MINUTES OF THE CITY COUNCIL MEETING OF
THE CITY OF VERNON HELD JUNE 2, 1992
AT 5 P.M. IN THE COUNCIL CHAMBERS OF
THE CITY HALL LOCATED AT 4305 SANTA FE
AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Ybarra, Gonzales, McCormick, Davis
MEMBERS ABSENT: Malburg
The meeting was called to order by Mayor Pro Tem
Ybarra.
It was moved by McCormick, seconded by Davis, that
the minutes of the City Council Meeting held May 19, 1992, be
approved as submitted and adopted. Motion carried.
At this time, Mayor Pro Tem Ybarra presented a 25
Year Service pin to Foreman Terry Gresham, and a 10 Year Service
to utility Clerk Karon Berry. Battalion Chief Richard Wiles
accepted 35 Year Service pins on behalf of Fire Engineers Robert
Beaudett and Robert Smith who were unable to attend the meeting.
The Mayor Pro Tem called a recess at 5:10 p.m.
The Council reconvened in regular session at 5:12
p.m., all members present before the recess again being present.
Police Department Activity Log for the period May 16
thru 31, 1992, was presented.
It was moved by McCormick, seconded by Gonzales, that
the Police Department Activity Log for the period May 16 thru 31,
1992, be received and filed. Motion carried.
Fire Department Activity Report for the period May 16
thru 31, 1992, was presented.
It was moved by Davis, seconded by Mccormick, that
the Fire Department Activity Report for the period May 16 thru
31, 1992, be received and filed. Motion carried.
The City Clerk advised that this was the time for
anyone in the audience who wished to address the Council on any
matter listed on the Agenda other than with regard to any Public
Hearings that may be listed.
There was no one in the audience who wished to'
address the City Council at this time.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 20, 1992, was presented, requesting authority and funds
for Mayor Leonis C. Malburg, Mayor Pro Tem Thomas Ybarra,
Councilman William McCormick, and Councilman Hilario Gonzales to
attend the Independent cities Association 32nd Annual Seminar in
San Diego, July 8-12, 1992, with an expense allowance of $1368.20
each.
It was moved by Gonzales, seconded by McCormick, that
authority be granted for the aforementioned City officials to
attend the Independent cities Association 32nd Annual Seminar in
San Diego, July 8-12, 1992, with an expense allowance of $1368.20
each. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 20, 1992, was presented, requesting authority and funds
for himself and Councilman William Davis to attend the
Independent cities Association 32nd Annual Seminar in San Diego,
July 8-12, 1992, with an expense allowance of $868.20 each.

It was moved by McCormick, seconded by Gonzales, that
authority be granted for the aforementioned City officials to
attend the Independent Cities Association 32nd Annual Seminar in
San Diego, July 8-12, 1992, with an expense allowance of $868.20

Communication from victor H. Vaits, Director of
Community Services, dated May 20, 1992, was presented, requesting
authority and funds for Kevin Wilson, civil Engineer, to attend
the League of California cities - Americans with Disabilities Act
Workshop in Irvine, June 25, 1992, with an expense allowance of
$119.28.
It was moved by Davis, seconded by McCormick, that
authority be granted for Kevin Wilson to attend the League of

Motion carried.
Communication from Kenneth J. DeDario, Director of
Light and Power, dated May 21, 1992, was presented, requesting
authority and funds for Senior Water & Power Dispatcher Carlos
Fandino and Generation Operator Robert Valenzuela to attend a
Lotus Seminar, Beyond the Basics, in Pasadena, July 13, 1992,
with an expense allowance of $173.00 each.
It was moved by Gonzales, seconded by McCormick, that
authority be granted for Carlos Fandino and Robert Valenzuela to
attend a Lotus Seminar, Beyond the Basics, in Pasadena, July 13,
1992, with an expense allowance of $173.00 each. Motion carried.
Communication from Police Chief Louis Rosenkrantz,
dated May 22, 1992, was presented, requesting authority and funds
for Police Officers John Kallal and Richard Harvison to attend
Laser Firearms Training at Biscaluiz Center, June 29, 1992, with
an expense allowance of $106.16 each which will be reimbursed by
POST.
It was moved by Davis, seconded by Gonzales, that
authority be granted for Officers John Kallal and Richard
Harvison to attend Laser Firearms Training at Biscaluiz Center,
June 29, 1992, with an expense allowance of $106.16 each. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 27, 1992, was presented, requesting authority and funds
for Anthony Serrano, Customer Service Representative, to attend
the Exceptional Customer Service Workshop in Downey, July 29,
1992, with an expense allowance of $165.00.
It was moved by McCormick, seconded by Davis, that
authority be granted for Anthony Serrano to attend the
Exceptional Customer Service Workshop in Downey, July 29, 1992,
with an expense allowance of $165.00. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 27, 1992, was presented, advising that the Vernon Lions
Club is requesting a Variance from the Uniform Fire Code, 1988
Edition, Section 78.102(b) to install a fireworks stand and
conduct the sale of fireworks at property located at 4515 S. Soto
Street from July 1 thru 4, 1992. This has been reviewed by the
Fire Chief, and it is hereby recommended that the Variance be
granted subject to the normal conditions imposed by the Fire
Department.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated May 27, 1992, be received
and filed; and that a Variance be granted to the Vernon Lions
Club subject to the normal conditions imposed by the Fire
Department. Motion carried.

Communication from Bruce V. Malkenhorst, Director of
Personnel, dated May 28, 1992, was presented, transmitting the
Agenda for the Personnel Committee Meeting to be held June 1,
1992, for approval of the recommendations contained therein.
It was moved by McCormick, seconded by Gonzales, that
the recommendations listed on the Agenda for the Personnel
Committee Meeting held June 1, 1992, be approved as submitted.
Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated May 28, 1992, was presented, transmitting the
Agenda for the Adjourned Finance Committee Meeting to be held
June 1, 1992, for approval of the recommendations contained
therein.
It was moved by Davis, seconded by Gonzales, that the
recommendations listed on the Agenda for the Adjourned Finance
Committee Meeting held June 1, 1992, be approved as submitted.
Motion carried.

It was moved by MCCormick, seconded by Davis, that
the Minutes of the Adjourned Finance Committee Meeting held May
20, 1992, be approved as submitted. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated May 28, 1992, was presented, transmitting the
Minutes of the Adjourned Finance Committee Meeting held May 26,
1992, for approval of the recommendations contained therein.
It was moved by Gonzales, seconded by McCormick, that
the Minutes of the Adjourned Finance Committee Meeting held May
26, 1992, be approved as submitted. Motion carried.
RESOLUTION NO. 6102 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the City
Treasurer to Transfer Unrestricted Fund Interest Earnings Into
the General Fund, was presented.
It was moved by Davis, seconded by McCormick, that
Resolution No. 6102 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated May 28, 1992, was presented, transmitting a report
submitted by the Director of Light and Power and a Pro Forma
Agreement for Gas Storage Service with Southern California Gas
Company (SoCal) pertaining to SoCal's offering "unbundled"
storage service to its customers. This program will enable
customers to select a mix of storage services with a total
estimated annual cost to the City of $7,000 made up of two parts:
- Basic Storage of $4,000 (renewable every year)
- Monthly-Firm Storage of $3,000 (25-year commitment)
This has been reviewed by the Director of Light and Power and the
City Attorney, and it is hereby recommended that the Pro Forma
Agreement for Gas Storage Service for Basic Storage and Monthly-
Firm Storage in the amount of approximately 3/4 of an average
month's usage at the costs estimated above be approved, and that
the execution of said agreement be ratified.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated May 28, 1992, be received
and filed, and that his recommendation be approved. Motion
carried.

RESOLUTION NO. 6103 - A Resolution of the City
Council of the City of Vernon Approving and Ratifying the
Execution of a Pro Forma Agreement for Gas Storage Service,
Account No. V08, By and Between the City of Vernon and Southern
California Gas Company, was presented.
It was moved by McCormick, seconded by Davis, that
Resolution No. 6103 be approved and adopted. Motion carried.
WARRANT REGISTER NO. 840 covering claims and demands
presented during the period of May 15 thru 28, 1992, drawn on the
First Interstate Bank totaling $267,565.24, which includes
Demands Nos. 37419 thru 37573 (inclusive), excluding Light &
Power Demands and Void Demand Nos. 37454 thru 37456 (inclusive)
(accounting period June, 1992) was examined and audited.
It was moved by Davis, seconded by McCormick, that
Warrant Register No. 840 be approved and payment authorized for
claims and demands totaling $267,565.24, excluding Light & Power
Demands. Motion carried.
WARRANT REGISTER NO. 840 covering claims and demands
presented during the period of May 15 thru 28, 1992, drawn on the

It was moved by Gonzales, seconded by McCormick, that
Warrant Register No. 840 be approved and payment authorized for
claims and demands totaling $1,897,351.99. Motion carried.
Councilman Davis abstained from voting and disqualified himself
because it is reasonably foreseeable that the decision may have a
material financial effect on his source of income.
Consideration of liability claim of Francisca Ibarra.
The City Clerk advised that the aforementioned claim
be deferred to Closed Session later this date.
The Mayor Pro Tem called a recess at 5:26 p.m.
The Council reconvened in regular session at 5:30
p.m., all members present before the recess again being present.
It was moved by McCormick, seconded by Gonzales, that
the Council go into Closed Session Attorney/Client privilege pur-
suant to Government Code sections 54956.9(a), 54956.9(b) (1) and
54956.9(c). Motion carried.
All persons with the exception of the City Clerk and
the City Attorney were excluded from Closed Session.
Mayor Pro tem Ybarra ordered all communications to
and from Closed Session deemed privileged and confidential.
It was moved by McCormick, seconded by Davis, that
the Council go out of Closed session and resume regular session,
the time being 5:46 p.m. Motion carried.
It was moved by Davis, seconded by McCormick, that
the claim of Francisca Ibarra be denied. Motion carried.
It was moved by Gonzales, seconded by Davis, that the
claim submitted by zeutzius & LaBran, Attorneys at Law, on behalf
of Louis Roque be denied. Motion carried.

It was moved by McCormick, seconded by Gonzales, that
authority be granted for David B. Brearley, City Attorney, and
Kane, Ballmer & Berkman, Special Counsel, to file a Notice of
Appeal in Los Anqeles Community College District vs. All Persons
Interested in the Matter of City of Vernon Ordinance No. 992.
etc.. et al.; LASC No. BC 017927, consolidated with BC 019968.
Motion carried.
The City Attorney advised the City Council that he
had received a notice from the Federal Energy Regulatory
Commission (FERC) in the matter of the Transmission Aqencv of
Northern California v. Pacific Gas and Electric Company. Southern
California Edison Company and San Dieqo Gas and Electric Company,
FERC Docket No. EL92-26-000, which indicated that the
Transmission Agency of Northern (TANC) had filed with FERC an
application for an order prescribing terms and conditions for
interconnection and coordinated operation of the California-
Oregon Transmission Project. He recommended that the City
Council ratify and approve his filing of an intervention in this
matter in order to preserve and protect the City's rights as a
participant in the California-Oregon Transmission Project.
It was moved by McCormick, seconded by Gonzales, that
the City Attorney's recommendation be approved and ratified.
Motion carried. Councilman Davis abstained from voting and
disqualified himself because it is reasonably foreseeable that
the decision may have a material financial effect on his source
of income.
The City Attorney advised the City Council that he
had filed an application for an order prescribing terms and
conditions for interconnection and coordinated operation of the
California-Oregon Transmission Project before the Federal Energy
Regulatory Commission in the matter of city of Vernon v. Pacific
Gas and Electric Company. Southern California Edison Company. and
San Diego Gas and Electric Company, FERC Docket No. EL92-32-000.
He recommended that the City Council ratify and approve his
filing of such application in said proceeding in order to
preserve and protect the City's rights as a participant in the
California-Oregon Transmission Project.
It was moved by Gonzales, seconded by McCormick that
the City Attorney's recommendation be approved and ratified.
Motion carried. Councilman Davis abstained from voting and
disqualified himself because it is reasonably foreseeable that
the decision may have a material financial effect on his source
of income.
There being no further business to come before the
Council at this time it was moved by McCormick, seconded by
Davis, that the meeting adjourn. Motion carried.
