MINUTES OF THE CITY COUNCIL MEETING
OF THE CITY OF VERNON HELD NOVEMBER
3, 1992 AT 5 P.M. IN THE COUNCIL
CHAMBERS OF THE CITY HALL LOCATED
AT 4305 SANTA FE AVENUE, VERNON,
CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick, Davis
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Davis, that the
minutes of the City Council Meeting held October 20, 1992, be
approved as submitted and adopted. Motion carried.
It was moved by McCormick, seconded by Gonzales, that
the minutes of the Adjourned City Council Meeting held October
29, 1992, be deferred to the next City Council Meeting to be held
November 10, 1992. Motion carried.
Police Department Activity Log for the period October
16 thru 31, 1992, was presented.
It was moved by Davis, seconded by Gonzales, that the
Police Department Activity Log for the period October 16 thru 31,
1992, be received and filed. Motion carried.
Fire Department Activity Report for the period
October 16 thru 31, 1992, was presented.
It was moved by Ybarra, seconded by McCormick, that
the Fire Department Activity Report for the period October 16
thru 31, 1992, be received and filed. Motion carried.
The City Clerk advised the City Council that now was
the time for anyone in the audience to address the City Council
on any matter listed on the Agenda other than with regard to any
Public Hearings that may be listed.
The Mayor asked if there was anyone in the audience
who wished to address the City Council at this time on any matter
listed on the Agenda other than with regard to any Public
Hearings that may be listed.
There was no one in the audience who wished to
address the City Council.
Consideration of Southern California Gas Company's
appeal regarding its application for an Encroachment Permit filed
May 28, 1992.
The City Clerk advised the City Council that he would
like to defer this matter for one week.
It was moved by Gonzales, seconded by Ybarra, that
the matter of Southern California Gas Company's appeal regarding
its application for an Encroachment Permit filed May 28, 1992, be
deferred to an Adjourned City Council Meeting to be held at 5
p.m. on November 10, 1992. Motion carried.
Communication from Bruce V. Ma1kenhorst, City Clerk,
dated October 20, 1992, was presented, requesting authority and
funds to attend the League of California cities Financial
Management Seminar in San Diego, December 3-4, 1992, with an
expense allowance of $602.00.

It was moved by Ybarra, seconded by Davis, that
authority be granted for Bruce V. Ma1kenhorst to attend the
League of California cities Financial Management Seminar in San
Diego, December 3-4, 1992, with an expense allowance of $602.00.
Motion carried.
Communication from Victor H. Vaits, Director of
Community Services, dated October 20, 1992, was presented,
advising that the bids received in accordance with Contract No.
514, Traffic Pavement Striping 1993, have been reviewed and
recommending that the contract be awarded to Arrow Straight
Marking and Striping Service, 3084 Strasbourg Drive, Riverside,
California 92504, on the basis of their bid of $29,590.62 (lowest
bid) .
It was moved by Gonzales, seconded by Mccormick, that
the communication from the Director of Community Services dated
October 20, 1992, be received and filed, and that his
recommendation be approved. Motion carried.
RESOLUTION NO. 6178 - A Resolution of the City
Council of the City of Vernon Accepting the Bid of Arrow Straight
Marking and Striping Service for Traffic Pavement Striping in
Accordance with Contract No. 514 of the City of Vernon and
Approving the Execution of Said Contract, was presented.
It was moved by Ybarra, seconded by Davis, that
Resolution No. 6178 be approved and adopted. Motion carried.
Communication from Bruce V. Ma1kenhorst, City Clerk,
dated October 21, 1992, was presented, requesting authority and
funds for Gloria J. Orosco, Chief Deputy City Clerk, to attend
the League of California Cities City Clerk's Department Election
Law Seminar in San Diego, December 2-4, 1992, with an expense
allowance of $694.50.
It was moved by Ybarra, seconded by McCormick, that
authority be granted for Gloria J. Orosco to attend the League of
California cities City Clerk's Department Election Law Seminar in
San Diego, December 2-4, 1992, with an expense allowance of
$694.50. Motion carried.
Communication from Bruce V. Ma1kenhorst, Director of
Personnel, dated October 29, 1992, was presented, transmitting
the Agenda for the Personnel Committee Meeting to be held
November 2, 1992, for approval of the recommendations contained
therein.
It was moved by Gonzales, seconded by McCormick, that
the recommendations listed on the Agenda for the Personnel
Committee Meeting held November 2, 1992, be approved as
submitted. Motion carried.
WARRANT REGISTER NO. 850 covering claims and demands
presented during the period of October 16 thru 29, 1992, drawn on
the First Interstate Bank totaling $217,391.51, which includes
Demand Nos. 39412 thru 39591 (inclusive), excluding Light & Power
Demands and Void Demand Nos. 39450 and 39451 (accounting period
November, 1992) was examined and audited.
It was moved by Davis, seconded by Gonzales, that
Warrant Register No. 850 be approved and payment authorized for
claims and demands totaling $217,391.51, excluding Light & Power
Demands. Motion carried.

It was moved by Ybarra, seconded by Mccormick, that
Warrant Register No. 850 be approved and payment authorized for
claims and demands totaling $4,113,728.66. Motion carried.
Councilman Davis abstained from voting and disqualified himself
because it is reasonably foreseeable that the decision may have a
material financial effect on his source of income.
The Mayor called a recess at 5:25 p.m.
The Council reconvened in regular session at 5:29
p.m., all persons present before the recess again being present.
It was moved by Ybarra, seconded by Davis, that the
Council go into Closed Session, Attorney/Client Privilege,
pursuant to Government Code Sections 54956.9(a) and 54956.9(C),
the time being 5:29 p.m. Motion carried.
All persons were excluded from Closed Session with
the exception of the City Clerk and the City Attorney.
The Mayor ordered all communications to and from
Closed Session deemed privileged and confidential.
It was moved by Ybarra, seconded by McCormick, that
the Council go out of Closed Session, Attorney/Client Privilege,
the time being 5:35 p.m. Motion carried.
It was moved by McCormick, seconded by Ybarra, that
the City Attorney be authorized, on behalf of the City, to join
an amicus brief being prepared on behalf of the League of
California cities for filing before the California Supreme Court
in Laurel Heiqhts Improvement Ass'n v. Regents of the University
of California. Motion carried.
It was moved by Ybarra, seconded by Davis, that the
Council go into Closed Session, Personnel, pursuant to Government
Code Section 54957, the time being 5:40 p.m. Motion carried.
All persons were excluded from Closed Session with
the exception of the City Clerk.
The Mayor ordered all communications to and from
Closed Session deemed privileged and confidential.
Bruce V. Ma1kenhorst, City Clerk, was excused at 5:41
p.m.
Mr. Malkenhorst returned at 6 p.m.
It was moved by Ybarra, seconded by McCormick, that
the Council go out of Closed Session, Personnel, and resume
regular session, the time being 6:10 p.m. Motion carried.
There being no further business to come before the
Council at this time, it was moved by Ybarra, seconded by
McCormick, that the meeting adjourn to November 10, 1992 at 5
p.m. Motion carried.
