19870818 Regular City Council Meeting - Minutes I I MINUTES OF A CITY COUNCIL MEETING OF THE CITY OF VERNON HELD AUGUST 18, 1987, AT 4:45; P.M. IN THE CITY COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Davis, Gonzales MEMBERS ABSENT: McCormick The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by Gonzales, that the minutes of the City Council meeting held August 4, 1987, be approved and adopted. Motion carried. Police Department Activity Log for the period August 1st thru 15, 1987, was presented. It was moved by Davis, seconded by Gonzales, that the Police Department Activity Log for the period of August 1st thru 15, 1987 be received and filed. Motion carried. Fire Department Activity Report for the period August 1st thru 15, 1987, was presented. It was moved by Ybarra, seconded by Davis, that the Fire Department Activity Report for the period of August 1st thru 15, 1987 be received and filed. Motion carried. Health Department Report for the month of July, 1987. r It was moved by Gonzales, seconded by Ybarra, that the Health Department Report for the month of July 1987, be deferred to the next City Council meeting. Motion carried. At this time it was moved by Ybarra, seconded by Davis, that the Public Hearing in the matter of Ordinance 970 be opened the time being 5:00 P.M. Motion carried. There was no one in the audience who wished to make any comments with regard to Ordinance No. 970. Larry Spadt, Acting Fire Chief, spoke briefly about Ordinance No. 970 and stated that basically there were not any major changes however this ordinance would now meet with the 1985 Edition of the Uniform Fire Code. It was moved by Gonzales, seconded by Davis, that the Public Hearing be closed, the time being 5:10 P.M. Motion carried. ORDINANCE NO. 970 - An Ordinance of the City Council of the City of Vernon, State of California, Amending Chapter 7, Fire Prevention, of the Code of the City of Vernon; and Adopting By Reference the Uniform Fire Code 1985 Edition, Including Appendices I-C, II-A, II-B, II-D, III-A, III-B, III-C,IV-A, V-A, VI-A, And Prescribing Regulations Governing Conditions Hazardous to Life and Property from Fire and Explosion; and Uniform Fire Code Standards and Repealing all Ordinances and Parts of Ordinances in Conflict Therewith, was read by title for a second and final reading. It was moved by Ybarra, seconded by Davis, that Ordinance No. 970 receive and pass a second and final reading and be adopted. Motion carried. Motion carried. There was no one in the audience who wished to address the Council regarding Ordinance No. 971. Victor Vaits, Director of Community Services advised the Council that there were no major changes being made by adoption of this Ordinance and basically it is needed in order to conform with the 1985 Edition of the Uniform Building Code, 1987 Edition of the National Electrical Code and the 1985 Edition of the Uniform Plumbing Code. It was moved by Davis, seconded by Ybarra, that the public hearing be closed the time being 5:20 P.M. Motion carried. ORDINANCE NO. 971 - An Ordinance of the City Council of the City of Vernon, State of California, Amending Chapter 7, Buildings; and Chapter 21, Sewers and Sewage Disposal, of the Code of the City of Vernon; and Adopting by Reference the Uniform Building Code 1985 Edition, Including Appendices, Chapters 1, 11, 12, 32, 38, & 57; National Electrical Code 1987 Edition, Uniform Mechanical Code 1985 Edition, including Appendices, Chapters A, B, and C; And Uniform Plumbing Code 1985 Edition, Including Appendices A, B, C, D, H, and I, and Repealing All Ordinances and Parts of Ordinances in Conflict Therewith, was read by title for a second and final reading. It was moved by Gonzales, seconded by 'Davis, that Ordinance No. 971 receive and pass a second and final reading and be adopted. Motion carried. There were no comments from the audience. Communication from Bruce V. Malkenhorst, City Clerk, dated August 10, 1987, was presented, requesting authority and funds for the below listed City Officials to attend the League of California Cities-89th Annual Conference in San Francisco, California, on October 4 thru 7, 1987, with an expense allowance of $1035: Leonis Malburg, Mayor Thomas Ybarra, Mayor Pro Tern Mike McCormick, Councilmember Bruce V. Malkenhorst, City Administrator David B. Brearley, City Attorney Victor Vaits, Director of Community Services Luis Espinoza, Chief of Police Fire Chief It was moved by Ybarra, seconded by Davis, that authority be granted to issue the above listed City Officials a warrant in the amount of $1035 to attend the League of California Cities-89th Annual Conference on October 4 thru 7, 1987. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 10, 1987, was presented, requesting authority and funds for Councilmembers Bill Davis and Larry Gonzales to attend the League of California Cities-89th Annual Conference in San 1533 I I City Council Minutes page 3 August 18, 1987 Francisco, California, on October 4 thru 7, 1987, with an expense allowance of $573. It was moved by Ybarra, seconded by Gonzales, that authority be granted to issue Councilmembers Bill Davis and Larry Gonzales a warrant in the amount of $573 to attend the League of California Cities-89th Annual Conference on October 4 thru 7, 1987. Motion carried. Communication from Norman Michiels, Director of Environmental Health, was presented, dated August 10, 1987, requesting authority and funds for John Reid, Environmental Specialist, to attend the Fundamental Course for Radiological Monitor in San Luis Obispo, California on August 23 thru 27, 1987, with an expense allowance of $369.60. It was moved by Davis, seconded by Ybarra, that author- ity be granted to issue John Reid, Environmental Specialist, a warrant in the amount of $369.60 to attend the Fundamental Course for Radiological Monitor on August 23 thru 27, 1987. Motion carried. Communication from Bruce V. Malkenhorst, Director of Personnel, dated August 12, 1987, was presented, transmitting the agenda for the Personnel Committee Meeting to be held August 17,1987, and recommending approval of recommendations contained thereon. It was moved by Gonzales, seconded by Davis, that the recommendations on the agenda for the Personnel Committee meeting held August 17, 1987 be approved. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated August 12, 1987, was presented, transmitting the agenda for the Adjourned Regular Finance Committee Meeting to be held August 17, 1987 and recommending approval of recommendations contained thereon. It was moved by Ybarra, seconded by Davis, that the agenda for the Adjourned Regular Finance Committee Meeting be deferred to the next City Council meeting. Motion carried. RESOLUTION NO. 5420 - A Resolution of the City Council of the City of Vernon Authorizing the Sale of Surplus Property from the Community Services Department pursuant to Section 2.31 of the Vernon City Code, was presented. It was moved by Gonzales, seconded by Davis, that Resolution No. 5420 be approved and adopted. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 12, 1987, was presented, advising of a request from Mr. Erwin Kochs, owner of property located at 5200 Santa Fe Avenue for a variance from City Code, Section 7.52 (truck loading space required) and Section 7.53 (access). The proposed approximately 10,000 sq. ft. building is on a small lot and not able to locate a driveway 75 ft. from curb return as required by Section 7.53, also due to the size of the building and proposed use it is expected that only smaller size trucks will be used. This request has been reviewed by the Director of Community Services and it is hereby recommended that said variance be granted with the following conditions: 1. The four (4) westerly docks be used by trucks not over 22 ft. in length; 2. The south east corner of Santa Fe Avenue and 52nd Street be improved to a 30 ft. curb return; 1534 I /1 City Council Minutes page 4 August 18, 1987 3. The proposed driveway on 52nd Street be located not closer than 62 ft. to the curb .return. It was moved by Ybarra, seconded by Gonzales, that the aforementioned communication from the City Clerk be approved and that a variance from City Code, Section 7.52 (truck loading space required) and Section 7.53 (access), be granted to Mr'. Erwin Kochs contingent upon the above conditions. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 12, 1987, was presented, advising of a request from Chicago Metallic Corporation, owner of property located at 5501 Downey Road, and Ernest E. Warsaw, John Caufield and Irving Schoenfeld, owners of property located at 5601 Downey Road, adjacent parcels, for an adjustment of the common boundary between parcels. The common boundary between the parcels would be moved northerly approximately 25 ft. from its present position. Said request is in accordance with the California Subdivision Map Act and the General Plan of the City; and has been reviewed by the Director of Community Services and the City Attorney and it is hereby recommended that the lot line adjustment be granted and a resolution be adopted. It was moved by Ybarra, seconded by Davis, that the aforementioned communication in the matter of an adjustment of the common boundary between parcels be received and filed and that the lot line adjustment be granted and a resolution adopted. Motion carried. RESOLUTION NO. 5419 - A Resolution of the City Council of the City of Vernon Approving "Lot Line Adjustment" Requested by Chicago Metallic Corporation and Ernest E. Warsaw, John Caufield and Irving Schoenfeld, was presented. It was moved by Gonzales, seconded by Davis, that Resolution No. 5419 be approved and adopted. Motion carried. Payroll Warrant Register No. 370 covering claims and demands presented during the period of June 7 thru July 18, 1987, which includes Demand Nos. 4806 thru 4836 (both inclusive) drawn on the First Interstate Bank totaling $1,169,826.43 (Accounting Period July 1987), was examined and audited. It was moved by Ybarra, seconded by Davis, that Payroll Warrant Register No. 370 be approved and payment authorized for Demands Nos. 4806 thru 4836 (both inclusive) in the amount of $1,169,826.43, with no exceptions. Motion carried. Warrant Register No. 723 covering claims and demands presented during the period of August 1 thru 15, 1987, which includes Demand Nos. 13894 thru 14135 (both inclusive) excluding Void Demand Nos. 13898, 13908, 13930, 13934 thru 14011, 14036 and 14075 and excluding Light & Power Demands, drawn on the First Intestate Bank totaling $496,575.58 (Accounting Period August 1987), was examined and audited. It was moved by Gonzales, seconded by Ybarra, that Warrant Register No. 723 be approved and payment authorized for Demand Nos. 13894 thru 14135 (both inclusive) excluding Void Demand Nos. 13898, 13908, 13930, 13934 thru 14011, 14036 and 14075 and excluding Light & Power Demands in the amount of $496,575.58, with no other exceptions. Motion carried. Warrant Register No. 723 covering claims and demands presented during the period of August 1 thru 15, 1987 which includes Light & Power Demand Nos. as listed below, drawn on the First Interstate Bank totaling $5,134,550.11 (Accounting Period .1535 I I City Council Minutes August 18, 1987 page 5 August 1987), was examined and audited: 13894 13948 13976 14024 14080 13906 13954 13987 14038 14083 13911 13956 13995 14049 14102 13916 13957 13996 14060 14107 13924 13964 14013 14065 14112 13925 13968 14015 14069 14122 14133 It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 723 be approved and payment authorized for Light & Power Demand Nos. as listed above, in the amount of $5,134,550.11 with no other exceptions. Motion carried. Councilman Davis abstained from voting on the above motion and disqualified himself because it's reasonably foreseeable that the decision will have a material financial effect on his source of income. It was moved by Ybarra, seconded by Davis, that the City Council recess to Closed Session/Personnel pursuant to Government Code Section 54957, the time being 6:01 P.M. Motion carried. All persons with the exception of th City Attorney, the City Clerk, Chief Espinoza, and Captain Rosenkrantz were excluded from Closed Session. The Mayor ordered all communications to and from Closed Session deemed privileged and confidential. Chief Espinoza and Captain Rosenkrantz were excused from Closed Session, the time being 6:12 P.M. It was moved by Gonzales, seconded by Ybarra, that City Council go out of Closed Session and resume Regular Session, the time being 6:15 P.M. It was moved by Ybarra, seconded by Davis, that the City Council recess to Closed Session pursuant to Government Code Section 54956.9(A), to confer with its attorney regarding pending litigations, the time being 6:16 P.M. Motion carried. All Persons with the exception of the City Attorney, the City Clerk and the Director of Water & Power were excluded from Closed Session. The Mayor ordered all communications to and from Closed Session deemed privileged and confidential. The Director of Light & Power was excused from Closed Session, the time being 7:12 P.M. Councilman Davis was excused from Closed Session, the time being 7:15 P.M. Councilman Davis resumed his seat on the Council at 7:35 P.M. It was moved by Ybarra, seconded by Gonzales, that City Council go out of Closed Session and resume Regular Session, the time being 7:36 P.M. Motion carried. It was moved by Ybarra, seconded by Davis, that Officer David Zapien be issued a written reprimand for violation of Section 400.11 of the Manual of Policy, Ethics and Procedure which states "...A member shall be absent only with proper leave or permission".
