MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD SEPTEMBER 24,
1985 AT 3:15 P.M., IN THE COUNCIL CHAMBER
OF THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Davis, McCormick
MEMBERS ABSENT: Gonzales
The meeting was called to order by Mayor Malburg.

It was moved by McCormick, seconded by Ybarra, that the
minutes of the Adjourned Regular City Council Meeting held
September 3, 1985, be approved as written and submitted.
Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk, dated
August 12, 1985, recommending that the agreement by and between
the City of Vernon and D. N. & E. Walters be approved and the
Mayor be authorized to execute same. The agreement is for the
Bandini-Long Beach Freeway Signal and will save the City $400.00
per year in maintenance and approximately 62% of all extraoJ:di-
nary maintenance and reconstruction costs, was presented (de-
ferred from the Adjourned Regular City Council Meeting held
September 3, 1985).
It was moved by Ybarra, seconded by Davis, that the rec-
ommendation of the City Clerk be approved and the Mayor be
authorized to execute the agreement by and between the City of
Vernon and D. N. & E. Walters. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk, dated
August 26, 1985, stating that based on the City Council's in-
tent to amend the Public Employees' Retirement System's (PERS)
contract with the City of Vernon, a calculation has been made
to determine the costs to be incurred by the City. The amend-
ment will cost 3.245% of the combined safety payroll, or,
based on the budgeted 1985-86 salaries for safety personnel,
$112,035.00 a year, was presented (deferred from the Adjourned
Regular City Council Meeting held September 3, 1985).
It was moved by McCormick, seconded by Davis, that the com-
munication from the City Clerk providing the costs to be in-
curred by the City to amend the Public Employees' Retirement
System's (PERS) contract be deferred to executive session.
Motion carried.
Police Department Activity Log for the period Septem~
ber 1-15, 1985, was presented.

It was moved by Davis, seconded by Ybarra, that the Police
Department Activity Log for the period September 1-15, 1985,
be received and filed. Motion carried.
Fire Department Activity Report for the period Septem-
ber 1-15, 1985, was presented.
It was moved by McCormick, seconded by Davis, that the
Fire Department Activity Report for the period September 1-15,
1985, be received and filed. Motion carried.
Warrant Register No. 677, covering claims and demands pre-
sented during the period September 1-15, 1985, which includes
Demand Nos. 5985-6141 (both inclusive), excluding void Demand
Nos. 6007, 6010-6012 (both inclusive), and Light and Power
Demands, drawn on the First Interstate Bank, totaling
$107,647.80 (accounting period September 1985), was examined and
audited.

It was moved by Ybarra, seconded by Davis, that Warrant
Register No. 677 be approved and payment authorized for Demand
Nos. 5985-6l41 (both inclusive), excluding void Demand Nos.
6007, 60l0-6012 (both inclusive) and Light and Power Demands
in the amount of $107,647.80, with no other exceptions. Motion
carried.
Warrant Register No. 677, covering claims and demands
presented during the period September 1-15, 1985, which includes
Light & Power Demand Nos. 5988, 5989, 5990, 6000, 6006, 6026,
6035, 6038, 6044, 6046, 6047, 6069, 6073, 6077, 6079, 6080,
6105, 6l16, 6117, 6122, 6123, 6127 and 6130, drawn on the First
Interstate Bank totaling $7,031,220.94 (accounting period Sep-
tember 1985), was examined and audited.

It was moved by McCormick, seconded by Ybarra, that War-
rant Register No. 677 be approved and payment authorized for
Light & Power Demands Nos. 5988, 5989, 5990, 6000, 6006, 6026,
6035, 6038, 6D44, 6046, 6D47, 6069, 6073,6077, 6079, 6080,
6105, 6l16, 6117, 6122, 6123, 6127 and 6130, in the amount of
$7,031,220.94, with no exceptions. Councilman Davis is ab-
staining from voting on the above motion and is disqualifying
himself because it is reasonably foreseeable that the decision
will have a material financial effect on his source of income.
Motion carried.
Health Department Report for the month of August, 1985,
was presented.
It was moved by Ybarra, seconded by Davis, that the Health
Department Report for the month of August, 1985, be received
and filed. Motion carried.
RESOLUTION NO. 5212 - A Resolution Of The City Council Of
The City Of Vernon Requesting That The League Of California
Cities Initiate A Statewide Ballot Initiative Regarding Joint
And Several Liability, was presented.
It was moved by McCormick, seconded by Davis, that Res-
olution No. 5212 be approved and adopted. Motion carried.

RESOLUTION NO. 5213 - A Resolution Of The City Council Of
The City Of Vernon Amending Schedule VII, Exhibit "F", Of Res-

Certain Expense Allowances, was presented.

Communication from L. A. Espinoza, Chief of Police, dated
September 16, 1985, requesting authority and funds for Solomon
Benudiz to attend the California Narcotic Officers Association
Training Conference in Millbrae, California, October 24-27,
1985, with an expense allowance of $551.10, was presented.
It was moved by Davis, seconded by McCormick, that the
recommendation of the Chief of Police be approved and author-
ity be granted to issue a warrant in the amount of $551.l0 to
Solomon Benudiz to attend the California Narcotic Officers
Association Training Conference in Millbrae, California,
October 24..27, 1985. Motion carried.

Finance, transmitting the minutes of the Adjourned Regular
Finance Committee Meeting held September 16, 1985, for ap-
proval of recommendations contained therein, was presented.
It was moved by McCormick, seconded by Davis, that the
minutes of the Adjourned Regular Finance Committee Meeting
held September 16, 1985, be approved as written and recom-
mendations contained therein be adopted. Motion carried.
Communication from Lewis R. Adams, Director of Light &
Power, dated September 18, 1985, requesting authority and
funds for Robert Kipness to attend the California Air Re-
sources Board Seminar "Fundamentals of Enforcement" in Santa
Cruz, California, October 1-3, 1985, with an expense allowance
of $444.50, was presented.
It was moved by Ybarra, seconded by Davis, that the rec-
ommendation of the Director of Water & Power be approved and
authority be granted to issue a warrant to Robert Kipness in
the amount of $444.50 to attend the California Air Resources
Board Seminar "Fundamentals of Enforcement" in Santa Cruz,
California, October 1-3, 1985. Motion carried~
Communication from Bruce V. Malkenhorst, City Clerk, dated
September II, 1985, transmitting the 1985-86 In-Lieu Replenish-
ment Agreement with Central and West Basin Water Replenishment
District. This agreement has been reviewed by the Director of
Water and it is hereby recommended that said agreement be ap-
proved and the Mayor be authorized to execute same, was pre-
sented.
RESOLUTION NO. 5215 - A Resolution Of The City Council Of
The City Of Vernon Approving The Execution Of A 1985-86 In-
Lieu Replenishment Agreement By And Between The City Of Vernon
And The Central And West Basin Water Replenishment District,
was presented.

sonnel, dated September 24, 1985, transmitting the minutes of
the Adjourned Personnel Committee Meeting held September 23,
1985, for approval of recommendations contained therein, was
presented.
It was moved by Ybarra, seconded by Davis, that the minutes
of the Adjourned Personnel Committee Meeting held September 23,
1985, be approved as written and recommendations contained
therein be adopted. Motion carried.
At 4:02 p.m., it was moved by McCormick, seconded by .
Ybarra, that the City Council go into executive session under
Attorney/Client privilege. Motion carried.
All persons with the exception of the City Clerk, and the
City Attorney were excluded from the executive session.
Mayor Malburg declared all communications to and from
the executive session deemed private and confidential.
At 4:40 p.m., Councilman Davis was excused.
At 4:54 p.m., Council Davis resumed his seat on the Council.
At 4:55 p.m., it was moved by Ybarra, seconded by McCormick,
that the City Council go out of executive session and resume
regular session. Motion carried.

There being no further business to come before the City
Council, it was moved by Ybarra, seconded by McCormick, that
the meeting be adjourned. Motion carried.
