MINUTES OF AN ADJOURNED REGULAR MEETING
OF THE CITY COUNCIL, HELD NOVEMBER 5, 1985
AT 5:00 P.M., IN THE COUNCIL CHAMBER OF
THE CITY HALL, LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales, McCormick
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Gonzales, that the
minutes of the Adjourned Regular City Council Meeting held
October 15, 1985, be approved as written and submitted.
Motion carried.
At this time, the Mayor presented Service Pin Awards to
the following employees:
Fire Engineer Carl Graffio 30 Years
Marvin King, Water Department 20 Years
Mr. Lew Adams, Director of Light & Power accepted on behalf
of Marvin King.
Report from the City Attorney concerning the Industrial
Disability Retirement of Fire Engineer Carl Graffio, dated
October 15, 1985, was presented, (deferred from October 15, 1985
City Council meeting).
It was moved by Davis, seconded by Ybarra, that the Report
from the City Attorney concerning the Industrial Disability
Retirement of Fire Engineer Carl Graffio, be received and filed.
Motion carried.
RESOLUTION NO. 5220 - A Resolution of the City Council of
the City of Vernon Determining the Disability Retirement of Carl
Graffio, A Local Safety Member Employed by the City of Vernon
(Sections 21024 & 21025 of the Government Code), was presented,
(deferred from October 15, 1985 City Council meeting).
It was moved by McCormick, seconded by Gonzales, that Res-
olution No. 5220 be approved and adopted. Motion carried.

RESOLUTION NO. 5222 - A Resolution Of The City Council Of
The City of Vernon Commending Carl Graffio For His Many Years Of
Service To The City Of Vernon, was presented.
It was moved by Gonzales, seconded by Ybarra, that Res-
olution No. 5222 be approved and adopted. Motion carried.

At 5:10 P.M., the Mayor declared a recess.
At 5:15 P.M., the City Council reconvened in regular

ORDINANCE NO. 955 - An Ordinance of the City Council of the
City of Vernon Authorizing An Amendment to the Contract Between
the City Council of the City of Vernon and the Board of Adminis-
tration of the Publice Employees' Retirement System (PERS),
was read by title for a second and final reading.
It was moved by McCormick, seconded by Davis, that
Ordinance No. 955 receive and pass a second and final reading and
be adopted. Motion carried.

Communication from Victor H. Vaites, Director of Community
Services, dated October 24, 1985, was presented, transmitting
Contract No. 471, Traffic Signal Modernization, Boyle Avenue &
Fruitland Avenue Intersection and recommending that said contract
be approved and authority be granted to advertise for bids.
RESOLUTION NO. 5223 - A Resolution Of The City Council Of
The City Of Vernon Approving Contract No. 471 And Authorizing
Notice Inviting Sealed Proposals Or Bids For Traffic Signal
Modernization, Boyle Avenue & Fruitland Avenue Intersection, In
Accordance With Contract No. 471 Of The City Of Vernon.
It was moved by Ybarra, seconded by Gonzales, that Res-
olution No. 5223 be approved and adopted. Motion carried.

RESOLUTION NO. 5224 - A Resolution Of The City Council Of
The City Of Vernon Approving Contract No. 472 And Authorizing
Notice Inviting Sealed Proposals Or Bids For Traffic Pavement
Striping 1986, In Accordance With Contract No. 472 Of The City
Of Vernon.
It was moved by McCormick, seconded by Davis, that Res-
olution No. 5224 be approved and adopted. Motion carried.

Communication from Jose M. Castillo, attorney at law,
dated October 22, 1985, on behalf of his client The Arres Family
Corporation, dba The San Antonio Rose, located at 4505 Downey
Road, Vernon, was presented. Mr. Castillo is requesting a
special permit to have live music on November 15 and 16, from
noon to 10:00 pm. Mr. Castillo asked that this request for a
special temporary permit be granted in order to allow the Arres
Family Corporation to celebrate the opening of its expanded
facility.
It was moved by Gonzales, seconded by Ybarra, that the
Communication from Jose M. Castillo, attorney at law, be deferred
to the City Council Meeting of November 19, 1985. Motion
carried.

Communication from Victor Vaits, Director of Community
Services, dated October 24,1985, was presented, requesting
authority and funds for Fred Tachovsky to attend the Interna-
tional Association of Electrical Inspectors' Executive Board and
General Membership meeting on November 22, 1985, with an expense
allowance of $41.20.
It was moved by McCormick, seconded by Davis, that
authority be granted to issue a warrant to Fred Tachovsky in the
amount of $41.20 to attend the International Association of
Electrical Inspectors' Executive Board and General Membership
meeting on November 22, 1985. Motion carried.
Payroll Warrant Register No. 349 covering claims and
demands presented during the period of September 15 thru October
12, 1985 which includes Demand Nos. 4309 thru 4331 (both inclusive)
drawn on the Crocker National Bank totaling $649,928.83 (accounting
period October 1985), was examined and audited.
It was moved by Ybarra, seconded by Davis, that Payroll
Warrant Register No. 349 be approved and payment authorized for
Demand Nos. 4309 thru 4331 (both inclusive) in the amount of
$649,928.83, with no exceptions. Motion carried.
Warrant Register No. 680 covering claims and demands
presented during the period of October 16 thru 31st, 1985, which
includes Demand Nos. 6428 thru 6614 (both inclusive), excluding
Void Demand Nos. 6458 thru 6464, 6503 thru 6505 (both inclusive),
6573, and 6582, and excluding Light & Power Demands, drawn on the
First Interstate Bank totaling $415,587.49 (accounting period
November 1985), was examined and audited.
It was moved by Davis, seconded by Gonzales, that Warrant
Register No. 680 be approved and payment authorized for Demand
Nos. 6428 thru 6614 (both inclusive), excluding Void Demand Nos.
6458 thru 6464, 6503 thru 6505 (both inclusive), 6573, and 6582,
and excluding Light & Power Demands, in the amount of
$415,587.49, with no other exceptions. Motion carried.

sented during the period of October 16 thru 31st, 1985, which
includes Light and Power Demand Nos. 6429, 6432 thru 6435,(both
inclusive 6444, 6445, 6447 thru 6451 (both inclusive),6453, 6455,

6559, 6575, 6583, 6588, 6591, 6593, 6598, 6600, and 6601, drawn
on the First Interstate Bank totaling $938,590.38 (accounting
period November 1985), was examined and audited.
It was moved by McCormick, and seconded by Ybarra, that
Warrant Regiater No. 680 be approved and payment authorized for
Light & Power Demand Nos. 6429, 6432 thru 6435, (both inclusive)
6444,6445,6447 thru 6451 (both inclusive),6453, 6455, 6470,
6493, 6500, 6511, 6512, 6520, 6539, 6542, 6544, 6547, 6548, 6559,
6575, 6583, 6588, 6591, 6593, 6598, 6600, and 6601, in the amount
of $938,590.38, with no exceptions. Councilman Davis is
abstaining from voting on the above motion and is disqualifying
himself because it is reasonably foreseeable that the decision
will have a material financial effect on his source of income.
Motion carried.
Police Department Activity Report - October 15 to 31, 1985,
was presented.
It was moved by Ybarra, seconded by Gonzales, that the
Police Department Activity Report for the Period October 15 to
31, 1985 be received and filed. Motion carried.
Fire Department Activity Report - October 15 to 31, 1985,
was presented.

It was moved by Davis, seconded by McCormick, that the
Fire Department Activity Report for the Period October 15 to 31,
1985 be received and filed. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated, November 4, 1985, was presented, recommending that authority
be granted for the purchasing section to go out to formal bid to
purchase additional lighting for the Diesel Plant, at an approxi-
mate cost of $20,000.
It was moved by McCormick, seconded by Ybarra, that
authority be granted for the purchasing section to go out to
formal bid for additonal lighting for the Diesel Plant. Motion
carried.
Communication from Bruce V. Malkenhorst, Director of
Personnel, dated November 5, 1985, was presented, transmitting
the minutes of the Adjourned Regular Personnel Committee Meeting
held November 4, 1985 for approval of recommendations contained
therein.
It was moved by Gonzales, seconded by Davis, that the
minutes of the Adjourned Regular Personnel Committee Meeting
held November 4, 1985, be approved as written and recommendations
contained therein be adopted. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Personnel, dated November 5, 1985, was presented, recommending
that Acting Lieutenant Robert Graham be appointed to the
position of Lieutenant, Grade 3, (no change in salary), effec-
tive November 10, 1985, contingent upon his executing an Employ-
ment Agreement for said position. Motion carried.
It was moved by Gonzales, seconded by Davis, that Acting
Lieutenant Robert Graham be appointed to the position of
Lieutenant, Grade 3, contingent upon his signing an Employment
Agreement for said position, effective November 10, 1985. Motion
carried.
RESOLUTION NO. 5225 - A Resolution of the City Council of
the City of Vernon, Transferring A Portion of the Private
Activity Bond Allocation of the City of Vernon to Los Angeles
County and Repealing Resolution No. 5190, was presented.
It was moved by Gonzales, seconded by Ybarra, that Res-
olution No. 5225, be approved and adopted. Motion carried.
At 6:10 p.m., it was moved by Ybarra, seconded by
McCormick, that the City Council go into Closed Session
under Government Code Section 54957. Motion carried.
All persons with the exception of Captain Rosenkrantz,
and Chief Espinoza, the City Clerk and the City Attorney
were excluded from the Closed Session.
Mayor Malburg declared all communications to and from
the Closed Session deemed private and confidential.
At 6:43 p.m., Captain Rosenkrantz and Chief Espinoza
were excused from Closed Session.
At 6:44 p.m., it was moved by McCormick, seconded by Ybarra,
that the City Council go out of closed Session and resume Regular
Session. Motion carried.

Communication from Bruce V. Malkenhorst, Director of Per-
sonnel, dated November 5, 1985, was presented, recommending that
Leilani Roach be terminated at the end of her tour of duty on
November 6, 1985, based upon her failure to pass probation.
It was moved by McCormick, seconded by Ybarra, that Leilani
Roach be terminated on November 6, 1985, based on her failure to
pass probation. Motion carried.
Communication from Bruce V. Malkenhorst, Director of Per-
sonnel, dated November 5, 1985, was presented, recommending that
Christopher Lopez be terminated on November 7, 1985, based upon
his failure to pass probation.
It was moved by Gonzales, seconded by Davis, that
Christopher Lopez be terminated on November 7, 1985, based on his
failure to pass probation. Motion carried.
At 6:50 p.m., it was moved by McCormick, seconded by Davis,
that the City Council go into Closed Session under Attorney/
Client privilege. Motion carried.
All persons with the exception of the City Clerk and the
City Attorney were excluded from Closed Session.
Mayor Malburg declared all communications to and from the
Closed Session deemed private and confidential.
At 6:53 p.m., it was moved by Davis, seconded by McCormick,
that the City Council go out of Closed Session and resume regular
Session. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk, dated
November 4, 1985, was presented, advising that a timely claim has
been received from the law offices of Larry H. Parker, Inc., on
behalf of Mr. Moises Navarro dated October 18, 1985 and received
on October 21, 1985, for property damages and bodily injury and
recommending that said claim be denied.
It was moved by McCormick, seconded by Ybarra, that the
claim received from the law offices of Larry H. Parker, Inc., on
behalf of Mr. Moises Navarro be denied. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk, dated
November 4, 1985, was presented, advising that a timely claim
from the law offices of Lubey & Lerner on behalf of Mr. Scott
Shong, dated October 3, 1985 and received on October 7, 1985, for
property damages and bodily injury and recommending that said
claim be denied.
It was moved by Davis, seconded by Gonzales, that the
claim received from the law offices of Lubey & Lerner on behalf
of Mr. Scott Shong, be denied. Motion carried.
The City Attorney presented proposed Stipulations with
Request for Award and Award in regard to the Workers' Compensa-
tion Appeals Board case of Paul Robert Zook v. City of Vernon,
Case No. 85 LA 520034/35 and recommended to the City Council that
said Stipulations be approved with a permanent disability rating
of 34 1/2%.
It was moved by Ybarra, seconded by McCormick, that the
proposed Stipulations with Request for Award and Award in the
case of Paul Robert Zook v. City of Vernon, Case No.
85 LA 520034/35 with a permanent disability rating of 34 1/2% be
approved and the City Attorney be authorized to execute said
Stipulations with request for Award and Award on behalf of the
City of Vernon. Motion carried.

Administrator/City Clerk be granted a 6% merit increase for a new
monthly salary of $8733, effective October 27, 1985; that his
executive time off be increased to 10 days per year; and that all
other recommendations be studied. Motion carried.
There being no further business to come before the City
Council, it was moved by Ybarra, seconded by McCormick, that the
meeting adjourn. Motion carried.
