19901204 Regular City Council Meeting - Minutes I I MINUTES OF THE CITY COUNCIL MEETING OF THE CITY OF VERNON HELD DECEMBER 4, 1990 AT 5 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, McCormick, Davis, Gonzales MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by McCormick, that the minutes of the Adjourned City Council Meeting held November 27, 1990, be approved as submitted and adopted. Motion carried. RESOLUTION NO. 5862 - A Resolution of the City council of the City of Vernon Approving and Authorizing the Execution of a One- Year Extension of Contract No. 478 and a Percentage Adjustment in Bid Price for R.F. Dickson Company, Inc., was presented. It was moved by Gonzales, seconded by Davis, that Resolution No. 5862 be approved and adopted. Motion carried. ORDINANCE NO. 993 - An Ordinance of the City Council of the City of Vernon Authorizing an Amendment to the Contract Between the City Council of the City of Vernon and the Board of Administration of the Public Employees' Retirement System ("PERS"), was read by title for a First Reading. It was moved by Ybarra, seconded by Davis, that Ordinance No. 993 be approved for a First Reading. Motion carried. At this time the Mayor presented a 30 year Service Pin to Eugene DeFrank, Survey Party Chief in the community Services Department. The Mayor called a short recess at 5:16 p.m. The City Council reconvened in regular session at 5:18 p.m., all members present before the recess again being present. Police Department Activity Log for the period November 16 thru 30, 1990, was presented. It was moved by McCormick, seconded by Gonzales, that the Police Department Activity Log for the period November 16 thru 30, 1990, be received and filed. Motion carried. Fire Department Activity Report for the period November 16 thru 30, 1990, was presented. It was moved by Davis, seconded by Ybarra, that the Fire Department Activity Report for the period November 16 thru 30, 1990, be received and filed. Motion carried. At this time, the Mayor asked if there was anyone in the audience who wished to address the City council on any matter on the Agenda other than with regard to any Public Hearings that may be listed. There was no one present who wished to address the City Council on any matter on the Agenda. Communication from victor H. Vaits, Director of Community Services, dated November 26, 1990, was presented, transmitting a fully executed Grant Deed from Donald Investment Company for a portion of property situated along the north side of Vernon Avenue, just east of Jewel Avenue. It is hereby recommended that the Grant Deed be accepted, and the certificate of Acceptance be approved and executed. It was moved by Ybarra, seconded by McCormick, that the communication from victor vaits be received and filed and that the Grant Deed from Donald Investment Company be accepted, and the Certificate of Acceptance be approved and executed. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated November 28, 1990, was presented, advising that Los Angeles County is proposing to synchronize the traffic signals along Slauson Avenue as part of a countywide program. The work in Vernon will include the installation of Radio Corrected time base units and other appurtenant work at the intersections of Slauson Avenue with State Street-Boyle Avenue and Alcoa Avenue. There is no cost to Vernon for the proposed improvements. This has been reviewed by the Director of Community Services and the City Attorney, and it is hereby recommended that the City Council find that this project is categorically exempt from the California Environmental Quality Act and that the following resolution be adopted. It was moved by McCormick, seconded by Davis, that the aforementioned communication from the city Clerk, dated November 28, 1990, be received and filed, and that the Council finds that this project is categorically exempt from the California Environmental Quality Act. Motion carried. RESOLUTION NO. 5860 - A Resolution of the City Council of the City of Vernon, Consenting to the Establishment of a Portion of Slauson Avenue from Hooper Avenue to Santa Fe Springs Road within said City to be a Part of the System of Highways of the County of Los Angeles for the Purpose of Synchronizing Traffic Signals, was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 5860 be approved and adopted. Motion carried. Communication from Police Chief Louis Rosenkrantz, dated November 14, 1990, was presented, requesting authority and funds for Police Officers Rex Hill, Anthony Zack and Michael Gillman to attend the Fingerprint "Pattern" Interpretation Class in Hermosa Beach, January 15-17, 1991, with an expense allowance of $70.20 each. Communication from Norman Michiels, Director of Environmental Health, dated November 27, 1990, was presented, requesting authority and funds for Lewis Pozzebon, Deputy Director of Environmental Health, to attend the Management Action Programs Workshop in Newport Beach, January 10-12, 1991, with an expense allowance of $305.16. Brearley to attend the California Contract cities Annual Legislative Seminar in Sacramento, January 22-24, 1991, with an expense allowance of $831.00 each. It was moved by Gonzales, seconded by Ybarra, that authority be granted for the aforementioned City officials to attend the California Contract cities Annual Legislative Seminar in Sacramento, January 22-24, 1991, with an expense allowance of $831.00 each. Motion carried. Communication from Kenneth J. DeDario, Director of Light and Power, dated November 19, 1990, was presented, requesting authority and funds for Manuel Garcia, Chief Water & Power Dispatcher, and Jim Siegert, Power Plant Superintendent, to attend the "Evaluating Employee Performance" Seminar in Los Angeles, with an expense allowance of $98.00 each. Mr. Siegert will be attending January 16 and Mr. Garcia, January 17, 1991. It was moved by Ybarra, seconded by McCormick, that authority be granted for Manuel Garcia and Jim Siegert to attend the "Evaluating Employee Performance" Seminar in Los Angeles, with an expense allowance of $98.00 each. Motion carried. Communication from Bruce V. Malkenhorst, Director of Personnel, dated November 29, 1990, was presented, recommending that the following personnel actions be approved: 4095 I I City Council Minutes page 4 December 4, 1990 MER:IT STEP :INCREASE Joan Francone, Risk Manager/Personnel Assistant, step 6 be granted a merit step increase to Risk Manager/Personnel Assistant, step 5, with a new monthly base salary of $3405, effective December 30, 1990, based on her satisfactory job performance during the past six months. It was moved by McCormick, seconded by Gonzales, that Joan Francone be granted a merit step increase to Risk Manager/Personnel Assistant, step 5, effective December 30, 1990. Motion carried. RECLASS:IP:ICAT:ION/REASS:IGNHENT Ricardo Lozano, System Operator, step 6 in the Light and Power Department, be advanced and reclassified to Water & Power Dispatcher II, Step 5, with a new monthly base salary of $2722, effective December 2, 1990, based on his meritorious job performance and increased job responsibilities. It was moved by Ybarra, seconded by Davis, to advance and reclassify Ricardo Lozano to Water & Power Dispatcher II, Step 5, effective December 2, 1990. Motion carried. Fernando Rodriguez, Police Officer, step 2, be reassigned from the Patrol Division to the Detective Bureau which will make him eligible for $125 per month Detective Pay. It was moved by McCormick, seconded by Gonzales, to reassign Fernando Rodriguez, Police officer, Step 2, to the Detective Bureau with an additional $125 per month Detective Pay added to his base salary. Motion carried. EXPLOYHENT AGREEMENT The 18 Month Employment Agreement by and between the City of Vernon and Police Officer Jeff Scott Bullock be accepted and ratified effective November 19, 1990. It was moved by Ybarra, seconded by Davis, to accept and ratify the 18 Month Employment Agreement by and between the City of Vernon and Police Officer Jeff scott Bullock. Motion carried. H:IRE Azam Flores be hired as Police Cadet (part-time), step 7, with an hourly wage of $8.00, effective November 26, 1990, with continued employment contingent upon Mr. Flores' satisfactory completion of the background process. Motion carried. Richard Harvison be hired as Police Officer, step 6, with a monthly salary of $2640, effective November 30, 1990. Mr. Harvison is scheduled to enter the Orange County Sheriff's Department Training Academy on November 30th, and continued employment is contingent upon his satisfactory completion of the background process and execution of a 36 Month Employment Agreement. It was moved by Davis, seconded by Ybarra, to hire Richard Harvison as Police Officer, step 6, effective November 30, 1990, with continued employment contingent upon his satisfactory completion of the background process and execution of a 36 Month Employment Agreement. Mr. Solano is a graduate of the San Bernardino Sheriff's Training Academy, and his continued employment is contingent upon his satisfactory completion of the background process and execution of an 18 Month Employment Agreement. It was moved by McCormick, seconded by Gonzales, to hire Charles Solano Jr. as Police Officer, Step 5, effective December 3, 1990, with continued employment contingent upon his satisfactory completion of the background process and execution of an 18 Month Employment Agreement. Motion carried. REIMBURSEMENT Wayne Barnard, Utilityman in the Community Services Department, be reimbursed $160.00 from the Education and Training Appropriation Account for his satisfactory completion of courses taken at California State University, Dominguez Hills, related to his position with the city. It was moved by Ybarra, seconded by Davis, to reimburse Wayne Barnard $160.00 from the Education and Training Appropriation Account. Motion carried. RETIREMENT/RESIGNATION The resignation (for retirement purposes) of Richard Sieben, Electrical Engineer in the Light and Power Department, dated October 1, 1990, be accepted, effective December 27, 1990 at the end of the business day. It was moved by McCormiCk, seconded by Ybarra, that the resignation (for retirement purposes) of Richard Sieben be accepted effective December 27, 1990, at the end of the business day. Motion carried. The resignation of Police Officer Robert Pellerin, dated November 20, 1990, be accepted, effective December 1, 1990 at the end of his tour of duty. It was moved by Gonzales, seconded by Davis, that the resignation of Robert pellerin be accepted effective December 1, 1990 at the end of his tour of duty. Motion carried. Communication from David B. Brearley, City Attorney, dated November 29, 1990, was presented, advising that Section 2.8-1 of the Vernon City Code, which was adopted pursuant to Ordinance No. 978 in October of 1988, authorized the City Administrator to issue a newsletter four or more times per year in accordance with a proposed version of FPPC Regulation No. 18901. The proposed version of FPPC Regulation No. 18901 exempted newsletters published pursuant to an ordinance from compliance with FPPC regulations. since the current version of FPPC Regulation No. 18901 does not contain such an exemption and since Section 2.8-1 of the Vernon City Code is no longer necessary for achieving FPPC compliance, it is hereby recommended that the following ordinance be adopted. It was moved by Ybarra, seconded by Mccormick, that the aforementioned communication from the City Attorney, dated November 29, 1990, be received and filed, and his recommendation be approved. ORDINANCE NO. 994 - An Ordinance of the City Council of the City of Vernon Repealing Section 2.8-1, Chapter 2 of the Code of the City of Vernon, California 1959 Regarding Official Newsletters of the City, was read by title for a First Reading. It was moved by McCormiCk, seconded by Davis, that Ordinance No. 994 be approved for a First Reading. Motion carried. 409? Motion carried. Councilman Davis abstained from voting and disqualified himself because it is reasonably foreseeable that the decision may have a material financial effect on his source of income. The City Clerk advised the Council that the matter of the claim of Ricardo Gonzales should be deferred to Closed Session. The Mayor declared a recess, the time being 5:45 p.m. The council reconvened in regular session at 6:05 p.m. All persons present before the recess again being present. It was moved by McCormick, seconded by Ybarra, that the Council recess to Closed Session Attorney/Client privilege pursuant to Government Code Section(s) 54956.9(a), 54956.9(b) (1), and 54956.9(c); the time being 6:10 p.m. Motion carried. The Mayor ordered all communications to and from Closed Session deemed privileged and confidential. All persons with the exception of the City Clerk and the City Attorney were excluded from Closed Session. It was moved by Ybarra, seconded by Mccormick, that the Council go out of Closed Session and resume regular session the time being 6:40 p.m. Motion carried. It was moved by Gonzales, seconded by Davis, that the Council go into Closed Session Personnel pursuant to Government Code section 54957, the time being 6:41 p.m. Motion carried. The Mayor ordered all communication to and from Closed Session deemed privileged and confidential. Motion carried. Motion carried. It was moved by Ybarra, seconded by Gonzales, that December 24 and 31, 1990, be granted as additional holidays for miscellaneous personnel who are not required for emergency services, and other non- represented employees so long as there is no adverse affect on the operations of the City. Motion carried. There being no further business to come before the Council at this time it was moved by McCormick, seconded by Ybarra, that the meeting adjourn. Motion carried.
