MINUTES OF THE ADJOURNED REGULAR CITY COUNCIL
MEETING OF THE CITY OF VERNON HELD NOVEMBER
13, 1991 AT 5 P.M. IN THE COUNCIL CHAMBERS
OF THE CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick, Davis
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
It was moved by Davis, seconded by Gonzales, that the
minutes of the City Council Meeting held November 5, 1991, be
deferred to the next City Council Meeting to be held November 19,
1991. Motion carried.
At this time, the Mayor asked if there was anyone in the
audience who wished to address the council on any matter listed on
the Agenda other than with regard to any Public Hearings that may be
listed.
There was no one in the audience who wished to address the
City Council on any matter on the Agenda at this time.
Consideration of California-Oregon Transmission Project
Entitlement.
David B. Brearley, City Attorney, addressed the City
Council and briefly summarized this matter indicating that the City
has a right to elect up to 121 megawatts pursuant to the Interim
Participation Agreement and recommended that the City Council approve
the election of 121 megawatts and that the City Clerk notify the
Transmission Agency of Northern California of the city's action to
elect to receive 121 megawatts from this project.
It was moved by Gonzales, seconded by McCormick, to
approve an ownership interest equal to a total of 121 megawatts as
the City's share of the California-Oregon Transmission project, and
to authorize the city Clerk to notify the Transmission Agency of
Northern California of the City's action in exercising its rights to
acquire the full 121 megawatts entitlement in the California-Oregon
Transmission project (which equals approximately 8.053% ownership
share of the project and 7.5497% entitlement of the project). Motion
carried. Councilman Davis abstained from voting and disqualified
himself because it is reasonably foreseeable that the decision may
have a material financial effect on his source of income.
ORDINANCE NO. 1004 - An Ordinance of the City Council of
the City of Vernon Amending the Code of the city of Vernon by Adding
Article XI Entitled "City of Vernon Municipal Facilities Revenue Bond
Law" to Chapter 2, Administration, Relating to Powers and Procedures
to Issue Revenue Bonds for the Purpose of Financing Municipal
Facilities of the City, and Including Definitions, General
Provisions, Powers, Issuance Procedures and Certain Supplemental
provisions, was read by title for a Second and Final Reading.
It was moved by McCormick, seconded by Gonzales, that
Ordinance No. 1004 be approved and adopted. Motion carried.

Communication from Bruce V. Malkenhorst, City Clerk, dated
November 4, 1991, was presented, requesting authority and funds for
Sharon Duckworth, Finance Department Office Manager, to attend the
League of California Cities Financial Management Seminar in Monterey,
December 11-13, 1991, with an expense allowance of $872.80.

It was moved by Ybarra, seconded by Davis, that authority
be granted for Sharon Duckworth to attend the League of California
cities Financial Management Seminar in Monterey, December 11-13,
1991, with an expense allowance of $872.80. Motion carried.
Discussion of proposed changes to business license taxes.
David B. Brearley, City Attorney, responded to questions
from the City Council regarding changes to the present business
license ordinance and resolution.
It was moved by MCCormick, seconded by Gonzales, that the
Council go into Closed Session, Attorney/Client Privilege, pursuant
to Government Code Section 54956.9(a}, the time being 5:50 p.m.
Motion carried.
The Mayor ordered all communications to and from Closed
Session deemed privileged and confidential.
All persons with the exception of the City Clerk and the
City Attorney were excluded from Closed Session.
5:55 p.m.
Councilman Davis was excused from Closed Session at
5:57 p.m.

Council go out of Closed Session and resume regular session.
Motion carried.
The City Attorney reported that the Pacific Gas & Electric
Company had filed a Petition for Review before the united States
Court of Appeals for review of certain orders issued by the Federal
Energy Regulatory Commission in Transmission Agency of Northern
California v. Pacific Gas and Electric Company, FERC Docket No. EL91-
8; and Pacific Gas and Electric Company, FERC Docket Nos. ER91-344
and ER91-505. He recommended that the City of Vernon intervene in
the appeal, Pacific Gas and Electric Company v. Federal Energy
Regulatory Commission, D.C. Circuit Case No. 91-1506, in order to
preserve and protect the city's rights.
It was moved by MCCormick, seconded by Gonzales, that
the City Attorney's recommendation be approved. Motion carried.
Councilman Davis abstained from voting and disqualified himself
because it is reasonably foreseeable that the decision may have a
material financial effect on his source of income.
There being no further business to come before the
Council at this time it was moved by Ybarra, seconded by
McCormick that the meeting adjourn. Motion carried.
