MINUTES OF THE CITY COUNCIL MEETING OF
THE CITY OF VERNON HELD SEPTEMBER 7,
1993 AT 5 P.M. IN THE COUNCIL CHAMBERS
OF THE CITY HALL LOCATED AT 4305 SANTA
FE AVENUE, VERNON, CALIFORNIA
MEMBERS PRESENT: Malburg, Ybarra, Gonzales, Davis, McCormick
MEMBERS ABSENT: None
The meeting was called to order by Mayor Malburg.
It was moved by Ybarra, seconded by Davis, that the
Minutes of the City Council Meeting held August 17, 1993, be
approved as submitted and adopted. Motion carried.
Mayor Malburg presented Service pins to the following
employees and extended congratulations on behalf of the entire
City Council:
Louis Rosenkrantz, Chief of Police - 35 years
Vincent Washington, Utilityman - 15 years
Edward LeBlanc, Electrical Engineering Manager - 5 years
Mauro Trujillo - utilityman 5 years
The following employees were unable to attend the meeting and
their Service pins were accepted by their respective Department
Head:
Robert Kipness, Chief Diesel Operator - 15 years
Daniel Vincent, Police Officer - 5 years
Eddie Rodriguez, utilityman - 10 years
Mayor Malburg called a recess at 5:16 p.m.
The Council reconvened in regular session at 5:20
p.m., all members present before the recess again being present.
Police Department Activity Log for the period August
16 thru 31, 1993, was presented.
It was moved by McCormick, seconded by Gonzales, that
the Police Department Activity Log for the period August 16 thru
31, 1993, be received and filed. Motion carried.
Fire Department Activity Report for the period August
16 thru 31, 1993, was presented.
It was moved by McCormick, seconded by Gonzales, that
the Fire Department Activity Report for the period August 16 thru
31, 1993, be received and filed. Motion carried.
The City Clerk advised that now was the time for
anyone in the audience to address the Council on any matter
listed on the agenda other than with regard to any Public
Hearings that may be listed.
The Mayor asked if there was anyone in the audience
who wished to address the Council.
There was no one in the audience who wished to
address the City Council.
Communication from Police Chief Louis Rosenkrantz,
dated July 27, 1993, was presented, requesting authority and
funds for Sergeant James Wohlt to attend the California
Association of Police Training Officers Conference in San Diego,
October 13-15, 1993, with an expense allowance of $547.83.

It was moved by Ybarra, seconded by Davis, that
authority be granted for Sgt. James Wohlt to attend the
California Association of Police Training Officers Conference in
San Diego, October 13-15, 1993, with an expense allowance of
$547.83. Motion carried.
Communication from Police Chief Louis Rosenkrantz,
dated July 27, 1993, was presented, requesting authority and
funds for Sergeant Thomas Igyarto to attend the Interview-
Interrogation Techniques Conference in Sacramento, October 4-7,
1993, with an expense allowance of $657.64.
It was moved by Davis, seconded by Gonzales, that
authority be granted for Sgt. Thomas Igyarto to attend the
Interview/Interrogation Techniques Conference in Sacramento,
October 4-7, 1993, with an expense allowance of $657.64. Motion
carried.
Communication from Fire Chief Dave Telford, dated
July 27, 1993, was presented, requesting authority and funds for
Battalion Chief James smith and Captain Steven Ruffoni to attend
the American Search and Rescue Technical Seminar in Joshua Tree,
California, October 11-16, 1993, with an expense allowance of
$737.50 and $675 respectively.
It was moved by Ybarra, seconded by McCormick, that

Communication from victor Vaits, Interim Director of
Community Services, dated August 16, 1993, was presented,
requesting authority and funds for Kevin Wilson, civil Engineer,
to attend the International Conference of Building Officials in
Sacramento, September 12-17, 1993, with an expense allowance of
$1,164.
It was moved by Gonzales, seconded by Ybarra, that
authority be granted for Kevin Wilson to attend the International
Conference of Building Officials in Sacramento, September 12-17,
1993, with an expense allowance of $1,164. Motion carried.
Communication from Fire Chief Dave Telford, dated
August 19, 1993, was presented, requesting authority and funds to
attend the New Fire Chiefs Workshop in Sacramento, October 25-29,
1993, with an expense allowance of $508.00.
It was moved by Davis, seconded by Ybarra, that
authority be granted for Chief Dave Telford to attend the New
Fire Chiefs Workshop in Sacramento, October 25-29, 1993, with an
expense allowance of $508.00. Motion carried.
Communication from Fire Chief Dave Telford, dated
August 18, 1993, was presented, requesting authority and funds
for the below listed Fire Department personnel to attend the
Truck Company Operations Seminar and Workshop in Anaheim on the
dates listed with an expense allowance of $75 each for
registration:

It was moved by Ybarra, seconded by McCormick, that
authority be granted for the aforementioned Fire Department
personnel to attend the Truck Company Operations Seminar and
Workshop in Anaheim on the dates listed with an expense allowance
of $75 each for registration. Motion carried.
Communication from Lewis Pozzebon, Director of
Environmental Health, dated August 26, 1993, was presented,
requesting authority and funds for Environmental Specialist
Timothy Blank to attend the Seafood Handling and Quality
Evaluation Workshop in Downey, October 20-21, 1993, with an
expense allowance of $200.00.
It was moved by McCormick, seconded by Davis, that
authority be granted for Timothy Blank to attend the Seafood
Handling and Quality Evaluation Workshop in Downey, October 20-
21, 1993, with an expense allowance of $200.00. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated August 31, 1993, was presented, advising that in accordance
with Government Code Section 65089, all cities must adopt a
Congestion Management Program. This has been reviewed by the
Interim Director of Community Services and the City Attorney, and
it is hereby recommended that an ordinance be approved and
adopted which addresses the various requirements of said
government code section.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated August 31, 1993 be
received and filed, and that his recommendation be approved.
Motion carried.
ORDINANCE NO. 1015 - An Ordinance of the City Council
of the City of Vernon Adopting a Trip Reduction and Travel Demand
Program in Order to Implement the Congestion Management Program
of the County of Los Angeles, was read by title for a first
reading.
It was moved by Ybarra, seconded by Mccormick, that
Ordinance No. 1015 be approved for a First Reading. Motion
carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated August 31, 1993, was presented, advising that the Agreement
for Contractual Services with Stanley C. Henslee providing for
services in connection with the aUditing of business licenses
expired June 30, 1993. This has been reviewed by the Assistant
to the City Administrator, Edward Cooney, Financial Consultant,
and the City Attorney, and it is hereby recommended that the
agreement be amended and the contact extended for an additional
twelve months.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated August 31, 1993 be
received and filed, and that his recommendation be approved.
Motion carried.
RESOLUTION NO. 6299 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Amendment No. 1 to the Agreement for Contractual
Services Between the City of Vernon and Stanley C. Henslee, was
presented.
It was moved by Ybarra, seconded by McCormick, that
Resolution No. 6299 be approved and adopted. Motion carried.
Communication from Lewis Pozzebon, Director of
Environmental Health, dated August 31, 1993, was presented,
requesting authority and funds for Environmental Specialist

Leonard Grossberg to attend the Petroleum-Hydrocarbon
Contaminated Soil Seminar in Pasadena, September 29-30, 1993,
with an expense allowance of $145.
It was moved by Davis, seconded by Ybarra, that
authority be granted for Leonard Grossberg to attend the
Petroleum-Hydrocarbon Contaminated Soil Seminar in Pasadena,
September 29-30, 1993 with an expense allowance of $145.
Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated August 31, 1993, was presented, advising that Assembly Bill
408, which became effective July 1, 1993, revises the provisions
of law governing the processing of standing and parking
violations. Governing bodies are now required to establish the
position of Hearing Examiner to adjudicate contested parking
violations. It is anticipated that the City would need the
services of a Hearing Examiner approximately two hours per month
at a flat rate of $15 per hour. This has been reviewed by the
Police Chief and the City Attorney, and it is hereby recommended
that Mr. Lloyd B. Carter and Mr. James A. Miller be retained as
Hearing Examiner and Alternate Hearing Examiner respectively, and
that an agreement for contractual services be approved and
executed.
It was moved by Gonzales, seconded by Davis, that the
communication from the City Clerk dated August 31, 1993 be
received and filed, and that his recommendation be approved.
Motion carried.
RESOLUTION NO. 6314 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of a Hearing Examiner Agreement By and Between the City
of Vernon and Lloyd B. Carter Respecting the Disposition of
Contested Parking/Standing Violations in Compliance with the
Vehicle Code of the State of California, was presented.
It was moved by McCormick, seconded by Ybarra, that
Resolution No. 6314 be approved and adopted. Motion carried.
RESOLUTION NO. 6316 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Alternate Hearing Examiner Agreement By and
Between the City of Vernon and James A. Miller Respecting the
Disposition of Contested Parking/Standing Violations in
Compliance with the Vehicle Code of the State of California, was
presented.
It was moved by Gonzales, seconded by Mccormick, that
Resolution No. 6316 be approved and adopted. Motion carried.
Communication from victor H. Vaits, Interim Director
of Community Services, dated September 1, 1993, was presented,
advising that Contract No. 516, Traffic Signal Modernization,
Atlantic Boulevard and District Boulevard; Santa Fe Avenue and
Pacific Boulevard; and Soto Street and Fruitland Avenue has been
completed. The total contract amount was $72,585 and a final
partial payment of $16,752 is now due, with the remaining ten
percent ($7,258.50) payable thirty-five days after acceptance.
It is hereby recommended that the work be accepted and that
authority be granted to pay the contractor, Signal Maintenance,
Inc., 2283 Via Burton Street, Anaheim, California 92806.
It was moved by Ybarra, seconded by McCormick, that
the communication from the Interim Director of Community Services
dated September 1, 1993 be received and filed, and that his
recommendation be approved. Motion carried.

RESOLUTION NO. 6312 - A Resolution of the City
Council of the City of Vernon Accepting the Work of Signal
Maintenance, Inc. in Accordance with Contract No. 516 of the City
of Vernon, was presented.
It was moved by Davis, seconded by Gonzales, that
Resolution No. 6312 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated, September 2, 1993, was presented, transmitting an
Agreement for Contractual Services with SCEC providing for
consulting services regarding environmental issues which may
affect the power plant or other City-related operations. This
agreement has been reviewed by the Director of Light and Power
and the City Attorney and it is hereby recommended that the
agreement be approved and executed.
It was moved by Ybarra, seconded by Gonzales, that
the communication from the City Clerk dated September 2, 1993 be
received and filed, and that his recommendation be approved.
Motion carried.
RESOLUTION NO. 6315 - A Resolution of the City
Council of the City of Vernon Approving and Authorizing the
Execution of an Agreement for Contractual Services By and Between
Montrose Environmental Corporation (dba SCEC) and the City of
Vernon Providing for Services relating to Environmental Issues
Affecting the City's Power Plant and Other City-Related
Operations, was presented.
It was moved by McCormick, seconded by Gonzales, that
Resolution No. 6315 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, City Clerk,
dated September 2, 1993, was presented, requesting authority and
funds to attend the California Contract Cities 13th Annual Fall
Seminar in San Diego, September 24-26, 1993, with an expense
allowance of $951.
It was moved by Ybarra, seconded by Davis, that
authority be granted for Bruce V. Malkenhorst to attend the
California Contract Cities 13th Annual Fall Seminar in San Diego,
September 24-26, 1993, with an expense allowance of $951. Motion
carried.
RESOLUTION NO. 6313 - A Resolution of the City
Council of the City of Vernon Authorizing the Sale of Surplus
Property from the Community Services Department, the Risk
Management/Personnel Department, the Administration/Customer
Service Department, the Light and Power Department, and the
Computer Services Department pursuant to Section 2.31 of the
Vernon City Code, was presented.
It was moved by Gonzales, seconded by Ybarra, that
Resolution No. 6313 be approved and adopted. Motion carried.
Communication from Bruce V. Malkenhorst, Director of
Personnel, dated September 2, 1993, was presented, recommending
that the following personnel actions be approved:
Hire
Ana Maria Bedoy be hired as Dispatcher, Step 7,
assigned to the Police Department, with a monthly salary of
$2005, effective August 23, 1993, with continued employment
contingent upon her satisfactory completion of the background
process.

It was moved by Ybarra, seconded by Davis, to hire
Ana Maria Bedoy as Dispatcher, Step 7, effective August 23, 1993
with continued employment contingent upon her satisfactory
completion of the background process. Motion carried.
Resiqnation
The resignation of Christina Miranda, temporary
employee assigned to the Health Department, be accepted effective
August 12, 1993 at the close of the business day.
It was moved by McCormick, seconded by Gonzales, to
accept the resignation of Christina Miranda effective August 12,
1993 at the close of the business day. Motion carried.
Merit step Increase
Kevin Wilson, civil Engineer, Step 2 in the Community
Services Department, be granted a merit step increase to civil
Engineer, Step 1, with a new monthly base salary of $7219,
effective October 3, 1993, based on his satisfactory job
performance during the past year.
It was moved by Ybarra, seconded by Davis, to grant
Kevin Wilson a merit step increase to civil Engineer, Step 1,
effective October 3, 1993. Motion carried.
Jerome Schreiber, Senior Electrical Inspector, Step
2, be granted a merit step increase to Senior Electrical
Inspector, Step 1, with a new monthly base salary of $5562,
effective October 3, 1993, based on his satisfactory job
performance during the past year.
It was moved by Davis, seconded by McCormick, to
grant Jerome Schreiber a merit step increase to Senior Electrical
Inspector, Step 1, effective October 3, 1993. Motion carried.
Reimbursements
Police Officer Mark Dressen be reimbursed $235.45,
which is one-half the purchase price of his body armor (vest),
and in accordance with section 11.1 of the Memorandum of
Understanding dated March 1, 1988.
It was moved by Gonzales, seconded by Davis, to
reimburse Officer Mark Dressen $235.45 for his purchase of body
armor. Motion carried.
Dan Downing, Environmental Specialist in the Health
Department, be reimbursed $220.00 from the Education and Training
Appropriation Account for his satisfactory completion of courses
taken at University of California Riverside related to his
position with the City.
It was moved by Ybarra, seconded by Davis, to
reimburse Dan Downing $220 from the Education and Training
Appropriation Account. Motion carried.
James Wilcox, Environmental Specialist in the Health
Department, be reimbursed $414.36 from the Education and Training
Appropriation Account for his satisfactory completion of courses
taken during the winter Quarter at University of California
Irvine related to his position with the City.
It was moved by McCormick, seconded by Ybarra, to
reimburse James wilcox $414.36 from the Education and Training
Appropriation Account. Motion carried.

Sergio Rodriguez, Water & Power Dispatcher, be
reimbursed $292.90 from the Education and Training Appropriation
Account for his satisfactory completion of courses taken during
the Spring Semester at Los Angeles Mission College related to his
position with the City.
It was moved by Gonzales, seconded by Davis, to
reimburse Sergio ROdriguez $292.90 from the Education and
Training Appropriation Account. Motion carried.
Police Officer James Rodriguez be reimbursed $88.32
from the Education and Training Appropriation Account for his
satisfactory completion of courses taken during the Summer
Semester at Coastline Community college related to his position
with the City.
It was moved by Ybarra, seconded by Gonzales to
reimburse Officer James Rodriguez $88.32 from the Education and
Training Appropriation Account. Motion carried.
Leonard Grossberg, Environmental Specialist in the
Health Department, be reimbursed $576.10 from the Education and
Training Appropriation Account for his satisfactory completion of
courses taken during the Summer Quarter at California State
University Northridge related to his position with the City.
It was moved by McCormick, seconded by Davis, to
reimburse Leonard Grossberg $576.10 from the Education and
Training Appropriation Account. Motion carried.
WARRANT REGISTER NO. 871 covering claims and demands
presented during the period of August 13 thru September 2, 1993,
drawn on the First Interstate Bank totaling $436,950.34, which
includes Demand Nos. 43387 thru 43616 (inclusive), excluding
Light and Power Demands and Void Demands as listed below
(accounting period September, 1993) was examined and audited:

It was moved by Gonzales, seconded by Davis, that
Warrant Register No. 871 be approved and payment authorized for
claims and demands totaling $436,950.34, excluding Light and
Power Demands. Motion carried.

It was moved by Ybarra, seconded by McCormick, that
Warrant Register No. 871 be approved and payment authorized for
claims and demands totaling $2,695,650.05. Motion carried.
Councilman Davis abstained from voting and disqualified himself
because it is reasonably foreseeable that the decision may have a
material financial effect on his source of income.
The Mayor called a recess at 6 p.m.

The Council reconvened in regular session at 6:01
p.m., all members present before the recess again being present.
It was moved by Ybarra, seconded by McCormick, that
the Council go into Closed Session, Personnel, pursuant to
Government Code Section 54957, the time being 6:02 p.m. Motion
carried.
All persons were excluded from Closed Session with
the exception of the City Clerk and the City Attorney.
The Mayor ordered all communications to and from
Closed Session deemed privileged and confidential.
It was moved by Gonzales, seconded by McCormick, that
the Council go out of Closed Session, Personnel, and resume
regular session, the time being 6:10 p.m. Motion carried.
It was moved by Ybarra, seconded by Davis, that the
Council go into Closed Session, Attorney/Client Privilege,
pursuant to Government Code Sections 54956.9(a) and 54956.9(c),
the time being 6:11 p.m. Motion carried.
All persons were excluded from Closed Session with
the exception of the City Clerk and the City Attorney.
The Mayor ordered all communications to and from
Closed Session deemed privileged and confidential.
The Mayor was excused at 6:11 p.m.
The Mayor returned at 6:14 p.m.
It was moved by McCormick, seconded by Ybarra, that
the Council go out of Closed Session, Attorney/Client Privilege,
and resume regular session, the time being 6:15 p.m. Motion
carried.
It was moved by Gonzales, seconded by Davis, that all
travel for business related meetings, seminars and conferences
shall be made in the most expedient manner so as to avoid any
additional time off or funds. Motion carried.
It was moved by Ybarra, seconded by McCormick, that
authority be granted to pay Adrian Yasutake for his absence on
August 31, 1993. Motion carried.
There being no further business to come before the
Council at this time, it was moved by McCormick, seconded by
Ybarra, that the meeting adjourn. Motion carried.
