It was moved by Gonzales, seconded by Ybarra, that Resolution No. 5302 be approved and adopted. Motion carried. Police Department Activity Log for the period July 1, thru 14, 1986, was presented. It was moved by McCormick, seconded by Davis, that the Police Department Activity Log for the period July 1, thru 14, 1986, be received and filed. Motion carried. Fire Department Activity Report for the period July 1 thru 14, 1986, was presented. It was moved by Ybarra, seconded by Gonzales, that the Fire Department Activity Report for the period July 1 thru 14, 1986, be received and filed. Motion carried. Health Department Report for the month of June, 1986, was presented. It was moved by Davis, seconded by Davis, that the Health Department Report for the month of June, 1986, be received and filed. Motion carried. Communication from Luis Espinoza, Chief of POlice, dated June 5, 1986, was presented, requesting authority and funds for Lieutenant James Mason to attend the Eleventh Annual Labor/ POlice/Management Seminar to be held in Las Vegas, Nevada, on September 11 to September 13, 1986, with an expense allowance of $413.50. I It was moved by Ybarra, seconded by Davis, that authority be granted to issue a warrant in the amount of $413.50 to James Mason to attend the Eleventh Annual Labor/police/Management Seminar to be held in Las Vegas, Nevada, on September 11 to 13, 1986. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated July 9, 1986, was presented, advising of a receipt of a request from Byron Jackson Pump Division, located at 2300 E. Vernon Avenue, for a six month extension to their existing temporary trailer permit that expired July 1, 1986. This request has been reviewed by the Director of Community Services and it is hereby recommended that the request for an extension to January 1, 1987 be approved. It was moved by Gonzales, seconded by Ybarra, that the recommendation of the City Clerk be approved and that an extension be granted to Byron Jackson Pump Division for their temporary trailer permit to January 1, 1987. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated July 9, 1986, was presented, advising of receipt of a signed frontage improvement agreement by Philip MacDonald for Ayers W133~ City Council Minutes Page 2 July 15, 1986 Avenue and a check in the amount of $5,100.00 to cover the expenses for work being performed by the City. This agreement has been reviewed by the Director of Community Services and it is hereby recommended that said agreement be approved and that the Mayor and City Clerk be authorized to execute same. It was moved by Ybarra, seconded by Davis, that the recommendation of the City Clerk be approved and that the Mayor and City Clerk be authorized to execute the frontage improvement agreement by Philip MacDonald for Ayers Avenue. Motion carried. I RESOLUTION NO. 5300 - A Resolution Of the City Council Of The City Of Vernon Approving The City Clerk's Appointment Of A Voter's Canvassing Board For The Special Municipal Election To Be Held On Tuesday, August 12, 1986, was presented. It was moved by Gonzales, seconded by Davis, that Resolution No. 5300 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated July 10, 1986, was presented, transmitting a computation report concerning the proposed Energy Cost Adjustment Billing Factor for the next three month period, as prepared by Lew Adams, Oper- ations Manager of the Light & Power Department. It is hereby recommended that the negative factor of $0.02486 be approved to be effective August 1, 1986. RESOLUTION NO. 5301 - A Resolution of the City Council Of The City Of Vernon Changing The Energy Cost Billing Factor Charged For Electrical Energy Distributed And Supplied To Its Electrical Consumers, was presented. It was moved by McCormick, seconded by Gonzales, that the computation report concerning the proposed Energy Cost Adjust- ment Billing Factor be received and filed, and that Resolution No. 5301 be approved and adopted. Motion carried. Warrant Register No. 697 - covering claims and demands presented during the period of July 1, thru July 15th, 1986 which includes Demand Nos. 9183 thru 9358 (both inclusive) excluding Void Demand Nos. 9192, 9206, 9207 and 9208 and excluding Light & Power Demands, drawn on the First Interstate Bank totaling $206,592.39. (Accounting Period July 1986), was examined and audited. I It was moved by Ybarra, seconded by Davis, that Warrant Register No. 697 be approved and payment authorized for Demand Nos. 9183 thru 9358 (both inclusive) excluding Void Demand Nos. 9192, 9206, 9207 and 9208 and excluding Light & Power Demands in the amount of $206,592.39, with no other exceptions. Motion carried. Warrant Register No. 697 - covering claims and demands presented during the period of July 1, thru July 15, 1986 which includes Light & Power Demands Nos. 9193, 9194, 9202, 9230, 9234, 9244, 9257, 9258, 9294, 9313, 9317, 9329, 9336, 9340, 9351, 9357 and 9358 drawn on the First Interstate Bank totaling $4,921,949.30. (Accounting Period July 1986), was examined and audited. It was moved by McCormick, seconded by Ybarra, that Warrant Register No. 697, be approved and payment authorized for Light & Power Demand Nos. 9193; 9194, 9202, 9230, 9234, 9244, 9257, 9258, 9294, 9313, 9317, 9329, 9336, 9340, 9351, 9357 and 9358, in the amount of $4,921,949.30, with no other exceptions. Motion carried. Councilman Davis is abstaining from voting on the above motion and is disqualifying himself because it is reasonably foreseeable that the decision will have a material financial effect on his source of income. Malkenhorst, Director of Personnel, dated July 15, 1986, was presented, transmitting the minutes of the adjourned Regular Personnel Committee Meeting held July 14, 1986, for your approval of recommendations con- tained therein. It was moved by Gonzales, seconded by Ybarra, that the minutes of the adjourned Personnel Committee Meeting held July 14, 1986, be approved as written and recommendations contained therein be adopted. Motion carried. I Communication from Bruce V. Malkenhorst, Director of Personnel, dated July 15, 1986, was presented, recommending that the Employment Agreement for the position of Police Officer I in the Vernon Police Department by and between Fernando Ramon Rodriguez and the City of Vernon be accepted and ratified, effective July 14, 1986. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated July 15, 1986, was presented, advising of a request from Kal Kan for an extension of their twenty (20) trailer permits. Present construction of their new office facility is underway and it is hereby recommended that said extension be granted to February 1, 1987. It was moved by Ybarra, seconded by Gonzales, that the recommendation of the City Clerk be approved and the request from Kal Kan for an extension of the twenty (20) trailer permits be granted to February 1, 1987. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated July 15, 1986, was presented, recommending that Art Morales be given a 30 day notice to vacate the premises at 3382 E. 50th Street. It was moved by Gonzales, seconded by Davis, that Art Morales be given a 30 day notice to vacate the premises at 3382 E. 50th Street. Motion carried. At 5:17 P.M., the Mayor declared a short recess. At 5:30 P.M. the Council reconvened in regular session I At this time the Mayor advised that this was the time to open the Evendentiary Hearing on the Application for a PERS Disability Retirement of Ronald L. Cummings (continued from June 24, 1986). A court reporter was present and transcribed the pro- ceedings which occurred. The Mayor declared that the Evendentiary Hearing in the matter of Ronald L. Cummings' application for a PERS disability Retirement be adjourned to a later date. It was moved by Ybarra, seconded by Gonzales that an Administrative Subpoena for Lloyd Schultz be issued and the Mayor be authorized to issue same in order to secure his testimony in the matter of Ronald L. Cummings' application for a PERS disability retirement. Motion carried At this time the Mayor declared a five minute recess. The Mayor ordered all communications to and from Closed Session deemed privileged and confidential. Councilman Davis was excused from Closed Session, the time being 7:24 p.m. Councilman Davis resumed his seat on the Council, the time being 7:30 p.m. It was moved by McCormick, seconded by Ybarra, that the Council go out of Closed Session and resume regular session. Motion carried. The City Attorney advised the City Council that on March 21, 1986, the City of Vernon filed a Protest, Support for Edison's Request for Waiver of Notice Requirements, and Motion to Intervene before the Federal Energy Regulatory Commission in Docket No. ER 86-344. He further indicated that this filing was made to test the justness and reasonableness of Edison's proposed rates for interruptible transmission service to Vernon. The City Attorney further advised the City Council that on July 2, 1986, the City of Vernon filed a Protest, Motion for Summary Rejection, Request for Hearing and Motion to Intervene before the Federal Energy Regulatory Commission in Docket No. EF86-205l. He further indicated that this filing was made to protest Bonneville Power Administration's proposed rate for Firm Displacement power sales effective December 16, 1986. He recom- mended that the City Council approve and ratify the filing of the aforementioned motions. It was moved by Gonzales, seconded by Ybarra, that the City Attorney's actions in filing said motions to intervene in FERC Docket Nos. 86-344 and EF86-205l are hereby ratified and approved. Motion carried. Councilman Davis is abstaining from voting on the above motion and is disqualifying himself because it is reasonably foreseeable that the decision will have a material financial effect on his source of income. Motion carried. There being no further business to come before the Council it was moved by McCormick, seconded by Ybarra, that the meeting adjourn to July 29, 1986 at 5:00 p.m. Motion carried.
