The meeting was called to order by Mayor Malburg.

It was moved by Ybarra, seconded by Davis, that the min-
utes of the Adjourned Regular City Council Meeting held Decem-
ber 4, 1984, be approved as written and submitted. Motion
carried.
ORDINANCE NO. 949 - An Ordinance Of The City Council Of
The City Of Vernon Amending The Code Of The City Of Vernon,
California 1959 By Adding New Chapter 6A Regulating Mobile
Check Cashing Services, Providing For The Issuance Of Permits
And Collection Of Fees Therefor, And Providing For Penalties
For The Violation Of Any provision Of This Ordinance was read
by title for a second and final reading.
It was moved by Gonzales, seconded by Davis, that Ordinance
No. 949 receive and pass a second and final reading and be
adopted. Motion carried.

Communication from Louis Hauger, Health Officer, dated
December 4, 1984, advising that in accordance with Section 459
of the California Health & Safety Code the City Jail has been
inspecteq and that it complies with the standards and require-
ments of the Board of Corrections, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
communication from Louis Hauger, dated December 4, 1984,
advising that in accordance with Section 459 of the California

Police Department Activity Log for the period December 1-
15, 1985, was presented.

Police Department Activity Log for the period December 1-15,
1984, be received and filed. Motion carried.
Warrant Register No. 659, covering claims and demands pre-
sented during the period of December 1-15, 1984, which includes
Demand Nos. 2655, 2806, 2977, and 3094-3289 (both inclusive),
excluding void Demand Nos. 3112-3115 (both inclusive), 3233 and
3240, and Light & Power Demands drawn on the First Interstate
Bank totaling $147,820.51 (accounting period December 1984),
was examined and audited.
It was moved by Davis, seconded by Ybarra, that Warrant
Register No. 659 be approved and payment authorized for Demand
Nos. 2655, 2806, 2977 and 3094-3289 (both inclusive), excluding
void Demand Nos. 3112-3115 (both inclusive), 3233 and 3240, and
Light & Power Demands, in the amount of $147,820.51, with no
other exceptions. Motion carried.

on the above motion and is disqualifying himself because it is
reasonably foreseeable that the decision will have a material
financial effect on his source of income. Motion carried.
Communication from L. A. Espinoza, Chief of Police, dated
December 10, 1984, recommending authority and funds to attend
the 1985 Annual California Police Chief's Association Conference
in Fresno, California, February 6-9, 1985, with an expense allow-
ance of $533.70, was presented.
It was moved by Ybarra, seconded by Davis, that the recom-
mendation of the Police Chief be approved and authority be
granted to issue a warrant to L. A. Espinoza, in the amount of
$533.70 to attend the 1985 Annual California Police Chief's
Association Conference in Fresno, California, February 6-9,
1985. Motion carried.
Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk dated December 13, 1984, advising of a request
from Mr. McClauclan, Principal of Vernon Elementary School, for
the school employees to park their vehicles in the upper parking
structure of the City Hall, was presented.
It was moved by McCormick, seconded by Gonzales, that the
recommendation of the City Administrator/City Clerk be approved
and that the school employees from Vernon Elementary School be
allowed to park their vehicles in the upper parking structure
of the City Hall, contingent upon the payment of parking fees
and insurance coverage. Motion carried.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 13, 1984, recommending authority
and funds for himself and Councilmen Thomas A. Ybarra, William
M. MCCormick, Leonis C. Malburg, and William J. Davis to attend
the League of California Cities Employee Relations Institute
Seminar in Oakland, January 22-24, 1985, with an expense allow-
ance of $556.00 each, was presented.
It was moved by McCormick, seconded by Gonzales, that the
recommendation of the City Administrator/City Clerk be approved
and authority be granted for Bruce V. Malkenhorst, Thomas A.
Ybarra, William M. McCormick, Leonis C. Malburg, and William J.
Davis to attend the League of California Cities Employee
Relations Institute Seminar in Oakland, January 22-24, 1985,
with an expense allowance of $556.00 each. Motion carried.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 17, 1984, recommending that the
common boundary of the City of Vernon and the City of Maywood
on Fruitland Avenue, District Boulevard and 52nd Drive be
adjusted. As the proposed boundary line adjustment is in ac-
cordance with the City of Vernon General Plan and will not have
a significant effect on the environment, it is proposed to es-
tablish the new boundary on the centerline of Fruitland Avenue
and 52nd Drive and on District Boulevard near Atlantic Avenue
the boundary will be placed on the south property line. It is
also recommended that authority be granted for the City Attorney
to prepare a resolution for said boundary adjustments and is
further recommended that a Negative Declaration, in accordance
with the California Environmental Quality Act be adopted, was
presented.
It was moved by Ybarra, seconded by McCormick, that the
communication from the City Administrator/City Clerk, dated
December 17, 1984, recommending that the common boundary of
the City of Vernon and the City of Maywood be adjusted, be
received and filed. Motion carried.
It was moved by Gonzales, seconded by McCormick, that a
Negative Declaration, in accordance with the California Envi-
ronmental Quality Act be adopted. Motion carried.
RESOLUTION NO. 5158 - Joint Resolution Of The Board Of
Supervisors Of Los Angeles County, The City Council Of The
City Of Vernon And The City Council Of The City Of Maywood
Approving And Accepting Negotiated Exchange Of Property Tax
Revenues Resulting From Reorganization Of Territory Identified
As "Reorganization 1-84, Parcels 1, 2 and 3, was presented.
It was moved by Ybarra, seconded by Davis, that Resolu-
tion No. 5158 be approved and adopted. Motion carried.

Health Department Report for the month of November, 1984,

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 17, 1984, advising that the
Tentative Parcel Map No. 16480, which was approved at the Nov-
ember 6, 1984 City Council Meeting, has met the conditions or
posted bonds to complete the requirements. The City Adminis-
trator/City Clerk also advised that the following evidence has
been submitted for the proposed Final Parcel Map and that is
consistent with the General Plan of the City and recommending
that said Parcel Map No. 16480 be approved:

2. Report on Final Map No. 16480
3. Exqerpts from subdivision Map Act
It was moved by Ybarra, seconded by Davis, that the com-
munication from the City Administrator/City Clerk, dated Dec-
ember 17, 1984, regarding Tentative Parcel Map No. 16480, be
deferred until the end of the meeting. Motion carried.
Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 17, 1984, recommending that the
City of Vernon agree to become a planning participant in the
"Mead/McCullough-Victorville/Adelanto Transmission Project,
Project Planning Agreement" and that the Mayor be authorized
to execute said agreement on behalf of the City, was presented.

The City Of Vernon Approving The Terms And Conditions Of A
Project Planning Agreement Between The Department Of Water And
Power Of The City Of Los Angeles And The Cities Of Anaheim,
Azusa, Banning, Burbank, Colton, Glendale, Pasadena, Riverside
and Vernon, The M-S-R Public Power Agency And The Western Area
Power Administration, And Authorizing The Execution Of And
Delivery Of Said Agreement By Officers Of The City Of Vernon,
was presented.
It was moved by Gonzales, seconded by McCormick, that Res-
olution No. 5154 be approved and adopted. Councilman Davis is
abstaining from voting on the above motion and is disqualifying
himself because it is reasonably foreseeable that the decision
will have a material financial effect on his source of income.

RESOLUTION NO. 5156 - A Resolution Of The City Council Of
The City Of Vernon Approving And Authorizing The Executives Of
A Memorandum Of Understanding ("MOU"), California-Oregon
Transmission Project, And A Supplemental Letter Agreement To
Third 500-KV AC Line MOU By The Cities Of Anaheim, Azusa,
Banning, Colton, Riverside And Vernon ("Southern California
Public Agencies"); California Department Of Water Resources
("CDWR"); Pacific Gas And Electric Company ("PG&E"), San
Diego Gas And Electric Company ("SDG&E"), And Southern Cali-
fornia Edison Company ("SCE"), Collectively "Investor-Owned
Utilities", The Western Area Power Administration ("WAPA"),
Transmission Agency Of Northern California ("Agency") And The
Los Angeles Department Of Water And Power ("LADWP"), was
presented.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 17, 1984, advising that the City
of Vernon has been allocated $4,000.00 in Industrial Development
Bonds and that Vernon businesses have received $7,000,000.00 in
Industrial Development Bond Financing through the Economic
Development Corporation of Los Angeles. The City Administrator/
City Clerk, hereby recommends that the funds be transferred to
the Economic Development Corporation, was presented.

ommendation of the City Administrator/City Clerk be approved
and that the $4,000.00 in Industrial Development Bonds that
had been allocated to the City of Vernon be transferred to
the Economic Development Corporation of Los Angeles County.

RESOLUTION NO. 5157 - A Resolution Of The City Council Of
The City Of Vernon Transferring A Portion Of The Private
Activity Bond Allocation Of The City Of Vernon To The Economic
Development Corporaton Of Los Angeles County, was presented.

monthly salary of $2657.00, effective January 6, 1985.

Technician, Step 3 with a monthly salary of $2657.00,

Randolph Lascurain to Sergeant Grade 2, with a monthly
salary of $2884.00 (which includes the 2~% incentive pay
for his possession of the intermediate P.O.S.T. certifi-

monthly salary of $2557.00, effective January 10, 1985.

effective January 10, 1985.

Christopher Hansen be granted a merit step increase to
Police Officer I, Step 3, with a monthly salary of
$1853.00, effective January 13, 1985. Motion carried.

Gerald Lowe be hired as a provisional police officer,
classified as Police Officer I, Step 4, with a monthly
salary of $1756.00 and that the employment agreement
for the position of Police Officer I, in the Vernon
Police Department by and between the City of Vernon
and Gerald Lowe be accepted and ratified, effective
December 6, 1984.
It was moved by McCormick, seconded by Davis, that
Gerald Lowe be hired as a provisional police officer,
classified as Police Officer I, Step 4, with a monthly
salary of $1756.00 and that the employment agreement
for the position of Police Officer I be accepted and
ratified, effective December 6, 1984. Motion carried.

Susan Venegas be hired on a temporary basis to work as
switchboard operator with an hourly wage of $5.25,
effective December 17, 1984.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 17, 1984, advising that the
Tentative Parcel Map No. 16480, which was approved at the
November 6, 1984 City Council Meeting, has met the conditions
or posted bonds to complete the requirements, and that the

Excerpts from Subdivision Map Act, have been submitted as
evidence and that it is consistent with the General plan of
the City. The City Administrator/City Clerk also advised
that the Subdivision Improvement Agreement, Compliance and
Demolition Agreement, Subdivision Faithful Performance Bond
and Subdivision Labor and Material Bond, for Parcel Map No.
16480, Exhibit A & D, Subdivision Faithful Performance Bond
and Subdivision Labor and Material Bon for Parcel Map No.
16480, Exhibit B, Subdivision Labor and Material Bond for
Parcel Map No. 164801 Exhibit C, and an Easement for storm
drain purposes have been submitted for execution and approval
and recommending that the Agreements, Easement and the Final
Parcel Map No. 16480 be approved, was presented.
It was moved by Gonzales, seconded by McCormick, that
the 'Print Final Map No. 16480, Report on Final Map No. 16480,
Excerpts from Subdivision Map Act, be received and filed as
evidence as this evidence supports a finding that the proposed
Final Parcel Map is consistent with the General Plan, as
adopted by the City of Vernon and that the above Agreements,
~onds, Easement, and the Final Map No. 16480 be approved,
contingent on the clearance letter from the County approving
the Parcel Map and receipt of the executed Agreements. Motion
carried.
Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk dated December 18, 1984, recommending that
Fernando Weathers, a Utilityman in the Water & Power Department,
be granted approval to lease a city house when one becomes
available. Mr. Weathers is willing to be placed on call and be
available for work in emergency situations, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
communication from the City Administrator/City Clerk, dated
December 18, 1984 recommending that Fernando Weathers be
granted approval to lease a city house when one becomes avail-
able be approved. Motion carried.

At 5:55 p.m., it was moved by Ybarra, seconded by McCormick,
that the City Council go into executive session under Attorney/
Client privilege. Motion carried.
All persons with the .exception of the City Administrator/
City Cterk, City Attorney and Louis Hauger were excluded from
the executive session.
Mayor Malburg declared.all communications to and from the
executive session deemed private and confidential.
At 6:05 p.m., Louis Hauger was excused.
At 6:18 p.m., it was moved by Gonzales, seconded by
McCormick, that the City Council go out of executive session
and resume regular session. Motion carried.

Communication from Bruce V. Malkenhorst, City Administra-
tor/City Clerk, dated December 13, 1984, advising that a timely
claim had been received from Philip J. Karlin, attorney at law,
on behalf of Andrew Zorillo Alaniz for bodily injury, and rec-
ommending that said claim be denied, was presented. '
It was moved by Davis, seconded by McCormick, that the
claim received from Philip J. Karlin, attorney at law, on
behalf of Andrew Zorillo Alaniz be denied. Motion carried.

The City Attorney advised the Council that he had appeared
at the hearing of Raymon L. Michalski v. City of Vernon, Case
No. 78 VB 24214, on December 18, 1984, and that a tentative
settlement had been reached based upon a lump sum figure of
$25,609.19 subject to the Council's approval and recommended
to the City Council that said settlement be approved and that
he be authorized to prepare and execute a Compromise and Release
incorporating the terms of said settlement.
It was moved by McCormick, seconded by Ybarra, that the
settlement by Compromise and Release for a lump sum figure of
$25,609.19 be approved and the City Attorney authorized to pre-
pare and execute said Compromise and Release on behalf of the
City of Vernon. Motion carried.
Communication from Bruce V. Malkenhorst, City Administrator/
City Clerk, dated December 13, 1984, recommending authority to
pay the reasonable costs involved in hosting the Independent
Cities Association Annual Christmas Dinner to be held on Dee",
ember 20, 1984, was presented.
It was moved Ybarra, seconded by Davis, that the communi-
cation from the City Administrator/City Clerk, dated December
13, 1984, be approved and authority given to pay the reasonable
costs involved in hosting the Independent Cities Association
Annual Christmas Dinner to be held on December 20, 1984. Motion
carried.
There being no further business to corne before the City
Council, it was moved by McCormick, seconded by Ybarra, that
the meeting be adjourned. Motion carried.
