council by the City Admin-
istrator be received and filed. Motion carried.
It was moved by Ybarra, seconded by Gonzales, that Bruce
V. Malkenhorst, City Administrator/City Clerk receive a merit
increase of 6% and an increase in life insurance to equal the
sum of $200,000, effecti:ve0ctober 28, 1984. Motion carried.
There being no further business to come before the City
Council, it was moved by Ybarra, seconded by Gonzales, that
the meeting be adjourned. Motion carried.
