19910903 Regular City Council Meeting - Minutes I I MINUTES OF THE CITY COUNCIL MEETING OF THE CITY OF VERNON HELD SEPTEMBER 3, 1991 AT 5:00 P.M. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, McCormick, Davis, Gonzales MEMBERS ABSENT: None The meeting was called to order by Mayor Malburg. It was moved by Ybarra, seconded by Davis, that the minutes of the City Council Meeting held August 20, 1991, be approved as submitted and adopted. Motion carried. Police Department Activity Log for the period August 16 thru 31, 1991, was presented. It was moved by Gonzales, seconded by McCormick, that the Police Department Activity Log for the period August 16 thru 31, 1991, be received and filed. Motion carried. Fire Department Activity Report for the period August 16 thru 31, 1991, was presented. It was moved by Davis, seconded by Ybarra, that the Fire Department Activity Report for the period August 16 thru 31, 1991, be received and filed. Motion carried. At this time, the Mayor asked if there was anyone in the audience who wished to address the Council on any matters listed on the Agenda other than with regard to any Public Hearings that may be listed. There was no one in the audience who wished to address the City Council on any matter on the Agenda at this time. Communication from Bruce V. Malkenhorst, City Clerk, dated July 30, 1991, recommending that authority be granted to sell surplus City property on Packers Avenue to Smart and Final, and that the Director of Community Services and the City Attorney be authorized to prepare escrow instructions. (Deferred from the City Council Meeting held August 20, 1991.) David B. Brearley, City Attorney, recommended to the Council that the aforementioned matter be removed from the Agenda. It was moved by Gonzales, seconded by Ybarra, to remove the aforementioned communication from the city Clerk dated July 30, 1991, from the Agenda. Motion carried. Communication from Kenneth DeDario, Director of Light and Power, dated August 12, 1991, was presented, requesting authority and funds for Carlos Fandino, Senior Water and Power Dispatcher, and Sergio Rodriguez, Water and Power Dispatcher, to attend the Organized Employee Workshop in Los Angeles, October 18, 1991, with an expense allowance of $94.00 each. It was moved by Davis, seconded by Gonzales, that authority be granted for Carlos Fandino and Sergio Rodriguez to attend the Organized Employee Workshop in Los Angeles, October 18, 1991, with an expense allowance of $94.00 each. Motion carried. Communication from Bruce V. Malkenhorst, City Clerk, dated August 28, 1991, was presented, recommending that Mr. Frank Saldana, utilityman in the Community Services Department, be allowed to rent the City house located at 4321 Furlong Place. Mr. Saldana is aware that he will be placed on call and must be available for call-out duty in emergency situations. It was moved by Davis, seconded by Gonzales, to allow Mr. Frank Saldana to rent the City house located at 4321 Furlong Place. Motion carried. RESOLUTION NO. 5981 - A Resolution of the City Council of the City of Vernon Approving and Authorizing the Execution of an Information Management and Software Maintenance Agreement By and Between the City of Vernon and Flair Data Services, Inc., was presented. It was moved by Gonzales, seconded by Ybarra, that Resolution No. 5981 be approved and adopted. Motion carried. Consideration of a Los Angeles Interagency Metropolitan Police Apprehension Crime Task Force (LA IMPACT) Memorandum of Understanding. RESOLUTION NO. 5982 - A Resolution of the City Council of the City of Vernon Approving and Authorizing the Execution of a Memorandum of Understanding Providing for the Participation of the city in the Los Angeles Interagency Metropolitan Police Apprehension Crime Task Force. It was moved by Ybarra, seconded by Davis, that the aforementioned matter with regard to the Los Angeles Interagency Metropolitan Police Apprehension Crime Task Force be referred to the next Finance Committee Meeting to be held September 10, 1991; and that Resolution No. 5982 be removed from the Agenda. Motion carried. RESOLUTION NO. 5983 - A Resolution of the City Council of the City of Vernon Expressing Its Regret at the Untimely Passing of Jack Parks and Offering Its Condolences to his surviving Family. was presented. It was moved by Ybarra, seconded by Mccormick, that Resolution No. 5983 be approved and adopted. Motion carried. 4260 I I City Council Minutes page 4 September 3, 1991 Communication from Bruce V. Malkenhorst, Director of Personnel, dated August 29, 1991, was presented, recommending that the following personnel actions be approved: MISCELLANEOUS Police Officer David Lopez not be held chargeable for his on-duty accident occurring on July 16, 1991, based on the findings of the Accident Investigation Committee. (Deferred from the Personnel Committee Meeting held August 19, 1991.) It was moved by Ybarra, seconded by Davis, that Officer David Lopez not be held chargeable for his on-duty accident occurring on July 16, 1991. Motion carried. HIRE Ramon Abueg be hired as Associate Power Engineer, Step 5, assigned to the Light and Power Department, with a monthly salary of $4827, effective October 5, 1991. Mr. Abueg has successfully completed the pre-employment physical. It was moved by McCormick, seconded by Gonzales, that Ramon Abueg be hired as Associate Power Engineer, Step 5, effective October 5, 1991. Motion carried. TERMINATION Rafael Perez, part-time Photo Technician in the Police Department be terminated effective August 20, 1991 at the end of his shift. It was moved by Ybarra, seconded by Davis, that Rafael Perez be terminated effective August 20, 1991 at the end of his shift. Motion carried. MERIT STEP INCREASE Leonard Grossberg, Environmental Specialist, Step 7 in the Health Department, be granted a merit step increase to Environmental Specialist, Step 6, with a new monthly base salary of $3664, effective August 25, 1991, based on his satisfactory job performance since his date of hire. It was moved by McCormick, seconded by Gonzales, to grant Leonard Grossberg a merit step increase to Environmental Specialist, Step 6, effective August 25, 1991. Motion carried. Michael Johnson, Police Officer, Step 4, be granted a merit step increase to Police Officer, Step 3, with a new monthly base salary of $3100, effective August 20, 1991, based on his satisfactory job performance during the past year. It was moved by Ybarra, seconded by Davis, to grant Michael Johnson a merit step increase to Police Officer, step 3, effective August 20, 1991. Motion carried. Claudia Padilla, utility Clerk, Step 9 in the Risk Management/Personnel Department, be granted a merit step increase to utility Clerk, Step 8, with a new monthly base salary of $1827, effective September 22, 1991, based on her satisfactory job performance during the past year. It was moved by Gonzales, seconded by Mccormick, to grant Claudia Padilla a merit step increase to utility Clerk, Step 8, effective September 22, 1991. It was moved by Ybarra, seconded by Davis, to grant Ana Ceja a merit step increase to utility Clerk, Step 8, effective September 22, 1991. Motion carried. DISCIPLINARY ACTION Jacqueline Warsaw receive a written reprimand as a result of excessive tardiness based on the recommendation of the Police Chief and in accordance with section 400.10 of the Vernon Police Department's Manual of POlicy, Ethics and Procedure. It was moved by McCormick, seconded by Gonzales, to issue a written reprimand to Jacqueline Warsaw to be placed in her personnel file. Motion carried. WARRANT REGISTER NO. 822 covering claims and demands presented during the period of August 16 thru 29, 1991, drawn on the First Interstate Bank totaling $274,620.04, which includes Demand Nos. 33758 thru 33936 (inclusive), excluding Light & Power Demands and void Demand Nos. 33763 and 33806 thru 33808 (inclusive), (accounting period September, 1991) was examined and audited. It was moved by Ybarra, seconded by Gonzales, that Warrant Register No. 822 be approved and payment authorized for claims and demands totaling $274,620.04 (excluding Light & Power Demands). Motion carried. Motion carried. Councilman Davis abstained from voting and disqualified himself because it is reasonably foreseeable that the decision may have a material financial effect on his source of income. The Mayor called a recess at 5:38 p.m. The Council reconvened in regular session at 5:45 p.m., all members present before the recess again being present. It was moved by Mccormick, seconded by Ybarra, that the Council go into Closed Session Attorney/Client privilege pursuant to Government Code Section 56956.9(a). Motion carried. All persons except the city Clerk and thQ city Attorney were excluded from Closed Session. 4262 I I City Council Minutes page 6 September 3, 1991 The Mayor ordered all communications to and from Closed Session deemed privileged and confidential. Councilman Davis was excused from Closed Session at 6:00 p.m. Councilman Davis resumed his seat on the Council at 6:24 p.m. It was moved by Ybarra, seconded by McCormick, that the Council go out of Closed Session and resume regular session. Motion carried. The City Attorney reported that the Federal Energy Regulatory Commission had issued its decision in FERC Docket No. ER91-195 approving the establishment of the Western Systems Power Pool. He further indicated that several parties had appealed the Commission's decision and recommended that the City of Vernon intervene in these appeals, Environmental Action, et aI, v. FERC, D.C. Cir. Nos. 91-1403 and 1404, in order to preserve and protect the City's rights. It was moved by Gonzales, seconded by Ybarra, that the city Attorney's recommendation be approved. Motion carried. Coun- cilman Davis abstained from voting on the above motion and disqualified himself because it is reasonably foreseeable that the decision will have a material financial effect on his source of income. The City Attorney reported that the Federal Energy Regulatory Commission had issued its final decision in FERC Docket No. ER84-75 (Phase II) and recommended that the City of Vernon appeal this decision on the mootness and curtailment issues. It was moved by Ybarra, seconded by McCormick, that the City Attorney's recommendation be approved. Motion carried. Councilman Davis abstained from voting on the above motion and disqualified himself because it is reasonably foreseeable that the decision will have a material financial effect on his source of income.
