MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD OCTOBER l6, 1984
AT ~ :45 P.M., IN THE COUNCIL CHAMBER OF
THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales, McCormick
MEMBERS ABSENT: None

The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Davis, that the
minutes of the adjourned regular City Council Meeting held
October 2, 1984, be approved as written and submitted.
Motion carried.
Request from Community Food Resources of Los Angeles
County, Inc., for the city to waive the business warehousing
fees based on their being a charitable, non-profit organiza-
tion (deferred from October 2, 1984 meeting), was presented.
It was moved by Ybarra, seconded by Gonzales that the
request from Community Food Resources of Los Angeles County,
Inc., for the city to waive the business warehousing fees
based on their being a charitable, non-profit organization
be deferred to the meeting of November 6, 1984. Motion
carried.
Communication from L. 'A. Espinoza, Chief of Police, dated
August 13, 1984, recommending authority and funds for Sgt.
Steven Towles to attend the P.O.S.T. Sergeant's Supervisory
School in Whittier, December 3-14, 1984, with an expense
allowance of $120.50, was presented.
It was moved by Davis, seconded by McCormick, that the
recommendation of the Chief of Police be approved and authority
be granted to issue a warrant in the amount of $120.50 to
Steven Towles to attend the P.O.S.T. Sergeant's Supervisory
School in Whittier, December 3-14, 1984. Motion carried.
Police Department Activity Log for the period October
1-15, 1984, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
Police Department Activity Log for the period October 1-15,
1984, be received and filed. Motion carried.

Health Department Report for the month of September 1984,
was presented.
It was moved by Gonzales, seconded by McCormick, that the
Health Department Report for the month of September 1984 be
received and filed. Motion carried.
Warrant Register No. 655, covering claims and demands pre....
sented during the period of October 1-15, 1984, which includes
Demand Nos. 2461-2636 (both inclusive), excluding void Demand
Nos. 2463, 2468, 2479-2484 (both inclusive), 2545, 2593 and
2636, and Light and Power Demands, drawn on the First Inter-
state Bank, totaling $195,479.43, (accounting period October
1983) was examined and audited.

It was moved by Davis, seconded by Gonzales, that Warrant
Register No. 655 be approved and payment authorized for Demand
Nos. 2461-2636 (both inclusive), excluding void Demand Nos.
2463, 2468, 2479-2484 (both inclusive), 2545, 2593 and 2636,
and Light:.' and Power Demands, in the amount of $l95,479.43,
with no other exceptions. Motion carried.
Warrant Register No. 655, covering claims and demands
presented during the period of October 1-15, 1984, which
includes Light & Power Demand Nos. 2464, 2474, 24.77, 2478,
2493,2501,2511,2513,2521,2524,2531,2533,2541,2546,
2554, 2562, 2583, 2594, 2613', 2614., 2616, 2617, 2624 and
2626, totaling $5,788,353.39 (accounting period October 1984),
was examined and audited.

rant Register No. 655, be approved and payment authorized for
Light & Power Demand Nos. 2464, 2474, 2477, 2478, 2493, 2501,

2511, 25l3, 25;21, 2524, 2531, 2533, 2541, 2546, 2554, 2562,
2583, 2594, 2613, 26l4, 26l6, 2617, 2624 and 2626 in the
amount of $5,788,353.39, with no exceptions. Motion carried.
Councilman Davis abstained.
RESOLUTION NO. 5142 - A Resolution Of The City Council Of
The City Of Vernon Approving And Authorizing The Execution Of
An Administrative Services Contract By And Between The City Of
Vernon And Mutual Life Insurance Company Of New York ("MONY")
(deferred from the October 2, 1984 meeting), was presented.
It was moved by McCormick, seconded by Ybarra, that Reso-
lution No. 5142 be approved and adopted. Motion carried.

Communication from Container Corporation of America dated
september 27, 1984, advising the City Council that they wish to
appeal the August 22, 1984 denial of their request for an elec-
tric transmission line encroachment license (deferred from the
October 2, 1984 meeting), was presented.

It was moved by Gonzales, seconded by Ybarra, that the
communication from Container Corporation of America dated Sep-
tember 27, 1984, advising the City Council that they wish to
appeal the August 22, 1984 denial of their request for an elec-
tric transmission line encroachment license be deferred to the
meeting of November 13, 19~4. Motion carried.
RESOLUTION NO. 5144 - A Resolution Of The City Council Of
The City Of Vernon Deternd.ning The Disability Retirement Of
Jack Kelly, A Local Safety Member Employed By The City Of
Vernon (SS21024 & 21025c;:>f the GOVernment Code), was presented.
It was moved by Ybarra, seconded by McCormick, that Reso-
lution No. 5144 be approved and adopted. Motion carried.

The City Of Vernon Amending Schedule VII, Exhibit "F", Of Res-
olution No. 5120, Which Amended Resolution No. 4918 Fixing The
Compensation For Certain Employees Of Said City And Authoriz-
ing Certain Expense Allowances, was presented.

Communication from Bruce V. Malkenhorst, Director of Per-
sonnel, dated October 16, 1984, transmitting the minutes of the
Personnel Committee Meeting held October l5, 1984, for approval
of recommendations contained therein, was presented.
It was moved by Gonzales, seconded by McCormick, that the
minutes of the Personnel Committee Meeting held October 15,
1984, be approved as written and recommendations contained
therein be adopted. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated October 16, 1984, transmitting the minutes of
the Finance Committee Meeting held October 15, 1984, for
approval of recommendations contained therein, was presented.
It was moved by Davis, seconded by McCormick, that the
minutes of the Finance Committee Meeting held October 15, 1984,
be approved as written and recommendations contained therein be
adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Administra~
tor/City Clerk, dated October 16, 1984, advising that a com-
putation has been made to determine the Energy Cost Adjustment
Billing Factor for the next three month period in accordance
with Ordinance No. 911 and recommending that said factor be a
positive (+) O.499~ per kilowatt hour, effective November 1,
1984, was presented.

It was moved by McCormick, seconded by Ybarra, that the
recommendation of the City Administrator/City Clerk be approved
and the computation report determining the Energy Cost Adjust-
ment Billing Factor for the next three months be received and
filed. Motion carried.
RESOLUTION NO. 5148 - A Resolution Of The City Council Of
The City Of Vernon Changing The Energy Cost Adjustment Billing
Factor Charged For Electrical Energy Distributed And Supplied
To Its Electrical Consumers, was presented.
It was moved by McCormick, seconded by Ybarra, that Reso-
lution No. 5148 be approved and adopted. Motion carried.

'At 5: 4 8 p.m. , it wa.s J'I}oved by Ybarra ,seconded by McCormick,
that the City Council go into executive session under Government
Code Section 54957. Motion carried.
All persons with the exception of the City Administrator/
City Clerk, City Attorney, Lloyd Schultz and George Bass, were
excluded from the executive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
At 6:11 p.m., it was moved by Gonzales, seconded by Ybarra,
that the City Council go out of executive session and resume
regular session. Motion carried.

At 6:13 p.m., it was moved by McCormick, seconded by Ybarra,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Administrator/
City Clerk and the City Attorney were excluded from the execu-
tive session.
Mayor Malburg declared all communications to and from the
executive session deemed private and confidential.
At 7:15 p.m., Councilman Davis was excused.
At 7:38 p.m., Councilman Davis resumed his seat on the
Council.
At 7:39 p.m., it was moved by Ybarra, seconded by McCormick,
that the City Council go out of executive session and resume
regular session. Motion carried.
RESOLUTION NO. 5146 ~ A Resolution Of The City Council Of
The City Of Vernon Determining The Nonindustrial Disability
Retirement Of William Mathison, A Local Safety Member Employed
By The City Of Vernon (SS2l024 & 21025 of the Government Code) ,
was presented.
