MINTUES OF AN ADJOURNED REGULAR CITY
COUNCIL MEETING HELD FEBRUARY 4, 1986
AT 5:00 P.M. IN THE COUNCIL CHAMBERS OF
THE CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: MALBURG, YBARRA, DAVIS, GONZALES, MCCORMICK
MEMBERS ABSENT: NONE
It was moved by Ybarra, seconded by Davis, that the minutes
of the Adjourned Regular City Council meeting held January 28,
1986, be approved as written and submitted. Motion carried.
At this time, Mayor Malburg presented Service Pin Awards to
the following personnel:
Fire Fighter Anthony Van Ryte
Fire Engineer Gerald Lohrke
25 Years

Mayor Pro-Tem Thomas Ybarra presented the Mayor with his
30 Year Service Pin Award.
At 5:06 P.M., the Mayor declared a recess.
At 5:16 P.M., the City Council reconvened in Regular Session,
all members present before the recess, again being present.
Police Department Activity Log for the period January 16 thru
31, 1986, was presented.
It was moved by McCormick, seconded by Davis, that the Police
Department Activity Log for the period Janaury 16 thru 31, 1986 be
received and filed. Motion carried.
Fire Department Activity Report for the period January 16 thru
31, 1986, was presented.
It was moved by Gonzales, seconded by Ybarra, that the Fire
Department Activity Report for the period of January 16 thru 31,
1986, be received and filed. Motion carried.
Payroll Warrant Register No. 352 covering claims and demands
presented during the period of 12/8/85 thru 1/18/86 which
includes Demand Nos. 4381 thru 4411 (both inclusive) drawn on
the Crocker National Bank totaling $978,583.47. (Accounting
Period January 1986), was examined and audited.
It was moved by Ybarra, seconded by Davis, that Payroll
Warrant Register No. 352 be approved and payment authorized for
Demand Nos. 4381 thru 4411 (both inclusive) in the amount of
$978,583.47 with no other exceptions. Motion carried.
Warrant Register No. 686 covering claims and demands presen-
ted during the period of January 15 thru 31, 1986 which includes
Demands Nos. 7448 thru 7537 (both inclusive) excluding Void
Demand Nos. 7472 thru 7475 and excluding Light and Power Demands
drawn on the First Interstate Bank totaling $120,489.41. (Accoun-
ting Period February 1986), was examined and audited.
It was moved by McCormick, seconded by Gonzales, that Warrant
Register No. 686 be approved and payment authorized for Demand
Nos. 7448 thru 7537 (both inclusive) excluding Void Demand Nos.
7472 thru 7475 and excluding Light & Power Demands in the amount
of $120,489.41, with no exceptions. Motion carried.
Warrant Register No. 686 covering claims and demands presen-
ted during the period of January 15 thru 31, 1986 which includes
Light & Power Demand Nos. 7448 thru 7451 (both inclusive) 7453,
7456, 7462 thru 7465 (both inclusive) 7468, 7471, 7483, 7485,
7489, 7494, 7497, 7499, 7516, 7519, 7531 and 7535 drawn on the
First Interstate Bank totaling $805,418.61. (Accounting period
February 1986), was examined and audited.

It was moved by Ybarra, seconded by Gonzales, that Warrant
Register No. 686 be approved and payment authorized for Light &
Power Demand Nos. 7448 thru 7451 (both inclusive) 7453, 7456,
7462 thru 7465 (both inclusive) 7468, 7471, 7483, 7485, 7489,
7494, 7497, 7499, 7516, 7519, 7531 and 7535, in the amount of
$805,418.61, with no exceptions. Motion carried. Councilman
Davis is abstaining from voting on the above motion and is
disqualifying himself because it is reasonably foreseeable that
the decision will have a financial effect on his source of income.

Communication from Bruce V. Malkenhorst, Director of Per-
sonnel, dated February 3, 1986, was presented, recommending that the
following personnel actions be approved:
1. The Employment Agreement for the Position of Police
Officer I in the Vernon Police Department by and be-
tween the City of VArnon and officer Rex Hill be
accepted and ratified.
It was moved by Gonzales, seconded by Ybarra, that
the Employment Agreement for the Position of Police
Officer I in the Vernon Police Department by and
between the City of Vernon and Officer Rex Hill be
accepted and ratified. Motion carried.
2. Merit Step Increases:
Sergeant Jim Wohlt be granted a merit step increase
to Sergeant Step 2 with a new monthly salary of $2884
which includes the 2 1/2% increase for his possession
of the Intermediate P.O.S.T. Certificate, effective
February 3, 1986, based on his satisfactory job per-
formance since his promotion to Sergeant.
It was moved by Davis, seconded by Ybarra, to grant
Sergeant Jim Wohlt a merit step increase to Sergeant
Step 2 with a new monthly salary of $2884 which
includes the 2 1/2% increase for his possession of the
Intermediate P.O.S.T. Certificate, effective February 3,
1986. Motion carried.

Fire Captain James Dunn to Captain, Step 1 with a
monthly salary of $3287 effective March 2, 1986,
based on his satisfactory job performance during the
past year.
It was moved by McCormick, seconded by Davis, to grant
Fire Captain James Dunn a merit step increase to Captain,
Step 1, effective March 2, 1986. Motion carried.
Fire Captain Gary Dressen to Captain, Step 2, with a
monthly salary of $3194 (which includes the 2 1/2%
educational incentive pay) based on his satisfactory
job performance during the past year, effective
March 2, 1986.
It was moved by Ybarra, seconded by Davis, to grant
Fire Captain Gary Dressen a merit step increase to
Fire Captain Step 2 with a new monthly salary of $3194
(which includes the 2 1/2% Educational Incentive Pay
previously granted) effective March 2, 1986. Motion
carried.
3. Police Training Classes
Officer Brad Elliott be granted authority to attend an
Advanced Officer Training Course at Rio Hondo College
March 17 to 19, at a cost of $10 for registration.
It was moved by McCormick, seconded by Gonzales, to
grant Officer Brad Elliott authority to attend an

Advanced Officer Training Course, on March 17 to 19,
1986. Motion carried.
Officer James Rodino to attend Field Training Officer
School at Golden West Academy March 17 to 21, 1986,
with no fees payable by the City.
It was moved by Ybarra, seconded by Davis, to grant
Officer James Rodino authority to attend Field Training
Officer School, on March 17 to 21, 1986. Motion
carried.

4. Reimbursements:
Officer Rex Hill be reimbursed for half the purchase
price of his body armor in the amount of $159.70.
It was moved by Davis, seconded by Gonzales, to
reimburse Officer Rex Hill one half the purchase price
of his body armor. Motion carried.
Engineering Aide Jorge Somoano be reimbursed $169.50
from the Education & Training Appropriation Account
for his satisfactory completion of college courses
related to his position with the city.
It was moved by McCormick, seconded by Gonzales, to
reimburse Engineering Aide Jorge Somoano $169.50.
Motion carried.
City Clerk's certification, was presented, pursuant to Sections
22843.5 or 22844 of the Elections Code of the State of California,
certifying to the following facts relating to the General
Municipal Election to be held on Tuesday April 8, 1986:
As of 5 p.m. on January 30, 1986, there were adequate
nominees for elective office in this city. The persons nominated
are:
Leonis C. Malburg
Thomas A. Ybarra
William M. McCormick
That Section 22843.5 and 22844 of the Elections Code allows
one of the following courses of action to be taken by the City
Council:
I
1. Appoint to the office the person(s) who have/has been
nominated.
2. Appoint to the office any eligible voter if no one has
been nominated.
3. Hold the election if either no one or only one person
has been nominated.
A notice of these facts will be posted (since there is no
newspaper of general circulation in the City of Vernon) on
February 5, 1986, in the City pursuant to Sections 22830,
22831, and 22903 of the Elections Code. After the tenth day
following the date of publication, the City Council will meet
again to either make the appointment(s) or direct an election
to be held. The person(s) appointed, if any, shall qualify and
take office and serve exactly as if elected at a municipal
election for the office.
If, by the 50th day before the municipal election, no person
has been appointed to the office(s) pursuant to (1) or (2) above,
the election shall be held.

If the City Council makes an appointment pursuant to Section
22843.5 or 22844 of the Elections Code, the City Clerk shall not
accept for filing any statement of write-in candidacy which is
submitted after the appointment is made.
It was moved McCormick, seconded by Ybarra, that the
Certification from the City Clerk certifying to the aforementioned
facts relating to the General Municipal Election to be held on
April 8, 1986, be received and filed. Motion carried.
Communication from the City Clerk, dated Febuary 4, 1986,
was presented, recommending that authority be granted to deposit
$115,792.39 each month for the next two months in a bank account
established by the City of Riverside, for Vernon's share of the
anticipated cost of replacement capacity and replacement energy,
in accordance with the Palo Verde Coordination Agreement.
It was moved by McCormick, seconded by Gonzales, that the
recommendation of the City Clerk to deposit into an account
established by the City of Riverside the amount of $115,792.39
each month for the next two months, be approved. Motion
carried.
At 5:45 P.M., it was moved by Gonzales, seconded by Ybarra,
that the City Council will recess to Closed Session to confer
with its Attorney regarding pending litigation pursuant to
Government Code Sections 54956.9(a) & 54956.9(c). Motion
carried.
All persons with the exception of the City Clerk and the
City Attorney, were excluded from Closed Session.
The Mayor declared all communications to and from Closed
Session privileged and confidential.
Councilman Davis was excused from Closed Session, the time
being 5:58 pm.
Councilman Davis resumed his seat on the Council, the time
being 6:38 pm.
It was moved by McCormick, seconded by Ybarra, that the
Council go out of Closed Session, the time being 6:38 pm.
Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated February 4, 1986, was presented, advising of a timely
claim from Mobil Oil Corporation on January 13, 1986 for alleged
personal injuries to a Mr. Edwardo Contino. The City Clerk
advised that the claim has been reviewed by our liability
administrators and hereby recommends that said claim be denied.
It was moved by Gonzales, seconded by Davis, that the claim
of Mobil Oil Corporation be denied. Motion carried.
The City Attorney requested the City Council's ratification
and approval of a Petition For Declaratory Order, Complaint And
Plea For Expedited Commission Processing And Waiver Of Procedural
Regulations In Order To Assure That Vernon Will Receive Timely
Credit For Intergration Of Its Interest In Palo Verde Nuclear
Generating Station Unit No. 1 In Accordance With Intergrated
Operation Agreement Between Vernon And Southern California
Edison Company filed with the Federal Energy Regulatory
Commission, Docket No. EL 86-21-000.
It was moved by Ybarra, seconded by McCormick, that the City
Attorney's request be approved and that said Petition is hereby
ratified and approved. Motion carried. Councilman Davis is
abstaining from voting on the above motion and is disqualifying
himself because it is reasonably foreseeable that the decision
will have a material financial effect on his source of income.

It was moved by Ybarra, seconded by Gonzales, that the City
host the Independent Cities Association's General Membership
Meeting on May 15, 1986. Motion carried.
There being no further business to come before the Council
it was moved by McCormick, seconded by Ybarra, that the meeting
adjourn. Motion carried.
