MINUTES OF THE CITY COUNCIL MEETING
OF THE CITY OF VERNON HELD' DECEMBER
15, 1992 AT 5 P.M. IN THE COUNCIL
CHAMBERS OF THE CITY HALL LOCATED
AT 4305 SANTA FE AVENUE, VERNON,
CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Gonzales, McCormick
MEMBERS ABSENT: Davis
The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Gonzales, that
the minutes of the City Council Meeting held December 1, 1992, be
approved as submitted and adopted. Motion carried.
The following employees were in attendance at the
Council Meeting and recognized for their exemplary service in
maintaining perfect attendance with the City, and the Mayor
extended congratulations on behalf of the City Council:

CITY CLERK'S DEPARTMENT
Martha Valenzuela, Accountant - 3 years
Police Chief Rosenkrantz accepted Two Year Perfect Attendance
Awards on behalf of Sergeants Robert Faldetta and James Rodino,
Officer Jeff Fagin, and Transcriber/Typist Martha Parra who were
unable to attend the meeting; and Battalion Chief Dick Wiles
accepted a Two Year Award on behalf of captain James Dunn who was
also unable to attend the meeting.
The Mayor called a recess at 5:07 p.m.
The Council reconvened in regular session at 5:10
p.m., all members present before the recess again being present.
Police Department Activity Log for the period
December 1 thru 14, 1992, was presented.
It was moved by McCormick, seconded by Gonzales, that
the Police Department Activity Log for the period December 1 thru
14, 1992, be received and filed. Motion carried.
Fire Department Activity Report for the period
December 1 thru 14, 1992, was presented.
It was moved by Ybarra, seconded by Gonzales, that
the Fire Department Activity Report for the period December 1
thru 14, 1992, be received and filed. Motion carried.
Health Department Report for the month of November,
1992 was presented.

It was moved by McCormick, seconded by Ybarra, that
the Health Department Report for the month of November, 1992 be
received and filed. Motion carried.
Risk Management Report for the month of November,
1992 was presented.
It was moved by Gonzales, seconded by Ybarra, that
the Risk Management Report for the month of November, 1992 be
received and filed. Motion carried.
The City Clerk advised that this was the time for
anyone in the audience to address the Council on any matter
listed on the Agenda other than with regard to any Public
Hearings that may be listed.
There was no one present in the audience who wished
to address the City Council.
Communication from Bruce V. Malkenhorst, City Clerk,
dated November 25, 1992, was presented, advising that the
Director of Community services has reviewed the payment schedule
for businesses paying taxes on gross receipts or tonnage and has
recommended that said businesses be allowed to pay these fees on
a quarterly basis. This has been reviewed by the City Attorney,
and it is hereby recommended that an amendment to the business
license ordinance be approved. (Deferred from the City Council
Meeting held December 1, 1992.)
It was moved by Ybarra, seconded by Gonzales, that
the communication from the City Clerk dated November 25, 1992, be
received and filed, and that his recommendation be approved.
Motion carried.
ORDINANCE NO. 1012 - An Ordinance of the City Council
of the City of Vernon Amending sections 15.12, 15.14, 15.20 and
15.37 of the Code of the City of Vernon, California, 1959,
Regarding Payment of Fees for Conducting Certain Business
Activities in the City of Vernon, was read by title for a First
Reading.
It was moved by McCormick, seconded by Ybarra, that
Ordinance No. 1012 be approved for a First Reading. Motion
carried.
RESOLUTION NO. 6188 - A Resolution of the City
Council of the City of Vernon Commending Jerome F. stickel for
His Many Years of Service to the City of Vernon, was read in its
entirety by the City Clerk.
It was moved by Ybarra, seconded by Gonzales, that
Resolution No. 6188 be approved and adopted, and the Mayor
presented said Resolution to Mr. stickel who was in attendance at
the meeting. Motion carried.
RESOLUTION NO. 6189 - A Resolution of the City
Council of the City of Vernon Commending Gerald Lohrke for His
Many Years of Service to the City of Vernon, was read in its
entirety by the City Clerk.
It was moved by McCormick, seconded by Ybarra, that
Resolution No. 6189 be approved and adopted, and the Mayor
presented said Resolution to Mr. Lohrke who was in attendance at
the meeting. Motion carried.
The Mayor called a recess at 5:20 p.m.
The Council reconvened in regular session at 5:21
p.m., all members present before the recess again being present.

Communication from Louis Rosenkrantz, Police Chief,
dated November 30, 1992, was presented, requesting authority and
funds for Sergeant Mark Moen to attend the Sergeant/Performance
Evaluator Course in Santa Rosa, California, January 5-8, 1993,
with an expense allowance of $765.16 of which $734.12 will be
reimbursed by POST.
It was moved by Ybarra, seconded by Gonzales, that
authority be granted for Sgt. Mark Moen to attend the Sergeant
Performance Evaluator Course in Santa Rosa, California, January
5-8, 1993, with an expense allowance of $765.16. Motion carried.
Communication from Police Chief Louis Rosenkrantz,
dated December 2, 1992, was presented, requesting authority and
funds for Dispatcher Stacy Waterfall to attend the Complaint
Dispatcher Course at Rio Hondo College, January 5-16, 1993, with
an expense allowance of $235.60 of which $173.60 will be
reimbursed by POST.
It was moved by McCormick, seconded by Gonzales, that
authority be granted for Dispatcher Stacy Waterfall to attend the
Complaint Dispatcher Course at Rio Hondo College, January 5-16,
1993, with an expense allowance of $235.60. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated December 8, 1992, was presented, requesting authority and
funds for Gerald W. Forde, Assistant to the City Administrator,
to attend "The Coalition Mixer" conference in Costa Mesa, January
29, 1993, with an expense allowance of $65.00.
It was moved by Ybarra, seconded by Gonzales, that
authority be granted for Gerald W. Forde to attend "The Coalition
Mixer" conference in Costa Mesa, January 29, 1993, with an
expense allowance of $65.00. Motion carried.
Communication from Kenneth J. DeDario, Director of
Light and Power, dated December 9, 1992, was presented,
requesting authority and funds to attend the California-Oregon
Transmission Project "Project Agreements Meeting" in Sacramento,
December 16 and 17, 1992, with an expense allowance of $336.15.
It was moved by Gonzales, seconded by Ybarra, that
authority be granted for Kenneth J. DeDario to attend the
California-Oregon Transmission Project "Project Agreements
Meeting" in Sacramento, December 16 and 17, 1992, with an expense
allowance of $336.15. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Finance, dated December 9, 1992, was presented, transmitting the
Minutes for the Finance Committee Meeting held December 8, 1992,
for approval of the recommendations contained therein.
It was moved by McCormick, seconded by Ybarra, that
the Minutes of the Finance Committee Meeting held December 8,
1992, be approved as submitted and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Personnel, dated December 10, 1992, transmitting the Agenda for
the Personnel Committee Meeting to be held December 14, 1992 for
approval of the recommendations contained therein.
The City Clerk advised that the Personnel Committee
Meeting, regularly scheduled for December 14, 1992, was
adjourned due to lack of quorum and recommended that the
following items (which were listed on the Personnel Committee
Agenda of December 14, 1992 as transmitted above) be acted upon
at this time.
Communication from Bruce V. Malkenhorst, Director of
Personnel, dated December 14, 1992, was presented, recommending
that the following personnel actions be taken:

REIMBURSEMENTS
Police Officer Alfred Jaime be reimbursed $267.92,
which is one half the purchase price of his Body Armor (vest);
and is in accordance with section 11.1 of the Memorandum of
Understanding dated March 1, 1988.
It was moved by Ybarra, seconded by Mccormick, that
Officer Alfred Jaime be reimbursed $267.92 for his purchase of
Body Armor. Motion carried.
Firefighter William Foltz be reimbursed $164.28 from
the Education and Training Appropriation Account for his
satisfactory completion of courses taken at Long Beach City
College related to his position with the City.
It was moved by Ybarra, seconded by Gonzales, that
Firefighter William Foltz be reimbursed $164.28 from the
Education and Training Appropriation Account. Motion carried.
MERIT STEP INCREASES
silas Williams, Diesel Operator V, Step 5 in the
Light and Power Department, be granted a merit step increase to
Diesel Operator V, Step 4, with a new monthly base salary of
$2297, effective December 27, 1992, based on his satisfactory job
performance during the past year.
It was moved by McCormick, seconded by Ybarra, that
Silas Williams be granted a merit step increase to Diesel
Operator V, Step 4, effective December 27, 1992. Motion carried.
Robert Kipness, Chief Diesel Operator, Step 2 in the
Light and Power Department, be granted a merit step increase to
Chief Diesel Operator, Step 1, with a new monthly base salary of
$5408, effective December 27, 1992, based on his satisfactory job
performance during the past year.
It was moved by Ybarra, seconded by Gonzales, that
Robert Kipness be granted a merit step increase to Chief Diesel
Operator, Step 1, effective December 27, 1992. Motion carried.
william Niesley, Fire Engineer, Step 5 in the Fire
Department, be granted a merit step increase to Fire Engineer,
step 4, with a new monthly base salary of $3665, effective
January 10, 1993, based on his satisfactory job performance
during the past year.
It was moved by McCormick, seconded by Ybarra, that
William Niesley be granted a merit step increase to Fire
Engineer, Step 4, effective January 10. 1993. Motion carried.
David Kimes, Fire Engineer, Step 4 in the Fire
Department, be granted a merit step increase to Fire Engineer,
Step 3, with a new monthly base salary of $3867, effective
January 10, 1993, based on his satisfactory job performance
during the past year.
It was moved by Gonzales, seconded by Ybarra, that
David Kimes be granted a merit step increase to Fire Engineer,
step 3, effective January 10, 1993. Motion carried.
RECLASSIFICATION
Inez Aragon, Transcriber/Typist, Step 4 in the Police
Department, be reclassified to Police Officer, Step 6, with a new
monthly base salary of $2911, effective January 4, 1993, when she
will enter Rio Hondo Police Academy. Ms. Aragon's reclassifi-
cation will be continqent upon her satisfactory completion of the
background process and execution of a 36 Month Employment
Agreement.

It was moved by Ybarra, seconded by McCormick, that
Inez Aragon be reclassified to Police Officer, step 6, effective
January 4, 1993, contingent upon her satisfactory completion of
the background process and execution of a 36 month Employment
Agreement. Motion carried.
BlRE
Joseph Klein be hired as Dispatcher, step 7, assigned
to the Police Department, with a monthly salary of $2005,
effective December 14, 1992, with continued employment contingent
upon his satisfactory completion of the background process.

It was moved by McCormick, seconded by Gonzales, that
Joseph Klein be hired as Dispatcher, step 7, effective December
14, 1993, with continued employment contingent upon his
satisfactory completion of the background process. Motion
carried.
RESIGNATION
The resignation (for retirement purposes) of Norman
J. Michiels, Director of Environmental Health, dated December 8,
1992, be accepted effective January 20, 1993 at the close of the
business day.
It was moved by Ybarra, seconded by Gonzales, that
the resignation (for retirement purposes) of Norman J. Michiels
be accepted January 20, 1993, at the close of the business day.
Motion carried.
WARRANT REGISTER NO. 853 covering claims and demands
presented during the period of November 26 thru December 10,
1992, drawn on the First Interstate Bank totaling $189,550.00,
which includes Demand Nos. 39935 thru 40106 (inclusive),
excluding Light & Power Demands and Void Demand Nos. 39952, 39981
thru 39984 (inclusive) and 40025 (accounting period December,
1992) was examined and audited.
It was moved by Ybarra, seconded by Gonzales, that
Warrant Register No. 853 be approved and payment authorized for
claims and demands totaling $189,550.00, excluding Light and
Power Demands. Motion carried.
WARRANT REGISTER NO. 853 covering claims and demands
presented during the periOd of November 26 thru December 10,
1992, drawn on the First Interstate Bank totaling $3,296,233.73,
which includes Light & Power Demand Nos. as listed below

It was moved by McCormick, seconded by Ybarra, that
Warrant Register No. 853 be approved and payment authorized for
claims and demands totaling $3,296,233.73. Motion carried.
PAYROLL WARRANT REGISTER NO. 437 covering claims and
demands presented during the period of October 18 thru November
14, 1992, drawn on the First Interstate Bank totaling
$1,492,596.57 (accounting period November, 1992) was examined and
audited.
It was moved by Gonzales, seconded by Ybarra, that
Payroll Warrant Register No. 437 be approved and payment
authorized for claims and demands totaling $1,492.596.57.
Motion carried.

The Mayor called a recess at 5:36 p.m.
The Council reconvened in regular session at 5:45
p.m., all members present before the recess again being present.
It was moved by Gonzales, seconded by McCormick, that
the Council go into Closed Session, Personnel, pursuant to
Government Code Section 54957, the time being 5:45 p.m. Motion
carried.
All persons were excluded from Closed Session with
the exception of the City Clerk, City Attorney, and the Director
of Light and Power.
The Mayor ordered all communications to and from
Closed Session deemed privileged and confidential.
The Director of Light and Power was excused from
Closed Session at 5:49 p.m.
The Chief of Police was called into Closed Session at
5:50 p.m.
The Chief of Police was excused from Closed Session
at 6:30 p.m.
It was moved by Ybarra, seconded by Gonzales, that
the Council go out of Closed Session, Personnel, and resume
regular session, the time being 6:35 p.m. Motion carried.
It was moved by Ybarra, seconded by Gonzales, that
both Ricardo Lozano, Water & Power Dispatcher, and system
Operator Joe Jimenez, Light and Power Department employees, be
suspended two (2) days without pay and be issued a Letter of
Discipline stating that a recurrence or other offense may result
in further disciplinary action up to and including dismissal.
Motion carried.
It was moved by McCormick, seconded by Gonzales, that
the Council go into Closed Session, Attorney/Client Privilege,
pursuant to Government Code Section 54956.9(a), the time being
6:38 p.m. Motion carried.
All persons were excluded from Closed Session with
the exception of the City Clerk and the City Attorney.
The Mayor ordered all communications to and from
Closed Session deemed privileged and confidential.
The Mayor was excused at 6:42 p.m.
The Mayor returned at 6:44 p.m.
It was moved by Ybarra, seconded by McCormick, that
the Council go out of Closed Session, Attorney/Client Privilege,
and resume regular session, the time being 6:50 p.m. Motion
carried.
There being no further business to come before the
Council at this time, it was moved by McCormick, seconded by
Gonzales, that the meeting adjourn. Motion carried.
