MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD OCTOBER 1,
1985 AT 5 :00 P.M., IN THE COUNCIL CHAMBER
OF THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales, McCormick
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.

It was moved by Ybarra, seconded by Gonzales, that the
minutes of the Adjourned Regular City Council Meeting held
September 24, 1985, be approved as written and submitted.
Motion carried.
Communication from Mr. J. Jeffrey Little of Crookall,
Shirley & Company, dated September 20, 1985, requesting per-
mission to address the City Council regarding the fencing of
the alley on the north side of 38th Street, just east of
Alameda Street, was presented.
The City Clerk advised the Mayor that Mr. Little was
present and in the audience.
The Mayor asked Mr. Little if he would like to address
the City Council at this time.
Mr. Little advised the Council that he was there on be-
half of his client Manny Zosa who is +equesting permission
of the Council to install fencing on the 38th Street side of
the alley of property located at 3710 S. Alameda Street. Mr.
Little stated that his client felt it necessary due to the
increased crime and easy access to his building.
Mayor Pro-Tern Ybarra suggested that perhaps brighter
lighting could be installed which should curtail any problem
Mr. Zosa may be having.
It was moved by McCormick, seconded by Davis, that the
request of Mr. Little on behalf of Mr. Manny Zosa be denied.
Motion carried.
At this time, the City Clerk advised the Mayor that Mr.
Bill Parks from Los Angeles Junction Railway wished to address
the City Council.

Mr. Bill Parks came before the Council along with Mr. Tom
Buckley of Santa Fe Railway to request approval to stage a
simulated auto vs. train accident. The location would be on
Boyle just south of Vernon Avenue and the time involved would
be approximately from 8:00 a.m. to 9:30 a.m, on November 7, 1985.
It was moved by McCormick, seconded by Davis, that approval
be granted to stage the simulated accident and block off the
necessary area contingent upon their providing traffic control
for the required period of time. Motion carried.
Payroll Warrant Register No. 348, covering claims and
demands presented during the period August 18-September 14,
1985, which includes Demand Nos. 4283-4305 (both inclusive),
drawn on the Crocker National Bank totaling $656,319.52
(accounting period September 1985), was examined and audited.

It was moved by Ybarra, seconded by Davis, that Pa~oll
Warrant Register No. 348, be approved and payment authorized
for Demand Nos. 4283-4305 (both inclusive), in the amount of
$656,319.52, with no exceptions. Motion carried.
Warrant Register No. 678, covering claims and demands
presented during the period September 16-30, 1985, which
includes Demand Nos. 6142-6259 (both inclusive), excluding
void Demand Nos. 6146, 6153, 6168-6172 (both inclusive), and
Light and Power Demands, drawn on the First Interstate Bank
totaling $205,292.27 (accounting period October 1985), was
examined and audited.

It was moved by Gonzales, seconded by Ybarra, that War-
rant Registe.r No. 678 be approved and payment authorized for
Demand Nos. 6142-6259 (both inclusive), excluding void Demand
Nos. 6146, 6153, 6168-6172 (both inclusive), and Light and
Power Demands in the amount of $204,292.27, with no other
exceptions. Motion carried.
Warrant Register No. 678, covering claims and demands
presented during the period September 16-30, 1985, which
includes Light & Power Demand Nos. 6143, 6145, 6156-6159
(both inclusive), 6185, 6191, 6197, 619ar 6199, 6201, 6205,
6214, 6218, 6227, 6231, 6237, 6240, 6242, 6249, 6251, and
6253, drawn on the first Interstate Bank totaling $380,748.67
(accounting period October 1985), was examined and audited.
It was moved by McCormick, seconded by Ybarra, that War-
rant Register No. 678 be approved and payment authorized for
Light & Power Demand Nos. 6143, 6145, 6156-6159 (both inclusive),
6185, 6191, 6197, 6198, 6199, 6201, 6205, 6214, 6218, 6227,
6237, 6240, 6242, 6249, 6251 and 6253, in the amount of
$380,748.67, with no exceptions. Councilman Davis is ab-
staining from voting on the above motion and is disqualifying
himself because it is reasonably foreseeable that the decision
will have a material financial effect on his source of income.
Motion carried.
Police Department Activity Log for the period September
16-30, 198,5, was presented.
It was moved by Ybarra, seconded by Davis, that the Police
Department Activity Log for the period September 16-30, 1985,
be received and filed. Motion carried.
Fire Department Activity Report for the period september
16-30, 1985, was presented.
It was moved by McCormick, seconded by Gonzales, that the
Fire Department Activity Report for the period September 16-30,
1985, be received and filed. Motion carried.

Communication fram Bruce V. Ma1kenhorst, Director of
Finance, dated October l,~ 1985,transmi,tting the minutes of
the Adjourned Finance Committee Meeting held September 30,
1985, for approval of recommendations contained therein, was
presented.

It was moved by Davis, seconded by Gonzales, that the
minutes of the Adjourned Regular Finance Committee Meeting
held September 30, 1985, be approved as written and recom-
mendations contained therein be adopted. Motion carried.
RESOLUTION NO. 5218 - A Resolution Of The City Council
Of The City Of Vernon Expressing Its Support Of A Freeway
Access From The Long Beach Freeway At Slauson Avenue, was
presented.
It was moved by Ybarra, seconded by Gonzales, that Res-
olution No. 5218 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, City Clerk,
dated October 1, 1985, advising that due to the City Coun-
cil's intent to amend the Public Employees' Retirement
System ("PERSfI) contract by ordinance, which will provide
benefits pursuant to S20024.2 (one year final compensation)
for local fire members of the City of Vernon, an actuarial
report has been submitted by PERS on the valuation to deter-
mine the contribution required to amend said contract. The
report indicated that the City's contribution rate for all
safety employees would increase by 3.245% for the fiscal
year 1985-86 based upon the budgeted 1985-86 salaries for
all safety personnel and the City's contribution would equal
approximately $112,035.00 for the year, was presented.
It was moved by Gonzales, seconded by Ybarra, that the
communication from the City Clerk, regarding the City Coun-
cil's intent to amend the Public Employees' Retirement System
("PERS") be received and filed. Motion carried.
ORDINANCE NO. 956 - An Ordinance Of The City Council
Of The City Of Vernon Authorizing The Issuance Of Hoover
Uprating Project Revenue Bonds By Southern California
Public Power Authority, was read by title for a first reading.
It was moved by Ybarra, seconded by Gonzales, that
Ordinance No. 956 receive and pass a first reading. Motion
carried.

ORDINANCE NO. 957 - An Ordinance Of The City Council
Of The City Of Vernon Authorizing The Issuance Of Notes By
Southern California Public Power Authority, was read by
title for a first reading.
It was moved by McCormick, seconded by Davis, that
Ordinance No. 957 receive and pass a first reading. Motion
carried.

Communication from Police Captain Rosenkrantz, dated
September 25, 1985, requesting authority and funds for Lt.
James Mason to attend the California Association of Labor
Relations Officers' Training Seminar in Palm Springs, Cal-
ifornia, October 24-25, 1985, with an expense allowance of
$218.73, was presented.

It was moved by Ybarra, seconded by Davis, that the
recommendation of Captain Rosenkrantz be approved and
authority be granted to issue a warrant to James Mason in
the amount of $218.73 to attend the California Association
of Labor Relations Officers' Training Seminar in Palm
Springs, California, October 24-25, 1985. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated October 1, 1985, requesting authority to rent two (2)
eight passenger station wagons in San Francisco for the
League of California Cities Conference at a cost of approx-
imately $49.95 per day for each vehicle, was presented.

It was moved by Davis, seconded by Gonzales, that the
recommendation of the City Clerk be approved and that au-
thority be granted to rent two (2) eight passenger station
wagons in San Francisco for the League of California Cities
Conference at a cost of approximately $49.95 per day for
each vehicle. Motion carried.
RESOLUTION NO. 5219 - A Resolution Of The City Council
Of The City Of Vernon Approving And Authorizing The Execution
Of A Palo Verde Coordination Agreement Among The Cities Of
Azusa, Banning, Colton, Riverside and Vernon, was presented.
It was moved by Ybarra, seconded by McCormick, that
Resolution No. 5219 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk, dated
October 1, 1985, advising that a timely claim has been received
from G. A. B. Business Services, Inc., as subrogee of Watkins
Associated Industries, for property damage, and recommending
that said claim be denied, was presented.
It was moved by McCormick, seconded by Ybarra, that the
claim received from G. A. B. Business Services, Inc., on
behalf of Watkins Associated Industries be denied. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk, dated
October 1, 1985, recommending that the bid for the new lighting
system for the Diesel Plant from John T. Howard Electric in the
amount of $6,318.00 be accepted and authority be granted to
issue a purchase order, was presented.
It was moved by Ybarra, seconded by Gonzales, that the
recommendation of the City Clerk be approved and authority be
granted to issue a purchase order to John T. Howard Electric
in the amount of $6,318.00 for the new lighting system for the
Diesel Plant. Motion carried.

At 6:28 p.m., it was moved by Ybarra, seconded by MCCormick,
that the City Council go into closed session under Attorney/Client
privilege. Motion carried.
All persons with the exception of the City Clerk, City At-
torney, Louis Rosenkrantz, Luis Espinoza and James Mason were
excluded from the closed session.
Mayor Malburg declared all communications to and from the
closed session deemed private and confidential.
At 7:05 p.m., Louis Rosenkrantz, Luis Espinoza and James
Mason were excused.
At 7:30 p.m., it was moved by McCormick, seconded by Ybarra,
that the City Council go out of closed session and resume regular
session. Motion carried.

Council, it was moved by Ybarra, seconded by McCormick, that
the meeting be adjourned. Motion carried.
