MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD AUGUST 20, 1985,
AT 4:45 P.M., IN THE COUNCIL CHAMBER OF
THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Gonzales, Davis

The meeting was called to order by Mayor Malburg.

It was moved by Ybarra, seconded by Davis, that the
Minutes of the Adjourned Regular City Council Meeting held
August 6, 1985, be approved as written and submitted. Mo-
tion carried.
Police Department Activity Log for the period August
1-15, 1985, was presented.
It was moved by Gonzales, seconded by Davis, that the
Police Department Activity Log for the period August 1-15,
1985, be received and filed. Motion carried.
Fire Department Activity Report for the period August
1-15, 1985, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
Fire Department Activity Report for the period August 1-15,
1985, be received and filed. Motion carried.
Health Department Report, for the month of July, 1985,
was presented.
It was moved by Davis, seconded by Ybarra, that the
Health Department Report for the month of July, 1985, be
received and filed. Motion carried.
Communication from George Bass, Fire Chief, dated August
6, 1985, recommending authority and funds for Francis W. Sumner,
Fire Inspector, to attend the Combined Northern/Southern Divi-
sion Fire Prevention Officer's Section Annual Meeting of the
California Fire Chief's Association in San Luis Obispo, Cali-
fornia, October 17-18, 1985, with an expense allowance of
$210.00, was presented.

It was moved by Davis, seconded by Ybarra, that the rec-
ommendation of the Fire Chief be approved and that authority
be granted to issue a warrant to Francis W. Sumner in the
amount of $210.00 to attend the Combined Northern/Southern
Division Fire Prevention Officer's Section Annual Meeting of
the California Fire Chief's Association in San Luis Obispo,
California, October 17~18, 1985. Motion carried.
Communication from Victor Vaits, Director of Community
Services, dated August 6, 1985, recommending authority and
funds for Fred A. Tachovsky, Electrical Inspector, to attend
the 62nd Annual Meeting of the International Association of
Electrical Inspectors in Sacramento, California, September
22-26, 1985, with an expense allowance of $637.30, was pre-
sented.
It was moved by Gonzales, seconded by Ybarra, that the
recommendation of the Director of Community Services be ap-
proved and authority be granted to issue a warrant to Fred A.
Tachovsky, in the amount of $637.30, to attend the 62nd Annual
Meeting of the International Association of Electrical Inspec-
tors in Sacramento, California, September 22-26, 1985. Motion
carried.

Communication from Bruce V. Malkenhorst, City Clerk,
dated August 12, 1985, recommending that the agreement by
and between the City of Vernon and D.N. & E. Walters be ap-
'proved and the Mayor be authorized to execute same. The
agreement is for the Bandini-Long Beach Freeway Signal and
will save the City $400.00 per year in maintenance and ap-
proximately 62% of all extraordinary maintenance and re-
construction costs, was presented.
It was moved by Ybarra, seconded by Davis, that the
communication of the City Clerk, dated August 12, 1985,
be deferred to the next council meet~ng. Motion carried.

Communication from Bruce V. Malkenhorst, Director of
Finance, dated August 12, 1985, transmitting the minutes of
the Adjourned Regular Finance Committee meeting held August
12, 1985, for approval of recommendations contained therein,
was presented.
It was moved by Ybarra, seconded by Davis, that the min-
utes of the Adjourned Regular Finance Committee Meeting held
August 12, 1985, be approved as writtenmd recommendations
contained therein be adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated August 12, 1985, advising that it had been previously
discussed and agreed to that the City would pick-up the highest
one year effective July 1, 1986 for the sworn fire department
personnel and Police Management. It is hereby recommended that
a resolution be adopted advising of the City's intent to approve
an amendment to contract between the Board of Administration of
the Public Employees' Retirement System (PERS), was presented.
RESOLUTION NO. 5206 - A Resolution Of The City Council Of
The City Of Vernon Declaring Its Intention To Approve An Amend-
ment To Its Contract Between The Board Of Administration Of The
Public Employees' Retirement System ("PERS") And The City
Council Of The City Of Vernon, was presented.
It was moved by Gonzales, seconded by Ybarra, that Reso-
lution No. 5206 be approved and adopted. Motion carried.

Communication from Victor Vaits, Director of Community
Services, dated August 12, 1985, advising that the bids for
Contract No. 469, have been reviewed and recommending that
said Contract be awarded to J & J Sewer Company, 4994 F Street,
Chino, California, 91710, based on their bid in the amount of
$80,831.60, was presented.

RESOLUTION NO. 5207 - A Resolution Of The City Council Of
The City Of Vernon Accepting The Bid Of J & J Sewer Co. For
Fruitland Avenue Sewer (Downey Road to Maywood Avenue) Con-
struction, In Accordance With Contract No. 469 Of The City Of
Vernon And Approving The Execution Of Said Contract, was pre-
sented.
It was moved by Ybarra, seconded by Davis, that Resolu-
tion No. 5207 be approved and adopted. Motion carried.

Communication from Victor Vaits, Director of Community
Services, dated August 12, 1985, advising that the bids for
Contract No. 470, have been reviewed and recommending that
said Contract be awarded to Sully-Miller Contracting Company,
3000 East South Street, Long Beach, California 90805, based
on their bid in the amount of $266,151.85, was presented.
RESOLUTION NO. 5208 - A Resolution Of The City Council
Of The City Of Vernon Accepting The Bid Of Sully-Miller
Contracting Company For Bandini Boulevard Resurfacing
(Downey Road To Ayers Avenue), In Accordance with Contract No.
470 Of The City Of Vernon And Approving The Execution Of Said
Contract, was presented.

Communication from Luis A. Espinoza, Chief of Police,
dated August 9, 1985, recommending authority and funds for
Sgt. Don Green to attend the California Association of Police
Officers Training Conference (C.A.P.T.O.) in Santa Rosa, Cal-
ifornia, October 16-18, 1985, with an expense allowance of
$460.96, was presented.
It was moved by Ybarra, seconded by Davis, that the rec-
ommendation of the Chief of Police be approved and authority
be granted to issue a warrant to Don Green in the amount of
$460.96 to attend the California Association of Police Officers
Training Conference (C.A.P.T.O.) in Santa Rosa, California,
October 16-18, 1985. Motion carried.
Communication from George F. Bass, Fire Chief, dated
August 12, 1985, recommending authority and funds for himself
and Battalion Chiefs Arnold deBoer, Frank Claunch and Larry
Spadt to attend the seminar to Improve Your Response To
Hazardous Materials Incidents in Fullerton, California, Sep-
tember 7-8, 1985, with an expense allowance of $96.50 each,
was presented.
It was moved by Gonzales, seconded by Ybarra, that the
recommendation of the Fire Chief be approved and that authority
be granted to issue warrants to George F. Bass, Arnold deBoer,
Frank Claunch and Larry Spadt, in the amount of $96.50 each,
to attend the seminar to Improve Your Response To Hazardous
Material Incidents in Fullerton, California, September 7-8,
1985. Motion carried.

Communication from Bruce V. Malkenhorst, City Clerk,
dated August 12, 1985, recommending authority and funds for
Victor Vaits, Lewis Adams, Luis Espinoza and George Bass to
attend the League of California Cities 87th Annual Conference
in San Francisco, California, October 6-9, 1985, with an
expense allowance of $814.00 each, was presented.
It was moved by Ybarra, seconded by Davis, that the rec~
ommendation of the City Clerk be approved and authority be
granted for Victor Vaits, Lewis Adams, Luis Espinoza and George
Bass to attend the League of California Cities 87th Annual Con-
ference in San Francisco, California, October 6-9, 1985, with
an expense allowance of $814.00 each. Motion carried.
Communication from Luis A. Es.pinoza, Police Chief, dated
August 12, 1985, recommending authority and funds for James
E. Mason to attend the lOth Annual Labor/Police/Management
Seminar in Las Vegas, Nevada, September 20-22, 1985, with an
expense allowance of $443.36, was presented.

It was moved by Gonzales, seconded by Davis, that the
recommendation of the Police Chief be approved and that
authority be granted to issue a warrant to James E. Mason
in the amount of $443.36 to attend the lOth Annual Labor/Police/
Management Seminar in Las Vegas, Nevada, september 20-22, 1985.
Motion carried.
Communication from George F. Bass, Fire Chief, dated
August 13, 1985, recommending authority and funds for Lloyd
Schultz to attend the Fair Labor Standards Act at the Los
Angeles International Airport September 5, 1985, with an
expense allowance of $73.00, was presented.

It was moved by Davis, seconded by Ybarra, that the rec-
ommendation of the Fire Chief be approved and that authority
be granted to issue a warrant to Lloyd Schultz in the amount
of $73.00 to attend the Fair Labor Standards Act at the Los
Angeles International Airport, September 5, 1985. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated August 15, 1985, advising The California Plan for Com-
mercial and Apartment Conservation Service, dated March 1985,
has been reviewed by the Director of Water & Power and rec-
ommending this plan be adopted and notification of said
adoption be made to the Department of Energy and the Califor-
nia Energy Commission and a program instituted, was presented.
It was moved by Gonzales, seconded by Davis, that the
recommendation of the City Clerk be approved and the Califor-
nia Plan for Commercial and Apartment Conservation Service be
adopted and notification of said adoption be made to the De-
partment of Energy and the California Energy Commission.
Motion carried.
Warrant Register No. 675, covering claims and demands
presented during the period August 1-15, 1985, which includes
Demand Nos. 5674-5862 (both inclusive}, excluding void Demand
Nos. 5698, 5699, 5700 and 5815, and Light and Power Demands,
drawn on the First Interstate Bank, totaling $73,772.51
(Accounting period August 1985), was examined and audited.
It was moved by Ybarra, seconded by Davis, that Warrant
Register No. 675 be approved and payment authorized for De-
mand Nos. 5674-5862 (both inclusive), excluding void Demand
Nos. 5698, 5699, 5700 and 5815, and Light and Power Demands,
in the amount of $73,772.51, with no other exceptions. Motion
carried.

Warrant Register No. 675, covering claims and demands pre-
sented during the period August 1-15, 1985, which includes
Light & Power Demand Nos. 5689, 5694, 5696, 5727, 5739, 5741,
5747, 5748, 5754, 5755, 57761 5782, 5786, 5792, 5793, 5794,
5799, 5808, 5810, 5815, 5832, 5836, 5839, 5840, 5843, 5851 and
5853, drawn on the First Interstate Bank totaling $6,779,252.76,
(Accounting period August 1985) was examined and audited.
It was moved by Gonzales, seconded by Ybarra, that Warrant
Register No. 675 be approved and payment authorized for Light &
Power Demand Nos. 5689, 5694, 5696, 5727, 5739, 5741, 5747, 5748,
5754, 5755, 5776, 5782, 5786, 5792, 5793, 5794, 5799, 5808, 5810,
5815, 5832, 5836, 5839, 5840, 5843, 5851 and 5853, in the amount
of $6,779,252.76, with no exceptions. Councilman Davis is abstain-
ing from voting on the above motion and is disqualifying himself
because it is reasonably foreseeable that the decision will have
a material financial effect on his source of income. Motion
carried.

Communication from Bruce V. Malkenhorst,Director of
Personnel, dated August 20, 1985, transmitting the minutes
of an Adjourned Regular Personnel Committee Meeting held
August 19, 1985, for approval of recommendations contained
therein, was presented.
It was moved by Gonzales, seconded by Ybarra, that the
minutes of an Adjourned Regular Personnel Committee meeting
held August 19, 1985, be approved as written and recommenda-
tions contained therein be adopted. Motion carried.
At 5:38 p.m., it was moved by Ybarra, seconded by
Gonzales, that the City Council go into executive session
under Attorney/Client privilege. Motion carried.

All persons with the exception of the City Clerk and the
City Attorney were excluded from the executive session.
Mayor Malburg declared all communications to and from
the executive session deemed private and confidential.
At 5:55 p.m., Councilman Davis was excused.
At 6:02 p.m., Councilman Davis resumed his seat on the
Council.
At 6:03 p.m., it was moved by Ybarra, seconded by Davis,
that the City Council go out of executive session and resume
regular session. Motion carried.
The City Attorney presented a proposed Compromise and
Release in regard to the Workers' Compensation Appeals Board
case of Ray Tisdale v. City of Vernon, Case No. 84 BG 089561
and recommended to the City Council that said Compromise and
Release be approved for a total lump sum of $12,687.09.
It was moved by Davis, seconded by Ybarra, that the pro-
posed Compromise and Release in the case of Ray.Tisdale v.
City of Vernon, Case No. 84 BG 089561, for a total lump sum of
$12,687.09 be approved and the City Attorney be authorized to
execute said Compromise and Release on behalf of the City of
Vernon. Motion carried.
RESOLUTION NO. 5209 - A Resolution Of The City Council Of
The City Of Vernon Commending Lois Hilton For Her Many Years Of
Service To The City Of Vernon, was presented.
It was moved by Ybarra, seconded by Davis, that Resolution
No. 5209 be approve.d and adopted. Motion carried.
